This anthology provides an in-depth analysis and discusses the issues surrounding nudging and its use in legislation, regulation, and policy making more generally. The 17 essays in this anthology provide startling insights into the multifaceted debate surrounding the use of nudges in European Law and Economics. Nudging is a tool aimed at altering people's behaviour in a predictable way without forbidding any option or significantly changing economic incentives. It can be used to help people make better decisions to influence human (...) behaviour without forcing them because they can opt out. Its use has sparked lively debates in academia as well as in the public sphere. This book explores who decides which behaviour is desired. It looks at whether or not the state has sufficient information for debiasing, and if there are clear-cut boundaries between paternalism, manipulation and indoctrination. The first part of this anthology discusses the foundations of nudging theory and the problems associated, as well as outlining possible solutions to the problems raised. The second part is devoted to the wide scope of applications of nudges from contract law, tax law and health claim regulations, among others. This volume is a result of the flourishing annual Law and Economics Conference held at the law faculty of the University of Lucerne. The conferences have been instrumental in establishing a strong and ever-growing Law and Economics movement in Europe, providing unique insights in the challenges faced by Law and Economics when applied in European legal traditions. Classical ethology encourages a causal approach to animal behaviour, using Tinbergen's four questions concerning evolution, function, mechanism and development of behaviour. It sets aside the study of mental processes, which could otherwise help to unify our picture of the relationships between animal and environment. Here the steps in research focused on the psychological meaning of a peculiar behaviour in the mouse — carrying its tail — and what this implies regarding the mouse's cognitive world are given. Initial empirical observations suggested (...) epistemic choices concerning space and object notions in the mouse; this led us to go beyond the first stage in exploring the significance of this behaviour. Later experiments showed the limitations of an explanation based on a cause-effect relationship. An interpretative model integrating a phenomenological conceptual framework is proposed. (shrink)

Deliberative democracy, as a dominant paradigm in contemporary democratic theory, offers a new, attractive conception of democratic legitimacy, which represents an alternative to a democracy that functions through the mechanism of political competition. A major problem with deliberation is the issue of its institutionalisation, as the theories of deliberative democracy have not produced a more specific institutional framework or form in which it could be used in political practice. Parliaments appear to be particularly suitable places for its potential implementation. Moreover, (...) deliberative democracy could contribute to a change in discourse quality and the way decision-making is conducted in parliaments, which is often considered problematic. Due to its incompatibility with competitive democracy, the opportunities for introducing deliberative democracy into parliaments are very limited. Should people with exceptionally profound disabilities be given an equal chance of surviving a pandemic, even when their care might require a greater use of limited medical resources? How might an ethics of care be used to shape a policy regarding these patients?

In the same spirit with the theme of last issue of this SGJ journal (“Ongoing creation”), this paper shortly reviews a plausible mechanism from Aether to become ordinary matter from the perspective of Neutrosophic Logic. We also discuss two other possible applications of Neutrosophic Logic, including a resolution of conflicting paradigms in medicine. We hope that some ideas as outlined herein will be proved useful in the near future.

Questions surrounding the assessment of medical school applicants' morality are difficult but they are nevertheless important for medical schools to consider. It is probably inappropriate to attempt to assess medical school applicants' ethical knowledge, moral reasoning, or beliefs about ethical issues as these all may be developed during the process of education. Attitudes towards ethical issues and ethical sensitivity, however, might be tested in the context of testing for personality attributes. Before any “ethics” testing is introduced as part of screening (...) for admission to medical school it would require validation. We suggest a number of ways in which this might be achieved. Non-invasive prenatal testing is at the forefront of prenatal screening. Current uses for NIPT include fetal sex determination and screening for chromosomal disorders such as trisomy 21. However, NIPT may be expanded to many different future applications. There are a potential host of ethical concerns around the expanding use of NIPT, as examined by the recent Nuffield Council report on the topic. It is important to examine what NIPT might be used for before these possibilities become consumer reality. There (...) is limited research exploring views of women on possible future uses of NIPT, particularly those of women who have undergone NIPT. In this study, we examined the views of women who undertook NIPT previously on the acceptability of and interest levels in using NIPT for a number of current and possible future applications. These included several medical conditions encompassing psychiatric, neurodevelopmental and adult-onset conditions as well as non-medical traits such as intelligence. One thousand women were invited to participate and 235 eligible surveys were received. Women generally reported an interest in using NIPT for medical conditions that severely impacted quality of life and with an onset earlier in life and stressed the importance of the accuracy of the test. Concerns were raised about the use of NIPT for non-medical traits. Respondents indicated that termination of pregnancy was not their only reason for testing, particularly in the case of sex. These results can further inform the ethical debate around the increasing integration of NIPT into healthcare systems. (shrink)

