This paper contributes to debates over algorithmic discrimination with particular attention to structural theories of racism and the problem of “proxy discrimination”—discriminatory effects that arise even when an algorithm has no information about socially sensitive characteristics such as race. Structural theories emphasize the ways that unequal power structures contribute to the subordination of marginalized groups: these theories thus understand racism in ways that go beyond individual choices and bad intentions. Our question is, how should a structural understanding of racism and (...) oppression inform our understanding of algorithmic discrimination and its associated norms? Some responses to the problem of proxy discrimination focus on fairness as a form of “parity,” aiming to equalize metrics between individuals or groups—looking, for example, for equal rates of accurate and inaccurate predictions between one group and another. We argue that from the perspective of structural theories, fairness-as-parity is inapt in the algorithmic context; instead, we should be considering social impact—whether a use of an algorithm perpetuates or mitigates existing social stratification. Our contribution thus offers a new understanding of what algorithmic racial discrimination is. (shrink)

This paper investigates necessary conditions for developing a participatory, rightsholder-driven approach to remedy for business-related human rights abuses by analyzing findings from a case study with the Fair Food Program. With the inclusion of human rights into discussions of business ethics and CSR, scholars and practitioners have made calls for participatory approaches to remedy to address cases of human rights abuses. However, a gap remains in our understanding of how to operationalize participatory approaches in a manner that empowers rightsholders, particularly (...) within contexts of severe power imbalances. The paper puts forth a rightsholder-driven theoretical framework for remedy, grounded on critical dialogic accountability principles and integrated with empirical analysis from the Fair Food Program case study. This framework defines remedy as a system comprising reinforcing aspects rather than standalone mechanisms. The critical dialogic accounting and accountability framework provides a theoretical framing of engagement that enables the inclusion of multiple, divergent voices and aims toward meaningful engagement with marginalized groups. The analysis of findings from the case study identifies enforcement and education as necessary conditions for effective and empowering rightsholder-driven approaches to remedy. The paper deconstructs these conditions to develop an understanding of the program’s unique approach to enforcement and education. The paper concludes by discussing the implications of rightsholder-driven remedy for Business and Human Rights and business accountability. (shrink)

The profession of nursing has recognized the need for contextual and relational frameworks to inform knowledge development. Two‐Eyed Seeing is a framework developed by Mi'kmaw Elders to respectfully engage with Indigenous and non‐Indigenous knowledges. Some scholars and practitioners, however, are concerned that Two‐Eyed Seeing re‐instantiates dichotomized notions regarding Western and Indigenous knowledges. As dichotomies and binaries are often viewed as polarizing devices for nursing knowledge development, this paper explores the local worldviews in which Two‐Eyed Seeing emerged, proposing that the onto‐epistemological (...) and axiological ‘roots’ of the framework are antithetical to divisiveness, paradoxically asserting space for the dichotomy to stand. Two‐Eyed Seeing, if understood as a relational, decolonial praxis, could fundamentally change the way nursing scholarship and practice operate by facilitating space for diverse knowledges, ways of being, doing and relating. In this paper, considerations for nursing scholarship and practice, as well as recommendations to support the uptake of Two‐Eyed Seeing are explored. The authors assert that conceptual divisiveness, dichotomization and exclusion can be mitigated if nursing is informed by contextual knowledge, seeks to enact accountable partnerships with Indigenous knowledge holders, and holds the Mi'kmaq worldview upon which the concept developed in positive regard. In this autobiographical essay, I reflect on my practice as an anthropologist through the medium of a dream experience. This dream occurred shortly before I was due to attend a ritual among the Booran Oromo in northern Kenya. In my discussion, I draw on analytical materialfrom anthropology, psychology, literature and philosophy. Using these different, but complementary approaches, I give three interpretations of the dream. The first two were provided to me by members of the culture, and are based on the (...) indigenous Oromo knowledge system. The third proposes a self‐analysis of the dream in terms of its structure and function. The entire exegesis is underpinned by an essay on dreams and dreaming by Foucault (1984). The analysis of the dream serves to situate my work in both theoretical and existential terms. The classic in this genre of writing is, of course, Lévi‐Strauss's (1973) Tristes Tropiques. (shrink)

