Multinational enterprises are aware of their responsibility to protect human rights now more than ever, but severe human rights violations, including physical integrity abuses, continue unabated. To explore this puzzle, we engage theoretically with the means-ends decoupling literature to examine if and when oil and gas firms’ policies and practices prevent severe human rights abuse. Using an original dataset, we identify two pathways to mitigate means-ends decoupling: while human rights policies alone do not reduce human rights abuses, firms with a (...) high-quality human rights policy over the long-term reduce severe human rights abuses; firms that combine preparedness—which we define as a firm’s capabilities, practices, and engagement—with a long-term human rights policy also reduce the likelihood of human rights abuses. Preparedness, we argue, can lead to reinforcement dynamics between long-term policy efforts and additional capabilities that provide a more holistic understanding of firm behavior. (shrink)

Abstract In this paper, I pursue an interpretive goal and a critical goal. My interpretive goal is to offer a clear restatement of Nagel's argument for a requirement of altruism (as found in The Possibility of Altruism). My critical goal is to explain why this argument is unsuccessful, and to make a case for the thesis that any argument of its kind must fail.

This chapter critically examines the evolutionary assumptions that underlie the notion that nature is like a master engineer. It compares and contrasts intentional genetic modification (IGM) with unintentional genetic modification (UGM) as to their potential for improving human life. The chapter first argues for two main theses. First, UGM operates under constraints that severely limit its ability to realize what human beings rightly value, including their own survival and improvement. Because IGM can remove these constraints, it is potentially more effective (...) in promoting human well‐being. Second, IGM is also potentially morally preferable to UGM, since the latter is wantonly destructive of life, often involves suffering on a massive scale. The chapter then articulates the kernel of truth in appeals to the wisdom of nature, arguing for the need to develop appropriate cautionary heuristics for IGM. (shrink)

The second essay of Nietzsche's Genealogy of Morality (GM) offers a naturalistic and developmental account of the emergence of conscience, a faculty uniquely responsive to remembering and honoring obligations. This article attempts to solve an interpretive puzzle that is invited by the second essay's explanation of nonmoral obligation, prior to the capacity to feel guilt. Ostensibly, Nietzsche argues that the conscience and our concept of obligation originated within contractual (“creditor-debtor”) relations, when creditors punished delinquent debtors (GM II:5). However, this interpretation, (...) which I call the contractualist reading, is incoherent and subject to an insoluble bootstrapping problem. I argue instead that Nietzsche provides two accounts of nonmoral obligation in the second essay, and that the conscience originated in the morality of custom to track rule prohibitions (“I will nots” [GM II:3]), which Nietzsche conceives of as involuntary or reciprocal obligations that, unlike contractual debts, do not require the making of promises. The authors share an enthusiasm for applying Deleuze and Guattari's schizoanalytic project to "religion," but they display significantly different ways of carrying out its creative and destructive tasks. As a whole, the book addresses the relevance of Deleuze for contemporary developments in political theology, liberation theology, Christian doctrine, and the recent (...) growth of interest in spirituality and atheism. In several contexts Nietzsche claims that he wants to free humanity of the affect of guilt. He also argues that we are not ultimately responsible for who we are or what we do because libertarian free will is a false belief invented for the purpose of legitimizing judgments of guilt. Combining these related threads of argument, we arrive at what would seem to be an uncontroversial conclusion: Nietzsche does not think guilt is an apt response to wrongdoing, and he therefore (...) thinks we ought to dispense with the feeling of guilt altogether. I argue against this conclusion by offering a comparative analysis of two kinds of guilt Nietzsche discusses in his works, reactive guilt, which is a reaction to an act of wrongdoing, and proactive guilt, which is a drive or desire to make oneself feel guilty. Here I offer an account of Greek guilt as a species of reactive guilt, and I argue that Nietzsche only rejects proactive guilt, which is endemic to Judeo-Christianity. (shrink)

