Two potentially lifesaving protocols, emergency preservation and resuscitation and uncontrolled donation after circulatory determination of death, currently implemented in some U.S. emergency departments, have similar eligibility criteria and initial technical procedures, but critically different goals. Both follow unsuccessful cardiopulmonary resuscitation and induce hypothermia to “buy time”: one in trauma patients suffering cardiac arrest, to enable surgical repair, and the other in patients who unexpectedly die in the ED, to enable organ donation. This article argues that to fulfill patient-focused fiduciary obligations (...) and maintain community trust, institutions implementing both protocols should adopt and publicize policies to guide ED physicians to utilize either protocol for particular patients, in order to address the appearance of conflict of interest arising from the protocols' similarities. It concludes by analyzing ethical implications of incentives that may influence institutions to develop the expertise required for uDCDD but not EPR. (shrink)

Although the impact of job demands and work–family conflict on burnout has been extensively discussed and analysed in the past literature, the role of WFC as a generative mechanism has been neglected. Therefore, the purpose of this study is to examine the mediating effects of WFC between job demands and burnout. The studied sample consisted of 713 Indian primary school government teachers who completed a self-report questionnaire assessing job demands, WFC and burnout. The results confirmed that WFC partially mediates the (...) adverse association of job demands with burnout. Primary schools should, therefore, be encouraged to provide effective practices to manage work–family interfaces. (shrink)

In amblyopia, abnormal visual experience during development leads to an enduring loss of visual acuity in adulthood. Physiological studies in animal models suggest that intracortical GABAergic inhibition may mediate visual deficits in amblyopia. To better understand the relationship between visual cortical γ-aminobutyric acid (GABA) and perceptual suppression in persons with amblyopia (PWA), we employed magnetic resonance spectroscopy (MRS) to quantify GABA levels in both PWA and normally-sighted persons (NSP). In the same individuals, we obtained psychophysical measures of perceptual suppression for (...) a variety of ocular configurations. In PWA, we found a robust negative correlation between the depth of amblyopia (the difference in visual acuity between the amblyopic and non-amblyopic eyes) and GABA concentration that was specific to visual cortex and was not observed in a sensorimotor cortical control region. Moreover, lower levels of visual cortical GABA were associated with weaker perceptual suppression of the fellow eye by the amblyopic eye and stronger suppression of the amblyopic eye by the fellow eye. Taken together, our findings provide evidence that intracortical GABAergic inhibition is an important component of the pathology of human amblyopia and suggest possible therapeutic interventions to restore vision in the amblyopic eye through enhancement of visual cortical GABAergic signaling in PWA. The traditional conception of immune function is that of a system which differentiates the organism’s own tissues (the self) from any foreign invaders (nonself), preserving the former by rejecting the latter. In a mammalian pregnancy, however, the immunologically foreign foetus is accepted by the gestator’s immune system. This presents a serious challenge to the self–nonself theory which has sometimes been called the immunological paradox of pregnancy. In this paper I shall defend the self–nonself theory against the critique posed by Thomas (...) Pradeu. In addition I critically examine the alternative he proposes—the continuity theory. The main problem I will raise for any theory of immunology is that the phenomenon to be explained in pregnancy is the non-rejection of the foetus despite the triggering of the gestator’s immune system. I will argue that contemporary modified versions of the self–nonself theory can rise to this challenge but that continuity theory cannot. As such, the immunology of pregnancy gives us a good reason to favour contemporary self–nonself theory over the continuity theory. (shrink)

