This paper presents a substantivist construal of discourse ethics, which claims that we should see our engagement in public deliberation as expressing and elaborating a substantive commitment to basic moral ideas of solidarity, equality, and freedom. This view is different from Habermas's standard formalist defence of discourse ethics, which attempts to derive the principle of discursive moral justification from primarily non-moral presuppositions of rational argumentation as such. After explicating the difference between the substantivist and the formalist (...) construal, I defend the former by showing that it is not only intuitively compelling, but also particularly well equipped for addressing four important objections recently levelled against discourse ethics and its political applications. I conclude by pointing out some consequences of the previous discussion for the future of Critical Theory. (shrink)

By focusing on the reasoned debate in the discourse -ethical approach to business ethics, this paper discusses the possibilities and limitations of moral reasoning as well as applied economic and business ethics. Business ethics, it is contended, can be looked at from the standpoint of two criteria: justification and application. These criteria are used to compare three approaches: the Integrative Business Ethics, developed by Swiss philosopher Peter Ulrich, the Cultural Business Ethics of the (...) Nuremberg School in German business ethics, and the concept of “Good Conservation” by Frederick Bird. It is argued that discourse -ethical approaches can be called upon for justifying moral principles. Improving the chances of their application, however, necessitates a good understanding of lifeworlds and culturally developed institutional settings. Bearing this in mind, further research perspectives stressing a linkage between discourse -ethical and critical approaches in social sciences are suggested. (shrink)

The characteristics of environmental disputes are such that dispute resolution approaches are not always successful. This was highlighted in recent attempts to resolve disputes related to the introduction of the Native Vegetation Conservation Act 1997 in New South Wales . Critical discourse analysis of stakeholder narratives is a technique that could be used for conflict scoping and assessment, allowing mediators or policy makers to better prepare themselves for dispute resolution processes. Media releases of the Nature Conservation Council and the (...) NSW Farmers' Association on native vegetation issues were analysed using this technique. The results show how insights into the underlying assumptions, positions, interests, value judgements and strategies of stakeholders can be obtained. This information can be used to aid the dispute resolution process by identifying misunderstandings and misconceptions, enhancing mutual understanding, appropriate integration of science and technical information and tracking changes in the dispute. The goal of this dissertation is to provide a critique of Jurgen Habermas's communication-theoretic proposal for a discourse ethics. In doing so, I confront the theory of communicative rationality with the pronounced intention of letting discourse ethics take, as Habermas puts it, its orientation for an intersubjective interpretation of the categorical imperative from Hegel's theory of recognition. My objections to this attempt to provide a critical theory with normative grounds generally relate to what I see as (...) a too excessive formalism, and a tendential repression of the dimension of ethical ontology. ;Although Habermas insists that agents always bring their lifewordly conditions of existence--their particular identities and histories--with them when they engage argumentatively to redeem validity claims, the discourse model has throughout its effective history been notoriously helpless when engaging with the internally related issues of motivation and the cognitive problems of judgment and context-sensitive application. In analyzing the principle of universalizability , I show why it is necessary to construct a dialectical relationship between morality and issues of the good life, and to introduce a notion of reflective judgment. Moreover, I argue for a detachment of moral theory from the quasi-transcendental grounding in formal structures of rationality. ;In the course of my successive interpretative confrontations with discourse ethics, I formulate a hermeneutic approach. One important upshot of this is that discourse ethics will be situated closer to Habermas's early suggestions towards a critical hermeneutics. This is a conception which emphatically promotes an internal link between judgment, action and argumentation. Another consequence relates to the need for a realist realignment of discourse ethics. I suggest that reflection and moral discourse, starting from the particularity of concrete cases but ultimately aiming towards universality , should be involved, not in a process of further disintegration of ethical life , but in a process of healing, in which universality serves a memorial, imaginative and communicative function: it creates a conceptual reservoir for interpreting our complex moral experiences, and ultimately for gaining knowledge of the self and its intricate bonds and attachments to others. This study investigates the ethical use of Big Data and Artificial Intelligence (AI) technologies (BD + AI)—using an empirical approach. The paper categorises the current literature and presents a multi-case study of 'on-the-ground' ethical issues that uses qualitative tools to analyse findings from ten targeted case-studies from a range of domains. The analysis coalesces identified singular ethical issues, (from the literature), into clusters to offer a comparison with the proposed classification in the literature. The results show that despite the variety (...) of different social domains, fields, and applications of AI, there is overlap and correlation between the organisations’ ethical concerns. This more detailed understanding of ethics in AI + BD is required to ensure that the multitude of suggested ways of addressing them can be targeted and succeed in mitigating the pertinent ethical issues that are often discussed in the literature. The recent bioethical literature addresses numerous new problems posed by advancing medical technology and demonstrates an erosion of standards rooted in religion and long widely accepted as almost axiomatic. In the deep soul-searching that pervades the publications on bioethics, several disturbing and dangerous trends neglect some basic lessons of philosophy, logic, and history. The bioethics (...) discourse on medical aid in dying emphasizes similarity over