Jakob Friedrich Fries is one of the most important representatives of the Critical Philosophy, someone who built immediately on the original Kantian philosophy. -/- Fries was born in 1773 in Barby (on the Elbe). In 1805 he was extraordinary professor for philosophy in Jena and in the same year was ordinary professor for philosophy in Heidelberg. Returning to Jena in 1816, one year later he was compulsorily retired because of his participation at the nationalistic and republican Wartburg Festival. In 1924 (...) he obtained a professorship for physics and mathematics, and in 1838 he was given back a professorship for philosophy. He died in 1843 in Jena. -/- The book summarizes the research results of the DFG-Project "Jakob Friedrich Fries' Influence on the Sciences of the 19th Century". The research project was carried out by Dr. Kay Herrmann (Institute of Philosophy, Jena University) and Prof. Dr. Wolfram Hogrebe (Institute of Philosophy, Bonn University). Such a study has special importance. There is available a large amount of literature about the "speculative contemporaries" of Fries, like Fichte, Schelling, and Hegel. In contrast to the "speculative philosophy", there has been published only a few studies about the Friesian natural philosophy. Fries was, in his natural-philosophical studies, looking for a link between philosophy and modern sciences, wheras his "speculative philosophical" contemporaries felt obligated to stick primarily to a descriptive, phenomenal view of nature. So far the question "How was mathematical natural philosophy regarded by scientists and mathematicians of the 19th century?" has hardly been investigated. Archival studies showed that this gap in Fries-research can be filled. The Friesian correspondence turned out to be a rich gold mine. -/- The present publication is more than a research report. The monographic first part is intended to introduce the foundations of the Friesian theory of cognition, the Friesian methodology, and the Friesian natural philosophy. This should facilitate entry into Friesian philosophy. -/- The Friesian theory is analyzed from two points of view: •How did Fries suceed in continuing and improving the Kantian approach? Is Fries able to remove the weak points of Kantian philosophy? -/- •What is the current significance of the Friesian approach? There are some interesting similarities between the Friesian approach and modern philosophical theories (such like Chomsky's theory of "universal grammer"). The lasting core of the Friesian theory of cognition is: To use empirical studies for working on philosophical problems. -/- Chapters 3 and 4 are scientific-historically oriented. These chapters analyze the Friesian position in scientific and mathematical debates (debates about the a priori foundations of physics, the problem of the identification of physics as an independent discipline, the problem of the boundary between chemistry and physics, the problem of mathematization of the sciences, the theory of the imponderabilia, the systematics and structure of sciences and mathematics, problems of infinity, the differential calculus, the theory of parallel lines) and the relation between Fries and the scientists of the 19th century. The book contains the latest findings gained by evaluation of the Friesian unpublished work (for example the correspondence with W. Weber, C. F. Gauß, E. F. Apelt, O. Schlömilch, Ch. Reichel, B. In the 1720s the antiquary and Newtonian scholar Dr. William Stukeley described his friend Isaac Newton as ‘the Great Restorer of True Philosophy’. Newton himself in his posthumously published Observations upon the prophecies of Daniel, and the Apocalypse of St. John predicted that the imminent fulfilment of Scripture prophecy would see ‘a recovery and re-establishment of the long-lost truth’. In this paper I examine the background to Newton’s interest in ancient philosophy and theology, and how it related to modern natural (...) philosophical discovery. I look at the way in which the idea of a ‘long-lost truth’ interested others within Newton’s immediate circle, and in particular how it was carried forward by Stukeley’s researches into ancient British antiquities. Gertrude Stein may be regarded as one of the most innovative and obscure modernist writers. At the core of Tender Buttons, her most experimental work, lies a dialectical tension between meaning and non-meaning, order and disorder, the opacity of which some of the earliest critical studies of Stein described as both “an eloquent mistake” and “the ravings of a lunatic,” resisting interpretation. In this paper, I show that phenomenology offers an appropriate tool for opening up the much-discussed dialectic of this (...) work. By “bracketing” the hard facts of our object-world, Stein enacts an epoché of sorts, allowing us to “see fine substances strangely” before the conventional structures of objectivity and factuality take over. For better or worse, places matter to us. Especially the familiar places we call home—the ones that embody our personal and cultural histories, give our lives a sense of stability, and support the routines of everyday life. Global Climate Change (GCC) poses an existential threat to these places, engendering nonmaterial losses that threaten subjective well-being and overall mental health. Unfortunately, these nonmaterial losses are often overlooked or