BackgroundAlthough the Covid-19 epidemic challenged existing medical care norms and practices, it was no excuse for unlawful conduct. On the contrary, legal compliance proved essential in fighting the pandemic. Within the European legal framework for the pandemic, patients were still entitled to be treated equally, by a specialized physician, with the possibility of seeking a second medical opinion, in a confidential setting, following prior and informed consent. This study examines physicians’ practices regarding patients’ rights during the Covid-19 pandemic and the (...) effects of age, experience, and specialty on physicians’ behavior and preferences. Additionally, it explores the nexus of malpractice complaints, malpractice fear, and legal compliance.MethodsA cross-sectional study was conducted on a convenience sample of attending physicians and general practitioners to assess compliance with patients’ rights regulations. Respondents were physicians practicing in private and public settings in Southwestern Romania from July 2021 to May 2022.Results396 attending physicians and 109 general practitioners participated in the research. Attending physicians acknowledged patients’ rights in 55.7% of statements, while general practitioners showed a slightly higher level of compliance at 59.9%. Emergency and Anesthesia and Intensive Care physicians showed the lowest compliance. There were no significant behavioral differences based on physicians’ age, years in practice, work sector, or location. However, when faced with the question of prioritizing treatment for patients with similar medical conditions, 46.2% of attending physicians reported favoring the younger patients. This preference was common among physicians under 39. Additionally, over half of the attending physicians reported working outside their area of expertise due to staff shortages. Malpractice fear was high among physicians, although unrelated to patients’ claims, legal compliance, or working outside the scope of practice. It resulted in pressure and behavioral changes.ConclusionAdherence to patients’ rights was low during the Covid-19 pandemic. Physicians could benefit from educational and administrative support to ensure better legal compliance. Further research is needed to determine if this behavior persists beyond the pandemic context. Violence is a known risk factor for health problems. In this epidemiological study across 5,385 male patients, we investigate the prevalence of perpetrated violence, exposure to violence, their overlap and the relationship between violence, mental, and psychosomatic health, as well as adverse health behaviors, such as self-harming behavior and the consumption of drugs. Participants completed an anonymous questionnaire addressing violence experience, age of victimization/perpetration, frequency, and perceived severity of violence exposure. We considered physical, psychological as well as sexual violence. Information (...) on health status and adverse health behaviors complemented the data. Results showed that 48.4% of the sample reported having experienced violence. The victim-perpetrator overlap formed the largest group, in which the incidence of having experienced multiple types of violence was significantly higher compared to victims and perpetrators. The age-crime curve flattened more slowly with increasing age in this group. Although the perceived severity of exposure to violence is lower in the overlap group, its health status and adverse health behaviors were worse. Interventions should focus on this group since they constitute a burden for the healthcare system. (shrink)

Are there any prima facie reasons that democracies might have for disenfranchising older citizens? This question reflects increasingly salient, but often incompletely theorized complaints that members of democratic publics advance about older citizens’ electoral influence. Rather than rejecting these complaints out of hand, we explore whether, suitably reconstructed, they withstand democratic scrutiny. More specifically, we examine whether the account of political equality that seems to most fittingly capture the logic of these complaints – namely, equal opportunity of political influence over (...) electoral outcomes – can justify disenfranchising older citizens. We conclude that equal opportunity of influence cannot ground a blanket disenfranchisement of older people and that, taken in conjunction with other general considerations that apply to all sound electoral policies, partial disenfranchisement proposals (i.e. proposals for reducing the electoral influence of older citizens via age-weighted voting) are both quasi-inapplicable and practically unrobust across a relevant range of political contexts. The goal of this paper is to present a collection of properties of the set of atoms and the set of finite injective tuples of atoms, as well as of the powersets of atoms in the framework of finitely supported structures. Some properties of atoms are obtained by translating classical Zermelo–Fraenkel results into the new framework, but several important properties are specific to finitely supported structures.