previously recognized important distinguishing features. For example, it overplays a likeness between assistance in dying and the withdrawal of life-saving technology. In many bioethics’ topics, arguments based on a logical continuum are used to question the lines demarcating important moral differences. l. The Line Between Ethical and Not: Logic Based on Continuum Careful case selection, often either end of a continuum, allows the tearing down or ridiculing of many rules and codes across most professions and fields of interest. This situation holds true for traffic laws as well as medical ethics guidelines. It is relatively simple for those who desire to attack a particular viewpoint by selecting a case that makes that position seem untenable. In the ethics realm, good and bad medicine exist at opposite ends of an ethical continuum, with many practices lying in between. For example, much of medical ethics exists between the Nazi criminal physicians and the most sainted nurse or physician. A gradual progression occurred over less than two decades from a utilitarian position that supported limited euthanasia for those with certain mental illnesses to genocide. German society embraced a utilitarian ethic in which the value of human life no longer was intrinsic but instrumental.[1] Many morally significant points on a continuum were then ignored as the misguided utilitarian policy rampantly continued. A point in the continuum to distinguish between ethically justifiable and that which is not can be difficult to identify compared to the two extremes. This continuum is not unique to ethics but can be applied to almost any other aspect of human life and endeavor. Between a severely ill schizophrenic person and a superbly well-adjusted individual, there is a continuum of mental and psychological function. The existence of a continuum should not paralyze thinking and prevent us from drawing lines and identifying moral differences based on objective criteria as well as moral philosophy. Yet, by focusing on a continuum, many bioethicists use logic to disregard dividing lines between an "ethical" and an "unethical" act. Unfortunately, sometimes bioethicists draw revolutionary conclusions that would change the scope of medical practices which is accepted as ethical. There are many examples of similar shifts on the continuum. Many authors argue for the ethical permissibility of abortion by pointing out that the human fetus is no different in various characteristics, one arguing it is as like an ape or chick as it is like a person,[2] and does not achieve unique human and individual characteristics until well into the first year of life.[3] While human fetuses arguably do not have certain distinctive qualities of personhood, most people shy away from the logical next conclusion: permitting infanticide. For example, Joshua Lederberg condemns infanticide, in the face of biological illogic, because of our emotional commitment to infants, to me, a relatively weak explanation. Sir Francis Crick suggests we might consider birth at two days of life in order to decide whether an infant is a "suitable" member of society.[4] Giublini and Minerva suggest that infanticide should be permissible since late pregnancy abortions are permissible, arguing there is no significant difference between a fetus just before birth and an infant just after birth.[5] Clearly the continuum approach would allow for subjective arguments in favor of later infanticide at other points many days post-birth. Years ago, with a cynical tone, I mentioned infanticide as a further step on the continuum beyond abortion, and I was rightly shouted down as being deliberately provocative to assert the logic would ever stretch so far. While it is not an accepted mainstream position, the movement in academic settings from widespread condemnation to limited possible acceptance of infanticide has taken place in an incredibly short time. Public opinion and medical opinion in these areas have shifted dramatically in a short time. In another area, from a biological and chemical point of view, there is a continuum from man down to a single carbon atom. Yet, it would not seem logical to ignore the emotional differences, the meaning of personhood, or the moral distinction between killing an insect and killing a person. ll. A False Continuum: Medical Aid in Dying I assert that there has been an erosion of ethical guidelines in recent years attributable to using continuums to camouflage important distinctions. James Rachels’ work on active and passive euthanasia, which contends that the two are ethically identical, exemplifies that logic.[6] He illustrates this thesis, using a continuum to compare different scenarios with like consequences as morally equivalent, by comparing the deliberate drowning of a child with a deliberate failure to rescue a drowning child when easily able to do so. The author's comparison proposes that since much of the medical profession has already made peace with withholding treatment in order to hasten death, consistency inexorably demands that we permit active euthanasia as well.[7] When permission for active euthanasia was first introduced, it was limited exclusively to patients suffering severely from an intractable, incurable, and irreversible disease. These guidelines have been continuously eroded. There is now a substantial serious consideration for permitting active euthanasia of healthy elderly individuals who feel that they have completed their lives and are "tired of living."[8] There are many moral and factual differences along the ethical continuum. In human life, there is a difference between a live baby and a fetus, between a viable fetus and one that is not, between a fetus and a zygote, and between a zygote and a sperm cell. Similarly, there is a difference between pulling a trigger to kill someone and not interfering in preventing his death, which is reprehensible though both may be. There is a difference between not resuscitating an 80-year-old man with cancer when his heart stops and injecting him with a fatal dose of potassium chloride. I argue that an overt act of taking life repels civilized human beings is to be commended and encouraged as the reverence for human life or even for just a moment of human life is one of the great contributions of our civilization. CONCLUSION As an orthodox Jew, I feel that divinely inspired guidelines that have stood the test of centuries shape my beliefs, and such guidelines contradict medical aid in dying. I cannot speak to the viewpoint of those who do not access religion in defining their moral stance, nor do I implicate them in the current bioethics' trends, as I am not aware of the personal role of religion in the lives of most such authors. While many nonreligious people have a firm philosophical grounding and oppose medical aid in dying, I suggest that in the absence of any religious or other absolute standards, developing logically defensible ethical guidelines may be challenging. At the least, religion may play a role in defining the points on the continuums that are ethically meaningful and refuting the trending beliefs that if the endpoint is the same, allowing different methods of arriving at that end are somehow ethically equal. The continuum of ways death may result does not negate analysis of whether death is brought about in ways that recognize the importance of life. The German philosopher Hans Jonas said, "It is a question whether without restoring the category of the sacred, the category most thoroughly destroyed by the scientific enlightenment, we can have an ethics able to cope with the extreme powers that we possess today and constantly increase and are compelled to use."