Honey bees are eusocial insects and the workers inform their nestmates of information regarding the location of food source using symbolic communication, called ‘dance communication’, that are based on their highly advanced learning abilities. Mushroom bodies (MBs), a higher-order center in the honey bee brain, comprise some subtypes/populations of interneurons termed Kenyon cells (KCs) that are distinguished by their cell body size and location in the MBs, as well as their gene expression profiles. Although the role of MBs in learning (...) ability has been studied extensively in the honey bee, the roles of each KC subtype and their evolution in hymenopteran insects remain mostly unknown. This mini-review describes recent progress in the analysis of gene/protein expression profiles and possible functions of KC subtypes/populations in the honey bee. Especially, the discovery of novel KC subtype/population, ‘middle-type KCs’ and ‘KC population expressing FoxP’, necessitated a redefinition of the KC subtype/population. Analysis of the effects of inhibiting gene function in a KC subtype-preferential manner revealed the function of the gene product as well as of the subtype where it is expressed. Genes expressed in a KC subtype/population-preferential manner can be used to trace the differentiation of KC subtypes during the honey bee ontogeny and the possible evolution of KC subtypes in hymenopteran insects. Current findings suggest that the three KC subtypes are unique characteristics to the aculeate hymenopteran insects. Finally, recent application of genome editing for the study of KC subtype functions in the honey bee is described. Genes expressed in a KC subtype-preferential manner can be good candidate target genes for genome editing, because they are likely related to highly advanced brain functions and some of them are dispensable for normal development and sexual maturation in honey bees. Although the cognition is significant in strategic reasoning, its role has been weakly analyzed, because only the average intelligence is usually considered. For example, prisoner's dilemma in game theory, would have different outcomes for persons with different intelligence. I show how various levels of intelligence influence the quality of reasoning, decision, or the probability of psychosis. I explain my original methodology developed for my MA thesis in clinical psychology in 1998, and grant research in 1999, demonstrating the bias of the (...) classic IQ method, and how the intelligence limits thinking. Based on that I defined Personality Model, providing insight into understanding of psychosis (schizophrenia, bi-polar), which has not been explained yet by psychology or psychiatry. In addition, it enables to analyze and assess non-linear problems, utilizable in computer programming, visualization (animation) or other fields including Baduk game. I've already applied some principles in complex information system www.each.co.uk, and video-animations exhibited in London, Germany, Tokyo. I need to mention my experience in chess composition between 1994 and 2000, winning a few international prizes and inventing a special class of fairy rules redefining the mate. The chess composition principles or patterns show the way to organize logical series to higher advanced mechanisms (like calculus), applicable to other fields. One of such principles is a logical aesthetic innovation: new strategy, defined by Italian composers. Finally I show how the simple redefinition of the classic utility concept links economics and psychology to explain irrational / destructive behavior. Kripke defines a rigid designator as one that designates the same object in every possible world in which that object exists. He argues that proper names are rigid. So also, he claims, are various natural kind terms. But we wonder how they could be. These terms are general and it is not obvious that they designate at all. It has been proposed that these kind terms rigidly designate abstract objects. This proposal has been criticized because all terms then seem to (...) come out rigid, thus trivializing rigidity. The paper starts with further criticisms of this proposal aimed particularly at a recent version given by LaPorte. The paper goes on to develop and defend an alternative proposal presented briefly in Devitt and Sterelny (1999): instead of taking those natural kind terms to rigidly designate an object we take them to rigidly apply to the members of their extensions. Schwartz has rightly insisted that a notion of rigidity must do some theoretical work if it is to be interesting. The paper argues that rigid application for kind terms does the same primary work as rigid designation for singular terms, the work of refuting description theories of some terms; and it does the same secondary work, of explaining certain modal phenomena (with one exception). This paper develops a compositional, type-driven constraint semantic theory for a fragment of the language of subjective uncertainty. In the particular application explored here, the interpretation function of constraint semantics yields not propositions but constraints on credal states as the semantic values of declarative sentences. Constraints are richer than propositions in that constraints can straightforwardly represent assessments of the probability that the world is one way rather than another. The richness of constraints helps us model communicative acts in essentially (...) the same way that we model agents’ credences. Moreover, supplementing familiar truth-conditional theories of epistemic modals with constraint semantics helps capture contrasts between strong necessity and possibility modals, on the one hand, and weak necessity modals, on the other. In terms of understanding and interpreting a text, both the Christian world and the Islamic world have developed a discipline appropriate to the nature of the belief in their own books. Schleiermacher, one of the names that had a profound effect on modern hermeneutics, proposes two methods, grammatical and psychological methods, in understanding and interpreting the New Testament (Gospels). In this study, an evaluation has been made about whether the psychological method (hermeneutics) of Schleiermacher, who is a Christian theologian, can (...) be utilized in the Qur’anic exegesis (Tafsir) and interpretation (Ta’wil) and the similarities and intersections of this method with the sciences in the Qur’anic exegesis method have been