This chapter focuses on developing an experimental technique for inducing flow and creating instances of effortless action in the laboratory. The effort to experimentally induce flow involves two conditions which are correlated with the flow state: The firstis the idea that the challenges of a given task are well within one’s capabilities; the other involves perceived goals and immediate feedback from the given task. This book aims to help readers interpret, and reflect on, their reading more effectively. It presents doctrines of ancient and renaissance rhetoric (an education in how to write well) as questions or categories for interpreting one's reading. The first chapter presents the questions. Later chapters use rhetorical theory to bring out the implications of, and suggest possible answers to, the questions: about occasion and audience (chapter 2), structure and disposition (3), narrative (4), argument (5), further elements of content, such as (...) descriptions, comparisons, proverbs and moral axioms, dialogue, and examples (6), and style (7). Chapter eight describes ways of gathering material, formulating arguments and writing about the texts one reads. The conclusion considers the wider implications of taking a rhetorical approach to reading. Someday soon (if it hasn't happened in secret already), a human will be cloned, and mankind will embark on a scientific and moral journey whose destination cannot be foretold. In Copycats: The Science and Ethics of Cloning, Arlene Judith Klotzko describes the new world of possibilities that can be glimpsed over the horizon. In a lucid and engaging narrative, she explains that the technology to create clones of living beings already exists, inaugurated in 1996 by Dolly the sheep, the first (...) mammal cloned from a single adult cell. Diese ist pluralismusfahig und kompatibel zu Erkenntnissen der politischen Philosophie, der Politikwissenschaft, der Soziologie und der Okonomie. Die Ergebnisse empirischer Gerechtigkeitsforschung stehen hier unverzichtbar am Beginn ethischen Argumentierens ebenso wie die Ergebnisse der Diskursethik. Daruber hinaus stellt sich die Autorin grundsatzlichen Fragen heutiger Ethik: "Haben Menschen einen naturlichen Sinn fur Gerechtigkeit und welchen? Ist Gerechtigkeit universal oder beliebig? Gehort Gleichheit zur Gerechtigkeit hinzu?" Das Neue einer (...) derartigen christlichen Ethik ist ihre Konsensorientierung mit globaler Reichweite. Die christliche Ethik vollzieht damit einen Paradigmenwechsel hin zum demokratietheoretisch fundierten Konsensparadigma moderner Ethik. Es wird klar herausgearbeitet, dass allgemeine Normen nicht mehr auf der Basis metaphysischer Wesensreflexionen uber die Natur der Dinge oder die Normalitat einer Handlung erfolgen durfen. Vielmehr sind alle potentiell Betroffenen in einer neutralen Vertragssituation nach ihrer Zustimmung zu Normen zu befragen. Deren Einigungsprozess stellt die Rekonstruktion einer normativen Ethik dar, ohne diese in die Beliebigkeit einzelner zu legen. In this paper we show how a realistic normative democratic theory can work within the constraints set by the most pessimistic empirical results about voting behaviour and elite capture of the policy process. After setting out the empirical evidence and discussing some extant responses by political theorists, we argue that the evidence produces a two-pronged challenge for democracy: an epistemic challenge concerning the quality and focus of decision-making and an oligarchic challenge concerning power concentration. To address the challenges we then (...) put forward three main normative claims, each of which is compatible with the evidence. We start with a critique of the epistocratic position commonly thought to be supported by the evidence. We then introduce a qualified critique of referenda and other forms of plebiscite, and an outline of a tribune-based system of popular control over oligarchic influence on the policy process. Our discussion points towards a renewal of democracy in a plebeian but not plebiscitarian direction: Attention to the relative power of social classes matters more than formal dispersal of power through voting. We close with some methodological reflections about the compatibility between our normative claims and the realist program in political philosophy. (shrink)