This article analyses the drama surrounding the activism of female imams in North America. The image of Muslim women presiding over mixed congregational prayers evokes dramatically divergent responses among different Muslim constituencies, highlighting the disputed nature of fundamental issues pertaining to identity, community and authority. Provocative questions are raised: Can Islamic texts and communities of interpreters accommodate female religious authorities? Is it in the interest of Muslim women to seek empowerment within a domain of communal life in which male authority (...) has traditionally been dominant in all Sunni and most Shi'ite denominations? Do efforts to advance women within such contexts promise to help bridge the gap between ‘Islam’ and the ‘West’, or merely underscore existing divisions and political motivations? In particular we explore two prominent figures, Amina Wadud and Asra Nomani, and each woman's understanding of basic textual debates, conception of Muslim women's needs, and perspective on themes pertaining to ‘Islamic—North American’ relations. Throughout this article, an attempt will also be made to clarify a central paradox of the North American imamah phenomenon: that it is both a highly contingent response to specific cultural and political circumstances and a manifestation of long-term negotiations within the larger Muslim community that favour the opening of new spaces for women within religious and social life. Neoliberal ideology and exclusionary policies based on racialized identities characterize the current contexts in North America and Western Europe. Nursing knowledge cannot be abstracted from social, political and historical contexts; the task of examining the influence of race and racial ideologies on disciplinary knowledge and inquiry therefore remains an important task. Contemporary analyses of the role and responsibility of the discipline in addressing race‐based health and social inequities as a focus of nursing inquiry remain underdeveloped. In this article, we examine (...) nursing's engagement with ideas about race and racism and explore the ways in which nursing knowledge and inquiry have been influenced by race‐based ideological discourses. Drawing on Henry and Tator's framework of democratic racism, we consider how strategic discursive responses—the discourses of individualism, multiculturalism, colour‐blindness, political correctness and denial—have been deployed within nursing knowledge and inquiry to reinforce the belief in an essentially fair and just society while avoiding the need to acknowledge the persistence of racist discourses and ideologies. Greater theoretical, conceptual and methodological clarity regarding race, racialization and related concepts in nursing inquiry is needed to address health and social inequities. (shrink)

Much attention has been given to determining whether an adolescent patient has the capacity to consent to research. This study explores the factors that influence adolescents' decisions to participate in a research study about youth violence and to determine positive or negative feelings elicited by being a research subject. The majority of subjects perceived their decision to participate to be free of coercion, and few felt badly about having participated. However, adolescents who were alone in the room during the assent (...) process were more likely to report that they chose freely to be a research subject. ObjectiveOverweight and obesity [body mass index ≥ 25 kg/m2] are associated with poorer prognosis among women with breast cancer, and weight gain is common during treatment. Symptoms of depression and anxiety are also highly prevalent in women with breast cancer and may be exacerbated by post-diagnosis weight gain. Altered brain function may underlie psychological distress. Thus, this secondary analysis examined the relationship between BMI, psychological health, and resting state functional connectivity among women with breast cancer.MethodsThe sample included 34 post-menopausal women (...) newly diagnosed with Stage 0-IIa breast cancer who were enrolled in a 6-month randomized controlled trial of aerobic exercise vs. usual care. At baseline prior to randomization, whole-brain analyses were conducted to evaluate the relationship between BMI and seed-to-voxel rsFC of the hippocampus and amygdala. Connectivity values from significant clusters were then extracted and examined as predictors of self-reported depression and anxiety.ResultsMean BMI was in the obese range. For both seeds examined, higher BMI was associated with lower rsFC with regions of prefrontal cortex, including ventrolateral PFC, dorsolateral PFC, and superior frontal gyrus. Hippocampal connectivity with the vlPFC was negatively correlated with self-reported anxiety.ConclusionHigher BMI was associated with lower hippocampal and amygdala connectivity to regions of PFC implicated in cognitive control and emotion regulation. BMI-related differences in hippocampal and amygdala connectivity following a recent breast cancer diagnosis may relate to future worsening of psychological functioning during treatment and remission. Additional longitudinal research exploring this hypothesis is warranted. (shrink)

