Este artículo se centra en The Law of Peoples (1999), libro con el que John Rawls cierra el tríptico de su concepción socio-democrática de la justicia dentro de la tradición liberal, iniciada a principios de la década de los ‘70 con A Theory of Justice (1971), donde describe la justicia como equidad como un ideal moral universal al que deben aspirar todas las sociedades, y continuada dos décadas más tarde con Political Liberalism (1993), obra en la que el pensador estadounidense (...) abunda en su idea de extender una concepción política de la justicia al Derecho de los pueblos y a su función reguladora de las relaciones justas entre los pueblos. De cualquier modo, pese a que Rawls admite expresamente la ascendencia que tienen sobre su idea de justicia el contractualismo y el iusnaturalismo kantianos, así como la influencia que ejerce sobre su estudio dedicado al Derecho de gentes la doctrina universalista e iusirenista del Derecho internacional público, veremos hasta qué punto satisfizo o defraudó Rawls con su visión pluralista del orden mundial las expectativas de quienes esperaban que hiciera una defensa firme de la justicia universal y de la democracia cosmopolita. El objetivo de este artículo es introducir, interpretar y defender la originalidad de la «primera mitad» de la fundamentación racional de la ética de Francisco Miró Quesada Cantuarias. Para ello, nos enfocaremos en sus tres primeros trabajos éticos —«El Intelectual, el Occidente y la Política», «Sobre el Derecho Justo» y «Ser Humano Naturaleza, Historia» — dejando sus escritos posteriores para un trabajo complementario. Mostraremos cómo Miró Quesada intenta refinar la filosofía moral de Immanuel Kant, superando su posible mayor defecto (...) —aquí llamado materialismo encubierto— y repensando el principio moral supremo, al que llama no arbitrariedad. Evaluaremos también su tesis de que el principio de no arbitrariedad es la condición necesaria de la ética y su invitación a renunciar a buscar su condición suficiente. En el camino, resaltaremos la originalidad de la propuesta de Miró Quesada. Finalmente, adelantaremos la tesis central de sus textos éticos posteriores y plantearemos breves preguntas que su teoría moral requiere responder. (shrink)

Este artículo propone estudiar la relación que hay entre filosofía y literatura para Deleuze y Guattari. La tesis de central muestra que se debe captar el diferencial justo donde ambas, filosofía y literatura están conectadas, a saber, en el acontecimiento. Por el tratamiento que cada una tiene del acontecimiento, resulta que ambas posibilitan, a su modo, nuevos cambios en la vida de los humanos. En la primera parte se expone la concepción del arte y de la filosofía, a partir (...) del bloque de sensación y del concepto. En la segunda parte, se expone la particularidad de la creación literaria respecto del lenguaje, la escritura, el sentido y el acontecimiento. En la tercera sección se precisa que la línea de fuga completa, en términos temporales, el acontecimiento en la literatura. La cuarta y última parte presenta el diferencial entre filosofía y literatura, para mostrar los derroteros hacia la relación con la filosofía política. (shrink)

The goal of this article is to introduce, interpret, and defend the originality of the «first half» of the rational foundation of ethics of Francisco Miró Quesada Cantuarias (Lima 1918-2019). To do so, we will focus on his three first ethical works —«El Intelectual, el Occidente y la Política» (1965), «Sobre el Derecho Justo» (1976) y «Ser Humano Naturaleza, Historia» (1987)—, leaving his later works aside for a complementary work. We will show how Miró Quesada tries to refine Immanuel (...) Kant’s moral philosophy, overcoming its possible main flaw —here called disguised materialism— and rethinking the supreme moral principle, which he calls non-arbitrariness. We will also evaluate both his thesis that the principle of non-arbitrariness is the necessary condition of ethics and his invitation to renounce looking for its sufficient condition. On the way, we will highlight the originality of Miró Quesada’s proposal. Finally, we will advance the central thesis of his later ethical works and posit brief questions that his moral theory needs to answer. (shrink)