[9] While countries vary on the role of religion in policy, with many emphasizing freedoms of religion, a recent position paper released by a group of Jewish, Christian, and Moslem leaders suggested the need for agreement on the unique sanctity of human life.[10] I would recommend that such a document serve as an example of consensus on critical foundational bioethical guidelines for democratic secular societies. - [1] Alexander L Medical science under dictatorship. The article emphasizes that the development of artificial intelligence acts as an innovative form of technology development when a new kind of human-machine technosubject is formed. The authors identify social problems of artificial intelligence application as the digitalization of life becomes a global anthropological challenge. Innovations of artificial intelligence are directly related to a number of ethical problems, as they contribute not only to the sustainable development of society but also cause dehumanization of relations between people and society. Based on the analysis of qualitative changes in scientific and technological research, using human-machine devices is becoming inevitable. "trans-" and "post-" humanity.MethodsTo complete a systematic survey of the literature, 19 databases and 4 individual open-access journals were employed. Searches were conducted using the indexing language of the U.S. National Library of Medicine. A Python code was used to eliminate duplications in the final bibliography.ResultsWhen taken with Parts 1-3, this bibliography aims to provide a listing of international peerreviewed papers, books, and book chapters published from 2002 through 2016. While seeking to be as comprehensive as possible, it may be that some works were inadvertently and unintentionally not included. The neo-Aristotelian virtue theory of Philippa Foot is presented here as an alternative framework that is arguably more useful than deontological approaches and that relies less on the assertions of moral claims about the intrinsic goodness of foundational principles. Instead, this project focuses more on cultivating a true ethic; that is, a set of tools and propositions to enable individuals to negotiate inevitable conflicts among moral values and challenges posed by cultural contexts and technology use. Foot's ?natural normativity? connects the (...) conditions of human flourishing and objective reasons for acting morally, providing a framework for a digital media ethic to address three critical categories: virtuality and authenticity, privacy and autonomy, and exchange and discourse. Business ethics researchers and practitioners are interested in understanding the temporal mechanisms of various managerial activities, processes, and policies. In this direction, I borrow notions of time from Virginia Woolf’s _Mrs. Dalloway_ to examine how social time intersperses with the paid and (unpaid) care work of female employees during the pandemic. I explore how discussions of social time in connection to care work appear in newspaper discourses of “shecession”, i.e. the large-scale job/income losses experienced by women during the COVID-19 (...) pandemic. Since shecession is a byproduct of the pandemic times, exploring the role of time in it is crucial. In fact, my findings show that the macro social time of the pandemic affects working women with care responsibilities who are situated at the intersection of multiple vulnerable social categories by simultaneously being a penalizer and a lost opportunity. Similarly, I also find that the micro social times of working women embed, stratify, and synchronize differently during the pandemic when compared to normal times. Working women with care responsibilities are thus adversely affected by both micro and macro social time changes. My findings, therefore, could be instrumental in developing and implementing inclusive policies and processes in business organizations and labor markets. In so doing, my study also indicates how a consideration of social time enriches the application of care ethics in work contexts. Ultimately, this article is also about developing caring organizations, societies, and families which care for the caregivers (working women), since receiving care is a precondition of giving care. This article presents a model for the procedure of elaboration of an effective ethical code. Taking as the starting point the concept of business ethics as critical hermeneutics, we describe a process which will lead to the creation of a document that is truly ethical and efficient. We believe the elaboration of an ethical code should follow a definite procedure, and that the process is as important as the result, but we also add that in order for the process (...) to be a truly rational dialogue it is necessary to make efforts to ensure the participation of truly valid interlocutors who can represent their interests in conditions that are as close as possible to an ideal community of dialogue. Our model for the elaboration of an ethical code attempts to break with the conventional distinction between processes of elaboration and application in order to develop a truly integrative ethics, while also giving attention to the concrete conditions in which the ethical code is developed. In our view the contribution made by this model is the emphasis it places on the transformation of the will of the participants in the dialogue. (shrink)

