Multinational enterprises are aware of their responsibility to protect human rights now more than ever, but severe human rights violations, including physical integrity abuses, continue unabated. To explore this puzzle, we engage theoretically with the means-ends decoupling literature to examine if and when oil and gas firms’ policies and practices prevent severe human rights abuse. Using an original dataset, we identify two pathways to mitigate means-ends decoupling: while human rights policies alone do not reduce human rights abuses, firms with a (...) high-quality human rights policy over the long-term reduce severe human rights abuses; firms that combine preparedness—which we define as a firm’s capabilities, practices, and engagement—with a long-term human rights policy also reduce the likelihood of human rights abuses. Preparedness, we argue, can lead to reinforcement dynamics between long-term policy efforts and additional capabilities that provide a more holistic understanding of firm behavior. (shrink)

Abstract In this paper, I pursue an interpretive goal and a critical goal. My interpretive goal is to offer a clear restatement of Nagel's argument for a requirement of altruism (as found in The Possibility of Altruism). My critical goal is to explain why this argument is unsuccessful, and to make a case for the thesis that any argument of its kind must fail.

This chapter critically examines the evolutionary assumptions that underlie the notion that nature is like a master engineer. It compares and contrasts intentional genetic modification (IGM) with unintentional genetic modification (UGM) as to their potential for improving human life. The chapter first argues for two main theses. First, UGM operates under constraints that severely limit its ability to realize what human beings rightly value, including their own survival and improvement. Because IGM can remove these constraints, it is potentially more effective (...) in promoting human well‐being. Second, IGM is also potentially morally preferable to UGM, since the latter is wantonly destructive of life, often involves suffering on a massive scale. The chapter then articulates the kernel of truth in appeals to the wisdom of nature, arguing for the need to develop appropriate cautionary heuristics for IGM. (shrink)

On connaît peu la pensée chinoise contemporaine. Annie Boisclair s'intéresse ici tout particulièrement au philosophe Mou Zongsan (1909-1995) au parcours singulier. D'origine modeste, il quitte le milieu rural de Shandong pour aller étudier à l'université de Pékin en 1929. Juste avant la prise du pouvoir par les communistes en 1949, Mou fuit à Taïwan puis, plus tard, à Hong Kong. Il enseignera dans diverses universités et les turbulences sociales et politiques de la Chine seront intimement liées à l'approfondissement de (...) sa connaissance de la tradition intellectuelle chinoise qu'il mettra en relation avec les courants philosophiques occidentaux. C'est le dialogue entre les deux traditions et leur fécondation mutuelle que Annie Boisclair fait apparaître en suivant la pensée du philosophe. De tous les penseurs de ce courant, peu ont eu autant d'influence que Mou Zongsan. Mou supposait que les Chinois subiraient une perte d'identité culturelle s'ils ne valorisaient que le savoir étranger et, en même temps, que la civilisation chinoise ne survivrait pas à un enfermement sur elle-même. La pensée de Mou intégrait déjà plusieurs traditions fondamentales chinoises comme le confucianisme, le taoïsme et le bouddhisme, il était donc naturel d'y inclure des courants de philosophie occidentale. Ainsi est déterminée une position en philosophie et en politique, assiette inédite qui en appelle à l'aléatoire et se donne comme un " chantier " ouvert à nos explorations. De fait, les catégories du sujet, de l'aliénation, de la dialectique, de l'idéologie, sont bradées ou ébranlées au profit du processus hasardeux et de la vicissitude des formes. In a recent paper, Al Mele (2003) suggests that the Simple View of intentional action is “fiction” because it is “wholly unconstrained” by a widely shared (folk) concept of intentional action. The Simple View (Adams, 1986, McCann, 1986) states that an action is intentional only if intended. As evidence that the Simple View is not in accord with the folk notion of intentional action, Mele appeals to recent surveys of folk judgments by Joshua Knobe (2003, 2004a, 2004b). Knobe’s surveys appear (...) to show that the folk judge unintended but known side effects of actions to be performed intentionally. In this paper we will reject Mele’s suggestion that the Simple View is “fiction.” We will also discuss the relationship between surveys and philosophical theories, and the abilities of surveys to access folk core concepts. In this study, we examined the perception of actual and ideal ethical climate type among 95 nurses working in the internal medicine wards of one central hospital in the state of Israel. We also examined whether nurses’ demographic characteristics influence that perception and if a relationship between perceptions of an actual and an ideal ethical climate type influences nurses’ job satisfaction. A questionnaire composed of three subquestionnaires was administered and the responses analyzed using multiple linear regressions, analysis of variance and (...) Pearson’s correlation coefficient. The results demonstrated that demographic characteristics (such as: gender, job tenure and level of education) partially influence the perception of an ideal ethical climate. Incongruence in perceptions of ‘caring’ and ‘independence’ climate types indicated a decline in nurses’ job satisfaction, while perception of actual ‘caring’ and ‘service’ climates positively influenced all aspects of job satisfaction. We recommend constructing training programs emphasizing the ethics of nursing practice and also to help lead nurses to clarify an ethical framework and guide nursing staff in dealing with ethical dilemmas. Ethical lapses associated with the first facial transplant included breaches of confidentiality, bending of research rules, and film deals. However, discussions of the risk-benefit ratio for face transplantation are often deficient in that they ignore the needs, experience, and decision-making capability of potential recipients.