Abstract:Although inquiry-based instruction has been a centerpiece of progressive visions of social studies education almost since its inception as a school subject a century ago, teachers often struggle to conceptualize it in ways that make true inquiry possible for their students. In this essay I suggest that social educators strengthen their connection with John Dewey’s pragmatic epistemology as the foundation of inquiry-based teaching in social studies, arguing in support of an approach that holds the promise of advancing goals associated with (...) meaningful democratic citizenship education. Nietzsche proclaims the second essay of the Genealogy of Morality to be the “long history of the origins of responsibility,” but the immediate context in which this claim is made, coupled with GM II's broader aims and themes, makes interpreting this claim immensely difficult. Not only does Nietzsche endorse an ideal of responsibility in relation to the sovereign individual, while the rest of the essay is concerned with other topics, but also, and more problematically, this ideal appears to be inconsistent (...) with his denial of free will and moral responsibility in other works. Here, I propose a Strawsonian reading of GM II, contending that GM II analyzes the idea of “responsibility” naturalistically in terms of the practice of holding oneself and others responsible, as constituted by what Nietzsche calls the “reactive affects,” namely guilt. A consequence of this interpretation is that libertarian free will is not a condition of responsible agency. (shrink)

This article explores the circulation of ‘anti-psychiatry’ in British film and television during the long 1960s, focusing on the controversial BBC television play In Two Minds and its cinema remake Family Life. These films were inspired by R. D. Laing's ideas on the aetiology of schizophrenia, and were understood as uniting the personal and political motivations of progressive film-makers and progressive psychiatrists. Drawing upon practitioner interviews with producer Garnett and director Loach, and extensive archival research on the production and reception (...) of these films, this article contests previous scholarship on the popular circulation of anti-psychiatry and the movement's perceived polarisation from mainstream British psychiatry. While the reception of In Two Minds and Family Life did intensify an adversarial relationship between ‘rebel’ anti-psychiatrists and hard-line behaviourists such as William Sargant, the wider psychiatric field largely welcomed the films' contributions to mental health awareness and used the publicity to counter the idea of a ‘battle’ within the profession. This included leading UK mental health organisation the National Association for Mental Health looking to Loach and Laing as models for engaging contemporary audiences as it rebranded to MIND in 1972. This article contributes to historical understandings of the complex interactions between the fields of media and mental health, as well as recent scholarship challenging the idea of a clear split between anti-psychiatry and British medical orthodoxy. While it is uncontroversial that the slave revolt in morality consists in a denial of the nobles as objects of value, Nietzsche’s account in the Genealogy’s first essay invites ambiguities concerning its origin, ressentiment’s relationship to value creation, and its meaning. In this paper, I address these ambiguities by analyzing the morality of good and evil as an historical artifact of Judeo-Christian tradition, and I argue for a two-stage, non-strategic interpretation of the slave revolt, according to which Judaism and Christianity (...) each made essential and different contributions. The inversion of values began with the Jewish prophets, who claimed the poor were holy and ‘good’ and the rich ‘evil’, and it was sustained throughout the Second Temple period by the Jewish priests in relation to a ‘priestly-noble’ conception of the virtuous person as holy and pure. Christ, through his espousal of egalitarianism, negated the pathos of distance essential to noble values, thus beginning the second phase of the slave revolt where goodness became associated with a distinctly slavish conception of virtue. In a recent paper, Al Mele (2003) suggests that the Simple View of intentional action is “fiction” because it is “wholly unconstrained” by a widely shared (folk) concept of intentional action. The Simple View (Adams, 1986, McCann, 1986) states that an action is intentional only if intended. As evidence that the Simple View is not in accord with the folk notion of intentional action, Mele appeals to recent surveys of folk judgments by Joshua Knobe (2003, 2004a, 2004b). Knobe’s surveys appear (...) to show that the folk judge unintended but known side effects of actions to be performed intentionally. In this paper we will reject Mele’s suggestion that the Simple View is “fiction.” We will also discuss the relationship between surveys and philosophical theories, and the abilities of surveys to access folk core concepts. We will argue that considerations of both fail to support Mele’s suggestion. (shrink)