The goal of this paper is to define and study the notion of infinity in the framework of finitely supported structures, presenting new properties of infinite cardinalities. Some of these properties are extended from the non-atomic Zermelo–Fraenkel set theory to the world of atomic objects with finite support, while other properties are specific to finitely supported structures. We compare alternative definitions for infinity in the world of finitely supported sets, and provide relevant examples of atomic sets which satisfy some forms (...) of infinity, while do not satisfy others. Background Only a few studies have been conducted to assess physicians’ knowledge of legal standards. Nevertheless, prior research has demonstrated a dearth of medical law knowledge. Our study explored physicians’ awareness of legal provisions concerning informed consent and confidentiality, which are essential components of the physician-patient relationship of trust. -/- Methods A cross-sectional study assessed attending physicians’ legal knowledge of informed consent and confidentiality regulations. The study was conducted in nine hospitals in Dolj County, Romania. Physicians were given a questionnaire (...) with ten scenarios and instructed to select the response that best reflected their practice. We assessed the responses of physicians who claimed their practice to be entirely legal. Their legal knowledge was evaluated by comparing their answers to applicable laws. We also calculated a score for the physicians who admitted to committing a legal breach. -/- Results Of the 305 respondents, 275 declared they never committed any law violation. However, their median correct answer score was 5.35 ± 1.66 out of 10. The specialty was the strongest predictor of legal knowledge, with emergency physicians rating the lowest and non-surgical physicians scoring the highest. Physicians who worked in both private and public sectors were better knowledgeable about legal issues than those who worked exclusively in the public sector. Results indicate that physicians are aware of the patient’s right to informed consent but lack comprehensive understanding. While most physicians correctly answered simple questions, only a tiny minority identified the correct solution when confronted with ethical dilemmas. The physicians who acknowledged breaching the law, on the other hand, had a slightly higher knowledge score at 5.45 ± 2.18. -/- Conclusion Legal compliance remains relatively low due to insufficient legal awareness. Physicians display limited awareness of legal requirements governing patient autonomy, confidentiality, and access to health data. Law should be taught in all medical schools, including undergraduate programs, to increase physicians’ legal knowledge and compliance. (shrink)

In an increasingly urbanized world, construction industry is called upon to serve the needs of human society, such as environmental protection and safety in terms of infrastructure. In this context, a sustainable and ethical development means a close connection between buildings and environment. This connection can be achieved through, for example, the concept of ecological concrete or green concrete, as it is often called. The conventional process of obtaining cement and mineral aggregates from the concrete composition generates pollution, especially through (...) greenhouse gas emissions. Also, one should not ignore the fact that extraction of the raw materials affects the habitats of the sites and of the neighboring areas. When construction materials are questioned, the ethical issues lay not in the means of expression, but mainly in the means of production. More to the point, the present contribution aimed to find solutions for enhancing the adhesion of vegetal aggregates with the cement matrix, in order to obtain a material with optimal mechanical properties, which is valued as an ethical approach of building industry. Results showed that plant aggregates can be used to obtain a building material which can be improved by using partial substitution of cement by silica fume, fly ash, or by using additives and that green concrete as an environmentally friendly material offers the alternative for lower energy use and fewer CO2 emissions. Marketers must understand not only the advantages of these green materials, but also that they have an ethical commitment to provide consumers with environmentally friendly materials. (shrink)

