State agents’ misconduct (SAM), such as the violations carried out by the police or prosecution, may harm an offender’s rights during the criminal process in various ways. What, if anything, can retributivism, as an offense-focused theory that looks to the past, offer in response to SAM? The goal of this essay is to advance a retribution-based framework for responding to SAM within the criminal process. Two retribution-based arguments are provided. First, a retribution-based response to SAM aims to protect the legitimacy (...) of the criminal process. Such an argument is based on how the crime and punishment connect to the moral standing of the state and that connection’s meaning for the legitimacy of the trial (legitimacy-based argument). Second, a retribution-based response to SAM aims to consider the offender’s side of the penal dialogue and promote a more accurate calibration of the penal suffering (compensation-based argument). Based on these arguments, the essay theorizes the legal response for SAM in US and non-US traditions through the retributive lens. The essay concludes with a call for expanding the multiple roles for retributive logic to include the actions of law-enforcement actors and addresses what that expansion means for the justice of the criminal process. Scholars depict punishment as a moral dialogue between the community and the offender, which addresses both the offender’s crime and character. However, how the penal message evolves vis a vis that crime and character as it passes through the different stages of the criminal process has remained under-theorized. This article, building on communicative theory, explores the interrelation between crime and character along the penal process, from sentencing, through prison, to parole release. We argue that in the penal dialogue the relationship (...) between crime and character evolves in a dynamic way through three phases: separateness (sentencing), fusion (prison), and re-distinction (parole) of crime and character. The proposed analysis develops the communicative meaning of the penal process, provides a normative account of the work of punishment administration authorities, and explores applications of our proposed normative analysis for the administration of the punishment. A presente pesquisa oferece ao leitor um estudo exegético-teológico do evangelho segundo Lucas 10:25-37, perícope na qual se narra um diálogo de Jesus com um intérprete da lei. O que se percebe é que há muitos estudos que consideram demasiadamente a parábola e ignoram o diálogo teológico presente no texto. Esta pesquisa pretende aprofundar o recurso narrativo de perguntas e respostas, utilizado por Lucas, para indicá-lo como um instrumento pedagógico de Jesus a fim de despertar seu discipulado. A perícope é (...) estruturada por duas perguntas do intérprete da lei: “Mestre, o que fazer para herdar a vida eterna?” e “E quem é o meu próximo?” ; três perguntas feitas por Jesus: “Na lei o que está escrito? Como lês?” e “Quem pois destes três te parece haver-se tornado próximo do que caiu entre os ladrões? ; duas respostas do intérprete da lei ; e um discurso parabólico. A metodologia aplicada é de cunho bibliográfico em perspectiva interdisciplinar, a fim de fomentar a pesquisa na área da Teologia Bíblica, a partir da contribuição da pedagogia no ensino religioso. This paper studies the relationship between organizational ethical climate and the forms of organizational citizenship behavior (OCB), including in-role and extra-role behaviors, and examines the mediating effect of employee loyalty. A sample of employees from a traditional Hong Kong-based company was used as a study group. The purpose of this study was to examine the causes and implications of how various ethical work climates affect employee performance. Based on a model proposed by Victor and Cullen, ethical climate is arranged from (...) lower levels to higher levels. The results suggest that lower levels of ethical climate (instrumentality and independence), characterizing a weak relational contract between employee and employer, are associated with negative extra-role behavior. In contrast, higher levels of ethical climate (caring and law-and-code), symbolic of a strong relational contract at work, are associated with positive extra-role behavior. Moreover, normative commitment mediated a positive relationship between caring and identification with the company, whereas attitudinal loyalty mediated the negative relationship between independence and altruism. We highlight the deep ecology movement, inspired on ecological knowledge but mainly on the life-style of the ecological and biological field-worker. Its creator, the Norwegian philosopher Arne Naess, stresses that human and no human beings have, at least, one kind of right in common: namely the ‘right’ to express its own nature, to live and blossom. This idea shows the inspiration from perseverare in suo esse, from Baruch Spinoza’s Ethics. But beyond this Spinozan influence, the striving for expression of one’s (...) own nature is interpreted from the perspective of present evolutionism and endosymbiosis. Even though, scientific knowledge, if necessary, is considered limited. Thus, this movement should be regarded as ecophilosophical rather than ecological, as a kind of sophia orwisdom. In turn, many supporters of conservation biology (following Michael Soulé) associate their science with ecosophy, not encouraging the dichotomy fact/value. Conservation biology axioms such as: evolution in valuable, organism’s diversity is good, premature extinction of species populations is negative, etc., have been inspired on the deep ecology movement. The consideration of the terms biodiversity, evolution or biosphere as thick ethical concepts (following Hillary Putnam), shows this integration of the descriptive and the normative. (shrink)