The desirability of creating norms within the framework of law has been a challenging process in a free market economy. The principles of antitrust law enunciated by courts in abuse of dominant cases has led to ‘refusal to deal’ as a contested doctrine. When dominance is treated as legitimate aspiration and free market choices are the medium to achieve the aspirations of free market enterprises, any duty or obligation cast on the firm is considered antithetical to the spirit of free (...) market unless it eclipses the anticompetitive effect. Where an economic analysis of antitrust law has non-economic impacts with ethical and moral issues, it calls for an alternative economic thought which also considers plural values of society. This also reflects a conflict arising out of lack of norms and respect for property rights. This paper attempts to analyze the cases and framework which is currently employed by the courts and the challenges it puts forth in creating a norm that is universal. The author by drawing on the principles of Gandhian economic thought and its essential features of trusteeship, non-possession and non-violence creates space for resolution of conflicts promoting ethical and moral considerations. Resolution of conflict through ethical and moral norms also assimilates the varied goals of antitrust regulation, including non-economic goals when the goals of antitrust require a broader consideration that accommodates the wider spectrum of market participants. We investigated how motor agency in the voluntary control of body movement influences body awareness. In the Rubber Hand Illusion , synchronous tactile stimulation of a rubber hand and the participant’s hand leads to a feeling of the rubber hand being incorporated in the participant’s own body. One quantifiable behavioural correlate of the illusion is an induced shift in the perceived location of the participant’s hand towards the rubber hand. Previous studies showed that the induced changes in body awareness are (...) local and fragmented: the proprioceptive drift is largely restricted to the stimulated finger. In the present study, we investigated whether active and passive movements, rather than tactile stimulation, would lead to similarly fragmented body awareness. Participants watched a projected image of their hand under three conditions: active finger movement, passive finger movement, and tactile stimulation. Visual feedback was either synchronous or asynchronous with respect to stimulation of the hand. A significant overall RHI, defined as greater drifts following synchronous than asynchronous stimulation, was found in all cases. However, the distribution of the RHI across stimulated and non-stimulated fingers depended on the kind of stimulation. Localised proprioceptive drifts, specific to the stimulated finger, were found for tactile and passive stimulation. Conversely, during active movement of a single digit, the proprioceptive drifts were not localised to that digit, but were spread across the whole hand. Whereas a purely proprioceptive sense of body-ownership is local and fragmented, the motor sense of agency integrates distinct body-parts into a coherent, unified awareness of the body. (shrink)

This essay draws a parallel between Macaulay’s stint as the “lawgiver” of India under the East India Company and the Anglicists-Orientalists debate that he brought to a decisive end on the one hand and on the other the culture/canon wars of the 1980s, and the neoconservative ascendancy that followed it and remained influential during the second Iraq War. Although neo-conservativism’s fierce resistance to a more inclusive liberal arts curriculum in the 1980s and its towering role during the militarization of the (...) US foreign policy in the last decade has established it as the most Eurocentric and logocentric intellectual movement at present, post-colonial studies is yet to take a serious reckoning of this ideological movement. This essay tries to fill this lacuna with an attempt to first establish Macaulayite Whiggism as a precursor of the American neo-conservatism and then to focus on Macaulay’s oedipal hostility with Sir William Temple, who was not just the most accomplished statesman of English Restoration Era (that Macaulay himself considered the golden period of English history and became its historian laureate), but also stood on the exact opposite pole of Macaulay’s Whiggish Eurocentrism. Finally, the essay will briefly consider Temple’s little-known essay “On the Ancient and Modern Learning” and its genuine and uniquely anti-logocentric outlook on non-European cultures and their histories. This paper examines the controversial diagnosis of excited delirium, which is often employed after individuals die during an encounter with the police. Rather than asking the important, and widely explored, question of whether the diagnosis is real or not, here, we consider how it operates in the world and why it seems to stick around, despite growing controversy and resistance to its use. First, we consider the question of what kinds of people are made up through the diagnosis of excited (...) delirium, exploring how racial stereotypes are exploited and certain behaviors are engendered through the illness script offered by excited delirium. Next, we ask what work excited delirium doing is doing in the world, unpacking how it tends to justify force and redirect responsibility, as well as who is it serving, and who is it not benefitting. Finally, we interrogate the slippery logic of excited delirium, examining how the way it is employed renders it non-falsifiable, and therefore impossible to uncover as real or unreal. (shrink)