Twenty-first-century biology rejects genetic determinism, yet an exaggerated view of the power of genes in the making of bodies and minds remains a problem. What accounts for such tenacity? This article reports an exploratory study suggesting that the common reliance on Mendelian examples and concepts at the start of teaching in basic genetics is an eliminable source of support for determinism. Undergraduate students who attended a standard ‘Mendelian approach’ university course in introductory genetics on average showed no change in their (...) determinist views about genes. By contrast, students who attended an alternative course which, inspired by the work of a critic of early Mendelism, W. F. R. Weldon, replaced an emphasis on Mendel’s peas with an emphasis on developmental contexts and their role in bringing about phenotypic variability, were less determinist about genes by the end of teaching. Improvements in both the new Weldonian curriculum and the study design are in view for the future. (shrink)

This paper argues that the augmented reality gaming application for smart devices, _Pokémon GO_ shows the fate of the legal subject as a neoliberal monster subjugated to the limitations imposed by hypercapitalism. The game, derived from Nintendo’s iconic Pokémon franchise, reveals the legal subject as a frenzied, diminished and impulsive being, allowed to see, move, catch and accumulate but unable to participate in more meaningful self-narration. It is not that the game is lawless, notwithstanding, anxieties in the semiosphere about users (...) trespassing or engaging in criminal behaviour. Rather the game is over structured and highly limited, both within its game-play which is repetitive and impulsive, and in its absence of narrative. Unlike the classic Nintendo Pokémon games which are within the role-playing game genre, _Pokémon GO_ abstracts the seeing, moving, catching and accumulating features of the classic games without the overarching narrative, questing and competition. In this _Pokémon GO_ manifests the transformation of the liberal legal subject of capitalism to the neoliberal subject of a digital orientated hypercapitalism where seeing, moving, catching and accumulating is immediate and impulsive, obliterating the ‘prudent’ subject participating in their own self-narration. Melissa Oliver-Powell Beyond the Spectacle of Suffering: Agnès Varda’s L’Unechante,l’autrepas and Rewriting the Subject of Abortion in France In the spring of 1971, three years after the revolutionary fervor of May 1968 in France, 343 women put their names to a courageous manifesto announcing that they were criminals of a particularly gendered nature. The authors of (...) Manifeste des 343 (Manifesto of the 343) comprised a large group of culturally eminent French women and activists declaring that they had all illegally undergone abortions, which at this point, despite growing decriminalization throughout much of Western Europe, were still outlawed within their republic. Though many of the revolutionary fires had now eased to embers, French feminists demonstrated that reproductive rights were still a vital and unresolved topic of social justice. Including names as weighty as Simone de Beauvoir, Jeanne Moreau, and Catherine Deneuve, the manifesto brought together exceptional women from the fields of academia, law, theater, film and literature, alongside grassroots activists. Their action was a bold challenge to the French authorities, daring them to arrest some of the country’s brightest thinkers and cultural innovators under a law the signatories felt was deeply unjust, sexist, and antithetical to the values of individual liberty and citizenship. It was a case of those with the broadest shoulders weaponizing their privilege to present a robust front line in the wider struggle for women’s rights. One of the signatories was filmmaker Agnès Varda. Her name, like those of several others on the list, demonstrates the symbiosis between Melissa Oliver-Powell 15 cultural production and gender politics that has often characterized French feminist thought. From the multidisciplinary writings of Beauvoir, to the novels of the écriture féminine movement, to the lyrical academic prose of Hélène Cixous, Luce Irigaray, Julia Kristeva, and others, French and Francophone feminist writers have tended to connect art and politics with a great deal of fluidity. As a committed activist and a filmmaker, Agnès Varda falls very much within this tradition, often adopting and developing feminist practices within her cinema. This article examines how Varda’s 1977 film, L’Une chante, l’autre pas (One Sings, The Other Doesn’t) interacts with and participates in the feminist political project of reproductive rights as well as the ongoing intellectual and moral debates over abortion taking place in France throughout the late 1960s and 1970s. I look particularly at the adversarial construction of abortion narratives within these debates and the location of victimhood therein. Within mainstream cultural representations in and beyond France, abortion is typically constructed as either a traumatic or a transgressive moment. The same is often true on either side of political and social debates on abortion, which have tended either to characterize the women who get abortions as irresponsible and amoral or as sympathetic victims in need of protection. Though the transgressive element persists, it is the interaction with representations of trauma that interests me here. In approaching discussions of gendered injustice, it is common for feminist writers and activists to leverage pathos as a rhetorical strategy. While suffering can be a highly effective and galvanizing expression of oppression, such discourses also run the risk of producing excessive depictions of victimhood, which can displace the capacity for action from the subject of hardship onto the privileged oppressor. This risk is particularly at stake within the cultural form of film, as its visuality and identificatory mechanics have the potential to spectacularize the female victim and make her relatable only through suffering. This was often the case in earlier French films that featured abortion such as Les Mauvaises rencontres (1955), Des gens sans importance (1956), Journal d’une femme en blanc (1965), and Une femme en blanc se révolte (1966), all of which made their subjects sympathetic by entwining them in long narratives of victimization ending in death or disgrace. It analyzes to what extent responsibility is becoming a crucial issue for all kinds of organizations, examining both the intensifying pressures of international competition and the growing crisis of confidence towards some management concepts and practices. As more and more socio-economic and political systems are suspected of serving (...) selfish interests instead of the public good, more accountable and integrated processes are appropriate in order to deal with the present and future stakes of our society. Further, with the development of digital technology and the use of data mining, new questions regarding responsibility require examination. David Annis is professor of philosophy at Ball State University. In this essay, Annis offers an alternative to the foundationalist-coherent controversy: "contextualism." This theory rejects both the idea of intrinsically basic beliefs in the foundational sense and the thesis that coherence is sufficient for justification. he argues that justification is relative to the varying norms of social practices.

