En el ámbito del derecho procesal penal, particularmente en el contexto del tránsito, existe una carencia de disposiciones legales que regulen el aspecto probatorio para demostrar infracciones por parte de las autoridades competentes. Específicamente, la falta de regulación sobre el uso de fotografías o videos como evidencia dificulta el proceso de aplicación de la ley, ya que ni el COIP ni la LOTTTSV ni sus reglamentos abordan adecuadamente cómo deben obtenerse pruebas mediante medios digitales. Esta laguna normativa plantea interrogantes sobre (...) qué aspectos pueden capturarse en contenido digital, cómo llevar a cabo dicho proceso y qué requisitos deben cumplir los dispositivos utilizados. Ante esta situación, se justifica la necesidad de realizar una investigación exhaustiva para determinar qué aspectos deben incorporarse en la normativa de tránsito con el fin de garantizar un debido proceso. El objetivo principal de esta investigación fue identificar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito, así como proponer recomendaciones para mejorar el marco normativo existente. Se buscó determinar qué aspectos deben ser incorporados en la normativa de tránsito para garantizar un debido proceso y una aplicación justa de la ley. Para abordar esta problemática, se llevó a cabo una investigación cualitativa con un enfoque descriptivo. Se empleó el método dogmático-jurídico analítico-sintético para analizar en detalle la legislación existente y las lagunas normativas relacionadas con la obtención de pruebas digitales en casos de infracciones de tránsito. Además, se realizaron entrevistas a expertos en derecho procesal penal y se recopiló información de jurisprudencia relevante. Este enfoque metodológico permitió una comprensión profunda de los desafíos y las posibles soluciones en este ámbito. Los resultados de la investigación revelaron importantes lagunas en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se identificaron problemas relacionados con la falta de claridad en los procedimientos de obtención de pruebas digitales y la ausencia de criterios específicos para la admisibilidad de dichas pruebas en los procesos legales. Además, se destacó la necesidad de establecer estándares claros y procedimientos adecuados para garantizar la integridad y fiabilidad de la evidencia digital en el contexto del tránsito. Esta investigación resalta la importancia de abordar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se recomienda la implementación de medidas específicas para mejorar la recopilación y admisibilidad de pruebas digitales, así como la revisión y actualización de la normativa existente. Esto contribuirá a garantizar un proceso legal justo y transparente en el ámbito del tránsito, fortaleciendo así el Estado de derecho y la confianza en el sistema judicial. (shrink)

