Posthumous Life launches critical life studies: a mode of inquiry that neither endorses nor dismisses a wave of recent "turns" toward life, matter, vitality, inhumanity, animality, and the real. Questioning the nature and limits of life in the natural sciences, the essays in this volume examine the boundaries and significance of the human and the humanities in the wake of various redefinitions of what counts as life. They explore the possibility of theorizing life without assuming it to be either a (...) simple substrate or an always-mediated effect of culture and difference. Fitouchi et al.'s moral disciplining approach highlights the significant role social evaluations of self-control appear to play in human moral judgment. At the same time, attributing the wide range of puritanical concerns to a singular focus on self-control seems unwarranted. A more pluralistic approach would enrich understanding of moral judgment in all its cultural and historical diversity.

The subdiscipline of public philosophy is in its adolescence. The mark of maturity in philosophy is the introduction of a metatheoretical discourse. The niche subfield “experimental philosophy” tries to incorporate social scientific methods, but like public philosophy, it too is in its adolescence, often falling back on haphazard and poorly defined methodologies. The definition of public philosophy distinguishes between professional philosophers and what would best be termed amateurs, where professional philosophers are analogous to professional athletes – credentialed individuals who do (...) philosophy full time, are paid for their work, and are usually affiliated with education or research‐focused institutions. Public philosophy must contend with the problems of expertise and wisdom, in so far as disciplinary specialization presume a certain level of each. Academic philosophy condemns public philosophy for failing to meet a set of imagined idealized standards that professors romanticize but also fail to meet. (shrink)

Physicians have an ethical responsibility to their patients to offer the best available medical care. This responsibility conflicts with their role as gatekeepers of the limited health care resources available for all patients collectively. It is ethically untenable to expect doctors to face this trade-off during each patient encounter; the physician cannot be expected to compromise the wellbeing of the patient in the office in favour of anonymous patients elsewhere. Hence, as in other domains of public policy where individual and (...) collective interests conflict, some form of collective solution is required. Collective solutions may take the form of placing explicit resource constraints on resources available to physicians, or clinical practice guidelines that recognise cost-effective care as acceptable. Such solutions will be politically and ethically sustainable only if patients as citizens of the larger population accept the need for rationing of limited resources in health care. (shrink)

This paper critically explores the ethical dimensions of Behavioral Public Policy (BPP), a domain grounded in the understanding that human rationality is bounded and that this limitation often leads to behaviors deemed irrational. By applying the behavioral lens, which posits that people operate under bounded rationality, BPP aims to craft interventions that safeguard individuals against their biases. However, this approach raises significant ethical concerns, both in the scientific underpinnings of BPP and its application through policy interventions. Accordingly, this paper examines (...) two distinct ethical dimensions of BPP, both as a scientific discipline and through its intervention methodologies. The analysis of the first dimension argues that, viewing bounded rationality as only instrumental in decision-making processes, risks oversimplifying ethical complexities. Such simplification may ignore the moral and value-based rationalities underlying decisions, potentially misattributing instances of immorality and akrasia (the failure to act according to one's judgment) to mere deficiencies in rational thinking. Secondly, the paper examines the impact of BPP on moral behavior and character development, addressing ethical concerns like the evidentiary basis of BPP research, the bounded rationality of choice architects themselves, and the morality of behavior changes induced by policy. Overall, this article provides a much-needed examination of the moral considerations associated with behavioral strategies in public policy and its epistemological foundations, contributing to a more comprehensive understanding of their ethical implications . Considero dos ejes específicos de análisis: la propiedad privada y la libertad subjetiva. El objetivo del artículo es señalar la relación que Hegel establece con Platón o, al menos, con República. Muestro que, en realidad, en este diálogo existen ciertos matices con respecto a los dos (...) ejes mencionados; estos matices implican diferencias de análisis respecto de la lectura hegeliana. At the end of his writing, “La Différance,” Jacques Derrida deconstructs his text by taking on an authoritative rhetorical tone. Reflecting back on his discussion of metaphysics, Derrida announces that “(t)here will be no unique name, even if it were the name of Being”. And then he takes a surprising phenomeno-logical turn and advocates a privileged attitude or disposition towards his reflection:And we must think this without nostalgia, that is, outside the myth of a purely maternal or paternal language, a (...) lost native country of thought. In Group Psychology and the Analysis of the Ego Freud addresses the problem of how groups are formed or of how society is possible. The question of the possibility of society presupposes that in some sense human beings are not thoroughly social beings, that they must agree to or be made to participate in a common life in which they submit to general principles regulating their conduct towards one another. The notion that the grounds for social order cannot be taken (...) for granted originates in the beginnings of modern thought, particularly in Hobbes’ Leviathan, in which the classical idea that human beings are essentially social and political animals is rejected in favor of the view that the individual is in a basic sense independent of society and opposed to it, and that society is merely a conventional unity. For Hobbes, society is primarily a defensive alliance guaranteed by fear of a sovereign who constitutes a legal order. Social order, then, is imposed externally on the individual, who submits to regulation only on the basis of prudence. The history of thought about the problem of order after Hobbes’ initial attempt to resolve it is a development of more refined motives for obedience, which culminates in Kant's notion of a self-legislated moral law. The importance of Kant's solution is that it provides a positive ground for society. Human beings do not merely submit to standards because they are inclined to, either out of fear or out of desire, but because they acknowledge a rational principle to which they give their voluntary assent. For Hobbes, society is at least an imposition and at most an expedient. For Kant, society may, indeed, be both an imposition and an expedient, but it is also an order of life that might be perfected. In Kant's view, human beings are imperfectly rational beings, not organisms entirely ruled by pleasure and pain, as they were for Hobbes. (shrink)