underappreciated. My aim in this article is to counter this tendency and explore the (...) relationship between people and place in a way that sheds light on the nonmaterial threat of GCC. I approach this task from the lens of everyday aesthetics. While finding adequate compensation for these nonmaterial losses is unlikely, I suggest that sensitivity to the aesthetic texture of everyday life can provide a source of aesthetic consolation that can make the challenges of GCC easier to manage. In this paper a tentative neurophysiologically framed approach of the Freudian unconscious that would function on the basis of linguistic (phonological) organizing principles, is proposed. A series of arguments, coming from different fields, are taken together. First, clinical reports indicate that in a state of high emotional arousal linguistic fragments are treated in a decontextualized way, and can lead to the isolation of phoneme sequences which, independently of their actual meaning, are able to resort emotional effects. Second, phonological and neurophysiological (...) arguments are given to make the case that language processing – be it producing, receiving or imagining language – is a motor event. A crucial distinction is proposed: while contextualized processing correlates on a neurophysiological level with action understanding, and is psychoanalytically akin to secondary processing, decontextualized language processing has a neurophysiological counterpart in object understanding and is psychoanalytically akin to primary processing. Third, isolated speech fragments are therefore considered as objects which, similarly to non-linguistic objects, undergo emotional conditioning and establish an idiosyncratic linguistically structured emotional memory. Phoneme sequences which in this way come to carry high emotional valences are thought to be more readily subject to threaten the bodily integrity, and therefore more readily inhibited. When this inhibition leads to the prevention of effective realization of the voluntary motor output, this is thought to result in the sustained high levels of neuronal activation which seek for release by attracting substitutes that are phonemically similar to the censored speech fragments though they are cognitively non threatening. As a result, the speech of the subject would be particularly concerned with the verbalizations of these substitutive phoneme sequences. In summary, the Freudian unconscious is conceived as the instantiation of a linguistic action space which would be idiosyncratically organized by particular phonemic “phantoms” operating as attractors for the subject’s (linguistic) actions. Since the 90’s, neurolaw is on the rise. At the heart of heated debates lies the recurrent theme of a neuro-revolution of criminal responsibility. However, caution should be observed: the alleged foundations of criminal responsibility (amongst which free will) are often inaccurate and the relative imperviousness of its real foundations to scientific facts often underestimated. Neuroscientific findings may impact on social institutions, but only insofar as they also engage in a political justification of the changes being called for, convince populations, (...) and take into consideration the ensuing consequences. Moreover, the many limits of neuroscientific tools call for increased vigilance when, if ever, using neuroscientific evidence in a courtroom. In this article, we aim at setting the basis for future sound debates on the contribution of neuroscience to criminal law, and in particular to the assessment of criminal responsibility. As such, we provide analytical tools to grasp the political and normative nature of criminal responsibility and review the current or projected use of neuroscience in the law, all the while bearing in mind the highly-publicized question: can neuroscience revolutionize criminal responsibility? Answering this question implicitly requires answering a second question: should neuroscience revolutionize the institution of criminal responsibility? Answering both, in turn, requires drawing the line between science and normativity, revolution and dialogue, fantasies and legitimate hopes. (shrink)

The rise of Islamic activism in Egypt during the 1970s relied in large part on the production and mass dissemination of religiously oriented periodicals. Islamic social movement organizations ranging from the established al-Gamʿiyya al-Sharʿiyya to the revived Muslim Brotherhood utilized magazines to inform, orient, and mobilize Egyptians while engaging the state directly during Anwar al-Sadat’s ‘Infitah’. By comparing the framing processes within three of the most prominent Islamist periodicals of this period, this article investigates the process by which movement leaders (...) actively constructed the frames around which activists recruited and mobilized supporters. I argue that Islamist magazines attempted to offer historical continuity with prior movements, authenticity in their teaching of religious thought and practice, and a reframing of a political agenda that was traditionally dominated by state institutions. More significantly, by forging a message that attempted to unify all of these elements, these publications aided in the construction of new communities of believers that charted the course for the next era of Islamic activism in Egypt. ABSTRACTThis