Ethical Dilemmas Related to the HIV-Positive Person in the Workplace.Annatjie Botes & Marianne Otto - 2003 - Nursing Ethics 10 (3):281-294.
This study’s objectives were: (1) to describe and explore the ethical dilemmas surrounding the HIV-positive person in the workplace in South Africa; and (2) to describe the Rational Interaction for Moral Sensitivity (RIMS) approach as a possible mechanism for solving these ethical dilemmas. A qualitative, exploratory and descriptive research design was used. The target populations were HIV-positive employees and occupational health nurses working for a South African company. Data collected through individual HIV-positive employee interviews and occupational health nurse workgroups were (...)

South Africa’s new standard material transfer agreement: proposals for improvement and pointers for implementation.Donrich W. Thaldar, Marietjie Botes & Annelize Nienaber - 2020 - BMC Medical Ethics 21 (1):1-13.
BackgroundWhenever South African research institutions share human biological material and associated data for health research or clinical trials they are legally compelled to have a material transfer agreement in place that uses as framework the standard MTA newly gazetted by the South African Minister of Health.Main bodyThe article offers a legal analysis of the SA MTA and focuses on its substantive fit with the broader legal environment in South Africa, and the clarity and practicality of its terms. The following problematic (...)

Beyond Neural Coding? Lessons from Perceptual Control Theory.Xerxes D. Arsiwalla, Ruben Moreno Bote & Paul Verschure - 2019 - Behavioral and Brain Sciences 42.
Pointing to similarities between challenges encountered in today's neural coding and twentieth-century behaviorism, we draw attention to lessons learned from resolving the latter. In particular, Perceptual Control Theory posits behavior as a closed-loop control process with immediate and teleological causes. With two examples, we illustrate how these ideas may also address challenges facing current neural coding paradigms.

You Say Social Agenda, I Say My Job: Navigating Moral Ambiguities by Frontline Workers in a Social Enterprise.Rose Bote, Tao Wang & Corine Genet - forthcoming - Journal of Business Ethics:1-17.
Building on the emerging literature on the ethics of social enterprises (SEs), this paper advances the underexplored role of frontline workers (FLWs) as embedded agents at the interface between communities and SEs. Specifically, we uncover the subjectivity of FLWs as they navigate moral ambiguities while performing their professional roles, dealing with rules and regulations within the organizational hierarchy and living as members of local communities. Based on an inductive case study of a microfinance organization in Cameroon, we find that FLWs (...)

Bridging the regulatory gaps created by Smart and Connected technologies in South Africa.M. Botes & B. Townsend - 2023 - South African Journal of Bioethics and Law 16 (2):36.
The prevalence of technology-embedded products, services, and cities, described colloquially as ‘smart’ technologies and ‘smart’ cities, has seen a spate of unprecedented growth in recent years. South Africa (SA) has not been left behind, with smartphones, smart watches, and smart voice-controlled virtual personal assistants such as Amazon’s Alexa now frequently used. But while these technologies hold great promise to revolutionise homes, offices and cities, their adoption poses challenges to individual and collective interests and wellbeing. After demonstrating the legal and ethical (...)

Catch-22: A patient’s right to informational determination and the rendering of accounts by medical schemes.M. Botes & E. A. Obasa - 2023 - South African Journal of Bioethics and Law 16 (2):67.
Many people who have reached the age of majority still qualify as financial dependents of their parents, and may be registered as dependents on their parents’ medical schemes. This poses a practical conundrum, because major persons enjoy complete autonomy over their bodies to choose healthcare services as they please, including informational determination. However, their sensitive health information may end up being disclosed in the accounts rendered to their parents, as main members of medical schemes, thereby breaching their informational privacy, medical (...)

Collective responsibility during a cholera outbreak: The case of Hammanskraal.A. E. Obasa, M. Botes & A. C. Palk - 2023 - South African Journal of Bioethics and Law 16 (3):99-104.
The transmission of cholera, a highly infectious disease, is closely linked to inadequate access to clean water and sanitation facilities, with resource-poor communities, including refugees, rural communities and temporary displacement camps particularly vulnerable to outbreaks. Any disruption in water and sanitation systems or a sudden surge in community size owing to displacement can spark a humanitarian and health crisis, elevating the risk of cholera transmission and possibly triggering a regional epidemic. Recently, Hammanskraal in Gauteng, South Africa, experienced such an epidemic. (...)

Involuntary admission and treatment of mentally ill patients – the role and accountability of mental health review boards.M. Botes - 2021 - South African Journal of Bioethics and Law 14 (3):93-96.
No known cure exists for COVID-19, and medical practitioners are exhausted and at their wits’ end trying to find treatments that prevent patients from ending up in hospital or intensive care, or even dying. A variety of treatments tried by medical practitioners include standard registered medicine, investigational or so-called experimental, unapproved or preapproved medicines, emergency or compassionate-use authorised medicine and pre-market approved medicine. However, the medicines that can be accessed via each of these categories are at different stages of efficacy (...)