Lieberman for taking the time to read and respond to our article, “Making Up Monsters, Redirecting Blame: An Examination of Excited Delirium,” so thoughtfully. They each offered us an opportunity to consider dimensions of excited delirium that we had not encountered as (...) of yet and encouraged us to think more carefully about them. In our response, we consider each of their commentaries in turn, given that, as a philosopher and a psychiatrist, they each speak to different aspects of our argument.First, we turn to Kathryn Petrozzo’s commentary “Excited Delirium: The Self-Fulfilling Prophecy of Police Brutality.” We are grateful for her generous comments and careful engagement with our arguments. While much of the commentary is supportive of our piece, Petrozzo makes three critical and insightful points that we hope to respond to here.The first point Petrozzo makes is that our assertion that excited delirium is non-falsifiable is not supported. She suggests that those “seeking to exonerate the police/first responders responsible for these deaths, are not accepting this evidence leading them to reject the excited delirium diagnosis, but rather, are crafting an incorrect causal narrative. This is deeply problematic, but it does not necessarily render excited delirium as nonfalsifiable.”Although we are intrigued by this challenge, we would like to hear more about what it would look like to falsify the phenomenon of excited delirium. The way that the causal theories related to it are structured are such that if one causal factor is not present (e.g., drug use), then another causal factor can be located (e.g., mental health), and if that is not found, another may be simply made up (e.g., genetic predisposition), making excited delirium multiply realizable in a seemingly endless fashion. This is precisely what took place in the case of Anthany Dawson, who was initially said to have been experiencing a mental health crisis, but was later said to have died from excited delirium related to a genetic condition never identified before (Hon, 2004; Razack, 2015). [End Page 361]In practice, confirmations of excited delirium are found on the basis of various unrelated factors, such that after a death involving police force, there is almost always the option to reach for excited delirium as an explanation/exoneration. According to proponents, there is no factor that could be present that could rule out the diagnosis of excited delirium as it is currently constructed. Indeed, even in the presence of video evidence showing police officers choking an individual until they stop breathing, these deaths are still attributed to excited delirium. This seems like a clear instance of non-falsifiability.Although Petrozzo might maintain that this is simply “an incorrect causal narrative,” it is a causal narrative that aligns with the current theoretical scaffolding surrounding excited delirium.The second point Petrozzo makes is regarding widespread criticisms of Popper’s demarcation criterion of falsifiability. Indeed, this criterion has been called too inclusive, in that any empirical claim can be called falsifiable in principle—even if it refers to a future apocalypse or a UFO landing. It has also been criticized for being too exclusive, in that it ignores the “remarkable tenacity of scientific theories,” as Lakatos puts it (2009, p. 516). In practice, scientists do not merely abandon a theory if it is not supported by facts; they tend to find other explanations (e.g., the measurement was faulty) rather than accept an instance of falsification.Despite this, we believe it is still worth discussing falsifiability in the context of excited delirium for two reasons. First, while falsifiability may not be successful as a criterion that draws a line between science and pseudoscience, in this case, we argue, it still works well as a signifier of pseudoscience. Recently, many interested in the demarcation question have turned towards pluralism as a way to identify pseudoscientific practices (Pigliucci & Boudry, 2013). Computer ethics, or more broadly, Information Technology (IT) ethics, is often concerned with issues about privacy, accuracy, property and accessibility and framing of policies and rules on the features. While ethical issues on these topics are important, issues about IT ethics apply more broadly. The purpose of ethics is not just to draft new policies or legal codes. Ethics also aims to probe and bring into limelight for ethical deliberations those issues, which have escaped policy formulations or human introspection. This (...) paper tries to address one such ethical issue. This paper concerns with email ethics and with one of the features of emailing - ‘forwarding’. As an applied ethics domain, I have tried to use some samples of forwarded mails. Through the analysis of the given sample mails, I claim that (1) this issue of ‘forwarding’ falls well outside the domain of framing ethical policies and (2) it is a matter of ethical concern. I have addressed this ethical concern by drawing a criterion to judge if one’s act of ‘forwarding’ a mail is ethical act or not. (shrink)