The Black community has a long, well-documented history of being disproportionately harassed by law enforcement. While psychological research has studied this phenomenon, more in-depth research on Black men’s lived-experience of police harassment is needed. This qualitative study used descriptive phenomenology to investigate Black men’s experience of being harassed by law enforcement officers. An analysis of non-structured interviews with a sample of four participants revealed several essential aspects of this experience, including: anxiety in response to the initial awareness of law enforcement’s (...) presence, fear and confusion in response to abrupt escalation of aggression and hostility by officers, a sense of humiliation in response to degrading police tactics, anger over inability to pursue redress through the justice system, ongoing negative emotion, and a sense of having been psychologically harmed by the harassment. This Element outlines the environments of loving in contemporary technoculture and explains the changes in the manner of feelings in technologically mediated relationships. Synchronic and retrospective in its approach, this Element defines affection in the reality marked by the material and affective 'intangibility' that has emerged from the rise of digitalism and technological advancement. Analysing the constructions of intimacy, it describes our sensual and somatic experiences in conditions where the human body, believed to be extending itself by means of the (...) media and technological devices, is in fact the extension of the media and their technologies. It is a study that outlines shifts and continuums in the 'practices of togetherness' and which critically rereads late modern paradigms of emotional and affective experiences, filling a gap in the existing critical approaches to technological and technologized love. Shared intention normally leads to joint action. It does this, it is commonly said, only because it is a characteristically stable phenomenon, a phenomenon that tends to persist from the time it is formed until the time it is fulfilled. However, the issue of what the stability of shared intention comes down to remains largely undertheorized. My aim in this paper is to remedy this shortcoming. I argue that shared intention is a source of moral and epistemic reasons, that responsiveness (...) to such reasons on the part of each individual reinforces her own relevant attitudes, and that this enhances the stability of the shared intention as a whole. We thus discover an important self-reinforcing and stability-enhancing mechanism at the heart of shared intention and action. It follows from this proposal that the psychological commitment that an individual exhibits in joint action is normally a function not only of her own participatory intention, as often maintained, but also of her endorsement of the reasons created by her group’s shared intention to so act. BackgroundPsychotherapy interventions increasingly utilize digital technologies to improve access to therapy and its acceptability. Opportunities that digital technology potentially creates for art therapy reach beyond increased access to include new possibilities of adaptation and extension of therapy tool box. Given growing interest in practice and research in this area, it is important to investigate how art therapists engage with digital technology or how practice might be safely adapted to include new potential modes of delivery and new arts media.MethodsAn integrative review (...) of peer-reviewed literature on the use of digital technology in art therapy was conducted. The methodology used is particularly well suited for early stage exploratory inquiries, allowing for close examination of papers from a variety of methodological paradigms. Only studies that presented empirical outcomes were included in the formal analysis.FindingsOver 400 records were screened and 12 studies were included in the synthesis, pertaining to both the use of digital technology for remote delivery and as a medium for art making. Included studies, adopting predominantly qualitative and mixed methods, are grouped according to their focus on: art therapists’ views and experiences, online/distance art therapy, and the use of digital arts media. Recurring themes are discussed, including potential benefits and risks of incorporating digital technology in sessions with clients, concerns relating to ethics, resistance toward digital arts media, technological limitations and implications for therapeutic relationship and therapy process. Propositions for best practice and technological innovations that could make some of the challenges redundant are also reviewed. Future directions in research are indicated and cautious openness is recommended in both research and practice.ConclusionThe review documents growing research illustrating increased use of digital technology by art therapists for both online delivery and digital art making. Potentially immense opportunities that technology brings for art therapy should be considered alongside limitations and challenges of clinical, pragmatic and ethical nature. The review aims to invite conversations and further research to explore ways in which technology could increase relevance and reach of art therapy without compromising clients’ safety and key principles of the profession. Substantial evidence indicates that cognitive training can be efficacious for older adults, but findings regarding training-related brain plasticity have been mixed and vary depending on the imaging modality. Recent years have seen a growth in recognition of the importance of large-scale brain networks on cognition. In particular, task-induced deactivation within the default mode network is thought to facilitate externally directed cognition, while aging-related decrements in this neural process are related to reduced cognitive performance. It is not yet clear whether task-induced (...) deactivation within the DMN can be enhanced by cognitive training in the elderly. We previously reported durable cognitive improvements in a sample of healthy older adults who completed 6 weeks of process-based object-location memory training compared to an active control training group. The primary aim of the current study is to evaluate whether these cognitive gains are accompanied by training-related changes in task-related DMN deactivation. Given the evidence for heterogeneity of the DMN, we examine task-related activation/deactivation within two separate DMN branches, a ventral branch related to episodic memory and a dorsal branch more closely resembling the canonical DMN. Participants underwent functional magnetic resonance imaging while performing an untrained object-location memory task at four time points before, during, and after the training period. Task-induced activation values were extracted for the ventral and dorsal DMN branches at each time point. Relative to visual fixation baseline: the dorsal DMN was deactivated during the scanner task, while the ventral DMN was activated; the object-location memory training group exhibited an increase in dorsal DMN deactivation relative to the active control group over the course of training and follow-up; changes in dorsal DMN deactivation did not correlate with task improvement. These results indicate a training-related enhancement of task-induced deactivation of the dorsal DMN, although the specificity of this improvement to the cognitive task performed in the scanner is not clear. Kierkegaard and the Challenges of Infinitude brings together a number of essays culminating the scientific events held during the duration of a project devoted to the translation and study of works by Søren Kierkegaard, which has been sponsored by the Fundação para a Ciência e a Tecnologia (PTDC/FIL/FIL/100.281/2008). The essays reunited here had their first versions delivered at an International Conference held in October 25-26th, 2012, under the auspices of the Centro de Filosofia da Universidade de Lisboa (Philosophy Centre of (...) the University of Lisbon, CFUL) and hosted by the Faculdade de Letras da Universidade de Lisboa (Faculty of Letters of the University of Lisbon). The conference was commissioned by José Miranda Justo and Eisabete M. de Sousa, who also co-edited the present volume, together with rené Rosfort, who was the recipient of a grant as resident scholar in the Kierkegaard project during the three last months of 2012. How do modal expressions determine which possibilities they range over? According to the Modal Anchor Hypothesis (Kratzer in _The language-cognition interface: Actes du 19_ _e_ _congrès international des linguistes_, Libraire Droz, Genève, 179–199, 2013 ), modal expressions determine their domain of quantification from particulars (events, situations, or individuals). This paper presents novel evidence for this hypothesis, focusing on a class of Spanish relative clauses that host verbs inflected in the subjunctive. Subjunctive in Romance is standardly taken to be licensed only (...) in a subset of intensional contexts. However, in our relative clauses, subjunctive is exceptionally licensed in extensional contexts. At the same time, the interpretation of these relative clauses still involves modality, a type of modality that targets the goals of the agent of the main event. We argue that the pattern displayed by these relative clauses follows straightforwardly if subjunctive is associated with a modal operator that, like modal indefinites (Alonso-Ovalle and Menéndez-Benito in _Journal of Semantics_ 35(1):1–41, 2017 ), can project its domain from a volitional event. Overall, our proposal supports the event-based analysis of mood (Kratzer in Evidential mood in attitude and speech reports. The COVID-19 crisis illustrates the fragility of supply chains. Countries with excellent health systems struggled to ensure essential supplies of food, medicines, and personal protective equipment which were vital to a fast and effective response. Using geo-legality, which maps the constitutive relations between law and space, we argue that the failure of supply chains in many western countries during the crisis reveals a fundamental tension between their role as facilitators of care and caring, and the logistic logics by which they (...) operate. While supply chains link the intimate, domestic concerns of providing medical care with the globalised geographical concerns of moving goods across different jurisdictions at the right time, their contemporary organisation and regulation does not reflect the caring relations and public goods they are meant to support. Drawing on analysis of examples from Canada, the United Kingdom, and the United States, this article argues that a reconfiguration of supply chains in accordance with feminist approaches that place care at the centre of supply chain operation and organisation will be important to amendments of both domestic and global health law. Counterfactual definiteness is supposed to underlie the Bell theorem. An old controversy exists among those who reject the theorem implications by rejecting counterfactual definiteness and those who claim that, since it is a direct consequence of locality, it cannot be independently rejected. We propose a different approach for solving this contentious issue by realizing that counterfactual definiteness is an unnecessary and inconsistent assumption. Counterfactual definiteness is not equivalent to realism or determinism neither it follows from locality. It merely reduces to (...) an incongruent application of counterfactual reasoning. Being incompatible with falsifiability, it constitutes an unjustified assumption that goes against the scientific method rigor. Correct formulations of the Bell theorem’s bases show it is absent either as a fundamental hypothesis or as a consequence of something else. Most importantly, we present a coherent Bell inequality derivation carefully devised to show explicitly and convincingly the absence of incompatible experiments or counterfactual reasoning. Thus, even admitting that counterfactual definiteness could be a consistent assumption, the necessary conclusion is that it is irrelevant for the inequality formulation and can be safely ignored when discussing Bell’s inequality philosophical and physical implications. We present a pragmatic analysis of the different meanings assigned to the term “local realism” in the context of the empirical violations of Bell-type inequalities since its inception in the late 1970s. We point out that most of them are inappropriate and arise from a deeply ingrained prejudice that originated in the celebrated 1935 paper by Einstein-Podolski-Rosen. We highlight the correct connotation that arises once we discard unnecessary metaphysics.