Esta ponencia presenta un avance parcial de la investigación sobre la democracia en los municipios colombianos desde la adopción de la elección popular de los alcaldes. A partir de una conceptualización básica y operacional de la democracia se determinan sus principales dimensiones y se presentan los resultados obtenidos para algunas variables significativas que se han procesado, aplicando técnicas de análisis multivariado. El objetivo final (aún en elaboración) es generar un índice de calidad democrática que permita comparar y explicar los avances (...) y retrocesos de la democracia en los muy diversos municipios colombianos. The phenomenon of corruption is a cancer that affects our country and that it is necessary to eradicate; This dilutes the opportunities for economic and social development, privileging the single conjunction of particular interests, political actors in non-legal agreements for their own benefit, which lead to acts of corruption. Recent studies indicate that the level of corruption present in a political system is directly related to the type of institutional structure that defines it (Boehm and Lambsdorff, 2009), as well as (...) the ineffectiveness of the control organisms (Casar, 2015; Cárdenas, 2010, Rojas, 2010, Carbonell, 2009, Restrepo, 2004), which requires citizen action to combat corruption (Sandoval, 2010, Villanueva, 2006). This work, focuses our attention on the federal public administration, presenting as a proposal to empower the citizen action in the fight against corruption and in the National Anticorruption System; the figure of Whistleblowers or generator of citizen alert, based on two fundamental principles: i) recognizing the citizen's obligation to report acts of corruption and ii) the granting by the authority of witness protection. These two actions will result in two important results: i) Consolidate the citizen's complaint to inform society about acts of corruption and ii) and the exercise of freedom of information so that society is able to be informed about acts of corruption. These actions will allow promoting and consolidating a culture of reporting acts of corruption that may constitute a crime as a fundamental pillar in the National Anticorruption System in Mexico. El fenómeno de la corrupción es un cáncer que afecta a nuestro país y que es necesario erradicar; éste diluye las oportunidades de desarrollo económico y social, privilegiando la sola conjunción de intereses particulares, de actores políticos en acuerdos no legales en beneficio propio, los cuales derivan en actos de corrupción. Estudios recientes señalan que el nivel de corrupción presente en un sistema político está directamente relacionado con el tipo de estructura institucional que lo defina (Boehm y Lambsdorff, 2009), así (...) como de la ineficacia de los organismos de control (Casar, 2015; Cárdenas, 2010; Rojas, 2010; Carbonell, 2009; Restrepo, 2004), por lo que se requiere de la acción ciudadana para combatir la corrupción (Sandoval, 2010; Villanueva, 2006). Este trabajo, centra nuestra atención en la administración pública federal, presentando como propuesta para empoderar la acción ciudadana en el combate de la corrupción y en el Sistema Nacional Anticorrupción; la figura de Whistleblowers o generador de alerta ciudadana, desde dos principios fundamentales: i) reconociendo la obligación del ciudadano de informar sobre actos de corrupción y ii) el otorgamiento por parte de la autoridad de la protección de testigos. Estas dos acciones derivarán en dos resultados importantes: i) Consolidar la denuncia ciudadana para informar a la sociedad sobre actos de corrupción y ii) y el ejercicio de la libertad de la información a fin de que la sociedad este en posibilidades de ser informada sobre actos de corrupción. Estas acciones permitirán promover y consolidar una cultura de la denuncia de actos de corrupción que pueden ser constitutivos de delito como pilar fundamental en el Sistema Nacional Anticorrupción en México. The problem of identity is central to epistemic transference. However, relative identity appears to be the only way to work out an epistemic useful notion of identity. Relative identity, on its part, is either parasitic on strict identity or not identity at all. If, on the contrary, we ought for a strict concept of identity capable of satisfying its requirements, we end up with a tautologic and epistemic worthless category. The paper provides an answer to this problem, which, while working (...) with a strict notion, shows how it might still serve epistemic purposes. In doing so, it shows how a formal reconstruction of our objectual world and the identities we refer to poses a workable model upon which our messy epistemic one acquires stability. Resumen Las tecnologías digitales han transfigurado el campo del arte teatral y vienen produciendo una serie de mutaciones que afectan la tradición perceptiva del espectáculo vivo. Para acercarnos a esos nuevos modos de comunicación que establece hoy el teatro, robustecido en el cruce con estas tecnologías, acudiremos al concepto de remediación planteado por Bolter y Grusin, para examinar en dos performances representativas de la escena latinoamericana del siglo XXI (Sin sangre, de Teatrocinema, yOthelo, de Buendía Theatre), las maneras cómo la (...) opacidad del medio (hipermediación) o su transparencia (inmediación) contribuyen a la construcción de las poéticas tecnológicas sobre la escena misma. Abstract Digital technologies have transfigured the field of theatrical art and have been producing a series of mutations that affect the perceptive tradition of live performance. To approach these new modes of communication that theater establishes today, strengthened in the intersection with these technologies, we will turn to the concept of remediation proposed by Bolter and Grusin, to examine two representative performances of the Latin American scene of the 21st century (Sin Sangre, by Teatrocinema, and Othelo, by Buendía Theatre), the ways in which the opacity of the medium (hypermediation) or its transparency (immediacy) contribute to the construction of technological poetics on the scene itself. Paniel Reyes Cárdenas provides a novel reading of Josiah Royce’s Absolute Pragmatism in the context of the nineteenth-century origins of Classical Pragmatism. Royce’s proposal leads to an integrated philosophy that unfolds the synthetic-semiotic theory of community.

The present paper deals with the ontological status of numbers and considers Frege ́s proposal in Grundlagen upon the background of the Post-Kantian semantic turn in analytical philosophy. Through a more systematic study of his philosophical premises, it comes to unearth a first level paradox that would unset earlier still than it was exposed by Russell. It then studies an alternative path, that departin1g from Frege’s initial premises, drives to a conception of numbers as synthetic a priori in a more (...) Kantian sense. On this basis, it tentatively explores a possible derivation of basic logical rules on their behalf, suggesting a more rudimentary basis to inferential thinking, which supports reconsidering the difference between logical thinking and AI. Finally, it reflects upon the contributions of this approach to the problem of the a priori. (shrink)