Peter Singer in his Practical Ethics and in other works as well gives importance to reason in making an ethical decision. Thinkers question Singer’s consistency and employment of reason in his ethical decisions. Jacqueline A Laing talks about Singer’s inconsistency in her article 'Inconsistency and Consequentialism'. With reference to animal rights and abortion, she claims that Singer uses different yardstick, thus Singer is inconsistent. She remarks that Singer uses the notion of ‘sentientism’ for the defense of animal rights, whereas he (...) comes up with ‘personism’ for human centered ethics. She claims that if Singer is consistent why can’t he use the same notion of ‘sentientism’ for animal rights as well as issues on humans like disabled human beings? According to her, this suggests there is an inconsistency in Singer’s work on ethical issues concerning animals and ethical issues concerning humans. As a corollary conclusion, she claims that Singer is biased towards animals. In this paper, the authors try to show that there is no such inconsistency. Contrary to her claims, the authors like to show that Singer uses personism in the discussions related to animals and similarly he uses sentientism in his discussion related to abortion and other human centered ethical issues. Therefore, Laing’s claims about Singer’s inconsistency and her following claim that Singer is biased towards animals need to be reconsidered. (shrink)

Defined as patients who ‘lack decision-making capacity and a surrogate decision-maker’, the unrepresented present a major quandary to clinicians and ethicists, especially in handling errors made in their care. A novel concern presented in the care of the unrepresented is how to address an error when there is seemingly no one to whom it can be disclosed. Given that the number of unrepresented Americans is expected to rise in the coming decades, and some fraction of them will experience a medical (...) error, creating protocols that answer this troubling question is of the utmost importance. This paper attempts to begin that conversation, first arguing that the precarious position of unrepresented patients, particularly in regards to errors made in their care, demands their recognition as a vulnerable patient population. Next, it asserts that the ethical obligation to disclose error still exists for the unrepresented because the moral status of error does not change with the presence or absence of surrogate decision-makers. Finally, this paper concludes that in outwardly acknowledging wrongdoing, a clinician or team leader can alleviate significant moral distress, satisfy the standards of a genuine apology, and validate the inherent and equivalent moral worth of the unrepresented patient. While American physicians have traditionally practised as non-unionised professionals, there has been increasing debate in recent years over whether physicians in training (known also as interns, residents or house staff) are justified in unionising and using collective action. This paper examines specific ethical criteria that would permit union action, including a desire to ameliorate patient care as well as the goal of improving the conditions of working physicians. We posit that traditional rebuttals to physician unionisation often lean on an infinite (...) conception of a doctor’s energies and obligations, one that promotes burnout and serves to advance the financial motives of hospital management and administration. Furthermore, this paper explores the empirical justifications for collective action, which include substantial reductions in medical error. Finally, we address the free-rider problem posed by non-union physicians who might benefit from working improvements garnered through union action. We conclude that in order to maintain a notion of justice as fairness, resident physicians who benefit from union deliberations are impelled to acquire union membership or make a commensurate donation and that the healthcare organisations for which they work ought to share in the responsibility to improve patient care. Isso gerou várias posições éticas como antropocentrismo, biocentrismo, ecocentrismo e similares. Sobre a relação do homem com o animal, B. G. Nortor menciona que animais em “contexto” devem ter prioridade em relação a animais em “conteúdo”. Norton nomeia animais domesticados e animais selvagens mantidos em cativeiros como animais em “contexto”. Ele sustenta que devemos cuidar dos animais domesticados na medida em que temos (...) um contrato hipotético com eles (Norton, 2003). Ao mesmo tempo em que concordamos com a posição de Norton de cuidar dos animais domesticados, defendemos que sua compreensão do contrato e sua subsequente compreensão de “cuidado” como derivando de um valor instrumental dos animais reflete sua posição de um antropocentrismo fraco. Neste artigo, defendemos que uma ética do “cuidado” é mais significativa quando emerge de uma perspectiva não-antropocêntrica que trate o outro como valioso intrinsecamente.: In environment related issues, the relationship of human beings to nature