attempted to be explained. In line with this goal, first of all, information about the understanding of the holy book in Christianity and Islam was given. Afterwards, the definitions of the intuitive and comparative method, psychological and technical task proposed by Schleiermacher in his psychological method were made and its contents were explained. In the last part, it has been evaluated whether the aforementioned methods will contribute to the interpretation of the Qur’an, and if a similar method has been formed as a science in the Islamic scientific tradition or in the method of tafsir, this is also stated. In addition, an opinion has been expressed on whether the methods that cannot be used directly in the interpretation of the Qur’an can be applied to the authors of tafsir (mufassirun) and the tafsirs they have written. We explore two ways of distinguishing the semantic operation of kind terms. First, we focus on a distinction between terms with a flexible versus terms with an inflexible semantics. Flexibility depends on whether some changes in the domain of application are taken to be possible while being consistent with past usage and what is intuitively the same meaning. On the other hand we discuss terms whose mode of operation is tolerant, in that the cohabitation in the speakers’ community of (...) more than one use or practice of use of the term in question is accepted. Those terms contrast with terms that operate in a strict way restricting severely the legitimacy of different uses that cut the domain of application in different ways. Among the latter we include terms with an ethical component and terms whose correct application involves high stakes. These distinctions are not new, since the phenomena that we identify as flexibility and tolerance have been observed, although in our view they have not been properly systematized and assessed. We argue that the two distinctions throw light on the bases of some disputes and on some legal disagreements. (shrink)

There are different possibilities for defining the areas for the application of ethics to engineering. They range from descriptive analysis of engineers’ relationship to moral criteria and extend to normative issues on how engineers should design more “sustainable” technology. In this paper, a frame of reference is proposed, which makes it possible to elaborate in a transparent manner goals for analysis of the scope of ethics in engineering. Its point of departure is marked by two questions: 1) which (...) types of situation in the practice of engineering require ethical reflection? and 2) to what extent are engineers expected to assume moral responsibility in the practice of their profession? The answers to both of these questions presuppose reflection on the societal processes of setting definitions and of making ascriptions. Understanding these processes of societal “construction” of demands for ethical reflection in engineering and of engineers’ moral responsibilities should be an important objective of the analysis of ethics in engineering. Following the studies of Araujo et al. (AI Soc 35:611–623, 2020) and Lee (Big Data Soc 5:1–16, 2018), this empirical study uses two scenario-based online experiments. The sample consists of 221 subjects from Germany, differing in both age and gender. The original studies are not replicated one-to-one. New scenarios are constructed as realistically as possible and focused on everyday work situations. They are based on the AI acceptance model of Scheuer (Grundlagen intelligenter KI-Assistenten und deren vertrauensvolle Nutzung. Springer, Wiesbaden, 2020) (...) and are extended by individual descriptive elements of AI systems in comparison to the original studies. The first online experiment examines decisions made by artificial intelligence with varying degrees of impact. In the high-impact scenario, applicants are automatically selected for a job and immediately received an employment contract. In the low-impact scenario, three applicants are automatically invited for another interview. In addition, the relationship between age and risk perception is investigated. The second online experiment tests subjects’ perceived trust in decisions made by artificial intelligence, either semi-automatically through the assistance of human experts or fully automatically in comparison. Two task types are distinguished. The task type that requires “human skills”—represented as a performance evaluation situation—and the task type that requires “mechanical skills”—represented as a work distribution situation. In addition, the extent of negative emotions in automated decisions is investigated. The results are related to the findings of Araujo et al. (AI Soc 35:611–623, 2020) and Lee (Big Data Soc 5:1–16, 2018). Implications for further research activities and practical relevance are discussed. (shrink)

This work investigates the possibility of iʿrâb (parsing) simple texts by utilizing simple grammar rules in the case of I’râb al-Awâmil al-mi’a. I'râb, which is the 'application of grammar on texts', is an operation of reinforcing the knowledge of grammar from one perspective, and an attempt to under-stand the text from another. Since I’râb al-Awâmil al-mi’a is the iʿrâb of al-Awâmil al-mi’a, which is a brief grammar treatise, it is clear that this iʿrâb is intended to reinforce grammar knowledge. (...) Moreover, it indicates the level of knowledge to be reinforced, as is evident from the text. We think that examining such iʿrâb works in terms of the applicability of iʿrâb, will provide data to the field of grammar teaching. The work is currently available in manuscript and consists of the object text and the author's iʿrâb. The object text of the work, al-Awâmil al-mi'a, is a textbook and the target reader of the book is beginners. It is naturally assumed that both al-Awâmil al-mi'a and its parsing were written for the same level. This work examines the validity of this assumption. In order to determine whether the rules used in the parsing are simple or complex, it was necessary to create a measure of simplicity. Three measures of simplicity have been created. If the grammatical rules used in parsing are: limited to the rules in al-Avâmil, or if they are within the frame of the main topics of grammar or if the author does not address controversial issues during the application of the iʿrâb, then they are simple rules. Moreover, in order to facilitate the achievement of our goal, we divided the sentences into simple and complex sentences, and selected our data mostly from complex sentences. We simplified complex sentences by dividing them into two types: sentences with missing elements and sentences that are semantically connected. We created a second dataset by adding some examples other than the complex sentence types. We selected the other sentence types that make up the second dataset from sentences that contain elements that al-Awāmil al-mi'a does not include. The mentioned datasets examined by utilizing the measure of simplicity that we created and the degree of complexity of the grammatical rules used in I'râb al-Awâmil al-mi'a, was revealed. (shrink)