article examines Elisabeth of Bohemia's account of the emotions. I argue that Elisabeth's objections against Descartes' ethics, which is often characterized as ‘Neo-Stoic’, show striking similarities to the arguments that the ancient Peripatetics made against classical Stoic approaches. Like the Peripatetics, she challenges the feasibility as well as the desirability of Descartes' ethical injunctions regarding emotional control. In particular, Elisabeth joins the Peripatetics in holding that certain external goods are essential for happiness and that the emotions are necessary for (...) motivating, guiding and correcting action. In aligning Elisabeth's thinking about the emotions with the Aristotelian tradition, I depart from various other interpretations, especially from those who see her position as a precursor of later feminist accounts, or as embodying a distinctively female perspective. Christopher Arciszewski, Arian mercenary and man of many facets, conducted a journal in which, it is suspected, he described military campaigns, the state of the colony and other interesting phenomena he was able to observe during his time of service in Brazil. In 1641, Gerard Vossius was completing his magnum opus De theologia. In Chapter 8 of the first volume, Vossius discusses the “cult of the demon” among various peoples. As an example the Netherlander erudite provides a colorful description of (...) such a cult among the Brazilian Tapuya tribe. Since the author never traveled to Brazil, he makes use of the observations of Christopher Arciszewski. How does an Arian, brought up in an atmosphere of intense pluralism and far-reaching tolerance towards other belief systems, react when he encounters, first-hand, a culture utterly different, and completely alien to him? His presentation of a hierarchically constructed morality existent among various cannibalistic tribes is, in a sense, an intellectual breakthrough. Instead of treating the nativescollectively as one homogenous culture, as simply “savages”, Arciszewski distinguishes between various cultural units, and treats them individually. The nobleman attempts to convey their own views of morality not on the basis of European ethical systems, but on the local ones in place. In his day, such ideas were nearly unthinkable for most educated Europeans. Cannibalism of any kind was perceived as godless behavior, a sort of devilry, which would eventually be abolished with coming of the “light of Christianity” to the New World and the inevitable Europeanization of the natives. The reader can marvel at the extent to which Arciszewski is willing go in his relativism, to the point of sympathizing with the Tapuya. He allows them to explain to the reader the functioning of theirendo-cannibalistic culture. Arciszewski adds to the rationalization of cannibalism a detailed description of the death-rite among the Tapuya, presenting these ceremonial customs in accordance with their own beliefs, as something potentially interesting for humanistic intellectuals back in the Old World. Vossius’ book also discusses the question of the tribe’s spiritual beliefs: their conceptions of good and evil, deities, etc. The reader once again witnesses Arciszewski’s readiness to accept beliefs and deities completely unknown to European religion. The author does not prima facie discount the possibility that the “universal laws” operating in the Old World have no place in the Brazilian wilderness. His philosophical outlook, demonstrated by his rationalization of what had before been considered “magical” or “irrational”, is surely a foreshadowing of the rationalism of Enlightenment, whose modes of thinking constitute the core-foundation for alllater philosophical and scientific inquiry. Arciszewski, as an Arian brother par excellence, essentially operated with such conceptual tools as relativism, toleration and universalism, and his intellectual arsenal did not altogether differ from our own. As such, Arciszewski, and Europeans like him, helped free the Western worldview of its mediaeval philosophically limited conceptions of the cosmos, and propelled it in new directions of inquiry. A firm's ability to shape its policies to meet societal demands depends on how it perceives the opportunities and risks in its environment. The authors hypothesized that corporate culture plays a significant role in shaping organizational percep-tions. This article summarizes the findings of a study on how the organizational culture of a chemical firm headquartered in West Germany affected the evolution of its social and personnel policy from 1950 to 1989 given the changes in its sociopolitical environment during this period. The study shows that the culture of a company, by shaping its perceptions, plays a central role in determining the areas in which the organization is likely to be able to learn easily and those in which it is likely to resist changing its policies. Recently, there have been a number of lawsuits in the United States in which families objected to performance of apnoea testing for determination of brain death. The courts reached conflicting determinations in these cases. We discuss the medicolegal complications associated with apnoea testing that are highlighted by these cases and our position that the decision to perform apnoea testing should be made by clinicians, not families, judges, or juries.