is seen as an important ethical issue. This issue has resulted in various ethical positions like anthropocentrism, biocentrism, ecocentrism and like. On man’s relationship with animal beings, Bryan G. Norton mentions that animals in ‘context’ should be given priority over animals in ‘content’. Norton brings the domesticated animals and captive bred wild animals under the ‘context’ animals. Norton maintains that we should take care of the domesticated animals as we have a hypothetical contract with them. (Norton, Searching for Sustainability: Interdisciplinary Essays in the Philosophy of Conservation Biology, 2003) While we agree to Norton’s position of taking care of the domesticated animals, we maintain that his understanding of contract and his subsequent understanding of ‘care’ as stemming from an instrumental value of animals reflects his position of weak-anthropocentrism. In this paper, we claim that a ‘care’ based ethics is more meaningful when it emerges from a non-anthropocentric perspective that treat the other as intrinsically valued. Put another way, why does he feel the need to be amidst nature in order to engage in these reveries? What do his reveries tell us about the role that nature has played in his life? This article will examine the role of nature in Rousseau’s solitary walks, as well as its presence in his life as revealed through his reveries. In particular, we will see that nature has played a central role in shaping Rousseau’s soul both during his adolescence and his adulthood. It is an essential ingredient to helping Rousseau realize his project of examining and ordering his soul, and in his attempt to understand what kind of man he is, given his deracination from mainstream society. Throughout his life nature has served as his mirror for self-examination; it acts as a trigger for various memories, it provides a harmonious setting for delving into the more painful of these memories, and allows him to extract insights that enable him to face his mortality. In what follows, we intervene in the long history of the study of curiosity to propose curiosity studies proper. Such a field, we argue, traverses the many disciplinary and experiential contexts in which curiosity appears, in order to generate theories, analytics, and practices of curiosity that are as complex and ubiquitous as the phenomenon of curiosity itself. Assuming an ecology of knowledge framework, which expressly resists academic silos and intellectual monocultures, we envision curiosity studies as an unbounded inquiry built on (...) three simple principles: (1) Curiosity is multiple; its markers shift across history, geography, species, social identities, institutions, contexts, and circumstances; therefore it requires immensely flexible analytic attention; (2) Curiosity is praxiological; far from something that is simply felt, curiosity is something that is done, expressed in behaviors, habits, architectures, and movements across physical, conceptual, and social space; and (3) Curiosity is political; its manifestations within sociocultural worlds are marked by inherited hierarchies of value among scientific methodologies, people groups, and ideologies. And yet, precisely because it is multiple, praxiological, and political, curiosity bears a keen subversive potential. It has the capacity to upend what we know, how we learn, how we relate, and what we can change. Curiosity has the capacity to become radical, to get at the root of things. We therefore propose curiosity studies not only as a field of scholarship but as a way of reimagining the world, both within the classroom and far beyond it. (shrink)

Aravind Adiga’s novel The White Tiger encapsulates the complexities of identity formation in a milieu effected by neo-capitalism. The novel, for many, is about a new identity made available to the hitherto marginalized in the form of opportunities unveiled by market forces. It is also perceived as a registration of the frustration and anger of the deprived that has become conscious of the new possibilities. Understandably, interpreting the novel on these lines leads to the identification of the protagonist Balram as (...) a champion of the marginalized, settling scores with the oppressive system. However, there are far subtler notes in the protagonist’s attitude to these sweeping changes than the simple and one dimensional approach of an achiever who is able to break the “rooster coop” and revel at the reversal of fortune. Neither is it a representative voice of the suppressed class turning the table on its oppressor by using the opportunities offered by the global market. The “notes” of the voices that emerge as Balram, the boy from darkness, moves up the ladder to become Ashok Sharma, the entrepreneur hiding in light, not only lack symphony but also create a distinct dissonance. Clearly, the discord in the changing notes is brought about by the forces that changed the world he lives in-a neo-capitalist world. The whole process of Balram turning into Ashok Sharma is a neocapitalist coup. (shrink)