Locke’s short essay, “Venditio,” offers a series of thought-provoking examples of prices that might or might not be viewed as just. Locke writes as though these examples and his comments about them point to a coherent doctrine about which agreed-to prices are morally acceptable and which are morally unacceptable. However, despite the acuity of some of Locke’s observations, no such coherent doctrine emerges from Locke’s discussions of these examples. Indeed, many of the conclusions Locke reaches as he moves from example (...) to example are implausible in themselves or inconsistent with one another. Nevertheless, not all is lost. Locke’s observations can be viewed as thought experiments on his part which, in conjunction with insights from Locke’s other economic writings, indicate what features a doctrine of acceptable and unacceptable prices needs to possess. I show how a line of argument which appears almost as a sidebar within “Venditio” offers a doctrine that provides those needed features. That doctrine affirms both “the common law of traffic” and “the common law of charity” and a view about when the latter takes priority over the former. (shrink)

ABSTRACT This essay is a critical study of Jason Brennan's Against Democracy. We make three main points. First, we argue that Brennan's proposal of a right to competent government only works if one considers the absence of government a viable proposition, something most of his opponents are not prepared to do. Second, we suggest that Brennan's account of competent decision-making is blind to forms of oligarchic power that work against the very ideals of justice and epistemic virtue that competence is (...) meant to safeguard. Third, we muster empirical evidence to argue that, in the real world, democracy is not just about making decisions and selecting policies, in which case Brennan's argument misses its mark. (shrink)

This article analyses how child victims of abuse may be subjected to hermeneutical injustice. I start by explaining how child victims are hermeneutically marginalised by adults’ social and epistemic authority, and the stigma around child abuse. In understanding their abuse, I highlight two epistemic obstacles child victims may face: (i) lack of access to concepts of child abuse, thereby causing victims not to know what abuse is; and (ii) myths of child abuse causing misunderstandings of abuse. When these epistemic obstacles (...) cause the child victims to fail to see themselves as being abused and/or to get adults to recognise that they are being abused, I argue that this constitutes hermeneutical injustice. While some may justify obstructing epistemic access to concepts of abuse on the grounds of parental rights and protection of children’s innocence, I reply that both grounds are unjust in light of children’s basic rights and the fact that children can easily be taught such concepts in a child-appropriate manner. The case of child abuse prompts important reflections on existing epistemic injustice literature, particularly on the ways in which hermeneutical injustice materialises, the epistemic responsibilities of institutional bodies and individuals, and the interrelationship between testimonial and hermeneutical injustice. Pandit Gopinath Kaviraj of Varanasi, India was a well-known interpreter of the Hindu Tantric traditions, who also practiced kundalini yoga according to his own understanding of four sequential paths. This study attempts to reconstruct the stages of Kaviraj's system of Tantric yoga by analyzing and integrating innumerable partial discussions scattered throughout his writings, in an effort to reveal the hidden structure of transformations. Primary research materials include collections of Kaviraj's essays on the Hindu Tantric traditions written in Bengali and Hindi, (...) and his philosophical notebook, Svasambedana . ;The concepts of formal and material ontologies, developed for linguistic theory by Ashok Kumar Gangadeen, are adopted in analyzing the category structure of Kaviraj's four paths. A synchronic methodology is used to present Kaviraj's interpretations of the Kashmir Saiva, S akta Tantric and Sahajiy a Vaisnava traditions in relation to known Tantric concepts and practices, found in the classical texts and secondary literature on these traditions. Categories that belong to the material ontologies of the various Tantric sects are examined for trans-sectarian thematic unity and for explicating the processual patterns that constitute the formal ontology which Kaviraj sees as underlying his own four paths. This formal ontology is based on the principle of increments of consciousness by which kundalini/ develops. ;Each of Kaviraj's Tantric paths incorporates orthodox Hindu forms of spiritual realization, but utilizes different means to them, as well as moves beyond them to uniquely Tantric forms of integral realization. Technical terms are discussed from the relevant traditional Hindu perspective and then from their revalorization in relation to uniquely Tantric forms of yogic realization. ;Kaviraj's systemic perspective on the architectonics of his four Tantric paths is also reconstructed and systematized from various schemata found in Svasambedana. Analyses are concerned both with structural replication and with understanding the series of paths as a single continuum based on laws of dialectical synthesis. Finally, there is a discussion of Kaviraj's supreme integral yoga , his own advanced practice for universal integral Self-realization, as taught by his guru and other adepts of the Jnanaganj asram of Tibet. An inquiry is made into its kala-structure, and it is suggested to be an innovative fifth path which utilizes the structure of the other four paths for the bestowal of universal grace. (shrink)