Serious thinking about the models of application of ethics has enabled us to move away from ethical engineering and adopting a social-scientific vocation that is an aid to moral-engineering. Time is ripe to rethink about the charge of “structuralism” on the non-engineering model of applied ethics. If we fail to resolve this issue, a structuralist application of ethics will be unavoidable, leading way to the old engineering. With the internationalisation of the Chinese market, Confucian ethics began to draw researchers' attention. However, little research has been conducted in the specific application of Confucian ethics in marketing communication. This article fills in the research gap by examining how Confucian ethics underpins the discourse of Chinese Expo invitations. Chinese sales managers' views are incorporated into the analysis as substantiation of findings. Confucian ethics embraces both qing (emotion) and li (reason) and relevant ethical values (...) such as guanxi (connections), qing, and mianzi (face) play an important role for advertising Expos and trade fairs. The study also highlights the complexities of Chinese Expo advertising that is embedded in inviting behaviour. These findings shed light on understanding Confucian ethics in marketing communications in general and have implications for ethical international marketing and advertising practices. (shrink)

Current advances in research, development and application of artificial intelligence systems have yielded a far-reaching discourse on AI ethics. In consequence, a number of ethics guidelines have been released in recent years. These guidelines comprise normative principles and recommendations aimed to harness the “disruptive” potentials of new AI technologies. Designed as a semi-systematic evaluation, this paper analyzes and compares 22 guidelines, highlighting overlaps but also omissions. As a result, I give a detailed overview of the field (...) of AI ethics. Finally, I also examine to what extent the respective ethical principles and values are implemented in the practice of research, development and application of AI systems—and how the effectiveness in the demands of AI ethics can be improved. _Purpose._ The authors of this paper seek to comprehend, on the basis of ethics of discourse and communicative philosophy, the dimensions of human existence in times of war. This involves solving the following research tasks: to show the importance of moral and ethical norms in the structure of human existence and to emphasize the need for their observance by a person in the realities of war; to find out what the role of responsibility and co-responsibility is in preserving (...) the space of human existence in times of war; to explore the influence of discourse on the establishment of rational and social dimensions of human existence, formation of communicative space of understanding. _Theoretical basis._ The ideas of communicative philosophy and principles of discourse ethics, focused on the problems of substantiating ethical norms and values in their relationship with the human life world, and its activities are underlying the research. The analysis of human existence in times of war was carried out considering the theoretical and methodological foundations of philosophical anthropology. _Originality._ It is substantiated that the recognition of the universality of moral norms and values, and the productive power of communication contribute to deepening the understanding of the complexity and versatility of human existence in times of war. It has been determined that human existence’s rational and moral dimensions acquire particular significance in the context of russian aggression against Ukraine. The role of discourse was defined for affirming the humanistic foundations of human existence, in achieving cohesion, interaction, social solidarity, which is a condition for human development as a collective and unique being. It is noted that in war conditions the value of individual forms of human existence is complemented by the obligatory responsibility and co-responsibility for a person, awareness of the significance of coexistence in a situation where there is a threat to human life. _Conclusions._ The study of human existence involves the use of the methodological potential of discourse ethics, the significance of the ideas of which is increasing in the modern world because of the dangers caused by russian aggression against Ukraine. The recognition of the power of universal moral norms and the productive power of communication results in the affirmation of the humanistic foundations of human existence, the formation of the communicative space of understanding and consent necessary for a person. In times of war, the need for communicative rationalization of human existence, awareness of the value of morality and human humanity becomes obvious. (shrink)

This contribution is a critical and constructive engage ment with discourse ethics. First, it clarifies why discourse ethics has difficulties with the grounding and application of moral norms. Second, it turns to a positive appropriation of the formal and proce dural aspects of discourse ethics. The goal is the elaboration of an ethics that is able to incorporate the material aspects of goods and the formal dimension of ethical validity and consensuability. Every (...) morality is the formal application of some substantive good. Every ethical perspective demands its evaluation in terms of its uni versability. In order to achieve this mediation, it is suggested that we must incorporate not only the historical dimension of moral systems, but also the role of critical consciousness and the negativity embod ied by those who are victims of the existing consensus. The essay con cludes with six points that need to be considered when formulating a material ethics that is universalizable and, most importantly, that can address the massive poverty and dehumanization of those excluded from the present community of communication. As a result of simultaneous developments, including the proliferation of opportunities for online feedback, the application of discourse ethics to journalism, and a greater emphasis on journalistic accountability, the time is ripe for revisiting opportunities that online mechanisms provide for holding journalists accountable to audiences. This paper proposes recommendations to guide hosting online comments in light of the Habermasian framework of discourse ethics developed by Glasser and Ettema (2008). This article critically re-examines the application of the principle of patient autonomy within bioethics. In complex societies such as those found in North America and Europe health care professionals are increasingly confronted by patients from diverse ethnic, cultural, and religious backgrounds. This affects the relationship between clinicians and patients to the extent that patients' deliberations upon the proposed courses of treatment can, in various ways and to varying extents, be influenced by their ethnic, cultural, and religious commitments. The principle (...) of patient autonomy is the main