The article presents possible applications of Paul Ricoeur’s theory in interpretation of legal texts and legally relevant human action. One should notice that Paul Ricoeur developed a comprehensive interpretation theory of two seemingly distant phenomena: literary texts and human action. When interrelating these issues, it becomes possible, on the basis of Ricoeur’s work, to construct a unified theory of the interpretation of legal texts and of legally relevant human action. What is provided by this theory for jurisprudence is the possibility (...) of formulating a comprehensive theory of application of law, well established in the ontology of the recipient of the legal text. It should be emphasised that the resulting benefits, outlined in the article become particularly noticeable when set against the background of the methodological weaknesses of legal positivism, concerning both the interpretation of law and a syllogistic model of its application. The modal logician's notion of possible world and the computer scientist's notion of state of a machine provide a point of commonality which can form the foundation of a logic of action. Extending ordinary modal logic with the calculus of binary relations leads to a very natural logic for describing the behavior of computer programs.

Development of decision-support and intelligent agent systems necessitates mathematical descriptions of uncertainty and fuzziness in order to model vagueness. This paper seeks to present an outline of Peirce’s triadic logic as a practical new way to model vagueness in the context of artificial intelligence. Charles Sanders Peirce was an American scientist–philosopher and a great logician whose triadic logic is a culmination of the study of semiotics and the mathematical study of anti-Cantorean model of continuity and infinitesimals. After presenting Peircean semiotics (...) within AI perspective, a mathematical formulation of a Peircean triadic set is given in relationship with classical and fuzzy sets. Using basic logical operators, all possible respective implication operators, bi-equivalence operators, valid rules of inference, and associative, distributive and commutative logical properties are derived and verified through the truth function approach. In order to suggest practical directions, aggregation operators for Peirce’s triadic logic have been formulated. A mathematical formulation of a medical diagnostic problem and ER diagram of a library management system using Peirce’s triadic relation show potential for further applications of the proposed triadic set and triadic logic. Alongside, a classical AI game—The Wumpus World—is implemented to show practical efficacy in comparison with binary implementation. Besides giving some preliminary formulations for trichotomous set theory and definition of finite automaton, development of hybrid architectures for intelligent agents and evolutionary computations are discussed as potential practical avenues for Peirce’s triadic logic. In many real-life applications of logic it is useful to interpret a particular sentence as true together with its negation. If we are talking about classical logic, this situation would force all other sentences to be equally interpreted as true. Paraconsistent logics are exactly those logics that escape this explosive effect of the presence of inconsistencies and allow for sensible reasoning still to take effect. To provide reasonably intuitive semantics for paraconsistent logics has traditionally proven to be a challenge. Possible-translations (...) semantics can meet that challenge by allowing for each interpretation to be composed of multiple scenarios. Using that idea, a logic with a complex semantic behavior can be understood as an appropriate combination of ingredient logics with simpler semantic behaviors into which the original logic is given a collection of translations preserving its soundness. Completeness is then achieved through the judicious choice of the admissible translating mappings. The present note provides interpretation by way of possible-translations semantics for a group of fundamental paraconsistent logics extending the positive fragment of classical propositional logic. The logics PI, Cmin, mbC, bC, mCi and Ci, among others, are all initially presented through their non-truth-functional bivaluation semantics and sequent versions and then split by way of possible-translations semantics based on 3-valued ingredients. Suppose that we want to frame a conception of reasons that isn't relativized to the inclinations of particular agents. That is, we want to identify particular things that count as reasons for acting simpliciter and not merely as reasons for some agents rather than others, depending on their inclinations. One way to frame such a conception is to name some features that an action can have and to say that they count as reasons for someone whether or not he is (...) inclined to care about them. The problem with the resulting conception, as we have seen, is that it entails the normative judgment that one ought to be inclined to care about the specified features, on pain of irrationality, and this normative judgment requires justification. The advantage of internalism is that it avoids these normative commitments. It says that things count as reasons for someone only if he is inclined to care about them, and so it leaves the normative question of whether to care about them entirely open. Yet if we try to leave this question open, by defining things as reasons only for those inclined to care about them, we'll end up with a definition that's relativized to the inclinations of particular agents—won't we? Not necessarily. For suppose that all reasons for acting are