Ariane Fischer, David Woodruff, and Johanna Bockman have translated Karl Polanyi’s “Sozialistische Rechnungslegung” [“Socialist Accounting”] from 1922. In this article, Polanyi laid out his model of a future socialism, a world in which the economy is subordinated to society. Polanyi described the nature of this society and a kind of socialism that he would remain committed to his entire life. Accompanying the translation is the preface titled “Socialism and the embedded economy.” In the preface, Bockman explains the historical (...) context of the article and its significance to the socialist calculation debate, the social sciences, and socialism more broadly. Based on her reading of the accounting and society that Polanyi offers here, Bockman argues that scholars have too narrowly used Polanyi’s work to support the Keynesian welfare state to the exclusion of other institutions, have too broadly used his work to study social institutions indiscriminately, and have not recognized that his work shares fundamental commonalities with and often unacknowledged distinctions from neoclassical economics. This is a selection of essays on moral responsibility that represent the major components of John Martin Fischer's overall approach to freedom of the will and moral responsibility. The collection exhibits the overall structure of Fischer's view and shows how the various elements fit together to form a comprehensive framework for analyzing free will and moral responsibility. The topics include deliberation and practical reasoning, freedom of the will, freedom of action, various notions of control, and moral accountability. The (...) essays seek to provide a foundation for our practices of holding each other (and ourselves) morally and legally accountable for our behavior. A crucial move is the distinction between two kinds of control. According to Fischer, "regulative control" involves freedom to choose and do otherwise ("alternative possibilities"), whereas "guidance control" does not. Fischer contends that guidance control is all the freedom we need to be morally responsible agents. Further, he contends that such control is fully compatible with causal determinism. Additionally, Fischer argues that we do not need genuine access to alternative possibilities in order for there to be a legitimate point to practical reasoning. Fischer's overall framework contains an argument for the contention that guidance control, and not regulative control, is associated with moral responsibility, a sketch of a comprehensive theory of moral responsibility (that ties together responsibility for actions, omissions, consequences, and character), and an account of the value of moral responsibility. On this account, the value of exhibiting freedom (of the relevant sort) and thus being morally responsible for one's behavior is a species of the value of artistic self-expression. (shrink)

I am going to argue that it is a cost of libertarianism that it holds our status as agents hostage to theoretical physics, but that claim has met with disagreement. Some libertarians regard it as the cost of doing business, not a philosophical liability. By contrast, Peter van Inwagen has addressed the worry head on. He says that if he were to become convinced that causal determinism were true, he would not change his view that humans are free and morally (...) responsible. Rather, he would give up at least one of the formerly-thought-to-be a priori truths that are elements in his argument for the incompatibility of causal determinism and the relevant sort of freedom. Thus, according to van Inwagen, our status as free and morally responsible agents would not be held hostage to the physicists or hang on a thread I think that van Inwagen’s strategy for securing our freedom and responsibility is unattractive. Somewhat tendentiously, I have called the rejection of an a priori ingredient in the incompatibilist’s argument, contingent upon learning that causal determinism is true, ‘metaphysical fip-flopping.’ -/- And it does seem that van Inwagen’s approach is implausible insofar as he is open to such metaphysical fip-fopping. That he is open to it—that he would fip-fop if he became convinced of the truth of causal determinism—is a problem for his actual philosophical position. Or so I will argue. (shrink)

In this paper I explore in a preliminary way the interconnections among narrative explanation, narrative value, free will, an immortality. I build on the fascinating an suggestive work of David Velleman. I offer the hypothesis that our acting freely is what gives our lives a distinctive kind of value - narrative value. Free Will, then, is connected to the capacity to lead a meaningful life in a quite specific way: it is the ingredient which, when aded to others, enows us (...) with a meaning over an above the cumulative value erived from ading together levels of momentary welfare. In acting freely, we are writing a sentence in the story of our lives, and the value of acting freely is thus a species of the value of artistic creativity or self-expression (understood appropriately). Finally, I contend that the fact that our lives are stories need not entail that they have endings, or that immortality would necessarily be unimaginable or essentially different from ordinary, finite human life. Yes, a certain sort of narrative understanding of our lives as a whole would be impossible in the context of immortality; but much of what we care about, and value, in our stories might remain. In the present article we argue that emotional interactions are not appropriately captured in present emotion research and theorizing. Emotional stimuli or antecedents are dynamic and change