normative constraint imposed upon medical treatment. Bioethicists typically appeal to the principle of patient autonomy as a means for generally attempting to resolve conflict between patients and clinicians. In recent years a number of bioethicists have responded to the condition of multiculturalism by arguing that the autonomy principle provides the basis for a common moral discourse capable of regulating the relationship between clinicians and patients in those situations where patients' beliefs and commitments do or may contradict the ethos of biomedicine. This article challenges that claim. I argue that the precise manner in which the autonomy principle is philosophically formulated within such accounts prohibits bioethicists' deployment of autonomy as a core ideal for a common moral discourse within multicultural societies. The formulation of autonomy underlying such accounts cannot be extended to simply assimilate individuals' most fundamental religious and cultural commitments and affiliations per se. I challenge the assumption that respecting prospective patients' fundamental religious and cultural commitments is necessarily always compatible with respecting their autonomy. I argue that the character of some peoples' relationship with their cultural or religious community acts to significantly constrain the possibilities for acting autonomously. The implication is clear. The autonomy principle may be presently invalidly applied in certain circumstances because the conditions for the exercise of autonomy have not been fully or even adequately satisfied. This is a controversial claim. The precise terms of my argument, while addressing the specific application of the autonomy principle within bioethics, will resonate beyond this sphere and raises questions for attempts to establish a common moral discourse upon the ideal of personal autonomy within multicultural societies generally. In this essay, James Scott Johnston examines Jürgen Habermas's transcendental justification of his discourse theory of morality. According to Johnston, the application of Habermas's theory to educational issues often assumes that this justification is a cogent one. However, if the theory is to provide reasoned and appropriate guidance for educators, the justification of discourse ethics requires closer examination. Johnston argues that Habermas's so-called “weak” transcendental approach is in fact unsustainable because it fails to reconcile two conflicting (...) schools of philosophical thought: Kant's transcendental idealism and George Herbert Mead's social pragmatism. Johnston concludes that a more plausible justification of the discourse ethical project can be achieved by rejecting Habermas's Kantianism and appealing solely to Mead's social pragmatic conception of rationality. En virtud de esta ceguera, y buscando dotar de cierta aplicabilidad a la propuesta (...) de Dussel, introduciré consistentemente aportes de la ética del discurso para identificar los fenómenos de colonización del mundo de la vida como el campo de acción para orientar el diseño de políticas públicas. Understanding the central thesis that Enrique Dussel presents in 20 Theses of Politics, as the reconstruction of a historical struggle among the will-of-life of the political community and the fetishized potestas, I note that the author only investigates the characteristics of the first one, being blind to those mechanisms for which the fetishized potestas pounds its fight for reproducing the conditions of its existence colonizing the world of life. Under this blindness, and seeking to endow of certain applicability to Dussel’s proposal, I will consistently introduce contributions to the ethics of the discourse to identify the phenomena of colonization of the world of life as the field of action to guide the design of public policies. This essay examines the possibilities of being/becoming an ethical researcher in the academy. It tackles this task through the lens of an ethics application by Mary [pseudonym], a PhD student in sociology whose research thesis was investigating the reasons why married men with children use prostitutes. Two analyses are offered of Mary's story. The first analysis presents the sort of critique that a university ethics committee might make of Mary's ethics application and uses the principles (...) that are the basis of regulatory research ethics frameworks around the world. From this starting point, the second analysis examines how the problems that an ethics committee would see in Mary's proposal might have come about. By way of explanation, I posit that an ethics of rational self-interest has asserted itself as a new moral economy among students, doctoral supervisors and within the management of universities. The co-existence of these two irreconcilable discourses of ethics ? principlism and rational self-interest ? has implications for being/becoming an ethical researcher and for the work of research ethics committees in the academy. Purpose Voice assistant technology is one of the fastest-growing artificial intelligence applications at present. However, the burgeoning scholarship argues that there are ethical challenges relating to this new technology, not the least related to privacy, which affects the technology’s acceptance. Given that the media impacts public opinion and acceptance of VA and that there are no studies on media coverage of VA, the study focuses on media coverage. In addition, this study aims to focus on media coverage in Indonesia, a (...) country that has been underrepresented in earlier research. Design/methodology/approach The authors used critical discourse analysis of media texts, focusing on three levels to study how VA technology was discussed in the Indonesian context and what power relations frame the representation. In total, 501 articles were collected from seven national media in Indonesia from 2010 to 2020 and the authors particularly focus on the 45 articles that concern ethics. Findings The ethical topics covered are gender issues, false marketing, ethical wrongdoing, ethically positive effects, misuse, privacy and security. More importantly, when they are discussed, they are presented as constituting no real critical problem. Regarding discursive practices, the media coverage is highly influenced by foreign media and most of the articles are directed to well-educated Indonesians. Finally, regarding social practices, the authors hold that the government ideology of technological advancement is related to this positive portrayal of VAs. Originality/value First, to provide the first media discourse study about ethical issues of VAs. Second, to provide insights from a non-Western context, namely, Indonesia, which is underrepresented in the research on ethics of VAs. (shrink)