Le travail mené par Jonathan Israel dans sa trilogie sur les Lumières aurait fourni des éléments pour une critique de la théologie comme fondement de la politique moderne et, de ce fait, il nous aurait offert une critique indirecte à l’œuvre de Carl Schmitt. Schmitt et Israel souscrivent à l’analyse des idées majeures que Spinoza hérite de la modernité. En revanche, ils ne s’entendent pas sur l’appréciation de cette contribution ni sur le sens qu’il faut donner à cet héritage. Tandis (...) que Spinoza s’avère être l’ennemi par excellence pour Schmitt – juif, libéral et paradigmatique −, il représente pour Israel le pilier du républicanisme démocratique; alors que pour le premier le pêché originel implique l’acceptation d’une anthropologie modérément pessimiste qui fondait la nécessité de l’État, le second assure que le perfectionnement humain et l’idée de progrès sont possibles ; tandis que Schmitt justifie l’existence de la guerre et du concept de katechon en tant que piliers politiques, pour Israel la tolérance universelle d’origine baylienne se pose comme alternative ; si Schmitt considère que le dialogue et le débat constituent de simples distractions bourgeoises qui empêchent de distinguer la véritable nature de la souveraineté – la décision dans un état d’urgence –, Israel estime quant à lui que la dialogue rationnel et philosophique qui suppose la revendication de la liberté de philosopher est la seule forme acceptable pour concevoir des normes morales et politiques ; si le juriste allemand attribue à la théologie catholique l’origine de tout concept politique – au sens historique et systématique –, pour l’historien anglais c’est plutôt dans la philosophie rationnelle matérialiste énoncée par les acteurs des Lumières radicales qu’il faudrait chercher les fondements de la doctrine politique occidentale républicaine et démocratique. La reconstrucción de lo común se ha convertido en el tema de nuestro tiempo. Las llamadas a la regeneración empiezan a ser escuchadas y encuentran respuesta en la filosofía, que se ve emplazada como en otros momentos a problematizar las categorías en curso, sometiéndolas a escrutinio ontológico, epistemológico, político… Pero siendo hoy, quizá, más sensibles, desde el pensamiento crítico, a la ambigüedad inherente a cualquier proyecto comunitario, a la vinculación de lo común y lo coercitivo, la reciprocidad y la dependencia, (...) lo emancipatorio y la violencia. De ahí la dificultad y necesidad de mirar hacia el afuera del excluido, como horizonte para una reconstrucción inacabable de lo común. Este libro aspira a poner de manifiesto la multiplicidad y complejidad con que dichas demanda afectan al pensar de nuestro tiempo. (shrink)

