Em uma famosa passagem de suas Institutas, o jurista romano Gaio dividiu o direito privado em duas partes: o direito civil e o direito dos povos. O primeiro é o direito criado pelo povo romano enquanto o segundo é o direito seguido por todas as nações. A despeito de sua origem clássica, os especialistas discordam acerca do modo de interpretar essa tese. No início do século XX, historiadores como Michel Villey viram na distinção sinais da influência da filosofia (...) grega entre os juristas romanos. Posteriormente Levy e mais recentemente Kelly contestaram essa afirmação e defenderam que filósofos e juristas possuíam, no período clássico, noções de natureza e direito natural completamente distintas. O objetivo desse artigo não está em provar a exata influência da filosofia grega entre os juristas, mas apenas em sugerir que não é possível fornecer uma interpretação dos textos clássicos sem atribuir a eles uma concepção teórica do direito natural. No que toca a filosofia do direito muitas são as dúvidas que recaem sobre as distintas noções de direito consideradas não só nas reflexões teóricas sobre a jurisprudência, mas também aquelas que surgem pela _práxis_ do sistema jurídico. Michel Villey defende a tese de que a única concepção estrita e exequível de direito é aquela criada em Roma que concebe o direito como uma coisa (_res_) atribuída de modo justo, pelos juristas, aos indivíduos. Qualquer noção subjetiva de direito, além de (...) ser desprovida do sentido lato do termo, se atribuída aos filósofos antigos e medievais, não passa de uma reinterpretação errônea. Entretanto, este artigo tem por objetivo mostrar que a argumentação de Villey contém algumas lacunas quanto a sua interpretação da noção de direito em textos como os de Gaio e de Tomás de Aquino. Posição essa sustentada através de autores como Brian Tierney e Alfredo Storck, os quais apresentam uma leitura pluralista acerca das noções de direito da antiguidade e do medievo mostrando que, ainda que não houvesse a presença do termo “direito subjetivo” no vocábulo da jurisprudência da época, por vezes, o direito era empregado nesse período para significar um poder, uma liberdade ou uma vantagem do indivíduo. L'Odyssée, le plus ancien poème de la culture occidentale, met en scène la métamorphose qui change Ulysse en lui-même sous les yeux dessillés de ceux qui échouaient jusque-là à le reconnaître. Ulysse constitue ainsi la première d'une longue série de figures donnant corps à cette opération mystérieuse : le passage de l'existence en régime d'obscurité à l'existence "en personne", dans une forme de vérité. Que signifie un tel passage? Comment s'opère cette transition? Quelles formes cette idée d'existence en personne a-t-elle (...) pu revêtir dans la pensée occidentale? Archaeology has been an important source of metaphors for some of the key intellectuals of the 20th century: Sigmund Freud, Walter Benjamin, Alois Riegl and Michel Foucault, amongst many others. However, this power has also turned against archaeology, because the discipline has been dealt with perfunctorily as a mere provider of metaphors that other intellectuals have exploited. Scholars from different fields continue to explore areas in which archaeologists have been working for over two centuries, with little or no reference to (...) the discipline. It seems that excavation, stratigraphy or ruins only become important at a trans-disciplinary level when people from outside archaeology pay attention to them and somehow dematerialize them. Meanwhile, archaeologists have been usually more interested in borrowing theories from other fields, rather than in developing the theoretical potential of the same concepts that other thinkers find so useful. The time is ripe for archaeologists to address a wider audience and engage in theoretical debates from a position of equality, not of subalternity. Reclaiming Archaeology explores how archaeology can be useful to rethink modernity's big issues, and more specifically late modernity (broadly understood as the 20th and 21st centuries). The book contains a series of original essays, not necessarily following the conventional academic rules of archaeological writing or thinking, allowing rhetoric to have its place in disclosing the archaeological. In each of the four sections that constitute this book (method, time, heritage and materiality), the contributors deal with different archaeological tropes, such as excavation, surface/depth, genealogy, ruins, fragments, repressed memories and traces. They criticize their modernist implications and rework them in creative ways, in order to show the power of archaeology not just to understand the past, but also the present. Philosophers of perception frequently assume that we see actual states of affairs, or facts. Call this claim factualism. In his book, William Fish suggests that factualism is supported by phenomenological observation as well as by experimental studies on multiple object tracking and dynamic feature-object integration. In this paper, I examine the alleged evidence for factualism, focusing mainly on object detection and tracking. I argue that there is no scientific evidence for factualism. This conclusion has implications for studies on the phenomenology (...) and epistemology of visual perception. (shrink)