The present volume brings together a number of studies, eight in all, dedicated to diverse aspects of Aristotle's conception of rational action and practical rationality. Two principal motifs account for their thematic unity. The first one is given in the idea that Aristotle's view is characterized by a fundamental tension between the totalizing orientation of practical rationality, on the one hand, and the situational subjection of human action, on the other. The second one concerns the connection that Aristotle establishes between (...) rational action (praxis) and truth, expressed in the notion of practical truth. The proposed interpretation seeks to show that Aristotle's conception is not just internally consistent and philosophically interesting; it is also capable of entering into fruitful dialogue with a whole range of modern and contemporary views. It is commonly accepted that Han Fei studied under Xunzi sometime during the late third century BCE. However, there is surprisingly little dedicated to the in-depth study of the relationship between Xunzi’s ideas and one of his best-known followers. In this essay I argue that Han Fei’s notion of xing, commonly translated as human nature, was not only influenced by Xunzi but also that it is an important feature of his political philosophy.

In the following paper, Annemiek Richters of the University of Leiden in the Netherlands addresses the dilemmas faced by health professionals who are asked to evaluate and provide supporting documentation for those refugees who seek political asylum in the countries of Europe. It is in the politically charged arena of asylum applications, government regulations, and public policy where bioethics, human rights, and health converge. Despite the 1951 Convention on Refugees, a treaty signed by nations around the world to safeguard the (...) rights of those who are displaced, and other treaties that protect the rights of vulnerable populations, refugee and asylum policies have become increasingly strict in an effort to deter those who would seek safety. This tightening of borders in the countries of the West challenges physicians who find themselves caught between obligations to treat, to advocate, and to challenge policies that make treatment a potentially dangerous proposition. Unfortunately, the World Trade Center attacks have exacerbated the problem by labeling asylees and refugees as potential terrorists and subject to deportation. (shrink)

Despite impressive technological developments, there is something that does not seem to have changed in the future of the Alien saga: capitalist society. The capitalist mode of production was largely triggered by an important event in the history of humanity: the Industrial Revolution. In the Alien films the worst tendencies of capitalism seem to drive the Weyland‐Yutani Corporation's decisions, confirming Karl Marx's fears that people would not be at the center of the process of capitalist production. It is clear the (...) Weyland‐Yutani Corporation has taken its goal of acquisition of profit at all costs very seriously, as demonstrated by Special Order 937. Alienation is one of Marx's key ideas. This chapter mainly focuses on alienation as it is described in a series of notebooks written in 1857‐1858, also known as the Grundrisse. Marx concludes, based on insights from ancient Greek and Hellenistic philosophers, that the good life should be one of active self‐realization and autonomy. (shrink)

His mission: to detonate a cold fusion device that will solidify the bubbling magma before it erupts and destroys an entire civilization. Meanwhile, Captain James T. Kirk is on the bridge of the Enterprise facing a dilemma. He's duty‐bound never to violate the Prime Directive. One way to address the problem of the Prime Directive is to follow the (...) criteria used by Vulcans: reason and logic. This approach has been highly revered in the history of moral philosophy, and was most convincingly articulated by Immanuel Kant. Confucius and Aristotle would agree that while the Prime Directive is usually correct, there will be cases where it's wrong not to break it. The Prime Directive symbolizes just how difficult making good moral decisions can be. (shrink)

The literary genesis of Einbahnstraße by Walter Benjamin represents a very special case of the use of the procedures of surrealism in the philosophical-literary production of the author. The process of evolution of thinking that ended up in the writing of this piece is unveiled throughout the present analysis. This is a sign of both waiver and restart; the opening for a new productive dimension in the career of one of the most important —and misunderstood— philosophers of the 20th century. (...) More than enlightening a small master piece of philosophy from a literary perspective, or analyzing a small master piece of literature from the philosophy, what is being problematized here is the division, cultivated or figured throughout the years, between both disciplines. This work is intended to recover what is insoluble from the philosophical-literary labor of Walter Benjamin, besides tracing a possible reconfiguration for an interdisciplinary field of work to come up and contribute in the understanding of the problem called The Retreat of Metaphor by Jacques Derrida. For both its enthusiastic adherents as well as its more generous opponents, liberalism commands considerable ethical appeal but at a price. And that price is its lack of systematic integrity or coherence. The charm of its ethical appeal stems from the great values which it celebrates. But for many these very values seem fatally incommensurable, seem to be forever colliding with and thwarting one another. As Isaiah Berlin has never tired of reminding us, liberty and equality continue to defy our (...) best efforts to reconcile them, to weave them together in some kind of orderly and compelling way. Liberalism, in other words, is flawed, if not tragically flawed. For those who nevertheless remain charmed by its ethical appeal, the tragedy of the incommensurability of its basic values is disappointing and disturbing. (shrink)