La biología utiliza múltiples criterios para individuar fenómenos biológicos. Frente a esta diversidad, los enfoques monistas proponen criterios fundamentales para el reconocimiento unívoco de individuos, esto es, formas únicas de dividir el mundo biológico en entidades individuales. El pluralismo, por otro lado, argumenta que no deberíamos restringir el estudio de la individualidad a concepciones únicas, reconociendo, en su lugar, diferentes tipos de individuos. En este artículo, analizaré cómo ciertos enfoques monistas y pluralistas enfrentan la pluralidad de criterios de individuación utilizados (...) por la práctica científica. Siguiendo las recientes aproximaciones epistemológicas y pragmáticas en filosofía de la individualidad biológica, argumentaré por qué la diversidad de individuaciones no suele representar un inconveniente para la biología y por qué contribuye a nuestro conocimiento del mundo biológico. La conclusión general será que requerimos múltiples maneras de individuar la naturaleza para poder cumplir los diversos objetivos epistémicos de la biología, una labor que las aproximaciones monistas no suelen visibilizar. In this paper I argue that teleology and a proper teleological analysis of the uterus is important for a comprehensive understanding of the rights of the unborn. I argue that a right to life entails the right to use those organs that naturally function for an individual’s survival. Consequently, an unborn child has a right to his mother’s uterus. If this is accepted, bodily-rights arguments for abortion such as those proposed by Judith Jarvis Thomson and David Boonin are completely undermined. (...) While Thomson and Boonin may be justified in arguing the right to life does not always entail the right to use another person’s body, I argue that the right to life of the unborn does entail the right to use their mother’s body. There is a long-standing discussion concerning the nature of moral discourse. Multiple views range from realism—according to which moral discourse is closer to scientific discourse than to fictional discourse—to anti-realism—according to which moral discourse is rather closer to fictional discourse. In this paper, I want to motivate a novel anti-realist account. On this view, there are no moral properties or truths, neither mind-independent nor mind-dependent ones (i.e., anti-realism). However, moral cognition results from the use of higher order cognitive abilities with (...) enough resources to grant moral discourse with all the features of a realist talk (i.e., cognitive quasi-realism). I defend this view based on empirical evidence on human moral development and by showing that the resulting account can meet the demands of robust moral realism. The paper concludes by placing the proposed view within the metaethical landscape by comparing it against other forms of anti-realism, most significantly against expressivism. (shrink)

Las Tecnologías de Información y Comunicación se presentaron como una alternativa “efectiva o no”, tanto para quienes enseñan su uso como para quienes las utilizan; es un hecho, se quiera o no, que arribaron a nuestra sociedad para permanecer y multiplicarse, una realidad compleja ante la cual tenemos dos alternativas: las proporcionamos, las profundizamos. Tecnológicamente hablando, hasta el ocaso de la era paleolítica, nuestros congéneres no tenían nada que decir…, sin embargo, si podían hablar y comunicarse por medio de la (...) palabra. El lenguaje es consustancial al ser humano; es importante hacer esta aclaración. El cuerpo humano, sobre todo ambas extremidades, fueron los primeros instrumentos que empleó la humanidad como apoyo para recordar y contar. Los dedos de la mano, pueden considerarse los primeros apoyos de los que se valieron hombres y mujeres de la antigüedad para contar y constituyen, por tanto, la noción más elemental de la aritmética, anterior incluso a la noción de número. Es muy probable que los dedos de las manos y los pies hayan sido el origen de los sistemas numéricos quinario, decimal y vigesimal: es decir, el Hombre podía contar cinco, diez o veinte. Los constantes cambios tecnológicos —políticos y filosóficos— que se manifestaron en el Siglo XX dieron como resultado la aparición a lo que se ha dado en llamar “Era de las Tecnologías o Informática” que ha cambiado radicalmente la situación mundial en todos los aspectos, y que ha dado origen a una revolución tecnológica presente cada día. A partir de una presentación general del concepto de especie aplicado a los humanos, este texto expone dos nociones generales sobre la naturaleza humana: la tipológica y la filogenética. Una vez expuestos los fundamentos de cada noción, se defiende una distinción entre naturaleza humana e identidad humana como dos aspectos que se han confundido respecto a este problema, pero que cumplen distintos roles en las explicaciones, por lo que se proponen como dos nociones complementarias. Así, la naturaleza humana estaría definida (...) en términos metafísicos y daría cuenta de la realidad biológica de los humanos desde un punto de vista filogenético, mientras que la identidad humana estaría definida en términos epistemológicos y daría cuenta de los conocimientos que tienen los humanos sobre ellos mismos, aludiendo a aspectos contingentes. This is a Trilingual collection of contributions made by members of the Peirce Latin-American Society to their inaugural event in 2019. it is a historical book since there is no such comprehensive approach to the variety of Peirce studies in Latin-America that shows the history of the reception of Peirce and his Pragmatism, a dialogue with the philosophy and thought of the region and, furthermore, contributions to the study of Peirce's thought made from the Americas.

