This brief commentary reappraises the issue of emigration of physicians from developing countries to developed countries. A methodological framework is developed for assessing the impact of physician emigration on population health outcomes. The evidence from macro and micro studies suggest that developing countries especially in sub-Saharan Africa would benefit from regulating physician emigration because the loss of physicians can lower quality of healthcare services and lead to worse health outcomes. In this paper, we argue that if a set of plausible conditions obtain, then driving a standard vehicle rather than riding in an autonomous vehicle (AV) will become analogous to driving drunk rather than driving sober, and therefore impermissible. In addition, we argue that a ban on the production, sale, and purchase of new standard vehicles would also become justified. We make this case in part by highlighting that the central reasons typically offered in support of state-mandated vaccination will also (...) support mandating AV use. Why do organizations conduct job interviews? The traditional view of interviewing holds that interviews are conducted, despite their steep costs, to predict a candidate’s future performance and fit. This view faces a twofold threat: the behavioral and algorithmic threats. Specifically, an overwhelming body of behavioral research suggests that we are bad at predicting performance and fit; furthermore, algorithms are already better than us at making these predictions in various domains. If the traditional view captures the whole story, then interviews seem (...) to be a costly, archaic human resources procedure sustained by managerial overconfidence. However, building on T. M. Scanlon’s work, we offer the value of choice theory of interviewing and argue that interviews can be vindicated once we recognize that they generate commonly overlooked kinds of noninstrumental value. On our view, interviews should thus not be entirely replaced by algorithms, however sophisticated algorithms ultimately become at predicting performance and fit. (shrink)

In recent months, pharmaceutical manufacturers have brought legal challenges to a provision of the 2022 Inflation Reduction Act (IRA) empowering the federal government to negotiate the prices Medicare pays for certain prescription medications. One key argument made in these filings is that price negotiation is a “taking” of property and violates the Takings Clause of the US Constitution. Through original case law and health policy analysis, we show that government price negotiation and even price regulation of goods and services, including (...) patented goods, are constitutional under the Takings Clause. Finding that the IRA violates the Takings Clause would radically upend settled constitutional law and jeopardize the US’s most important state and federal health care programs. (shrink)

In this paper, we present a computational algebraic representation of Hindi syntax. This paper is the first attempt to establish the representation of various facets of Hindi syntax into algebra, including dual nominative/ergative behavior, a syntacto-semantic case system and complex agreement rules between the noun and verb phrase. Using the pregroup analysis framework, we show how we represent morphological type reduction for morphological behavior of lexical markers, the representation of causative constructions which are morphologically affixed, as well as of light (...) verb constructions which form the verb by joint predication. We present examples adapted from the Hindi Dependency Treebank to show the pregroup analysis of Hindi sentences. (shrink)

The one thing that is at once most predictable and unpredictable about life is death. Yet, man lives, forgetting death as if he were immortal. Between these two -- a visible manifestation of death and an innate sense of immortality -- hangs the balance of life, a paradox which we do not easily understand. What if death is not an end, but a passage to another life? What if rebirth is not about retribution, but is a form of evolution? What (...) if life and death are not opposites but work towards a common goal? There must be a larger picture, a missing piece of the puzzle to complete the story and make our understanding whole. How should we deal with trauma and loss, suffering and pain and other ethical and existential issues? Social media companies commonly design their platforms in a way that renders them addictive. Some governments have declared internet addiction a major public health concern, and the World Health Organization has characterized excessive internet use as a growing problem. Our article shows why scholars, policy makers, and the managers of social media companies should treat social media addiction as a serious moral problem. While the benefits of social media are not negligible, we argue that social media addiction raises unique ethical (...) concerns not raised by other, more familiar addictive products, such as alcohol and cigarettes. In particular, we argue that addicting users to social media is impermissible because it unjustifiably harms users in a way that is both demeaning and objectionably exploitative. Importantly, the attention-economy business model of social media companies strongly incentivizes them to perpetrate this wrongdoing. (shrink)