This article explores Ruth’s theology of resilience amidst vulnerability: a resilience rooted in ḥesed. Ḥesed is a powerful social force that could address current issues for those both in privileged positions and in vulnerable situations. A re-reading of Ruth offers modern theologians and serious students of the Bible pathways towards building resilience amidst vulnerability, and in caring for those in vulnerable positions. The text at hand offers a pathway to be true to one’s core values and character, even amidst desperate (...) situations. In Ruth resilience is developed by caring for others, identifying with a particular faith community, and taking initiatives while maintaining integrity. The narrative unveils a sustainable life of resilience that happens when one’s private and public life is lived congruently to each other. This article also reads Ruth’s narrative through a lens of a minority foreign woman that uses feminist and post-colonial approaches while looking at Ruth through a hermeneutic of trust. First, the author identifies her assumptions and considerations. Secondly, the article examines resilience as rooted in one’s identity and explores ḥesed under cultural and spiritual frameworks, within the narrative of Ruth and Naomi’s road scene from Moab to Bethlehem. Lastly, it examines resilience as rooted in ḥesed, within the narrative of the threshing floor scene encounter between Ruth and Boaz. The road and threshing floor scenes are decisive moments for Ruth. Her words and actions in each instance reveal her resilience: her strength of mind, emotion, and spirit, in spite of her vulnerability. (shrink)

Firms face mounting pressure to appoint ethical leaders who will avoid unnecessary risk, scandal and crisis. Alongside mounting evidence that narcissistic leaders place organizations at risk, there is a growing consensus that women are more ethical, transparent and risk-averse than men. We seek to interrogate these claims by analyzing whether narcissism is as prevalent among women CEOs as it is among men CEOs. We further analyze whether narcissistic women CEOs take the same types of risk as narcissistic men CEOs. Drawing (...) on social role and token theories, we test hypotheses related to gender differences in the prevalence and impact of CEO narcissism on firm-level practices. Using a unique dataset that includes a large sample of CEOs of S&P 1500 companies from 1992 through 2014, we create a narcissism composite score for each CEO based on their photograph size in the annual report, and their cash earnings and non-cash earnings relative to the next highest paid executive. We find that women CEOs are less likely to exhibit narcissistic personality traits compared to men CEOs. Furthermore, we find that gender moderates the relationship between narcissistic CEOs and our outcome variables of risk-taking and questionable behaviors. (shrink)

Many critics of libertarian freedom have charged that freedom is incompatible with indeterminism. We show that the strongest argument that has been provided for this claim is invalid. The invalidity of the argument in question, however, implies the invalidity of the standard Consequence argument for the incompatibility of freedom and determinism. We show how to repair the Consequence argument and argue that no similar improvement will revive the worry about the compatibility of indeterminism and freedom.

This essay re-examines the disability critique of prenatal and pre-implantation screening in light of evidence about the larger context in which fertility and reproductive healthcare is rendered in the U.S. It argues that efforts to identify acceptable criteria for trait-based selection or otherwise impose reasons-based limitations on reproductive choice should be avoided because such limitations tend to perpetuate the discrimination encountered by adults with disabilities seeking fertility and reproductive health services.