over time because they often interact and have a specific relationship with the subject. Earlier emotional interactions may, for example, intensify later emotional reactions to a specific person, or our anger reactions towards powerful or powerless others may differ considerably. Thus, we suggest that such social factors not only affect the intensity, but also (...) the nature of emotional experiences and expressions, and specifically the nature of the social movement (e.g., moving towards, away, or against). We discuss different processes that are implicated in the relation between the social environment and our emotions, describe how emotional expressions shape social behavior, and provide suggestions for incorporating the social dimension of emotion in future research. For better or worse, places matter to us. Especially the familiar places we call home—the ones that embody our personal and cultural histories, give our lives a sense of stability, and support the routines of everyday life. Global Climate Change (GCC) poses an existential threat to these places, engendering nonmaterial losses that threaten subjective well-being and overall mental health. Unfortunately, these nonmaterial losses are often overlooked or underappreciated. My aim in this article is to counter this tendency and explore the (...) relationship between people and place in a way that sheds light on the nonmaterial threat of GCC. I approach this task from the lens of everyday aesthetics. While finding adequate compensation for these nonmaterial losses is unlikely, I suggest that sensitivity to the aesthetic texture of everyday life can provide a source of aesthetic consolation that can make the challenges of GCC easier to manage. The rise of Islamic activism in Egypt during the 1970s relied in large part on the production and mass dissemination of religiously oriented periodicals. Islamic social movement organizations ranging from the established al-Gamʿiyya al-Sharʿiyya to the revived Muslim Brotherhood utilized magazines to inform, orient, and mobilize Egyptians while engaging the state directly during Anwar al-Sadat’s ‘Infitah’. By comparing the framing processes within three of the most prominent Islamist periodicals of this period, this article investigates the process by which movement leaders (...) actively constructed the frames around which activists recruited and mobilized supporters. I argue that Islamist magazines attempted to offer historical continuity with prior movements, authenticity in their teaching of religious thought and practice, and a reframing of a political agenda that was traditionally dominated by state institutions. More significantly, by forging a message that attempted to unify all of these elements, these publications aided in the construction of new communities of believers that charted the course for the next era of Islamic activism in Egypt. Although medicolegal challenges to the use of neurologic criteria to declare death in the USA have been well-described, the management of court cases in the United Kingdom about objections to the use of neurologic criteria to declare death has not been explored in the bioethics or medical literature. This article (1) reviews conceptual, medical and legal differences between death by neurologic criteria (DNC) in the United Kingdom and the rest of the world to contextualize medicolegal challenges to DNC; (2) summarizes (...) highly publicized legal cases related to DNC in the United Kingdom, including the nuanced 2022 case of Archie Battersbee, who was transiently considered dead by neurologic criteria, but ultimately determined to be in a vegetative state/unresponsive-wakeful state; and (3) provides an overview of ethical issues raised by medicolegal challenges to DNC in the United Kingdom and a comparison to the management of these challenges in the USA. In the future, when we compare the welfare of a being of one substrate (say, a human) with the welfare of another (say, an artificial intelligence system), we will be making an intersubstrate welfare comparison. In this paper, we argue that intersubstrate welfare comparisons are important, difficult, and potentially tractable. The world might soon contain a vast number of sentient or otherwise significant beings of different substrates, and moral agents will need to be able to compare their welfare levels. However, (...) this work will be difficult, because we lack the same kinds of commonalities across substrates that we have within them. Fortunately, we might be able to make at least some intersubstrate welfare comparisons responsibly in spite of these issues. We make the case for cautious optimism and call for more research. I argue that racism is essentially a civic character trait: to be a racist is to have a character that rationally reflects racial supremacist sociopolitical values. As with moral vice accounts of racism, character is my account’s primary evaluative focus: character is directly evaluated as racist, and all other racist things are racist insofar as, and because, they cause, are caused by, express or are otherwise suitably related to racist character. This collective book analyzes seriality as a major phenomenon increasingly connecting audiovisual narratives (cinematic films and television series) in the 20th and 21st centuries. The book historicizes and contextualizes the notion of seriality, combining narratological, aesthetic, industrial, philosophical, and political perspectives, showing how seriality as a paradigm informs media convergence and resides at the core of cinema and television history. This article explores the dynamics of the discourse and practice of corporate social responsibility (CSR) in France to illustrate the interplay between endogenous and exogenous factors in the development of CSR in a country. It shows how the cultural, socioeconomic, and legal traditions influence the way ideas are raised, the kinds of questions considered relevant, and the sorts of solutions conceived as desirable and possible. Furthermore, the article traces how expectations and practices evolve as a result of various social and (...) economic factors within a country, and increasingly, as a result of global influences such as the international academic discourse, the international practices of multinational companies, nongovernmental organizations and trade unions, and initiatives of supranational organizations. The American Policy Sciences, Complexity and the Crisis of Government: On the Social Embeddedness of Concept Formation in the Social Sciences. By analyzing debates about social “complexity” in the American policy sciences and in intellectual discourse of the 1970s, this article draws attention to the social embeddedness of concept formation and theory building in the social sciences. In the 1970s, a new concept of social “complexity” emerged in the social sciences, when scholars transferred and adapted elements of complexity theory from (...) mathematics, computer science, cybernetics, and general systems theory to refine social theory. The article analyzes the context and conditions in which this transfer occurred. It shows that the scholarly debates about social complexity were entwined with broader public-political discourses, dealing in particular with the challenges of government and public policy in the advanced Western democracies. The discourse on complexity among social scientists had additional layers of meaning: even in academic discourse, “complexity” was also used as a buzzword and as a metaphor. (shrink)

Rare diseases, defined as having a prevalence inferior to 1/2000, are poorly understood scientifically and medically. Appropriate diagnoses and treatments are scarce, adding to the burden of living with chronic medical conditions. The moral significance of rare disease experiences is often overlooked in qualitative studies conducted with adults living with rare diseases. The concept of morally problematic situations arising from pragmatist ethics shows promise in understanding these experiences. The objectives of this study were to (1) acquire an in-depth understanding of (...) morally problematic situations experienced by adults living with rare diseases in the province of Québec and (2) to develop an integrative model of the concept of morally problematic situations. To this end, an online survey targeting this population was developed through a participatory action research project. Respondents provided 90 long testimonies on the most important morally problematic situations they faced, often in healthcare settings. An integrative model was developed based on various qualitative analyses of these testimonies and relevant literature. The integrative model showcases that morally problematic situations have causes (i.e., contextual and relational factors, personal factors, jeopardized valuations), have affective repercussions (i.e., emotions and feelings, internal tensions), prompt action (i.e., through empowerment strategies leading to the evolution of situations), and elicit outcomes (i.e., factual consequences, residual emotions and feelings, positive or negative resolutions). In sum, this study advances understanding of the moral experiences of adults living with rare diseases while proposing a comprehensive conceptual tool to guide future empirical bioethics research on moral experiences. Arguments for veganism don’t make many vegans, or even many who think they ought to be vegans, at least when they’re written by philosophers. Others — such as the one by Jonathan Safran Foer — seem to do a bit better. Why? To answer this question, I sketch a theory of ordinary moral argumentation that highlights the importance of meaning-based considerations in arguing that people ought to act in ways that deviate from normal expectations for behaviour. In particular, I outline (...) an eclectic theory, where we draw on a variety of moral frameworks and don’t assume that morality is generally overriding. I suggest that meaning-based considerations help us sort through the array of reasons available to us, as well as explain why, in a particular case, what we ought to do morally is what we ought to do all things considered. Since the 90’s, neurolaw is on the rise. At the heart of heated debates lies the recurrent theme of a neuro-revolution of criminal responsibility. However, caution should be observed: the alleged foundations of criminal responsibility (amongst which free will) are often inaccurate and the relative imperviousness of its real foundations to scientific facts often underestimated. Neuroscientific findings may impact on social institutions, but only insofar as they also engage in a political justification of the changes being called for, convince populations, (...) and take into consideration the ensuing consequences. Moreover, the many limits of neuroscientific tools call for increased vigilance when, if ever, using neuroscientific evidence in a courtroom. In this article, we aim at setting the basis for future sound debates on the contribution of neuroscience to criminal law, and in particular to the assessment of criminal responsibility. As such, we provide analytical tools to grasp the political and normative nature of criminal responsibility and review the current or projected use of neuroscience in the law, all the while bearing in mind the highly-publicized question: can neuroscience revolutionize criminal responsibility? Answering this question implicitly requires answering a second question: should neuroscience revolutionize the institution of criminal responsibility? Answering both, in turn, requires drawing the line between science and normativity, revolution and dialogue, fantasies and legitimate hopes. (shrink)