features of a single kind, whose influence depends on a single inclination. And suppose that the inclination on which the influence of reasons depends is, not an inclination that distinguishes some agents from others, but rather an inclination that distinguishes agents from nonagents. In that case, to say that these features count as reasons only for those who are inclined to care about them will be to say that they count as reasons only for agents—which will be to say no less than that they are reasons for acting, period, since applying only to agents is already part of the concept of reasons for acting. The restriction on the application of reasons will drop away from our definition, since it restricts their application, not to some proper subset of agents, but rather to the set of all agents, which is simply the universe of application for reasons to act. . This papers examines formal properties of logical squares and their generalizations in the form of hexagons and octagons. Then, several applications of these constructions in philosophical analysis are elaborated. They concern contingency (accidentality), possibility, permission, axiological concepts (bonum and malum), the generalized Hume thesis (deontic and epistemic modalities), determinism, truth and consistency (in various senses. It is shown that relations between notions used in various branches of philosophy fall into the same formal scheme.

Background: Patients prescribed with medication that treats mental health conditions benefit the most compared to those prescribed with other types of medication. However, they are also the most difficult to adhere. The development of mobile health (mHealth) applications (‘apps’) to help patients monitor their adherence is fast growing but with limited evidence on their efficacy. There is no evidence on the content of these apps for patients taking psychotropic medication. The aim of this study is to identify and evaluate the (...) aims and functioning of available apps that are aiming to help and educate patients to adhere to medication that treats mental health conditions. Method: Three platform descriptions (Apple, Google and Microsoft) were searched between October 2015 and February 2016. Included apps need to focus on adherence to medication that treats mental health conditions and use at least a reinforcement strategy. Descriptive information was extracted and apps evaluated on a number of assessment criteria using content analysis. Results: Sixteen apps were identified. All apps included self-monitoring properties like reminders and psycho-educational properties like mood logs. It was unclear how the latter were used or how adherence was measured. Major barriers to medication adherence like patients’ illness and medication beliefs and attitudes were not considered nor where information to patients about mediation side effects. Very few apps were tailored and none was developed based on established theories explaining the processes for successful medication adherence like cognitions and beliefs. Reported information on app development and validation was poor. Discussion: A variety of apps with different properties that tackle both intentional and unintentional non-adherence from a different perspective are identified. An evidence-based approach and co-creation with patients is needed. This will ensure that the apps increase the possibility to impact on non-adherence. Theories like social cognition models can be useful in ensuring that patients’ education, motivation, skills, beliefs and type of adherence are taken into consideration when developing the apps. Findings from this study can help clinicians and patients make informed choices and pursue policy-makers to integrate evidence when developing future apps. Quality-assurance tools are needed to ensure the apps are systematically evaluated. (shrink)

The role of possible worlds in philosophy is hard to overestimate. Nevertheless, their nature and existence is very controversial. This is particularly serious, since their standard applications depend on there being sufficiently many of them. The paper develops an account of possible worlds on which it is particularly easy to believe in their existence: an account of possible worlds as pleonastic entities. Pleonastic entities are entities whose existence can be validly inferred from statements that neither refer to nor quantify over (...) them as a matter of conceptual necessity. This book provides an overview of computer techniques and tools — especially from artificial intelligence (AI) — for handling legal evidence, police intelligence, crime analysis or detection, and forensic testing, with a sustained discussion of methods for the modelling of reasoning and forming an opinion about the evidence, methods for the modelling of argumentation, and computational approaches to dealing with legal, or any, narratives. By the 2000s, the modelling of reasoning on legal evidence has emerged as a significant area within (...) the well-established field of AI & Law. An overview such as this one has never been attempted before. It offers a panoramic view of topics, techniques and tools. It is more than a survey, as topic after topic, the reader can get a closer view of approaches and techniques. One aim is to introduce practitioners of AI to the modelling legal evidence. Another aim is to introduce legal professionals, as well as the more technically oriented among law enforcement professionals, or researchers in police science, to information technology resources from which their own respective field stands to benefit. Computer scientists must not blunder into design choices resulting in tools objectionable for legal professionals, so it is important to be aware of ongoing controversies. A survey is provided of argumentation tools or methods for reasoning about the evidence. Another class of tools considered here is intended to assist in organisational aspects of managing of the evidence. Moreover, tools appropriate for crime detection, intelligence, and investigation include tools based on link analysis and data mining. Concepts and techniques are introduced, along with case studies. So are areas in the forensic sciences. Special chapters are devoted to VIRTOPSY (a procedure for legal medicine) and FLINTS (a tool for the police). The recently developed CRISPR-Cas9 gene editing technology is transforming basic biomedical research, but it also may have