The use of genetically modified plants in agriculture (GM crops) is controversially discussed in academic publications. Important issues are whether the release of GM crops is beneficial or harmful for the environment and therefore acceptable, and whether the modification of plants is ethically permissible per se . This study provides a comprehensive overview of the moral reasoning on the use of GM crops expressed in academic publications from 1975 to 2008. Environmental ethical aspects in the publications were investigated. Overall, 113 (...) articles from 15 ecology, environmental ethics, and multidisciplinary science journals were systematically reviewed. Three types of moral concerns were used to structure the normative statements, moral notions, and moral issues found in the articles: concerns addressing consequences of the use of GM crops, concerns addressing the act (the technique itself), and concerns addressing the virtues of an actor. Articles addressing consequences (84%) dealt with general ecological and risk concerns or discussed specific ecological issues about the use of GM crops. Articles addressing the act (57%) dealt with the value of naturalness, the value of biotic entities, and conceptual reductionism, whereas articles addressing the actor (43%) dealt with virtues related to the handling of risks and the application of GM crops. The results of this study may help to structure the academic debate and contribute to a better understanding of moral concerns that are associated with the key aspects of the ethical theories of consequentialism, deontology, and virtue ethics. This text focuses on selected basic arguments of libertarianism that could be found in certain debates on the moral issues of euthanasia and the application of moral fictionalism in bioethics. Firstly, I devote my article to the criticism of libertarian arguments (as one of the dominant discourses related to the debate over euthanasia) in a wider perspective of moral philosophy. The article is based on an approach that understands morality as a kind of social practice and the primary goal (...) is to grasp the key theoretical concepts which are included in the mechanism for identifying and assessing our moral intuitions. This text is primarily an analysis of selected arguments of current normative theories of libertarianism on two levels: first it examines the idea of self-ownership in connection with certain debates over euthanasia, while the latter part of the article concerns an analysis of the critique of libertarian arguments and a comparison of the alternative arguments of moral fictionalism. When originally independent pragmatic texts were included in larger early Chinese compilations, this entailed a recontextualization that potentially transformed the meaning of those texts significantly. Focusing on examples from the Analects and the Zengzi chapters in Da Dai Liji, this paper demonstrates that some didactic precepts which have come to be appreciated as general Ru moral and political philosophy are probably rooted in concrete and more modest applications. The texts discussed are in part based on a discourse accompanying the (...) establishment of meritocratic administrative structures in the early to mid Warring States period. These pragmatic discourses inspired didactic texts that reflected shi status anxiety. Members of the shi class not only composed texts for the edification of their rulers and the education of their princes. They also directed admonitions at their own peers, formulating standards by which they could manifest their claim to elevated social status. The further these texts became removed over time from their original historical context, the more they came to be read as Ru ethics in the sense of universally applicable standards. (shrink)

Privacy is a critical challenge for corporate social responsibility in the mobile device ecosystem. Mobile application firms can collect granular and largely unregulated data about their consumers, and must make ethical decisions about how and whether to collect, store, and share these data. This paper conducts a discourse analysis of mobile application developer forums to discover when and how privacy conversations, as a representative of larger ethical debates, arise during development. It finds that online forums can be (...) useful spaces for ethical deliberations, as developers use these spaces to define, discuss, and justify their values. It also discovers that ethical discussions in mobile development are prompted by work practices which vary considerably between iOS and Android, today’s two major mobile platforms. For educators, regulators, and managers interested in encouraging more ethical discussion and deliberation in mobile development, these work practices provide a valuable point of entry. But while the triggers for privacy conversations are quite different between platforms, ultimately the justifications for privacy are similar. Developers for both platforms use moral and cautionary tales, moral evaluation, and instrumental and technical rationalization to justify and legitimize privacy as a value in mobile development. Understanding these three forms of justification for privacy is useful to educators, regulators, and managers who wish to promote ethical practices in mobile development. (shrink)

Nanomedicine plays a prominent role among emerging technologies. The spectrum of potential applications is as broad as it is promising. It includes the use of nanoparticles and nanodevices for diagnostics, targeted drug delivery in the human body, the production of new therapeutic materials as well as nanorobots or nanoprotheses. Funding agencies are investing large sums in the development of this area, among them the European Commission, which has launched a large network for life-sciences related nanotechnology. At the same time government (...) agencies as well as the private sector are putting forward reports of working groups that have looked into the promises and risks of these developments. This paper will begin with an introduction to the central ethical themes as identified by selected reports from Europe and beyond. In a next step, it will analyse the most frequently invoked ethical concerns–risk assessment and management, the issues of human identity and enhancement, possible implications for civil liberties (e.g. nanodevices that might be used for covert surveillance), and concerns about equity and fair access. Although it seems that the main ethical issues are not unique to nanotechnologies, the conclusion will argue against shrugging them off as non-specific items that have been considered before in the context of other biomedical technologies, such