This book is about the ethical issues that clinicians encounter as they care for patients and is written to assist those who serve on hospital ethics committees as they deliberate about appropriate action in difficult ethical cases.

The paper presents a framework to realise “meaningful human control” over Automated Driving Systems. The framework is based on an original synthesis of the results of the multidisciplinary research project “Meaningful Human Control over Automated Driving Systems” lead by a team of engineers, philosophers, and psychologists at Delft University of the Technology from 2017 to 2021. Meaningful human control aims at protecting safety and reducing responsibility gaps. The framework is based on the core assumption that human persons and institutions, not (...) hardware and software and their algorithms, should remain ultimately—though not necessarily directly—in control of, and thus morally responsible for, the potentially dangerous operation of driving in mixed traffic. We propose an Automated Driving System to be under meaningful human control if it behaves according to the relevant reasons of the relevant human actors (tracking), and that any potentially dangerous event can be related to a human actor (tracing). We operationalise the requirements for meaningful human control through multidisciplinary work in philosophy, behavioural psychology and traffic engineering. The tracking condition is operationalised via a proximal scale of reasons and the tracing condition via an evaluation cascade table. We review the implications and requirements for the behaviour and skills of human actors, in particular related to supervisory control and driver education. We show how the evaluation cascade table can be applied in concrete engineering use cases in combination with the definition of core components to expose deficiencies in traceability, thereby avoiding so-called responsibility gaps. Future research directions are proposed to expand the philosophical framework and use cases, supervisory control and driver education, real-world pilots and institutional embedding. (shrink)

How should autonomous vehicles be programmed to behave in the event of an unavoidable accident in which the only choice open is one between causing different damages or losses to different objects or persons? This paper addresses this ethical question starting from the normative principles elaborated in the law to regulate difficult choices in other emergency scenarios. In particular, the paper offers a rational reconstruction of some major principles and norms embedded in the Anglo-American jurisprudence and case law on the (...) “doctrine of necessity”; and assesses which, if any, of these principles and norms can be utilized to find reasonable guidelines for solving the ethical issue of the regulation of the programming of autonomous vehicles in emergency situations. The paper covers the following topics: the distinction between “justification” and “excuse”, the legal prohibition of intentional killing outside self-defence, the incommensurability of goods, and the legal constrains to the use of lethal force set by normative positions: obligations, responsibility, rights, and authority. For each of these principles and constrains the possible application to the programming of autonomous vehicles is discussed. Based on the analysis, some practical suggestions are offered. (shrink)

Evidence for incubation effects in problem-solving is increasing, but the mechanisms that underlie incubation are unclear. An experiment tested two hypotheses about incubation: Spreading activation and opportunistic assimilation. Participants solved easy or difficult remote associates tasks without incubation period, or with an incubation period filled with high or low cognitive load tasks. A lexical decision task with cue and neutral words was given either before or after a second problem attempt. When solving difficult problems, the low-load incubation group benefitted more (...) from the presence of a cue than the high-load incubation group, and the opposite was found with easy problems. Neither incubation nor an initial problem attempt affected lexical decision times to cue words. The results favour opportunistic assimilation as an explanation of incubation effects. They also suggest a differential role for attentional allocation depending on problem difficulty, easy problems benefitting from focused attent.. (shrink)

In this paper, in line with the general framework of value-sensitive design, we aim to operationalize the general concept of “Meaningful Human Control” in order to pave the way for its translation into more specific design requirements. In particular, we focus on the operationalization of the first of the two conditions investigated: the so-called ‘tracking’ condition. Our investigation is led in relation to one specific subcase of automated system: dual-mode driving systems. First, we connect and compare meaningful human control with (...) a concept of control very popular in engineering and traffic psychology, and we explain to what extent tracking resembles and differs from it. This will help clarifying the extent to which the idea of meaningful human control is connected to, but also goes beyond, current notions of control in engineering and psychology. Second, we take the systematic analysis of practical reasoning as traditionally presented in the philosophy of human action and we adapt it to offer a general framework where different types of reasons and agents are identified according to their relation to an automated system’s behaviour. This framework is meant to help explaining what reasons and what agents play a role in controlling a given system, thereby enabling policy makers to produce usable guidelines and engineers to design systems that properly respond to selected human reasons. In the final part, we discuss a practical example of how our framework could be employed in designing automated driving systems. (shrink)

Abstract:This is a phenomenological study of mindfulness, a term commonly used to translate the Pāli term sati, and the practice that can lead to its establishment. It first attempts to account for mindfulness as a way of being-in-the-world. It then uses this description as a contrast to present an alternative and more satisfactory account. According to the alternative account, the practice of cultivating mindfulness is the practice of switching one's mode of being from being-in-the-world to 'nature-naturing'. From a different perspective, (...) this is the practice of tuning-out of our projects (the kind of possibility that is constitutive of being-in-the-world) and tuning-in to 'thingly possibilities' (the kind of possibility that is constitutive of nature-naturing). Mindfulness, the potential fruit of this practice, is the feeling of being tuned-in to naturenaturing and thingly possibilities. The study concludes with a description of how mindfulness gives rise to wisdom, the understanding of things as they are. (shrink)