As laws are written in 'universal terms' they offer inadequate guidance for those difficult cases that do not fall neatly under one general rule or another. While Aristotle is clear that written laws are essential to secure justice in a political community, he is quick to recognize that alone they are insufficient to achieve this aim. Bridging the gap between legal principle and concrete situation is Aristotle's concept of epieikeia: that virtue which 'corrects' the law where it falls short. Through (...) an acute attentiveness to relevant mitigating factors, epieikeia allows the judge to discern what -- beyond rigid application the law -- a just decision entails. However, though triggered by and tied to particular circumstances, epieikeia does not sanction egregious deviation from established law. This is because it serves the ends of 'universal', or 'natural' justice and so is guided, and therefore constrained by its fixed and unchanging principles. In conclusion, this article explores the normative repercussions of incorporating epieikeia into legal decisions, specifically how it might work to transform justice into a virtue which promotes mercy, kindness, and forgiveness. The history of brushtail possums in New Zealand is bleak. The colonists who forcibly transported possums from their native Australia to New Zealand in the nineteenth century valued them as economic assets, quickly establishing a profitable fur industry. Over the past 80 or so years, however, New Zealand has increasingly scapegoated possums for the unanticipated negative impact their presence has had on the native environment and wildlife. Now this marsupial—blamed and despised—suffers the most miserable of reputations and is extensively targeted (...) as the nation's number one pest. This paper examines anti-possum rhetoric in New Zealand, identifying the operation of several distinct—yet related—discourses negatively situating the possum as an unwanted foreign invader and a threat to what makes New Zealand unique; the subject of revenge and punishment ; and recognizably “cute, but...” merely a pest and therefore unworthy of compassion. This paper argues that the demonization of possums in New Zealand is overdetermined, extreme, and unhelpfully entangled in notions of patriotism and nationalism. (shrink)