Voluntary participation is connected to cultural, political, religious and social contexts. Social and societal factors can provide opportunities, expectations and requirements for voluntary activity, as well as influence the values and norms promoting this. These contexts are especially central in the case of voluntary participation among students as they are often responding to the societal demands for building a career and qualifying for future assignments and/or government requirements for completing community service. This article questions how cultural values affect attitudes towards (...) volunteerism, using data from an empirical research project on student volunteering activity in 13 countries in North America, Europe, the Middle East, and the Asia Pacific region. The findings indicate that there are differences in motivation between countries which represent different cultural values. This article sets these findings in context by comparing structural and cultural factors which may influence volunteerism within each country. (shrink)

This article sets out to demonstrate the role of the ‘one-legged devil’, also called General Kassam. Kassam was one of the pioneer generals of the Mau Mau, a guerrilla movement that operated from the central Kenya forests as they participated in the war of liberation from the early 1950s to the early 1960s. Was Kassam a one-legged general from the word go? Methodologically speaking, the article is partially based on interviews conducted with the general before his death (...) at the age of 89 in 2011. Being an insider, Kassam helped to give an in-depth understanding of the Mau Mau war of independence by relating the role of the Kavirondo people of western Kenya in Mau Mau historiography. Were they enticed by the colonial government to abandon the idea of the armed struggle as a way of writing off colonialism? Or did the Kavirondo embrace the theology of non-violence and eventually left the central Kenya group to battle it alone? Or were the people of western Kenya dissuaded to take part in the struggle by the Christian ‘gospel of love’ that abhorred violence, leading to abandoning their colleagues from central Kenya at the last minute? Theoretically speaking, the article is largely informed by John Walton’s theory of reluctant rebels. Walton argues that rebels are always incited by the leading elites in a society that undergoes war or civil war at any given time in history.Contribution: The article contributes to growing knowledge by discussing the Mau-Mau Movement in Kenya’s quest for freedom, from the 1950s to early 1960s, to demonstrate the religious role of armed conflicts in Africa. In this case, General Kassam, a baptised Anglican Christian, whose loyalty to the ancestral pantheons drove him to the quasi-religious war of independence, is the key subject in this article. In this war of independence in Kenya, a seeming conflict between African religion and Christian religion appears as a key emerging issue. The article is relevant to the HTS Journal and the world of scholarship because it is a theo-anthropocentric piece of work which deals with God, creation, and inevitable human conflicts – all of which have answers before God. Court (Shar’iyya) recordings are at the forefront of primary written sources, which contain important documents related to Turkish history, sociology and culture. The court records shed light on city history of the period concerned with rich information and documents. These records are important books in which the documents related to the judicial, administrative, economic, architectural and social structure of a city as well as diplomatic correspondence between the center and the province were recorded. The purpose of this study is to (...) prepare a detailed catalog in addition to the catalog which was made in 1963 and contained only 119 books specifying only the dates covered by the book number. As we have seen in this study, all of the 119 notebooks in the records do not consist of the court registers in the known form. They are the books that include the records of court proceedings, which are different from those of the court, especially after the Tanzimat e.g. Qassam, Enkiha, Zabt al-Da’wa, Permission and so on. The microfilms of the books were presented to the service of researchers in Sivas Ziya Bey Library of Ancient Works. The originals of the books are in the Prime Ministry State Archives.SummaryShar’iyyaregisters are one of the primary written sources about Turkish history, sociology, and culture relevant to our life. They are important notebooks, which are related to the judicial, administrative, economic, architectural and social structure of a city, and also