This article examines Elisabeth of Bohemia's account of the emotions. I argue that Elisabeth's objections against Descartes' ethics, which is often characterized as ‘Neo-Stoic’, show striking similarities to the arguments that the ancient Peripatetics made against classical Stoic approaches. Like the Peripatetics, she challenges the feasibility as well as the desirability of Descartes' ethical injunctions regarding emotional control. In particular, Elisabeth joins the Peripatetics in holding that certain external goods are essential for happiness and that the emotions are necessary for (...) motivating, guiding and correcting action. In aligning Elisabeth's thinking about the emotions with the Aristotelian tradition, I depart from various other interpretations, especially from those who see her position as a precursor of later feminist accounts, or as embodying a distinctively female perspective. Differences between men and women in the performance of tests designed to measure spatial abilities are explained by evolutionary psychologists in terms of adaptive design. The Hunter-Gatherer Theory of Spatial Ability suggests that the adoption of a hunter-gatherer lifestyle (assuming a sexual division of labor) created differential selective pressure on the development of spatial skills in men and women and, therefore, cognitive differences between the sexes. Here, we examine a basic spatial skill—wayfinding (the ability to plan routes and navigate a (...) landscape)—in men and women in a natural, real-world setting as a means of testing the proposition that sex-based differences in spatial ability exist outside of the laboratory. Our results indicate that when physical differences are accounted for, men and women with equivalent experience perform equally well at complex navigation tasks in a real-world setting. We conclude that experience, gendered patterns of activity, and self-assessment are contributing factors in producing previously reported differences in spatial ability. (shrink)

English summary: The philosophy of play during the Middle Ages and the Renaissance has been largely neglected by scholars, despite the fact that influential thinkers, such as Albertus Magnus and Thomas Aquinas, perceived recreational play to be a vital part of a philosopher's life. By exploring a heterogeneous collection of diverse philosophical approaches to ludic practices, this innovative study provides the first in-depth discussion of the complexity of medieval and early-modern ludic philosophy. Particular attention is devoted to the relationship between (...) play and philosophy, which the influential Aristotelian discourse on play, initiated by Albert and Thomas, conceptualized as a contradictory dichotomy. By focusing on the manifold epistemic transformations which occurred during the Renaissance, this study analyses how philosophers in various contexts developed alternative or complementary theories of the connection between ludus and philosophia. Whereas evidence-based medicine (EBM) encourages the translation of medical research into decision-making through clinical practice guidelines (CPGs), patient-centred care (PCC) aims to integrate patient values through shared decision-making. In order to successfully integrate EBM and PCC, I propose a method of orienting physician decision-making to overcome the different obligations set out by a formally-rational EBM and substantively-rational ethics of care. Although death by neurologic criteria is legally recognized throughout the United States, state laws and clinical practice vary concerning three key issues: the medical standards used to determine death by neurologic criteria, management of family objections before determination of death by neurologic criteria, and management of religious objections to declaration of death by neurologic criteria. The American Academy of Neurology and other medical stakeholder organizations involved in the determination of death by neurologic criteria have undertaken concerted action to address variation (...) in clinical practice in order to ensure the integrity of brain death determination. To complement this effort, state policymakers must revise legislation on the use of neurologic criteria to declare death. We review the legal history and current laws regarding neurologic criteria to declare death and offer proposed revisions to the Uniform Determination of Death Act and the rationale for these recommendations. Recently, there have been a number of lawsuits in the United States in which families objected to performance of apnoea testing for determination of brain death. The courts reached conflicting determinations in these cases. We discuss the medicolegal complications associated with apnoea testing that are highlighted by these cases and our position that the decision to perform apnoea testing should be made by clinicians, not families, judges, or juries.

In 1968, the definition of death in the United States was expanded to include not just death by cardiopulmonary criteria, but also death by neurologic criteria. We explore the way the definition has been modified by the medical and legal communities over the past 50 years and address the medical, legal and ethical controversies associated with the definition at present, with a particular highlight on the Supreme Court of Nevada Case of Aden Hailu.