In this text, I consider two examples in the history of emancipation and manumission of enslaved, Black populations in the Caribbean and South America in order to theorize a colonial mode of conceiving of freedom at play in the first half of the nineteenth century. This mode is marked by the figure of the promise, enacting a notion of freedom as a constantly deferred, external compensation. Indeed, instead of an immediate decision deeming the practice of enslavement and trade of human (...) beings unacceptable, and an effective liberation of the enslaved Black populations in these different emancipation proclamations, the various histories of manumission in Latin America and the Caribbean show a long series of political and legal attempts to reduce and limit the extent of the slave trade that deferred the process of liberation for decades. Moreover, in many of these territories the practice did not end with the official proclamation of emancipation but was continued by illegal practices and mutations into legal forms of exploitation and oppression that are still operative today. After outlining this first trajectory, reconstructing the promise of manumission in the historical examples of Martinique (as read by Édouard Glissant) and La Gran Colombia and the Republic of Nueva Granada (contemporary Panamá, Colombia, Venezuela, and Ecuador), I analyze a second mode of investigation in examples of individual and collective strategies of liberation coming from the enslaved themselves, as reconstructed by contemporary feminist scholars in South America. These strategies appropriate liberation not as a promise, but as a negotiation and calculation that begins with the enslaved’s resistance to their oppressive conditions and that ultimately depends on the external concession by juridical authorities. In the third section of the chapter, I read these practices not as marronage, as they are sometimes approached, but as a different mode of turning back to these glimpses of freedom that more effectively challenge the narrative of emancipation and, with it, the promise of manumission in our present. -/- . Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. This article tells the empirical story of women from seven villages of Kwale, the most southeastern county in the Coast Province of Kenya that borders with Tanzania—Lunga Lunga, Godo, Perani, Umoja, Maasailand, Mpakani and Jirani—as they searched for community health, equity, gender equality and peace on their own terms. This article shows that creative health initiatives can be successfully used as mechanisms for peace building. Since 2010, the Nikumbuke-Health by All Means projects from the University of Madison-Wisconsin in the United (...) States, have trained 57 health promoters and 32 female actors on disease prevention and health promotion that have outreached approximately 120,000 inhabitants around the county enhancing unity in diversity, and breaking down the walls of ethnic hostilities and prejudice. Because of its low cost and high effectivity, the United Nations awarded N-HbAM[1] the 2013 Public Service Award as a model of best practice in gender, community development and sustainable wellbeing. [1] In 2013, at the time of the UNPS Award the projects were still called Nikumbuke-Health by Motorbike. The name was changed in 2018 as the projects broadened in scope and geographical location. The casting of maize seeds is a tool used by contemporary daykeepers in the Ayöök area of Oaxaca, Mexico, which along with the prognostications and prescriptions of the 260-day calendar, helps to cure illnesses and afflictions. This divinatory practice was also employed by precolonial tonalpouhque, who were experts of reading the tonalamatl, the pictographic manuscripts with calendrical, ritual and oracular content, such as the now called Borgia Group codices. In this article maize divination will be described and analyzed, arguing that (...) maize divination results in images that can be read in a similar way to these codices. The reading of maize is approached here by employing the concepts of signs and symbols as described by Carl Jung and the notions of chronotope and dialogical narratives by Mijail Bakhtin. The Jungian understanding of divinatory practices as a means of gaining consciousness of oneself is also applied to argue in favor of the therapeutic capacity of reading maize, as it offers relief and triggers action. In this paper, I accomplish a conceptual task and a historical task. The conceptual task is to argue that (1) Einstein’s Principle of Separability (henceforth “separability”) is not a supervenience principle and that (2) separability and entanglement are compatible. I support (1) by showing that the conclusion of Einstein’s incompleteness argument would still follow even if one assumes that the state of a composite system does not supervene on the states of the subsystems, and by showing that what Einstein says (...) in “Quantum Mechanics and Reality” (1948) strongly suggests that separability is not a principle about how subsystem states relate to the state of composite systems. I support (2) by showing that if separability was incompatible with entanglement, then Einstein’s argument would be incoherent in a trivial way. Thus, by arguing for (1) and (2) I directly challenge what has been, and still is, a very common reading of separability. The historical task is to offer the first detailed review of the different ways in which separability has been defined by physicists and philosophers in the last 60 years. Among other things, such a review distinguishes three different definitions of the principle, and shows that since the 1990s and up until the present date, it became standard to take separability (as presented by Einstein) to be a supervenience principle. Imagine that we are on a train playing with some mechanical systems. Why can’t we detect any differences in their behavior when the train is parked versus when it is moving uniformly? The standard answer is that boosts are symmetries of Newtonian systems. In this paper, I use the case of a spring to argue that this answer is problematic because symmetries are neither sufficient nor necessary for preserving its behavior. I also develop a new answer according to which boosts (...) preserve the relational properties on which the behavior of a system depends, even when they are not symmetries. (shrink)