as gene therapy or xenotransplantation. Rather, the paper will call on ethicists to help foster a rational, fair and participatory discourse on the different potential applications of nanotechnologies in medicine, which can form the basis for informed and responsible societal and political decisions. Using the example of contemporary Islamic fundamentalism, and especially the writings of Sayyid Qutb, this article raises questions about discourse ethics as a mode of conflict resolution. It appears that discourse ethics is only relevant when all parties have already agreed to settle disputes deliberatively and already share the notions of rational deliberation and individual autonomy. This raises questions not only about the capability of discourse ethics to incorporate a deep plurality of worldviews, but (...) also about its capability to successfully solve disputes. When confronting situations where the willingness to deliberate is absent, discourse ethics is left standing empty handed. This, I argue, is due to both the conceptual distinction between communicative action and strategic action, as well as the abstracted nature of Habermas's discourse ethics. (shrink)

Biobank research and genomic information are changing the way we look at health and medicine. Genomics challenges our values and has always been controversial and difficult to regulate. In the future lies the promise of tailored medical treatments and pharmacogenomics but the borders between medical research and clinical practice are becoming blurred. We see sequencing platforms for research that can have diagnostic value for patients. Clinical applications and research have been kept separate, but the blurring lines challenges existing regulations and (...) ethical frameworks.Then how do we regulate it? This book contains an overview of the existing regulatory landscape for biobank research in the Western world and some critical chapters to show how regulations and ethical frameworks are developed and work. How should international sharing work? How design an ethical informed consent? An underlying critique: the regulatory systems are becoming increasingly complex and opaque. The international community is building systems that should respond to that. According to the authors in fact, it is time to turn the ship around. Biobank researchers have a moral responsibility to look at and assess their work in relation to the bigger picture: the shared norms and values of current society. Research ethics shouldn't only be a matter of bioethicists writing guidelines that professionals have to follow. Ethics should be practiced through discourse and regulatory frameworks need to be part of that public discourse. Ethics review should be then not merely application of bureaucracy and a burden for researchers but an arena where researchers discuss their projects, receive advice and practice their ethics skills. It contends that the ultimate failure of Husserlian phenomenology is a testament to the dilemma of subjectivist philosophy. Indeed, political philosophy requires a paradigm-shift from subjectivity to intersubjectivity. With this in mind, this paper examines the classical encounter between morality and ethical life in connection with discursive ethics. This paper discusses the question of universality of Luciano Floridi’s information ethics (IE). This is done by introducing the theory and discussing its conceptual foundations and applications. This paper addresses the question of what discourse ethics might have to contribute to increasingly urgent issues in intergenerational justice. Discourse ethics and deliberative democracy are often accused of neglecting the issue, or, even worse, of an inherently presentist bias that disregards future generations. The few forays into the topic mostly seek to extend to future people the “all affected principle” according to which only those norms are just to which all affected can rationally consent. However, (...) this strategy conflicts with core commitments of discursive ethics, as it renders agreement hypothetical and discursive participation virtual. I will attempt a supplementary route toward a connection between discourse ethics and intergenerational justice. Discourse ethics must be concerned, in what Habermas calls the symbolic reproduction of the lifeworld, with the emergence of rational minds capable of assessing reasons for proposed norms and policies, and such emergence is an intrinsically intergenerational affair. Symbolic reproduction links overlapping and non-overlapping generations in what has been elaborated as a chain-of-concern model, which I show to be linked to forms of indirect reciprocity among more than two parties. I conclude by discussing some consequences of this model for the all affected principle when viewed as specifically applied to future generations. (shrink)

Since it is now broadly acknowledged that ethics should receive early consideration in discourse on emerging technologies, ethical debates tend to flourish even while new fields of technology are still in their infancy. Such debates often liberally mix existing applications with technologies in the pipeline and far-reaching visions. This paper analyses the problems associated with this use of ethics as “preparatory” research, taking discourse on human enhancement in general and on pharmaceutical cognitive enhancement in particular as (...) an example. The paper will outline and discuss the gap between the scientific and technological state of the art and the ethical debates, pointing out epistemic problems in this context. Furthermore, it will discuss the future role of genuine ethical reflection in discourse on human enhancement, arguing also that such discourse needs to include a technology assessment—in the broad sense of the term—which encompasses, inter alia, anthropological perspectives and aspects of social theory. In lieu of an abstract, here is a brief excerpt of the content:The Past and Future of Environmental Ethics/PhilosophyBryan Norton (bio)About 15 years ago, at one of the first meetings of the group known as the International Society for Environmental Ethics (ISEE) at American Philosophical Association (APA) meetings, I drew an analogy with the field of medical ethics, arguing that environmental ethicists should look beyond philosophy departments and seek liaisons with Schools of Forestry, Schools of Marine Science, (...) and Environmental Studies Programs, and that philosophers should take a more active role in policy discussions and process. At that time, I was actively engaged in the actual policy processes, at the Environmental Protection Agency and other agencies, and perceived that: (a) These agencies desperately needed the kinds of conceptual and