Stem cells did not become a proper research object until the 1960 s. Yet the term and the basic mind-set—namely the conception of single undifferentiated cells, be they embryonic or adult, as the basic units responsible for a directed process of development, differentiation and increasing specialisation—were already in place at the end of the nineteenth century and then transmitted on a non-linear path in the form of tropes and diagrams. Ernst Haeckel and August Weismann played a special role in this (...) story. The first coined the term Stammzelle (stem cell), the second was the author of the first cellular stem-tree diagram. Even today, I shall argue, the understanding of stem cells, especially the popular perception, is to a large extent a Haeckelian–Weismannian one. After having demonstrated this, by analysing the terminology, in this essay I will focus on the use of cytogenetic tree diagrams between 1892 and 1925 and on the tacit understanding of stem cells that they transmit. During the time of English Nonconformity, Arianism was not only embraced, but openly acknowledged by most of the Presbyterian ministers. That generation of ministers, who contended so zealously for the orthodox faith, had finished their labours, and received from their Lord a dismissal into eternal rest. Those champions among the laity who, at the beginning of the controversy, stood up so firmly for the truth, had entered as well into the joy of their Lord. Though their children continued Dissenters, too (...) many of them did not possess the same sentiments or spirit. Among those who succeeded these ministers were too many who embraced the Arian creed. To this unhappy change contributed the example and conversation as well of many from the younger Presbyterian ministers. In consequence Arianism spread far and wide in the Presbyterian congregations, both among the ministers and the people. This unhappy controversy proved the grave of the Presbyterian congregations, and of those of the General Baptists. The effects of Arianism, though at first scarcely visible, gradually produced desolation and death. (shrink)

Although death by neurologic criteria is legally recognized throughout the United States, state laws and clinical practice vary concerning three key issues: the medical standards used to determine death by neurologic criteria, management of family objections before determination of death by neurologic criteria, and management of religious objections to declaration of death by neurologic criteria. The American Academy of Neurology and other medical stakeholder organizations involved in the determination of death by neurologic criteria have undertaken concerted action to address variation (...) in clinical practice in order to ensure the integrity of brain death determination. To complement this effort, state policymakers must revise legislation on the use of neurologic criteria to declare death. We review the legal history and current laws regarding neurologic criteria to declare death and offer proposed revisions to the Uniform Determination of Death Act and the rationale for these recommendations. Jordan, Poem about My Rights Introduction: The Evidence of Slime Slavery, itself a kind of “slime,” remains an active marketplace for the production of Black female sexuality and its representations.1 The impact of chattel slavery and the pervasive rape of Black female slaves on modern 1. In using the term “Black women,” I am referring to African American women for whom the history of chattel slavery in the Americas has produced the socio-historical conditions that uniquely inform Black female subjectivity and sexual politics. My use of this term is not to essentialize Black American womanhood; rather, like Black feminist scholar Patricia Hill Collins, I use the term to gesture to a Black women’s standpoint influenced by the condition and experience of gendered and racialized abjection, a “common experience of being Black women in a society that denigrates women of African descent.” Patricia Hill Collins, Black Feminist Thought: Knowledge, Consciousness and the Politics of Empowerment (London: Routledge, 1990), 22. In this essay, I focus on Black women who practice BDSM, a small but nonetheless heterogeneous group of women in the already-marginalized larger kink community. 410 Ariane Cruz constructions and representations of Black women has been well theorized, in particular by a number of Black feminist scholars who have worked to rupture what Darlene Clark Hine terms the “culture of dissemblance,” the politics of silence shrouding expressions of Black female sexuality.2 While the antebellum legacy of sexual violence on Black women is substantive, what has not been effectively considered is how Black women deliberately employ the shadows of slavery in the deliverance and/or receiving of sexual pleasure. That is, how the “slime”—a staining sludge of pain and violence—becomes a type of lubricant to stimulate sexual fantasies, access sexual pleasure, and heighten sexual desire. In this paper, I explore how Black women facilitate a complex and contradictory negotiation of pain, pleasure, and power in their performances in the fetish realm of BDSM.3 Situating my analysis in the context of hardcore BDSM Internet pornography and the controversial praxis of race play, I argue that BDSM is a critical site from which to reimagine the formative links between Black female sexuality and violence. This article explores the dynamics of the discourse and practice of corporate social responsibility (CSR) in France to illustrate the interplay between endogenous and exogenous factors in the development of CSR in a country. It shows how the cultural, socioeconomic, and legal traditions influence the way ideas are raised, the kinds of questions considered relevant, and the sorts of solutions conceived as desirable and possible. Furthermore, the article traces how expectations and practices evolve as a result of various social and (...) economic factors within a country, and increasingly, as a result of global influences such as the international academic discourse, the international practices of multinational companies, nongovernmental organizations and trade unions, and initiatives of supranational organizations. The article closes with reflections about what can be learned from the French experience with CSR and how to stimulate such cross-border learning. (shrink)

Slow Food is an Italy-based international organization that aims to save the varieties, breeds, and foods threatened by the standardization and homogenization of agriculture resulting from the widespread use of conventional practices. Through an analysis of one of Slow Food’s projects, a Basque Presidium, this paper examines the effects of Slow Food’s efforts on the products, producers, and agrobiodiversity it is trying to save. Drawing upon Igor Kopytoff’s descriptions of commoditization as process, this paper argues that the products and the (...) values they embody, which Slow Food has identified for their singularity, are commoditized through a variety of mechanisms. This paper then argues that commoditization makes the endeavors of Slow Food resemble the conventional agricultural system it is trying to oppose, as well as undermining the very agrobiodiversity the organization seeks to protect. These effects create a disconnect between the organization’s goals and its actions on-the-ground, indicating that Slow Food is not as alternative as it claims to be. This paper ends by examining Slow Food’s role within the overall agricultural system, and suggests that the organization’s producers are important guardians of the global agrobiodiversity which conventional production erodes. In 1968, the definition of death in the United States was expanded to include not just death by cardiopulmonary criteria, but also death by neurologic criteria. We explore the way the definition has been modified by the medical and legal communities over the past 50 years and address the medical, legal and ethical controversies associated with the definition at present, with a particular highlight on the Supreme Court of Nevada Case of Aden Hailu.