Este artículo revisa el proceso histórico de la ‘Conquista del desierto’ y la existencia de campos de concentración para indígenas en Argentina a través de una lectura de hermenéutica filosófica. El objetivo del artículo es interpretar el periodo y el uso de campos como instancias que configuraron la diferenciación del pueblo mapuche como sujeto racializado en la sociedad argentina. Los resultados de la exposición muestran que la marginación del cuerpo mapuche ocurre por el registro de excepciones y que aquella es (...) disputada por sujetos mapuche. This paper reviews the historical process of the ‘Conquest of the Desert’ and the existence of concentration camps for indigenous people in Argentina. The research is conducted through philosophical hermeneutics. The objective of the paper is to read the period and the use concentration camps as instances that shaped the differentiation of the Mapuche people as a racialized subject in Argentine society. The results of the argumentation show that marginalization of the Mapuche body occurs through the registration of exceptions, which is disputed by Mapuche subjects. (shrink)

In the face of the criticism raised against Habermas distinction between morality and ethics and its universalist foundation of morality, it is argued that the priority of moral objectives results constitutively out of the normative reflection structure of the thinking subject, on which depend both the life objectives and corresponding social order in the specific contexts, as well as the personal ones; expanding, thus, the frame of the structurally constitutive in practical reflection. Additionally, the persistence of the Kantian moral thinking (...) in the foundational architecture of ED is reconsidered. (shrink)

Consensus in the contemporary philosophical literature has it that conserved quantity theories of causation such as that of Dowe [2000]—according to which causation is to be analysed in terms of the exchange of conserved quantities (e.g., energy)—face damning problems when confronted with contemporary physics, where the notion of conservation becomes delicate. In particular, in general relativity it is often claimed that there simply are no conservation laws for (say) total-stress energy. If this claim is correct, it is difficult to see (...) how conserved quantity theories of causation could survive. In this article, we resist the above consensus and defend conserved quantity theories from this conclusion, at least when focusing on the apparent problems posed by general relativity. We argue that this approach to causation can continue to be defended in general relativity, once one appreciates (a) the availability of approximate symmetries in generic general relativistic spacetimes, and (b) the role of modelling and idealisation in that theory. Given these points, conserved quantity theories of causation must stand or fall on other grounds. (shrink)

It is often said in physics that if two models of a theory are related by a symmetry, then the two models provide (or could provide) two different representations of the very same situation, alike the case of two maps of different color for the very same city. It is also said that the situations represented by two models of a theory are indiscernible in some ways when the models in question are related by a symmetry of the theory, just (...) like the situation in the interior of the cabin of a train when the train is at rest in the station is empirically indiscernible from the situation in the interior when the train is moving uniformly (in classical mechanics, these two situations are represented by two models related by a boost). In recent years, philosophers of physics have focused a lot of attention in developing various principles that aim to elucidate these and similar remarks on symmetries, models, physical equivalence, and representation that are widespread in physics practice. The goal of the current article is to provide a critical review of these principles, and suggest a new framework for thinking about these kinds of questions. One important upshot of the paper is that questions of indiscernibility, and questions of the representational capacity of models, must be distinguished from one another. (shrink)