In the last few decades, the study of terminology has undergone a cognitive shift that has led to the development of several approaches that study the social, linguistic, and cognitive dimension of terms, such as Communicative Theory of Terminology (CTT) and Frame-Based Terminology (FBT). CTT was developed in the early 1990s and argues that the study of terminology should be based on a communicative perspective, taking into account aspects such as the communicators and the context of communication. FBT has been (...) developed from 2007 and uses certain aspects of Frame Semantics to conceptualise specialised domains and create non-language-specific representations through the analysis of the domain event and on the study of the behaviour of the terminological units in texts. The two theories share many of the same premises and propose the representation of the concepts of a domain in an ontology. FBT also proposes a representation in frames. We explore how these two methods of domain representation can be used to represent the terminology of the domain of seafood in Germany and Spain. (shrink)

A discussion of Nieuwenhuizen’s description for the hidden variables of the detectors in the derivation of Bell’s theorem is presented. This description prevents Bell’s inequalities from being effected. However it will be argued, on mathematical and physical bases, that the flaws attributed by Nieuwenhuizen to Bell’s probability distribution function are unjustified.

A common mistake present in the derivation of the usually known as the CHSH form of Bell’s inequalities is pointed out. References and comments to the correct approach are given. This error does not alter the final result and only affects the logical consistency of the derivation, but since it seems to be a widespread misconception regarding the roll and interpretation of the of use of hidden variables in Bell’s theorem it is considered to be of general interest.