therapeutic applications. This essay examines how the technology works, its possible applications in somatic and germline cell therapy, and the use of gene drives to control disease vectors like mosquito-borne illnesses. While potentially valuable, all of these applications present ethical problems, including the specific risks of unintentional mutations; pre-existing concerns over the relationship between biomedical technology, power, and procreation; and CRISPR’s unintended consequences for (...) the environment. This paper discerns two types of mathematization, a foundational and an explorative one. The foundational perspective is well-established, but we argue that the explorative type is essential when approaching the problem of applicability and how it influences our conception of mathematics. The first part of the paper argues that a philosophical transformation made explorative mathematization possible. Metaphysically possible worlds have many uses. Epistemically possible worlds promise to be similarly useful, especially in connection with propositions and propositional attitudes. However, I argue that there is a serious threat to the natural accounts of epistemically possible worlds, from a version of Russell’s paradox. I contrast this threat with David Kaplan’s problem for metaphysical possible world semantics: Kaplan’s problem can be straightforwardly rebutted, the problems I raise cannot. I argue that although there may be coherent accounts of epistemically possible (...) worlds with fruitful applications, any such an account must fundamentally compromise the basic idea behind epistemic possibility. In international arbitration, timely application and enforcement of interim measures can have a substantial effect on the possibility of the enforcement of final arbitration award, especially when issues relating to the protection of assets or evidence arise before or during the course of arbitration proceedings. Though the substantive amendments to the UNCITRAL Model Law on International Commercial Arbitration concerning the application and enforcement of interim measures in international arbitration were made in 2006, the legal regulation of these matters (...) in Lithuania by the Law on Commercial Arbitration remained as previous. Hence, the purpose of this article is to provide a brief analysis of the contemporary universal legal doctrine and international practice regarding the availability, application and enforcement of interim measures in international arbitration; to examine and evaluate the Lithuanian law and court practice, their compliance with the analyzed contemporary universal legal doctrine and international practice on the application and enforcement of interim measures in international arbitration. The paper deals with the topical issue of studying cyclic patterns in the economy and their practical application for the forecasts on the development of financial markets. The work aims to establish the features of the seasonal-cyclic patterns "The January barometer" and "The first five days of January" in the international financial markets in current conditions and to develop recommendations for the practical application of these patterns in the investment activities. The US stock market as an integral part (...) of the World financial market was chosen as a basis for research. The research was conducted by statistical processing of data on the values of the broad market index Standard & Poor's-500 for the period from 1950 to 2019. The study showed that the formation of forecasts about the annual growth or decline of the stock market index using the seasonal-cyclic patterns "The January barometer" and "The first five days of January" can show a high result in cases where the growth of the Standard & Poor's-500 index by the results of both the first five days of January and the results of the entire month of January of this year is a positive value. Otherwise, forecasting based on these instruments is not advisable. The best results (the forecast efficiency was 93.3%) were achieved with the joint application of both cyclic patterns. The practical application of the research results makes it possible to improve the efficiency of investment activities in international financial markets. (shrink)

Maintenance of proper health and prevention of diseases of civilization are now significant public health problems. Nutrition is an important factor in the development of youth, as well as the current and future state of health. The aim of the study was to show the benefits of the application of cluster analysis to assess the dietary habits of high school students. The survey was carried out on 1,631 eighteen-year-old students in seven randomly selected secondary schools in Bialystok using a (...) self-prepared anonymous questionnaire. An evaluation of the time of day meals were eaten and the number of meals consumed was made for the surveyed students. The cluster analysis allowed distinguishing characteristic structures of dietary habits in the observed population. Four clusters were identified, which were characterized by relative internal homogeneity and substantial variation in terms of the number of meals during the day and the time of their consumption. The most important characteristics of cluster 1 were cumulated food ration in 2 or 3 meals and long intervals between meals. Cluster 2 was characterized by eating the recommended number of 4 or 5 meals a day. In the 3rd cluster, students ate 3 meals a day with large intervals between them, and in the 4th they had four meals a day while maintaining proper intervals between them. In all clusters dietary mistakes occurred, but most of them were related to clusters 1 and 3. Cluster analysis allowed for the identification of major flaws in nutrition, which may include irregular eating and skipping meals, and indicated possible connections between eating patterns and disturbances of body weight in the examined population. We deal with several pcf problems: we characterize another version of exponentiation: maximal number of κ-branches in a tree with λ nodes, deal with existence of independent sets in stable theories, possible cardinalities of ultraproducts and the depth of ultraproducts of Boolean Algebras. Also we give cardinal invariants for each λ with a pcf restriction and investigate further T D (f). The sections can be read independently, although there are some minor dependencies.