Corporate ethics has undergone significant change in response to environmental issues, and is beginning to evolve further in response to emerging notions of social responsibility, defined in terms of human rights issues. Three dimensions of ethical behaviour – national, international and theoretical – are defined and illustrated through three case studies. The increasingly complex interaction between two of the dimensions, national and international in a global context, poses a significant challenge to corporations attempting to develop and extend best practices. Essentially, (...) that challenge is not only one of corporate compliance, either voluntary or enforced by a system of regulatory and legal measures, but also a question of responsibility for damage or abuse. Three cases are presented which illustrate the complexity of the interactions. The Simon Jones case emphasises the dangers of casual work in multinational labour transactions, and the shortcomings of national remedies even in an advanced economy such as the UK. The second case, Tommy Hilfiger et al., raises a complex set of questions regarding national and international responsibility for compensation in developing economies. The third case, the Royal/Dutch Shell Group, serves as a model of voluntary corporate reform designed to bridge the gap between principles and practice both nationally and internationally. (shrink)

The business of clinical research has become more diverse, involving academic institutions, clinician-researchers in community settings, pharmaceutical companies, and contract research organizations. This growth has been accompanied by increasing concerns about the ethical conduct of research. Much of this concern has been directed to procedural issues including institutional review board review, data monitoring, and informed consent forms. However, the protection of human (...) subjects cannot be achieved by relying solely on procedural safeguards. There are more nuanced issues related to recruitment and retention of subjects, and to the process of informed consent, that are generated during the interaction between study staff and subjects. It is only through an examination of these relationships that one can more fully define and understand the challenges of protecting subjects in research. (shrink)

Four years after the Panama Papers scandal, tax avoidance remains an urgent moral-political problem. Moving beyond both the academic and policy mainstream, I advocate the “democratization of tax enforcement,” by which I mean systematic efforts to make tax avoiders accountable to the judgment of ordinary citizens. Both individual oligarchs and multinational corporations have access to sophisticated tax avoidance strategies that impose significant fiscal costs on democracies and exacerbate preexisting distributive and political inequalities. Yet much contemporary tax sheltering occurs within the (...) letter of the law, rendering criminal sanctions ineffective. In response, I argue for the creation of Citizen Tax Juries, deliberative minipublics empowered to scrutinize tax avoiders, demand accountability, and facilitate concrete reforms. This proposal thus responds to the wider aspiration, within contemporary democratic theory, to secure more popular control over essential economic processes. (shrink)

This essay identifies ‘oligarchic harm’ as a dire threat confronting contemporary democracies. I provide a formal standard for classifying oligarchs: those who use personal access to concentrated wealth to pursue harmful forms of discretionary influence. I then use Aristotle to think through both the moral and the epistemic dilemmas of oligarchic harm, highlighting Aristotle’s concerns about the difficulties of using wealth as a ‘proxy’ for virtue. While Aristotle’s thought provides great resources for diagnosing oligarchic threats, it proves less useful as (...) a guide to democratic institutional design. Aristotle raises a deep-seated objection to democratic forms of ‘rule by the poor.’ A successful response to oligarchy must move beyond Aristotle’s objection and affirm the demos’ tripartite status as many, free, and poor. I briefly outline the terms of this ‘new’ mixed regime: one that seeks to tame oligarchy through a mixture of aggregative, deliberative, and plebeian institutions. (shrink)