The ethical challenges of teaching business ethics: ethical sensemaking through the Goffmanian lens.Taran Patel, Rose Bote & Jovana Stanisljevic - 2023 - Journal of Business Ethics 190 (1):23-40.
Business ethics (BE) professors play a crucial role in sensitizing business students toward their future ethical responsibilities. Yet, there are few papers exploring the ethical challenges these professors themselves face while teaching BE. In this qualitative paper, we rely on the lenses of ethical sensemaking and dramaturgical performance, and draw from 29 semi-structured interview conducted with BE professors from various countries and field notes from 17 h of observation of BE classes. We identify four kinds of rationalities that professors rely (...)

Towards a data transfer agreement for the South African research community: The empowerment approach.L. Swales, M. Botes, D. Donnelly & D. Thaldar - 2023 - South African Journal of Bioethics and Law 16 (1):13-18.
The idea of a data transfer agreement (DTA) template for the South African (SA) research community is receiving increasing attention. Whiledeveloping such a DTA template is certainly a worthwhile project, questions regarding the project’s practical execution should be addressed, including how to best operationalise the envisioned DTA template, and the content of the envisioned DTA template. It is proposed that anempowerment approach be followed in operationalising the envisioned DTA template, which is contrasted with the regulatory approachfollowed with the material transfer agreement (...)

Thaldar, Beverley Townsend & Marietjie Botes - 2022 - Journal of Medical Ethics 48 (3):165-168.
WHO in 2019 established the Advisory Committee on Developing Global Standards for Governance and Oversight of Human Genome Editing, which has recently published a Draft Governance Framework on Human Genome Editing. Although the Draft Framework is a good point of departure, there are four areas of concern: first, it does not sufficiently address issues related to establishing safety and efficacy. Second, issues that are a source of tension between global standard setting and state sovereignty need to be addressed in a (...)

    (Ex)poniendo el cuerpo: espacios, transiciones y resistencias.Hernando Carlos Gómez Prada, Agustina Varela-Manograsso & Marcos Alonso Bote Díaz - 2022 - Recerca.Revista de Pensament I Anàlisi 27 (1).
Transition experienced by trans people shakes Social Sciences conven-tional understanding of time and space as static analytical units based on tradi-tional biological and physical axioms. Overcoming sexual binarism entails also questioning time and space as isolated elements to become, instead, entangled realities. Departing from trans studies and Halberstam´s concepts of queer temporalities and space as theoretical framework, this papers lines up the indi-vidual story of a trans man with physical disability and ASD with social “trans-formations”, by linking the exposition of (...)

Posture Recognition and Behavior Tracking in Swimming Motion Images under Computer Machine Vision.Zheng Zhang, Cong Huang, Fei Zhong, Bote Qi & Binghong Gao - 2021 - Complexity 2021:1-9.
This study is to explore the gesture recognition and behavior tracking in swimming motion images under computer machine vision and to expand the application of moving target detection and tracking algorithms based on computer machine vision in this field. The objectives are realized by moving target detection and tracking, Gaussian mixture model, optimized correlation filtering algorithm, and Camshift tracking algorithm. Firstly, the Gaussian algorithm is introduced into target tracking and detection to reduce the filtering loss and make the acquired motion (...)

The German phenomenologist Max Scheler, commonly considered one of the most important exponents of value objectivism, does not claim an “absolute” value objectivism, as often asserted. The values are objecttive towards the will of the subject, not towards the creative act of loving. This presupposes a radical new conception of the value. According to Scheler, in fact, the values are no qualities to be attributed to the perceived object but the very first thing grasped on a phenomenon, i.e. the “first (...)

In this article the author focuses mainly in the last part of Ronald Dworkin´s Justice for Hedgehogs and in his argument for a partnership conception of democracy. For that purpose, first, he recalls some of the main features that Dworkin had advanced in previous but intrinsically related works, about political morality, equality and democracy; second, he reassess the arguments for a partnership conception of democracy; third, he reconsiders the resistance produced by Jeremy Waldron in his “A Majority in the Lifeboat” (...)

This study seeks to understand a diaspora community narrative of rape and abduction suffered during the genocidal massacre of 1915 in the Ottoman Empire and its aftermath. Based on interviews with 50 Aramean, Assyrian and Chaldean migrants in Sweden, Germany and the Netherlands, whose families are from the village of Bote, known as one of the ‘killing fields’ in southeast Turkey, the article explores the ways in which descendants remember the ‘forgotten genocide’ of Aramean, Assyrian and Chaldean communities in 1915.