Technology acceptance by users has been extensively studied in recent years in various fields such as technologies for learning, e-commerce, and business technologies. This review focuses specifically on Human Resource Information Systems and its acceptance by users. Given their widespread use in organisations, HRIS acceptance has been researched but not synthesised in any way. This article aims to review the effectiveness of the classical TAM and UTAUT models commonly used for new technologies and to identify the variables added to these (...) models to better predict HRIS acceptance by employees. It also highlights the importance of the human-machine-organisation relationship to contribute to the understanding of HRIS acceptance in professional environments. This review confirms the effectiveness of the TAM and UTAUT models and proposes to develop them by variables reffering to technological characteristics, user satisfaction with the system, and organisational variables. In 1966 Richard Levins argued that applications of mathematics to population biology faced various constraints which forced mathematical modelers to trade-off at least one of realism, precision, or generality in their approach. Much traditional mathematical modeling in biology has prioritized generality and precision in the place of realism through strategies of idealization and simplification. This has at times created tensions with experimental biologists. The past 20 years however has seen an explosion in mathematical modeling of biological systems with the rise (...) of modern computational systems biology and many new collaborations between modelers and experimenters. In this paper I argue that many of these collaborations revolve around detail-driven modeling practices which in Levins’ terms trade-off generality for realism and precision. These practices apply mathematics by working from detailed accounts of biological systems, rather than from initially idealized or simplified representations. This is possible by virtue of modern computation. The form these practices take today suggest however Levins’ constraints on mathematical application no longer apply, transforming our understanding of what is possible with mathematics in biology. Further the engagement with realism and the ability to push realistic models in new directions aligns well with the epistemological and methodological views of experimenters, which helps explain their increased enthusiasm for biological modeling. In lieu of an abstract, here is a brief excerpt of the content:Philosophy, Psychiatry, & Psychology 9.4 (2002) 353-358 [Access article in PDF] The Application of Nondual Epistemology to Anomalous Experience in Psychosis Caroline Brett THE COMMENTARIES PROVIDED by Marzanski and Bratton, and McGhee have drawn my attention to several ways in which my analysis could benefit from clarification or supplementation, and the range of the specific phenomena to which it can be applied. Since writing this paper nearly 3 (...) years ago, my own views of the area have developed, and in some aspects, shifted; nevertheless, within this response I shall comment on the specific aspects of the original paper that I feel may have been misunderstood or overlooked by the commentators, and those aspects that benefit from the broader perspective they provided.To clarify the direction of the original paper: I would describe it as an attempt to make a deeper examination of processes involved in some kinds of anomalous experience than is provided by the "cognitive problem-solving model"; in other words, to supplement rather than challenge or undermine this perspective. Moreover, the focus is intended to be more on identifying the point at which the experience, or the response to the experience (more on the relation between these two below) becomes pathological, than on cleanly distinguishing a psychotic state from a mystical one. However, because I do use these terms contrastively throughout the paper, I concede that these aims become blurred and may in fact be indistinguishable.Third, the paper concerns only a relatively narrow arena of both mystical and psychotic phenomenology, selected for the purpose of a tight conceptual analysis and comparability, and possibly suffers a lack of generalizability or scope of application as a result. Most notably, I leave aside the paranoid or persecutory interpretative framework often seen as paradigmatic of the psychotic state (although a brief mention of how emotionally relevant themes may arise out of anomalous cognition is included), focussing instead on the more "Schneiderian" aspects of psychotic phenomenology, in which there is a self-observed alteration of normal experience. 1 It may be an important point of contrast that I do not specifically focus on "hallucinations, voices, and visions" as described by McGhee and, to an extent, Jackson and Fulford. It may also be worth [End Page 353] flagging up the fact that I do not focus on "delusional beliefs" at all, instead choosing to focus on the "delusional mood," which notably does not involve crystallized delusions as such. As a result, the main aim is not to compare two descriptively defined states of mind, as seems to be suggested by McGhee in his commentary, but rather to see to what extent a certain form of experience can be understood within a particular epistemological structure, and the implications of this.Further to this issue, Marzanski and Bratton raise an objection to a view in which a common core of mystical experience is posited; one which could be identified interculturally and independently of "the language and tradition in which the self is formed." They make an important point that the perspective gained by applying the epistemology of Zen Buddhism or Advaita Vedanta may have no authority in helping to understand the locus of pathology in anomalous experiences that have occurred in an individual who is not established in these cultures or traditions or for a person who does not accept these epistemologies in the first place. The issue of the existence of some core mystical experiences that are translated into religious experiences in different cultures is a matter of comparative religion and theology, and outside the scope of this paper (although my own opinion is that such a core exists). In the absence of any argument to support this opinion, it must be conceded that this may severely limit the applicability of my analysis, especially if irreconcilable differences are thought to exist between the epistemologies of, for example, theistic and monistic philosophies. The probability ranking conclusion is an extension of the absolute form evaluation conclusion. Firstly, the random simulation evaluation model is introduced; then, the general idea of converting the traditional evaluation method to the random simulation evaluation model is analyzed; on this basis, based on the rule of “further ensuring the stability of the ranking chain on the basis of increasing the possibility of the ranking chain,” two methods of solving the probability ranking conclusion are given. Based on the rule of (...) “further guaranteeing the stability of the ranking chain on the basis of improving the likelihood of the ranking chain,” two methods are given to solve the likelihood conclusion. This paper argues that this absolute form of conclusion hinders the approximation of the theory to the essence of the actual problem and is an important reason for the problem of “non-consistency of multi-evaluation conclusions.” To address this problem, a stochastic simulation-based comprehensive evaluation solution algorithm based on the idea of “Monte Carlo simulation” is proposed, and the corresponding ranking method is investigated, which is characterized by generating evaluation conclusions with probability information, and thus has more advantages than the absolute conclusion form in terms of problem interpretability. The method is characterized by the generation of evaluation conclusions with probabilistic information and thus has more advantages than the absolute conclusion form in terms of problem interpretation. Because of the independence of the stochastic simulation solution method, it is applied to the “bottom-up” evaluation model as an example, and a novel autonomous evaluation method is constructed. Cartwright and Munro argued that extrapolation of findings from randomized controlled trials to other settings can be difficult because information about the underlying causal structure and subgroups is often not available. They advocated the use of ‘capacities’ – that is fixed causal contributions – in predicting effects of interventions. In psychiatry, it is often not possible to determine what the fixed causal contributions are and one can only establish ‘approximate capacities’. However, using ‘approximate capacities’ does imply a different way of (...) evaluating health services, especially combined interventions. In health service research, if different studies, randomized controlled trials or other designs, have given different outcomes, the best way to investigate the effectiveness of a particular way of service organization is not to conduct more randomized controlled trials. It is preferable to study the effects of certain elements of the complex intervention, which have been tested before in other settings, that is investigating ‘approximate capacities’. One should check whether the separate elements do form a part of the complex intervention in practice and whether they have the same effect as in other studies and if not, why not. This enhances knowledge about the underlying causal structure and increases the possibility of extrapolation of the findings. (shrink)

This paper explores the possibility of a standard legal language (e.g. English) for a principled evolution of law in line with technological development. In doing so, reference is made to blockchain networks and smart contracts to emphasise the discontinuity with the liberal legal tradition when it comes to decentralisation and binary code language. Methodologically, the argument is built on the underlying relation between law, semiotics and new forms of media adding to natural language; namely: code and symbols. In what follows, (...) I will concentrate on the study of factors that explain why such approach can be fruitful for the future of law and innovation. I have three reasons for selecting this topic. The first is a more pragmatic reason, based on my current research of law as a linguistic phenomenon. Secondly, the topic does also touch the matter on binary code language, rivalrous to legal alphabetic language. Lastly, the study aims at emphasizing the pivotal role of the jurist as an interpreter in a changing society accommodating diverging realms of reality. The study is structured as follows. Firstly, a quick exam of the traits of blockchain networks would provide the contextual link to establish the arguments in support of the need of a standard legal language. Secondly, a comparison between liberal legal institutions and theory of semiotics is set to perceive their functioning and ascertain their limits in the light of todays unprecedented changes. Thirdly, a summary on blockchain networks’ legal features would constitute the thrust behind the idea of a uniform legal language. Methodologically, the argument does also establish some relations with classical laws of physics and philosophy of media. Its aim is to demonstrate how the suggested legal interpretation and semiotic-based approach can contribute to overcome existing stumbling blocks including, but not limited to, the lack of cooperation at the international level as well as the gap in State norms when it comes to innovation. In this sense, the proposed strategies do not intend to replace current advances in the legal thought. In contrast, it seeks to harmonise their results providing a methodical approach that can concur to inform a new technique to address new controversial issues. In practice, the proposed method regarding the adoption of a uniform legal language would lower transactive costs in terms of normative coordination in the matter of international cooperation and in the definition of applicable law among different legal systems. Alternatively, it might contribute to the convergence of legal systems and/or their underlying concepts. Differently put, article’s contribution can be envisaged in fostering juridical consistency with regards to different forms of languages’ coexistence. (shrink)