normative analysis philosophers could provide; but that (b) Practitioners of environmental policy did not find that the categories and concepts of traditional "metaphysical" approaches to environmental value provided them with useful guidance in policy decision making.My urging gained me some heavy criticism, and even made me some enemies, as leading members of the environmental ethics establishment openly complained that my judgment—in seeing philosophy of environmental protection as needing a basis in analysis of possible actions—had been compromised by "spending too much time inside the beltway."Since those early years, I have watched my colleagues in environmental ethics debate this point, but mainly as a sideline to their metaphysical speculation.In the meantime, my colleagues in medical ethics have populated medical schools, formed liaisons with medical research institutions, and become regular commentators on newscasts about ethically controversial medical issues. Meanwhile, Chris Stone, the legal scholar, had his students do a word search of the Congressional Record over several years, and found almost no references to "environmental ethics."As I see it, there are three differences between the environmental ethics and the medical ethics cases: (1) Philosophers have responded to medical issues by engaging practitioners, while most environmental ethicists have become, at best, "token" members of philosophy departments and, whereas medical ethics practitioners tend to talk about decision criteria [End Page 134] ("informed consent", etc.), environmental ethicist continue to concentrate on the metaphysical foundations of environmental values; (2) The medical profession, beset with public controversies, recognized the need for more ethical discourse about medical choices, and actively embraced philosophers in their programs, whereas most environmental practioners cannot see how philosophical analysis will help them to make better decisions; and (3) Being much wealthier than environmentalists, the medical schools and professionals were able to initiate positions and offer financial support, while environmental ethicists have to compete with other environmental researchers and commentators for small pots of funding.While we can't do much about (3), we can, I assert, do a lot more about (1) and (2). With respect to philosophy departments, the trend may be(and in my view should be) toward developing joint appointments between philosophy departments and policy schools, forestry schools, and environmental studies programs. This will bring philosophers and students into more direct contact with real problems and the language of decision making, rather than metaphysics. And with respect to point (2), I continue to urge environmental philosophers to address real problems, rather than operating on an abstract level and then finding "applications" of these abstractions.Philosophers, in other words, should become more "pragmatic" in their approach to both policy and philosophy. One aspect of this move is the need—after years of thinking of environmental philosophy as environmental ethics—to concentrate on epistemological, not metaphysical, aspects of environmental science and decision making.Let me expand on this last point, because it seems to me to be the most important consideration affecting the future of environmental ethics, at least in the short and medium run. I think the central debates about whether nonhumans have "intrinsic value" will be (and should be) replaced with a vigorous discussion of the epistemology of all environmental values. Recently, two leading environmental philosophers, Baird Callicott and Mark Sagoff, have strongly endorsed what would traditionally be called "non-naturalist" approaches to the epistemology of environmental ethics. The paper develops ethical guidelines for the development and usage of persuasive technologies (PT) that can be derived from applying discourse ethics to this type of technologies. The application of discourse ethics is of particular interest for PT, since ‘persuasion’ refers to an act of communication that might be interpreted as holding the middle between ‘manipulation’ and ‘convincing’. One can distinguish two elements of discourse ethics that prove fruitful when applied to PT: the (...) analysis of the inherent normativity of acts of communication (‘speech acts’) and the Habermasian distinction between ‘communicative’ and ‘strategic rationality’ and their broader societal interpretation. This paper contains a critique of Habermas' discourse theory of law and democracy from an economic perspective. An example drawn from Klaus Günther's work on discourses of application suggests the failure of discourse ethics to adequately account for the problem of scarcity. This blindpoint is reflected in Habermas' legal theory through the latter's inadequate recognition of the internal connection between markets and law. Discourses of implementation are introduced as a discourse‐relevant procedure to account for the (...) problem of scarcity. The Crimea Conference is by all means an extremely complex historical event. Any attempt to estimate its role and significance without analyzing its ethical components would unavoidably result in unduly simplifying the historical reality of the time, as well as in forming erroneous assumptions that would necessarily be used in the analysis of the causes of Cold War. A thorough examination will show that as far as the ‘ethical’ issues are concerned, there are significant developments with regard to general methodology, (...) as well as its application to the sources. Generations of historians who have addressed the issue of Yalta Conference, although they have not been able to form a scientific, distinct ‘ethical’ tradition so far, have developed all the necessary prerequisites for its establishment. This is evident in the possibility of segmenting the issue in two parts on the one hand, and on the other in the availability of sufficient sources, structured databases, and selected outstanding works. Still, there are no studies about the Yalta Conference so far that address exclusively ethical issues concerning ‘good’ and ‘evil,’ ‘morality,’ ‘duty,’ and ‘honor.’ Although historiographical approaches are to a large extent dependent upon ethical viewpoints, in the case of Yalta agreements so far there have been no techniques available, so as to connect historical accounts with ideology, and historical facts with their philosophical background. In a sense, the situation is quite the same as it is with the study of prehistory: although there is an abundance of data and facts that can be primarily processed, there are no methodological guidelines, nor any devices to classify and explain them.