In Nepal, live donor organ transplantation is only 14 years old with the first successful kidney transplant made in 2008 and a successful liver and bone marrow transplant made in 2016. However, transplantation of cadaveric cornea dates back to 1998. There are still no cases of animal-to-human organ transplantation in Nepal. There are stringent laws to regulate human body organ transplantation in Nepal which are amended from time to time. However, there is a racket of human traffickers who lure rural (...) people from this low-income country into the illegal organ trade. Furthermore, there is a substantial lack of awareness of organ donation among the general public. This article focuses on the stipulations of ethical, legal, and practical issues of obtaining organs procured from living and brain-dead donors that support the process of transplantation in Nepal. In addition, the article also explores the legal and practical issues of organ trafficking and organ donation awareness in Nepal on the basis of factual data and findings from other studies. I propose a leadership theory with moral concerns at its core. Sāttvika leadership is defined as a set of purposive leader actions comprising knowledge-driven cooperation that are initiated on the basis of positive and reasonably accurate assumptions and executed through morally responsible and sustainably fruitful means to secure the flourishing of followers and the collective. SL enhances psychological capital, psychological empowerment, and work engagement of followers while developing them into morally better persons. Indian psychology scholars have primarily focused on developing triguṇa-based personality models. However, triguṇa-based personality models are not epistemologically consistent with Sāṁkhya. This article offers a bhāva-based conception of personality that is epistemologically consistent with Sāṁkhya. It proposes svabhāva as a personality-like construct that refers to individual-specific arrangements of prākṛtika and vaikṛtika bhava. This article contributes to both Indian psychology and Sāṁkhya scholarship.

Interferons (IFNs) are a diverse group of cytokines whose potent antitumor effects have piqued the interest of scientists for decades. Some of the most sustained clinical accomplishments have been in the field of myeloproliferative neoplasms (MPNs). Here, we discuss how both historical and novel breakthroughs in our understanding of IFN function may lead to more effective therapies for MPNs. The particular relevance and importance of modulating the novel IFN‐regulated ULK1 pathway to optimize IFN responses is highlighted.

Aruna Ramachandra Shanbaug breathed her last after 42 years of being in a persistent vegetative state. Euthanasia in any form is not permitted in India and it was only in the year 2011 that a petition was filed in the court that urged the cessation of her force feeding with a nasogastric tube and the request for her peaceful death. What followed was a string of arguments and counter arguments relating to Euthanasia. When an employee’s off-duty conduct generates mass social media outrage, managers commonly respond by firing the employee. This, I argue, can be a mistake. The thesis I defend is the following: the fact that a firing would occur in a mass social media outrage context brought about by the employee’s off-duty conduct generates a strong ethical reason weighing against the act. In particular, it contributes to the firing constituting an inappropriate act of blame. Scholars who caution against firing an employee (...) for off-duty conduct have thus far focused primarily on due process related issues or legal concerns pertaining to free speech, lifestyle discrimination, and employment at-will. However, these concerns amount to only a partial, and contingent, diagnosis of what is at issue. I argue that even when due process considerations are met, firings in these contexts can be unjustified. Moreover, even if a business is not concerned with the unethical conduct per se, but is rather strictly concerned with PR, the argument I advance nevertheless provides one important ethical reason that counts against firings in mass social media outrage contexts. Given that managers are often under significant pressure to respond swiftly in cases where an employee is at the center of mass social media outrage, it is especially important that scholars begin to clarify the normative issues. This article builds on the burgeoning philosophical literature on the ethics of blame and provides a novel account of a distinctive ethical concern that arises with firings in mass social media outrage contexts. This book puts together the most important contemporary writings in the debate on secularism. It deals with conceptual, normative and explanatory issues in secularism and addresses urgent questions, including the relevance of secularism to non-Western societies and the question of minority rights.

Employment-at-will (EAW) is the legal presumption that employers and employees may terminate an employment relationship for any or no reason. Defenders of EAW have argued that it promotes autonomy and efficiency. Critics have argued that it allows for the domination, subordination, and arbitrary treatment of employees. We intervene in this debate by arguing that the case for EAW is contextual in a way that existing business ethics scholarship has not considered. In particular, we argue that the justifiability of EAW for (...) a given jurisdiction depends on existing complementarities among the institutions that constitute the jurisdiction’s political economy. Notably, our view takes seriously the ethical concerns EAW critics have raised by showing how these concerns can be mitigated through public policy measures that do not require eliminating EAW. The literature on methodological individualism is characterized by a widely held view that if the doctrine were stated with sufficient care it would be seen to be trivially true. Professor Bhargava questions this view. He begins by carefully disentangling the various formulations of the doctrine, identifies its most plausible version, and finally locates the principal assumption underlying it, namely that beliefs are attitudes individuated entirely in terms of what lies within the individual mind. Bhargava argues that once this (...) individualist assumption is challenged it is possible to rehabilitate a non-individualist methodology which permits a contextual study of beliefs and actions, and even a study of social context relatively independent of the beliefs and actions of individuals. It can further advance only when one explores different value dimensions with additional goals in education than mere technical goal with an appropriate curriculum. Written over the last two decades, these essays answers important questions on secularism. Some of the topics covered are the democratic vision of the new republic of India, the evolution and distinctiveness of India's linguistic federalism, India's secular constitution, the Muslim personal law, and the majority-minority syndrome.