The American Policy Sciences, Complexity and the Crisis of Government: On the Social Embeddedness of Concept Formation in the Social Sciences. By analyzing debates about social “complexity” in the American policy sciences and in intellectual discourse of the 1970s, this article draws attention to the social embeddedness of concept formation and theory building in the social sciences. In the 1970s, a new concept of social “complexity” emerged in the social sciences, when scholars transferred and adapted elements of complexity theory from (...) mathematics, computer science, cybernetics, and general systems theory to refine social theory. The article analyzes the context and conditions in which this transfer occurred. It shows that the scholarly debates about social complexity were entwined with broader public-political discourses, dealing in particular with the challenges of government and public policy in the advanced Western democracies. The discourse on complexity among social scientists had additional layers of meaning: even in academic discourse, “complexity” was also used as a buzzword and as a metaphor. (shrink)

Freud proposes that in unconscious processing, logical connections are also (heavily) based upon phonological similarities. Repressed concerns, for example, would also be expressed by way of phonologic ambiguity. In order to investigate a possible unconscious influence of phonological similarity, 31 participants were submitted to a tachistoscopic subliminal priming experiment, with prime and target presented at 1ms. In the experimental condition, the prime and one of the 2 targets were phonological reversed forms of each other, though graphemically dissimilar (e.g., “nice” and (...) “sign”); in the control condition the targets were pseudo-randomly attributed to primes to which they don’t belong. The experimental task was to “blindly” pick the choice most similar to the prime. ERPs were measured with a focus on the N320, which is known to react selectively to phonological mismatch in supraliminal visual word presentations. The N320 amplitude-effects at the electrodes on the midline and at the left of the brain significantly predicted the participants’ net behavioral choices more than half a second later, while their subjective experience is one of arbitrariness. Moreover, the social desirability score (SDS) significantly correlates with both the behavioral and the N320 brain responses of the participants. It is proposed that in participants with low SDS the phonological target induces an expected reduction of N320 and this increases their probability to pick this target. In contrast, high defensive participants have a perplexed brain reaction upon the phonological target, with a negatively peaking N320 as compared to control and this leads them to avoid this target more often. Social desirability, which is understood as reflecting defensiveness, might also manifest itself as a defense against the (energy-consuming) ambiguity of language. The specificity of this study is that all of this is happening totally out of awareness and at the level of very elementary linguistic distinctions. (shrink)

Whereas evidence-based medicine encourages the translation of medical research into decision-making through clinical practice guidelines, patient-centred care aims to integrate patient values through shared decision-making. In order to successfully integrate EBM and PCC, I propose a method of orienting physician decision-making to overcome the different obligations set out by a formally-rational EBM and substantively-rational ethics of care. I engage with Weber’s concepts “the ethic of responsibility” and verstehen as a new model of clinical reasoning that reformulates the relationship between medical (...) knowledge and social values, while demonstrating the relevance of the classical sociological cannon to contemporary medical humanities. Differences between men and women in the performance of tests designed to measure spatial abilities are explained by evolutionary psychologists in terms of adaptive design. The Hunter-Gatherer Theory of Spatial Ability suggests that the adoption of a hunter-gatherer lifestyle (assuming a sexual division of labor) created differential selective pressure on the development of spatial skills in men and women and, therefore, cognitive differences between the sexes. Here, we examine a basic spatial skill—wayfinding (the ability to plan routes and navigate a (...) landscape)—in men and women in a natural, real-world setting as a means of testing the proposition that sex-based differences in spatial ability exist outside of the laboratory. Our results indicate that when physical differences are accounted for, men and women with equivalent experience perform equally well at complex navigation tasks in a real-world setting. We conclude that experience, gendered patterns of activity, and self-assessment are contributing factors in producing previously reported differences in spatial ability. (shrink)