El presente trabajo parte del planteamiento del enfoque radical e inclusivo en el que, entre otros aspectos, se señala que hay determinados temas, denominados radicales, que no son socialmente demandados, pese a que su inclusión en educación es clave para la formación. Este es el caso del “amor”, un tema que no se suele tener en cuenta, aunque se puede intuir su impacto significativo en nuestra educación. Desde este enfoque, se entiende el amor como opuesto al egocentrismo, y considera la (...) importancia de incluir estos temas como forma de alcanzar una educación plena. Por ello, nuestro trabajo se centra en comprobar la presencia de este tema radical (el amor) en la legislación educativa vigente en España. El estudio se realiza a través de una metodología de análisis documental, considerando la normativa referente al desarrollo curricular de la Ley Orgánica 3/2020 (LOMLOE), así como sus concreciones a nivel autonómico, utilizando como unidades de análisis la palabra amor y derivadas. El análisis se realiza a través de técnicas cuantitativas, registrando la frecuencia de la presencia del concepto en los Reales Decretos por los que se establecen la ordenación y las enseñanzas mínimas, así como en los documentos derivados del desarrollo posterior que realizan de estas normas las comunidades autónomas en las diferentes etapas educativas (Infantil, Primaria, Secundaria Obligatoria y Bachillerato), asimismo se atendió a los ámbitos de conocimiento donde está este término presente. Los resultados obtenidos indican que el marco normativo curricular estatal y autonómico apenas incluye el concepto amor. Por este motivo, este estudio detecta que los temas relacionados con el amor no son prioritarios en los documentos analizados, por lo que se plantea la necesidad de que desde el ámbito educativo se incluya en los currículos, de las diferentes etapas educativas, el tema del amor que es primordial para la formación. It has been commonplace to maintain of the phenomenon that occurred during classical times, the change from relying on myth to trusting in reason: (1) that the emergence of philosophy from myth was marked by an abrupt discontinuity; (2) that mythical thinking was left behind once philosophy was invented or discovered; and (3) that the ancient Greeks were the agents of this miracle. This paper suggests that the so-called “Greek miracle” was, in fact, a miracle manqué and, more importantly, that (...) close examination of this failed miracle offers valuable insight into the philosophical crisis facing the world today. The principle of beneficence directs healthcare practitioners to promote patients’ well-being, ensuring that the patients’ best interests guide treatment decisions. Because there are a number of distinct theories of well-being that could lead to different conclusions about the patient’s good, a careful consideration of which account is best suited for use in the medical context is needed. While there has been some discussion of the differences between subjective and objective theories of well-being within the bioethics literature, less attention has been (...) given to the questions of what work a theory of well-being needs to do in bioethics and which standards of success ought to be used in selecting a theory of well-being for use in medicine. In this article, I argue that traditional theories of well-being developed in philosophy are not well suited to meet the needs of the medical context. For the principle of beneficence to be most useful, the underlying account of well-being should satisfy two conditions: first, it needs to lead to a concrete, action-guiding determination of the patient’s good; and, second, any recommendations it offers need to be justifiable to patients. Standard accounts of well-being have difficulty satisfying both conditions. Exploring the limitations of these theories when applied to treatment dilemmas helps point the way toward the development of an account of well-being better suited to healthcare. (shrink)

The paper concentrates on the Chinese philosophical strand of Daoism and analyses in how far this philosophy can contribute to new directions in management theory. Daoism is an ancient Chinese philosophy, which can only be traced back roughly to about 200 or 100 BC when during Han dynasty the writers Laozi and Zhuangzi were identified as “Daoists”. However, during Han dynasty Daoism and prevalent Confucianism intermingled. Generally, it is rather difficult today to clearly discern Daoist thought from other philosophical strands (...) as in the same period also Buddhism, Mohism and Legalism shaped contemporary thinking. Furthermore, there is a difference between the religious practice of Daoism in the sense of popular religion and the theoretical basis of Daoist thought presented in Laozi and Zhuangzi. The religious practice in contrast can have very mystical elements, which are linked to superstition. Moreover, there is also the question of in how far Daoist thought and practice is still prevalent at all in Chinese society today. Hence, the picture of Daoism is heterogeneous, first, regarding the question of what can be defined as the “original core” of Daoism, second, the difference between thought and religious practice, and third, the question of the prevalence of Daoist thought in China today. This paper offers a broader discussion regarding the potential ways of application of Daoist thought today over five parts. First, it illuminates the most important values taught under the name of Daoism. Thereby, it focuses on the Daoist thought and leaves out the actual religious practice together with its mystical elements. Second, these values are then put into the management context to analyse in how far Daoism can broaden our contemporary understanding of management in general and different management styles in particular. Third, Daoism in a management context is then contrasted with the comparably rigid Confucian doctrine also applied in a business context. Here, the application of Daoist and Confucian thought in the fields of leadership, management and corporate ethics is presented and compared. Fourth, insights into the real business practice in China regarding Chinese philosophies like Daoism and Confucianism in fields like management, strategy or corporate ethics are provided. Fifth, an outlook is presented where Daoism is discussed in the context of contemporary debates on sustainability and CSR. Here, the proposed paper illuminates in how far the philosophy of Daoism can also contribute to a more holistic understanding of sustainability and CSR today, thereby contributing to more innovative solutions in management. Reply to a commentary by Joseph J. Fins on “Financial Side Effects: Why Patients Should Be Informed of Costs.”.