In this study, we examined the perception of actual and ideal ethical climate type among 95 nurses working in the internal medicine wards of one central hospital in the state of Israel. We also examined whether nurses’ demographic characteristics influence that perception and if a relationship between perceptions of an actual and an ideal ethical climate type influences nurses’ job satisfaction. A questionnaire composed of three subquestionnaires was administered and the responses analyzed using multiple linear regressions, analysis of variance and (...) Pearson’s correlation coefficient. The results demonstrated that demographic characteristics (such as: gender, job tenure and level of education) partially influence the perception of an ideal ethical climate. Incongruence in perceptions of ‘caring’ and ‘independence’ climate types indicated a decline in nurses’ job satisfaction, while perception of actual ‘caring’ and ‘service’ climates positively influenced all aspects of job satisfaction. We recommend constructing training programs emphasizing the ethics of nursing practice and also to help lead nurses to clarify an ethical framework and guide nursing staff in dealing with ethical dilemmas. Ethical lapses associated with the first facial transplant included breaches of confidentiality, bending of research rules, and film deals. However, discussions of the risk-benefit ratio for face transplantation are often deficient in that they ignore the needs, experience, and decision-making capability of potential recipients.

Twenty-first-century biology rejects genetic determinism, yet an exaggerated view of the power of genes in the making of bodies and minds remains a problem. What accounts for such tenacity? This article reports an exploratory study suggesting that the common reliance on Mendelian examples and concepts at the start of teaching in basic genetics is an eliminable source of support for determinism. Undergraduate students who attended a standard ‘Mendelian approach’ university course in introductory genetics on average showed no change in their (...) determinist views about genes. By contrast, students who attended an alternative course which, inspired by the work of a critic of early Mendelism, W. F. R. Weldon, replaced an emphasis on Mendel’s peas with an emphasis on developmental contexts and their role in bringing about phenotypic variability, were less determinist about genes by the end of teaching. Improvements in both the new Weldonian curriculum and the study design are in view for the future. (shrink)