Two notions of reconciliation exist. The weak or thin conception is akin to ‘resignation’. It is sought by groups that have waged war against one another but have come to the realization that neither can win. Reconciliation in this sense results from an enforced lowering of expectations. In the stronger sense, reconciliation means a virtual cancellation of enmity or estrangement via a morally grounded forgiveness, achievable only when conflicting groups acknowledge collective responsibility for past injustice, and shed their deep prejudices (...) by a profound and painful transformation in their identities. It is because this process is not possible without a somewhat brutal confrontation with oneself and a painful recognition of one’s own moral degradation that reconciliation is difficult to achieve. We examine whether social capital mitigates managerial opportunism around share repurchase announcements. We find that firms headquartered in high social capital states are associated with: (i) higher repurchase completion rates, and more so in environments where governance is weak and the potential for misleading investors is high, (ii) a smaller likelihood of information manipulation such as revealing bad news before repurchases, and (iii) lower completion rates when shares are less undervalued. By documenting that firms’ external social environments help curb managerial (...) opportunism, our study suggests that the location of headquarters facilitates trustworthiness and affects ethical considerations in corporate announcements. The desirability of creating norms within the framework of law has been a challenging process in a free market economy. The principles of antitrust law enunciated by courts in abuse of dominant cases has led to ‘refusal to deal’ as a contested doctrine. When dominance is treated as legitimate aspiration and free market choices are the medium to achieve the aspirations of free market enterprises, any duty or obligation cast on the firm is considered antithetical to the spirit of free (...) market unless it eclipses the anticompetitive effect. Where an economic analysis of antitrust law has non-economic impacts with ethical and moral issues, it calls for an alternative economic thought which also considers plural values of society. This also reflects a conflict arising out of lack of norms and respect for property rights. This paper attempts to analyze the cases and framework which is currently employed by the courts and the challenges it puts forth in creating a norm that is universal. The author by drawing on the principles of Gandhian economic thought and its essential features of trusteeship, non-possession and non-violence creates space for resolution of conflicts promoting ethical and moral considerations. Resolution of conflict through ethical and moral norms also assimilates the varied goals of antitrust regulation, including non-economic goals when the goals of antitrust require a broader consideration that accommodates the wider spectrum of market participants. Earlier evidence suggests that besides humans, some species of mammals and birds demonstrate visual self-recognition, assessed by the controversial “mark” test. Whereas, there are high levels of inter-individual differences amongst a single species, some species such as macaques and pigeons which do not spontaneously demonstrate mirror self-recognition can be trained to do so. We were surprised to discover that despite being widely used as a model system for avian research, the performance of zebra finches on the mark test had not (...) been studied earlier. Additionally, we studied the behavioral responses of another species of passerine songbirds to a mirror and the MSR mark test. Although a small number of adult male zebra finches appeared to display heightened responses toward the mark while observing their reflections, we could not rule out the possibility that these were a part of general grooming rather than specific to the mark. Furthermore, none of the house crows demonstrated mark-directed behavior or increased self-exploratory behaviors when facing mirrors. Our study suggests that self-directed behaviors need to be tested more rigorously in adult male zebra finches while facing their reflections and these findings need to be replicated in a larger population, given the high degree of variability in mirror-directed behaviors. This volume examines various aspects of the Indian Constitution from the perspective of political theory. The essays view the Constitution as a political or ethical document, thereby reflecting configurations of power and interests or articulating a moral vision.

India is one of the most culturally, philosophically and religiously diverse countries in the world. The roots, not only of these diversities but also of morally appropriate responses to them, i.e. to pluralism, go very deep. This presentation substantiates this claim by looking at the relevant edicts of Emperor Asoka who reigned in India in the 3rd century BCE. Asoka not only advises people with deeply divergent worldviews to live together face to face but also suggests what the basis for (...) this coexistence could be. He claims that resources exist in all traditions to exercise self-restraints. These self-restraints are of two kinds: self-related and other-related. Everyone should exercise both these self-restraints, particularly in speech. This ‘control of tongue’ is crucial for morally legitimate and principled coexistence. In the article, I try to explicate the meaning of these edicts and flesh out this argument by providing a vivid, quasi-phenomenological account of what public life in Asokan times was like. (shrink)