Today’s medical training environment exposes medical trainees to many aspects of what has been called “the hidden curriculum.” In this article, we examine the relationship between two aspects of the hidden curriculum, the performance of emotional labor and the characterization of patients and proxies as “bad,” by analyzing clinical ethics discussions with resident trainees at an academic medical center. We argue that clinicians’ characterization of certain patients and proxies as “bad,” when they are not, can take an unnecessary toll on (...) trainees’ emotions. We conclude with a discussion of how training in ethics may help uncover and examine these aspects of the hidden curriculum. (shrink)

The structure of rhodopsin is a subject of intense interest. Solving the structure by traditional methods has proved exceedingly challenging. It may therefore be useful to confront the problem by a combination of alternate techniques. These include FTIR (Fourier transform infrared spectroscopy) and AFM (atomic force microscopy) on the intact protein. Furthermore, additional insights may be gained through structural investigations of discrete rhodopsin domains.

This study was conducted to determine the appropriateness and potential of a set of books as a resource for infusing character education in a social studies classroom. Based on a research review, the literature chosen was the past decade (2001–2011) of Newbery-Award winning books. As recipients of perhaps the most prestigious award for children's literature, Newbery books were of exceptional quality and widely available. Narrative analysis ( Neuendorf, 2002 ) allowed us to explore their suitability for character education. The Josepheson (...) Institute's character pillars, the Katz and Braly List of Verbal Stereotypes, identification of moral dilemmas in these stories, and factors of race, gender, and disability provided tools for coding elements as part of the narrative-analysis methodology. Additional literacy and social studies activities were developed to enhance peer interaction, a component determined essential to future programs ( Berkowitz & Bier, 2005 ). Ultimately these 10 books were deemed viable tools for addressing character education. The authors found a key benefit of our process to be the messy self-examination, the inward look at one's own values, beliefs, and behaviors, and the subsequent interaction and collaboration that either validated or challenged those beliefs. Intersex people first began to publicly tell their stories in the 1990s. Twenty years on, these narratives, scorching in their candor, attest to a continuing failure to bear witness to or to acknowledge some of the most painful experiences we inflict on one another. More than anecdotes, these narratives provide a first–person reflection on care and thus represent a type of long–term follow–up that is largely absent in clinical literature. Out of respect for their courage, we owe these narratives serious (...) consideration. Clinicians who must make daily decisions that may alter patients’ lives may distance themselves from negative outcomes and stories like those told here to avoid professional regret. Honest self–appraisal and accepting regret open the door to feeling guilty, devalued and ashamed, but experiencing these emotions can be a crucial first step in changing clinical practice. (shrink)

The traditional college student of today is part of the Net Generation who has been raised in an era of instant access. Their communication and learning is complemented by the Internet, a major influence on this cohort. The regular method of contact is text messaging, instant messaging and cell phones. Learning methods for the Net Generation include Internet tools such as Web-CT, Blackboard, online courses, online journals and i-pod downloads. Are they ready to also change from print textbooks to Internet (...) based textbooks? This paper describes the attitudes of some Net Generation students towards the usage of electronic textbooks. Three case studies were conducted: one class used an online textbook and two other classes used e-chapter supplements. Students were questioned on their perceptions of using and learning with e-textbooks. Their views describe some changing thoughts towards network connected media that is the mantra of this generation. (shrink)

This article tackles the issue of offshore tax sheltering from the perspective of normative political realism. Tax sheltering is a pressing contemporary policy challenge, with hundreds of billions in private assets protected in offshore trusts and shell companies. Indeed, tax sheltering produces a variety of empirical dilemmas that render it a distinctive challenge for global governance. Therefore, it is crucial for normative political theorists to confront this problem. A realist approach offers three distinct advantages, elaborated in the three subsequent sections (...) of the article. First, it relaxes the theoretical burden by starting from the real practice of tax evasion rather than from an abstract theory of equality or justice. Second, this approach recognizes that sheltering is a political harm: a threat to the very maintenance of order, not just a problem of inequality or injustice. If politicians fail at such polity maintenance, realism's ethic of responsibility provides clear political reasons why they should be held accountable. Third, realism's focus on power and its acceptance of coercion open up new strategies for addressing the problem that would not be allowed by theories with a stronger emphasis on consensus. (shrink)