This paper argues that the augmented reality gaming application for smart devices, _Pokémon GO_ shows the fate of the legal subject as a neoliberal monster subjugated to the limitations imposed by hypercapitalism. The game, derived from Nintendo’s iconic Pokémon franchise, reveals the legal subject as a frenzied, diminished and impulsive being, allowed to see, move, catch and accumulate but unable to participate in more meaningful self-narration. It is not that the game is lawless, notwithstanding, anxieties in the semiosphere about users (...) trespassing or engaging in criminal behaviour. Rather the game is over structured and highly limited, both within its game-play which is repetitive and impulsive, and in its absence of narrative. Unlike the classic Nintendo Pokémon games which are within the role-playing game genre, _Pokémon GO_ abstracts the seeing, moving, catching and accumulating features of the classic games without the overarching narrative, questing and competition. In this _Pokémon GO_ manifests the transformation of the liberal legal subject of capitalism to the neoliberal subject of a digital orientated hypercapitalism where seeing, moving, catching and accumulating is immediate and impulsive, obliterating the ‘prudent’ subject participating in their own self-narration. Peirce’s system may be identified as one of a family of “organic memory” theories which flourished during the period in which he developed it, especially in the Monist journals which published much of his late work. “Organic memory” theories were vigorously opposed in their own day and are remembered in our own, if at all, only in connection with discredited theories such as racial memory and Lamarckian inheritance. When read in the context of their own time, however, “organic memory” theories (...) stand revealed as among modernity’s first attempts at a still-unrealized, post-nominalist re-foundation of science. Being thus closely related to Peirce’s own project both in time and in spirit, they deserve to be understood on their own terms. The synthesis of these theories in the book Das Gesetz der Serie (1919) by the Austrian biologist Paul Kammerer (1880-1926), a prominent representative of organized Monism's European branch, provides insight into the systematic unity of the various aspects of Peirce's thought, especially the close relationship between pragmatism and what is now called “emergence.”. Melissa Oliver-Powell Beyond the Spectacle of Suffering: Agnès Varda’s L’Unechante,l’autrepas and Rewriting the Subject of Abortion in France In the spring of 1971, three years after the revolutionary fervor of May 1968 in France, 343 women put their names to a courageous manifesto announcing that they were criminals of a particularly gendered nature. The authors of (...) Manifeste des 343 (Manifesto of the 343) comprised a large group of culturally eminent French women and activists declaring that they had all illegally undergone abortions, which at this point, despite growing decriminalization throughout much of Western Europe, were still outlawed within their republic. Though many of the revolutionary fires had now eased to embers, French feminists demonstrated that reproductive rights were still a vital and unresolved topic of social justice. Including names as weighty as Simone de Beauvoir, Jeanne Moreau, and Catherine Deneuve, the manifesto brought together exceptional women from the fields of academia, law, theater, film and literature, alongside grassroots activists. Their action was a bold challenge to the French authorities, daring them to arrest some of the country’s brightest thinkers and cultural innovators under a law the signatories felt was deeply unjust, sexist, and antithetical to the values of individual liberty and citizenship. It was a case of those with the broadest shoulders weaponizing their privilege to present a robust front line in the wider struggle for women’s rights. One of the signatories was filmmaker Agnès Varda. Her name, like those of several others on the list, demonstrates the symbiosis between Melissa Oliver-Powell 15 cultural production and gender politics that has often characterized French feminist thought. From the multidisciplinary writings of Beauvoir, to the novels of the écriture féminine movement, to the lyrical academic prose of Hélène Cixous, Luce Irigaray, Julia Kristeva, and others, French and Francophone feminist writers have tended to connect art and politics with a great deal of fluidity. As a committed activist and a filmmaker, Agnès Varda falls very much within this tradition, often adopting and developing feminist practices within her cinema. This article examines how Varda’s 1977 film, L’Une chante, l’autre pas (One Sings, The Other Doesn’t) interacts with and participates in the feminist political project of reproductive rights as well as the ongoing intellectual and moral debates over abortion taking place in France throughout the late 1960s and 1970s. I look particularly at the adversarial construction of abortion narratives within these debates and the location of victimhood therein. Within mainstream cultural representations in and beyond France, abortion is typically constructed as either a traumatic or a transgressive moment. The same is often true on either side of political and social debates on abortion, which have tended either to characterize the women who get abortions as irresponsible and amoral or as sympathetic victims in need of protection. Though the transgressive element persists, it is the interaction with representations of trauma that interests me here. In approaching discussions of gendered injustice, it is common for feminist writers and activists to leverage pathos as a rhetorical strategy. While suffering can be a highly effective and galvanizing expression of oppression, such discourses also run the risk of producing excessive depictions of victimhood, which can displace the capacity for action from the subject of hardship onto the privileged oppressor. This risk is particularly at stake within the cultural form of film, as its visuality and identificatory mechanics have the potential to spectacularize the female victim and make her relatable only through suffering. This was often the case in earlier French films that featured abortion such as Les Mauvaises rencontres (1955), Des gens sans importance (1956), Journal d’une femme en blanc (1965), and Une femme en blanc se révolte (1966), all of which made their subjects sympathetic by entwining them in long narratives of victimization ending in death or disgrace. This book aims to spur critical thought on the various dimensions and impacts of "responsibility" for organizations, including companies, institutions, and governments, while considering international differences and similarities, as well as global challenges. It analyzes to what extent responsibility is becoming a crucial issue for all kinds of organizations, examining both the intensifying pressures of international competition and the growing crisis of confidence towards some management concepts and practices. As more and more socio-economic and political systems are suspected of serving (...) selfish interests instead of the public good, more accountable and integrated processes are appropriate in order to deal with the present and future stakes of our society. Further, with the development of digital technology and the use of data mining, new questions regarding responsibility require examination. This edited collection is a culmination of the international scientific conference "Responsible Organizations in the Global Context", co-organized by the CIED of Georgetown University (United States) and the Larequoi Research Center of the University of Versailles St-Quentin (France) in June 2017 in Washington DC.