The paper presents the role of the experience of historical transformation in the modifications of the historical conscience: the fragmentation, the marginality and the removal from the rational foundation of values. It associates the postmodern world with different forms of losing the sense of values, the lack of measure and nuance in appreciation, the weak preoccupation for identity, authenticity, conscience of values in human behavior. Bloomsbury, 2021. 376pp.Far from “mourning” the demise of theory, this timely and thoughtfully curated essay collection testifies to its “renewed vitality,” (...) its compelling presence “across fields, domains of life, and geocultural boundaries,” and its power to build an ever-expanding world community of practioners who are forming what has come to be known as a “theory commons” (ix). As the collection’s editors point out, theory’s new lease on life hinges on ensuring both the democratic workings of this “world discourse formation” (1) and on the responsible theorizing of the very notion of community in “a world threatened by all kinds of anti-communal actions and reactions, from runaway globalization to exacerbated tribalism and tunnel-vision politics” (x). Working on the margins, specifically, out of a Romanian “lab” called The Critical Theory Institute (CTI), which opened its doors in early 2000, the contributors seek to revise the “standard history of theory,” one whose “Western origins, authority, and cultural compass ” strike them as “exceedingly reductive” (3). This project of geotheoretical repositioning and recalibration aims to recast theory as a “quintessentially cross-linguistic, cross-cultural, trans- and intercontinental undertaking” (4). As such, it carries on the project, launched in a previous volume, Romanian Literature as World Literature (2018), of fashioning an alternative to the nation-state paradigm that has long shaped literary and intellectual histories. In both of these works, Romanian critics and theorists have tuned into a wide range of voices, and tapped into a shared conceptual and methodological apparatus—itself the product of “an ethno-linguistic medley of traditions” (8). This approach informs what editors see as the “epoch-making” (17) discursive paradigm that has taken shape in globally networked post-Cold War societies (17), a viral model of cultural influence that fosters an ontology of “contact, contagion, of infection, dissemination, and horizontal accumulation” (15).To give us a sense of theory’s complex genealogy and evolution, the editors reference the Bulgarian critic Galin Tihanov, who has attributed [End Page 122] important developments in contemporary theory to the achievements of theorists (Nikolai Trubetskoi, Roman Jakobson, Vladimir Propp, and Georg Lukács) and schools of thought (Russian Formalism and the Prague Linguistic Circle). Migration generates well-being for individuals and communities, but the pursuit of well-being is not without risks. Tens of thousands of Romanian children are affected by the migration of their parents, others have to cope with the effects of their own migration. Should migrants have difficulties adjusting when returning “home”? Is readjustment even possible for all remigrants, without support? The article aims to present some issues that the remigrants are confronted with when trying to readjust to their communities of origin. According to traditional Judeo-Christian-Islamic theism, God is an omniscient, omnipotent, and morally perfect agent. This volume shows that philosophy of religion needs to take seriously alternative concepts of the divine, and demonstrates the considerable philosophical interest that they hold.

I. Science, myth, magic: three components of knowledge, in other words three types of activity in man who, in interaction with his surrounding environment seeks to accomodate himself to the constraints which this environment imposes on him while at the same time seeing to his own immediate or far-reaching needs.

In the wake of the considerable cultural changes and social shifts that the United States and all advanced industrial democracies have experienced since the late 1960s and early 1970s, social discourse around the disempowered has changed in demonstrable ways. In From Property to Family: American Dog Rescue and the Discourse of Compassion, Andrei Markovits and Katherine Crosby describe a “discourse of compassion” that actually alters the way we treat persons and ideas once scorned by the social mainstream. This “culture (...) turn” has also affected our treatment of animals inaugurating an accompanying “animal turn”. In the case of dogs, this shift has increasingly transformed the discursive category of the animal from human companion to human family member. One of the new institutions created by this attitudinal and behavioral change towards dogs has been the breed specific canine rescue organization, examples of which have arisen all over the United States beginning in the early 1980s and massively proliferating in the 1990s and subsequent years. While the growing scholarship on the changed dimension of the human-animal relationship attests to its social, political, moral and intellectual salience to our contemporary world, the work presented in Markovits and Crosby’s book constitutes the first academic research on the particularly important institution of breed specific dog rescue. This book provides an original and challenging perspective of religions as abstract complex adaptive systems, using an interdisciplinary approach to try to understand what religions are and how they function, two fundamental issues which, despite an intense struggle from several fields, have not yet been resolved. What is the source of religious belief? How do religions work and what are they made of? Why is religion so important for us that it has survived centuries of scientific progress and secularization? Why (...) are people religious even outside religion? The book addresses these questions using an interdisciplinary approach that seeks to untangle the Gordian knot of defining religion. In short, they can be considered entropy-reducing technologies. What differentiates them from other meaning-producing systems is their configuration which employs specific building blocks as tools for mitigating entropy, which are also subsystems and combine in various ways to build a unique configuration: rituals, myths, taboos, supernatural agents, authority, identity, superstitions, moral obligations, afterlife beliefs and the sacred. As a reaction to perturbances or pressure, systems can collapse. Inspired by Nicholas Nassim Taleb, it is, in this book, referred to as fragility—the negative reaction of systems to random events, and four parameters can be used to evaluate it in religious systems: monotonicity (the inability to learn from past mistakes), coupling (linking with other systems: such as political or economic), centralization and stress starvation. Several case studies are provided in order to test the theoretical claims made in this book, based on the author's field research in Romania, Japan, North Korea and Mongolia, and offering details that could be of interest to casual readers, students and researchers of religion. Built in between the end of the nineteenth century and the beginning of the twentieth century in a mountainous region in Romania, the Peleş Castle and its gardens were conceived according to the mid sixteenth and early seventeenth centuries landscape design principles. Thus, the surrounding landscape, the park and gardens at the royal residence in Sinaia make up an overall image of a Mannerist landscape in which the Villa or, in this case, the castle, is integrated in a complex allegorical, (...) alchemical and political programme. To explore this chronologically incongruent design and to explore gardening principles perhaps invisible in plain sight for modern eyes, the following study aims to emphasize the presence of early modern Western European gardens in the design of the park and gardens at Peleş. This analysis will also reveal the various ways in which, by manipulating nature according to Late Renaissance and Mannerism principles, nature was staged to achieve political goals. (shrink)