The sensorimotor theory of vision and visual consciousness is often described as a radical alternative to the computational and connectionist orthodoxy in the study of visual perception. However, it is far from clear whether the theory represents a significant departure from orthodox approaches or whether it is an enrichment of it. In this study, I tackle this issue by focusing on the explanatory structure of the sensorimotor theory. I argue that the standard formulation of the theory subscribes to the same (...) theses of the dynamical hypothesis and that it affords covering-law explanations. This however exposes the theory to the mere description worry and generates a puzzle about the role of representations. I then argue that the sensorimotor theory is compatible with a mechanistic framework, and show how this can overcome the mere description worry and solve the problem of the explanatory role of representations. By doing so, it will be shown that the theory should be understood as an enrichment of the orthodoxy, rather than an alternative. (shrink)

The objective of this study is to provide insight into culinary systems. Each culture expresses its own identity through the way in which it transforms food into an elaborated cuisine. The phases of a cooking process start with the choice of ingredients, their preparation, their processing, how they are served, and how they are eaten. Each of these phases makes it possible to understand the semiotic and social behavior of a human group in the moment they choose to prepare and (...) eat a particular food. Therefore, this article contains a contrastive analysis of how Mexican, Texan, and Italian cuisines show how spicy and hot food is interpreted depending on the values that ​​are given to it in regards to being considered a dish, a spice or a vegetable. It bases its analysis on the mechanisms built around the meaning of chile in order to express cultural characteristics and differences. The recipes and their narrative processes, in addition to the use of color, allow the identification of parameters to describe the various cuisines through recipes books. (shrink)

Claude Romano repense à nouveaux frais la méthode phénoménologique en la mettant en dialogue avec d'autres courants de la philosophie contemporaine, et notamment la philosophie analytique. Sa réflexion s'ordonne autour de trois axes. Tout d'abord, la question des rapports entre langage et expérience, dans le sillage des recherches empiriques en linguistique : le langage n'exige-t-il pas, pour pouvoir être compris, que l'on interroge ses liens avec des significations pré-linguistiques qui fondent notre expérience même du monde? Ensuite, la question du (...) réalisme : la phénoménologie entretient-elle une affinité nécessaire avec l'idéalisme, comme l'ont cru un certain nombre de disciples de Husserl, ou ne nous met-elle pas plutôt sur la voie d'un réalisme qui demanderait à être reformulé? Enfin, comment une phénoménologie réaliste et soucieuse d'une articulation plus fine entre expérience et langage permet-elle d'approcher de manière renouvelée des phénomènes " classiques " comme le corps, les émotions ou l'habitude? The Critique of Pure Reason—Kant’s First Critique—is one of the most studied texts in intellectual history, but as Alfredo Ferrarin points out in this radically original book, most of that study has focused only on very select parts. Likewise, Kant’s oeuvre as a whole has been compartmentalized, the three Critiques held in rigid isolation from one another. Working against the standard reading of Kant that such compartmentalization has produced, The Powers of Pure Reason explores forgotten parts of the First (...) Critique in order to find an exciting, new, and ultimately central set of concerns by which to read all of Kant’s works. Ferrarin blows the dust off of two egregiously overlooked sections of the First Critique—the Transcendental Dialectic and the Doctrine of Method. There he discovers what he argues is the Critique’s greatest achievement: a conception of the unity of reason and an exploration of the powers it has to reach beyond itself and legislate over the world. With this in mind, Ferrarin dismantles the common vision of Kant as a philosopher writing separately on epistemology, ethics, and aesthetics and natural teleology, showing that the three Critiques are united by this underlying theme: the autonomy and teleology of reason, its power and ends.