in the form of diplomatic correspondence between the central and provincial posts.After the Anatolian Selçuk (Saljūq) State, which collapsed under the pressure and domination of the Iranian Mongols in the last half of the XIIIth century, a state was established in the Selçuk-Byzantine border in the north-west of Anatolia in XIVth century, which did not even lasted a hundred years and had a reign in three continents. In the Bursa inscription, which dated to 1337/8, the second Ottoman Sultan (Sulṭān) Orhan was titled as the mujahedeen (warrior), the sultan of the veterans, son of veteran of veteran. The fact that Orhan carring these titles shows that since the earliest times, the Ottoman sultans considered themselves as the leader of the religious war against the infidels. Since the first years of the establishment of the Ottoman State, the Sharīʿa ruled on the establishment of administration and for this reason, they established institution of the Shaykh al-Islām(the chief juristconsult). Firstly, by appointing a subaşı(subashi, an Ottoman gubernatorial title) to the conquered places, then it gradually began to establish judicial courts from the smallest areas.In the XVth century, the number of qāḍī increased in parallel with the increase in their jurisdiction as a result of the expansion of the Ottoman Empire, and the proliferation of the administrative units called sancak, (sanjaq, division of a province) and so the failure of oneqāḍīto satisfy court affairs of an entire sanjaq. New districts arose from some of the former large districts. As a result of this in the XVIth century, the administrative system of the sanjaq's Tımar system and at the same time a geographical integrity of the districts/provinces to see the legal work of a qāḍī to pass by the districts and sub-district as a legal caused to occur two legal definitions that is legal and military administrative. Records of qāḍīs, which is called as sicilemerged because it was their duty to record their works and orders issued to them and the answers and the provisions given to them.The courts of Shar’iyyaserved as primary general courts (maḥākim-i ʿumūmiye) until the declaration of the Tanẓīmāt in the Ottoman Empire and heard the suit at legal, criminal, administrative, military, financial and all kinds of cases. Tanẓīmāt period, or rather Maḥmūd II and the period following him, the judicial organs in terms of reorganization was a circuit that was on the scene.In this way, which was occurred in the judicial system, records which were kept in the Meşihat (Mashīkhat) began to diversify depending on this change. Since in the registry books, which we call classical, all correspondence between the central and provincial offices were recorded. Records such as pleas, letters of patent, verdicts, order of the high, bonds etc. could be found in these documents.These records, which are one of the most important sources of an Ottoman city history, were kept in the museums and libraries of the cities until recently. A few years ago, these records, with a correct decision, were collected in the Prime Ministry Ottoman Archives and it was preserved and presented to the use of researchers by transferring them into digital. The Sivas Court building as it is known in history is now in the Pāshābeg quarter and known as the Court Bazaar in these days. There is no clear information about when the court was built in Sivas. In time, changes have occurred in cities and we are losing the historical side of them. In addition, the fact that people acted in an unconscious manner that would harm the historical texture was the biggest factor in disappearance of material remains. With the remaining physical materials available, we can only access crumb information and we can only make predictions. In this evaluation, the biggest materials are the documents and notebooks, which are the memory of city dates. However, it is understood from the records that there is a foundation belonging to this court and some of the court's repair and maintenance works were carried out by this foundation. As it is understood from a document dated 14 August 1798, one of the repairs was sponsored by Ḥüseyin Efendī. In an inscription dated 1906, which was found during the renovation of the basement of an apartment building owned by the General Directorate of Foundations in May 2018, the location of the building was previously known as the Sivas Muftī 's Office.In this study, a total of 240 registry books belonging to Sivas were prepared as in a catalog system. In this study, we have seen that a great deal of records have been lost, burnt or destroyed in a certain way through history. The burn marks in the records of 79 is a striking example in this regard. The book number 139, which is not shown in Osman Ersoy's work, is a record book in classical form. An important case in this study is that the register number 206, which is registered to Sivas, belongs to the province of Burdur and it is also a registry book in classical form. This book covers the dates of 18 M. 1248/23 N.1250 - 1832-1835. (shrink)