In this paper we aim to examine a novel view on distributive justice, i.e. limitarianism, which claims that it is morally impermissible to be rich. Our main goal is to assess the two arguments provided by Ingrid Robeyns in favour of limitarianism, namely the democratic argument and the argument from unmet urgent needs and the two distinct limitarian views which these arguments give rise to. We claim that strong limitarianism, which is supported by the democratic argument, should be rejected as (...) it fails to fully instantiate the value of political equality, while having some other unattractive implications as well. By contrast, we argue that weak limitarianism, which is supported by the argument from unmet urgent needs, should be endorsed, albeit in a qualified version which also takes responsibility constraints into consideration. Digital inequality and digital justice are pressing issues in today's world. This work examines the socio-philosophical aspects of these problems and proposes measures to achieve digital justice. The authors draw attention to the fact that digital inequality can manifest itself in various forms, such as access to information, technology and resources, as well as opportunities to participate in the digital economy. This can lead to increased social inequalities and limited opportunities for the development of individuals and society as a whole. (...) To achieve digital justice, the authors propose a number of measures, such as improving access to digital technologies and resources, ensuring equal opportunities to participate in the digital economy, and protecting consumer rights and data privacy. They also draw attention to the need to promote digital literacy and education so that people can make effective use of digital technologies and resources. The authors also examine digital inequality and digital justice in the context of monopoly and free speech. They point out that some companies that declare their social responsibility may use their monopolistic position in the market to limit freedom of speech and access to information. In this context, the authors suggest strengthening the role of the state in regulating the digital economy and protecting consumer rights. In conclusion, the research is a valuable contribution to the field of research on digital inequality and digital justice. It emphasizes the need to take into account the socio-philosophical dimensions of these issues and suggests measures to achieve digital justice. It also draws attention to the importance of cultural and historical sensitivity in the development of digital policies and resources. (shrink)

This paper raises some concerns about Paul Humphreys’ fusion emergence in general and about his core example of fusion emergence (i.e., covalent bonding) in particular. It argues that the extent to which covalent bonding undermines the idea that our world’s ontology is wholly compositional has been overstated.

Instituţionalizarea Uniunii Europene este cheia de boltă a construcţiei istorice europene. Început în anul 1957, acest proces a lăsat urme adânci în conştiinţa politică europeană. Since Kaplan : 81–98, 1979) first provided a logic for context-sensitive expressions, it has been thought that the only way to construct a logic for indexicals is to restrict it to arguments which take place in a single context— that is, instantaneous arguments, uttered by a single speaker, in a single place, etc. In this paper, I propose a logic which does away with these restrictions, and thus places arguments where they belong, in real world conversations. The central innovation is (...) that validity depends not just on the sentences in the argument, but also on certain abstract relations between contexts. This enrichment of the notion of logical form leads to some seemingly counter-intuitive results: a sequence of sentences may make up a valid argument in one sequence of contexts, and an invalid one in another such sequence. I argue that this is an unavoidable result of context sensitivity in general, and of the nature of indexicals in particular, and that reflection on such examples will lead us to a better understanding of the idea of applying logic to context sensitive expressions, and thus to natural language in general. In this paper I aim to provide a novel account of the Democratic Argument for limitarianism. I first claim that the standard version of this argument is questionable due to its reliance on a problematic central premise, namely that excessive wealth damages democracy because of its detrimental impact on political equality. Subsequently, I relocate the fundamental democratic worry in regard to excessive wealth in the process of backsliding, and more specifically in the relation between excessive wealth and political polarization. I (...) then offer a new account of the Democratic Argument for limitarianism which envisages wealth capping as instrumental for democratic resilience, but I maintain that the argument is not unambiguously successful.