China is a country with a long-standing and rich history. This rich history is also expressed in its cultural, religious and philosophical diversity. One of China’s most prominent and influential philosophical strands is Daoism, which is still practiced today despite the political turmoil of the 20th century. It came into existence at roughly the same time as Confucianism. This paper focuses on a particular work of the Daoist canon, which at the same time is one of its most prominent ones: (...) The Dao De Jing by Laozi. The purpose of this paper is to evaluate in how far the virtues described in the Dao De Jing are applicable in a business context. Thereby this paper presents a first draft to turn the Dao De Jing into a “virtue ethics for business” by a thorough and comprehensive analysis of all 81 chapters based on drawing on eight different translations. The presence of patients’ families during cardiopulmonary resuscitation (CPR) is a controversial topic, due to its repercussions for clinical practice. While family members’ presence may help them to overcome their grief, it could be detrimental, as it may case posttraumatic stress disorder (PTSD), and there is the possibility that family members may interfere with the procedure. For these reasons, families’ presence during CPR has rejected by some healthcare providers.To research concerns about families’ presence among providers dealing with CPR in the (...) Fundación Hospital Alcorcón (Madrid), I performed this study. Of the 190 providers surveyed, 115 submitted a complete questionnaire. The most frequently reported concerns were interference (78.3 percent of respondents), and PTSD (69.6 percent of respondents). Fewer pediatric providers were concerned about PTSD than other providers (41.2% percent versus 74.5 percent, p = 0.01). Providers were reluctant to offer families the option of being present unless they had requested it, and would only permit it under certain conditions. Having a staff member to support the family was of great value to most respondents. The author believes families have a negative right to be present during CPR and so should be invited to stay. En este artículo se analiza “Malena, una vida hervida” de Almudena Grandes como relato paradigmático de las propuestas posfeministas que la autora española presenta en su obra narrativa, la cual recurrentemente se distancia y critica los modelos patriarcales de mujer tradicional, al mismo tiempo que cuestiona varios presupuestos feministas. “Malena, una vida hervida”, integrante de la colección Modelos de mujer, critica los parámetros estéticos que establece la sociedad, y replantea el erotismo y su vinculación con la comida. Para ello, Grandes (...) propone una versión, subversión y parodia tanto de modelos masculinos como femeninos a la vez que exhibe la incapacidad de escapar al modelo femenino impuesto por el patriarcado. How do teachers learn about what learners already know? How do learners aid teachers by providing them with information about their background knowledge and what they find confusing? We formalize this collaborative reasoning process using a hierarchical Bayesian model of pedagogy. We then evaluate this model in two online behavioral experiments (N = 312 adults). In Experiment 1, we show that teachers select examples that account for learners' background knowledge, and adjust their examples based on learners' feedback. In Experiment 2, (...) we show that learners strategically provide more feedback when teachers' examples deviate from their background knowledge. These findings provide a foundation for extending computational accounts of pedagogy to richer interactive settings. (shrink)

En el presente trabajo se pone de relieve una tesis del último Kuhn que ha sido, y aún es, desatendida: el carácter no universal del lenguaje. Luego de ubicarla en los textos y contextos teóricos donde aparece, se intenta aclararla a partir de algunos de sus textos posteriores. En este afán, el trabajo presente en primer lugar muestra, cómo, deben ser modificadas algunas de las propuestas filosóficas atribuidas al Kuhn clásico para poder comprender esta tesis y en segundo lugar, intenta (...) dar cuenta muy brevemente de ciertas innovaciones filosóficas del último Kuhn. Además, se comparan algunas de esas nuevas tesis de Kuhn con sus posibles -aunque nunca explicitados- interlocutores, a saber: N. Chomsky y J. Fodor. This paper draws attention to one of the theses of the Later Kuhn, which has been ignored: the non-universal character of language. After locating the thesis in the texts and theoretical contexts in which it appears, it is attempted to be clarified in view of some of his later texts. In regard of this, the paper firstly shows, how some of the philosophical proposals attributed to the Early Kuhn must be modified in order to understand it. Secondly, a very brief account for certain philosophical innovations in the Later Kuhn is attempted to be given. In addition, some of Kuhn's new theses are compared with his most likely, even if never explicit, interlocutors, namely N. Chomsky and J. Fodor. (shrink)