Background Debates and controversies have shaped the understanding and the practices related to death determined by neurological criterion . Confusion about DNC in the public domain could undermine this notion. This confusion could further jeopardise confidence in rigorous death determination procedures, and raise questions about the integrity, sustainability, and legitimacy of modern organ donation practices.Objective We examined the depictions of ‘brain death’ in major American and Canadian print media to gain insights into possible common sources of confusion about DNC and (...) the relationship between expert and lay views on this crucial concept.Methods We gathered 940 articles, available in electronic databases, published between 2005 and 2009 from high-circulation Canadian and American newspapers containing keywords ‘brain dead’ or ‘brain death’. Articles were systematically examined for content using the NVivo 8 software.Results Our results showed problematic aspects in American and Canadian media, with some salient differences. DNC was used colloquially in 39% of the articles and its medical meaning infrequently defined . The neurological criterion for determination of death was mentioned in less than 10% of the articles, and life support in about 20% of the articles. Organ donation issues related to DNC were raised more often in Canadian articles than in American articles .Interpretation Further discussion is needed to develop innovative strategies to bridge media representations of DNC with experts’ views in connection with organ donation practices. Jordan, Poem about My Rights Introduction: The Evidence of Slime Slavery, itself a kind of “slime,” remains an active marketplace for the production of Black female sexuality and its representations.1 The impact of chattel slavery and the pervasive rape of Black female slaves on modern 1. In using the term “Black women,” I am referring to African American women for whom the history of chattel slavery in the Americas has produced the socio-historical conditions that uniquely inform Black female subjectivity and sexual politics. My use of this term is not to essentialize Black American womanhood; rather, like Black feminist scholar Patricia Hill Collins, I use the term to gesture to a Black women’s standpoint influenced by the condition and experience of gendered and racialized abjection, a “common experience of being Black women in a society that denigrates women of African descent.” Patricia Hill Collins, Black Feminist Thought: Knowledge, Consciousness and the Politics of Empowerment (London: Routledge, 1990), 22. In this essay, I focus on Black women who practice BDSM, a small but nonetheless heterogeneous group of women in the already-marginalized larger kink community. 410 Ariane Cruz constructions and representations of Black women has been well theorized, in particular by a number of Black feminist scholars who have worked to rupture what Darlene Clark Hine terms the “culture of dissemblance,” the politics of silence shrouding expressions of Black female sexuality.2 While the antebellum legacy of sexual violence on Black women is substantive, what has not been effectively considered is how Black women deliberately employ the shadows of slavery in the deliverance and/or receiving of sexual pleasure. That is, how the “slime”—a staining sludge of pain and violence—becomes a type of lubricant to stimulate sexual fantasies, access sexual pleasure, and heighten sexual desire. In this paper, I explore how Black women facilitate a complex and contradictory negotiation of pain, pleasure, and power in their performances in the fetish realm of BDSM.3 Situating my analysis in the context of hardcore BDSM Internet pornography and the controversial praxis of race play, I argue that BDSM is a critical site from which to reimagine the formative links between Black female sexuality and violence. Race play is a BDSM practice that explicitly uses race to script power exchange and the dynamics of domination and submission. Most commonly an interracial erotic play, race play employs racism, often involving the exchange of racist language, role-playing, and the construction of racist scenes. Edmund Beecher Wilson is generally celebrated for his contribution to chromosome theory and genetics, whereas opinion concerning his cytological thinking is often restricted to the idea that he provided evidence for the dominant role of the nucleus. But Wilson's cell theory was much more. It was a child of the German Zellforschung, and its attempt to provide a comprehensive cellular answer to a wide range of biological and physiological questions. Wilson developed a corpuscular, micromeristic and preformistic concept, and treated the (...) cell as an organism subject to ontogenetic and phylogenetic processes. He defended his comprehensive theory even in the 1920's, when cytological research had become specialised and directed at more practical goals. For many of his younger readers this concept might have seemed antiquated, but today many of its features sound surprisingly modern. (shrink)

This essay develops a framework for understanding what I call the ethics of reflexivity, that is, the norms that govern attitudes and actions with respect to one’s own worth. I distinguish five central aspects of the reflexive commitment to living in accordance with one’s personal ideals: the extent to which and manner in which one regards oneself from an evaluative point of view, the extent to which one cares about receiving the respect of others, the degree to which one interprets (...) one’s personal ideals in an individualistic or collective manner, the degree to which one’s commitment to living in accordance with one’s personal ideals is rigid or flexible, and the worthiness of one’s personal ideals. This framework, I argue, illuminates the nature and moral significance of virtuous and vicious forms of the character trait of pride. (shrink)