Sweeping changes in technology followed by political, social and economic transformation are modifying the expectations from education. There is urgent need for reforms in the aim, content and method of education systems. Evidence is gathered to justify this need and suggest a process that will lead to the desired reform. We argue that character education is a requirement in order to ensure that changes move in the direction envisaged. This paper focuses on the nature of cultural group rights in relation to individual rights. The recent liberal acceptance that minority cultures should have a collective power over their cultural matters has been challenged by other liberals on the grounds that cultural rights as group rights cannot be reconciled with the basic moral and political principles of liberalism which are derived from individual liberties and rights. Through tackling some liberal arguments against group rights, we reject the view that regards group (...) rights as normatively and practically incompatible with individual rights, and argue that group rights can be defended and justified on the ground that the interests and values protected through them are the shared interests and values of individuals. Thus, whether they are exercised individually or collectively, justifications of all group rights are derived from the interests and values that individuals have as members of the group. Like any other rights, cultural group rights also have some limitations. That is, the rights of a group to preserve its culture are limited by individual human rights, the rights of other relevant groups and the state. (shrink)

When should we use care robots? In this paper we endorse the shift from a simple normative approach to care robots ethics to a complex one: we think that one main task of a care robot ethics is that of analysing the different ways in which different care robots may affect the different values at stake in different care practices. We start filling a gap in the literature by showing how the philosophical analysis of the nature of healthcare activities can (...) contribute to robot ethics. We rely on the nature-of-activities approach recently proposed in the debate on human enhancement, and we apply it to the ethics of care robots. The nature-of-activities approach will help us to understand why certain practice-oriented activities in healthcare should arguably be left to humans, but certain goal-directed activities in healthcare can be fulfilled with the assistance of a robot. In relation to the latter, we aim to show that even though all healthcare activities can be considered as practice-oriented, when we understand the activity in terms of different legitimate ‘fine-grained’ descriptions, the same activities or at least certain components of them can be seen as clearly goal-directed. Insofar as it allows us to ethically assess specific functionalities of specific robots to be deployed in well-defined circumstances, we hold the nature-of-activities approach to be particularly helpful also from a design perspective, i.e. to realize the Value Sensitive Design approach. This is a partial phenomenological study of a phenomenon that I call “displaced feeling”, which is best illustrated through a concrete example. I am overcome by a strong desire to stop writing. For one reason or another, I reject the possibility of pursuing this desire. Instead of giving up the desire altogether, however, I may “speak to myself” as follows: “I feel like having a coffee” and, the chatter goes on in the background “of course to make coffee means to (...) stop writing”. I endorse the desire to get a cup of coffee. But the action through which I pursue this desire is coloured not by the feeling that anticipates the value associated with drinking coffee but by a feeling that anticipates the value associated with stopping writing. The latter feeling has displaced the former: I am in a state of displaced feeling. Here, I will elucidate two invariant structures of displaced feeling. First, I will show that displaced feeling involves the realisation of an endorsed state of affairs, the bringing about of a rejected state of affairs, and the belief that the former will determine the latter. Next, I will show that the endorsed state of affairs appears prominently as the end of an intention, that the rejected state of affairs appears inconspicuously in the horizon of the same intention, and that the belief appears twice: as a motive for this intention and as the “glue” that keeps its prominent and inconspicuous zones together. This work is best described as an endeavour to contribute to the phenomenology of intentions, the experiences of intending to do something. It finds its point of departure in the discussion of two ‘analytic philosophers’, John Searle and John McDowell, where two contrasting accounts of intentions are offered. The first task is to derive a hybrid account, according to which there are different kinds of intentions, each having the property of being a potential continuant with prior- and in-action phases. The (...) remainder of the discussion is a phenomenological justification of the hybrid account. Through a critical engagement with work of the classical phenomenologists, descriptions are advanced towards the end of demonstrating that the genus intention splits into the species projecting and willing and that each instantiates the property of being a potential continuant with prior- and in-action phases. This work does not offer a complete justification of the hybrid account; rather, the discussion culminates with the articulation of a concrete phenomenological problem, the answer to which is a condition for the evaluation of the phenomenological merit of the hybrid account. This problem functions as an invitation for other phenomenologists to return to thing themselves and engage in concrete phenomenological work. (shrink)

This book is an attempt to get to the bottom of an acute and perennial tension between our best scientific pictures of the fundamental physical structure of the world and our everyday empirical experience of it. The trouble is about the direction of time. The situation (very briefly) is that it is a consequence of almost every one of those fundamental scientific pictures--and that it is at the same time radically at odds with our common sense--that whatever can happen can (...) just as naturally happen backwards. Albert provides an unprecedentedly clear, lively, and systematic new account--in the context of a Newtonian-Mechanical picture of the world--of the ultimate origins of the statistical regularities we see around us, of the temporal irreversibility of the Second Law of Thermodynamics, of the asymmetries in our epistemic access to the past and the future, and of our conviction that by acting now we can affect the future but not the past. The modern era has witnessed an extraordinary and unprecedented growth in our empirical knowledge regarding the human body. This raises the question: what, if anything, can phenomenology teach us about the body that the empirical sciences cannot? Whereas common sense and empirical sciences begin from the body as straightforwardly and obviously given and go on from there to think about what this thing is, what it is made up of, and how it originated, phenomenology steps back from the straightforward fact (...) in order to ask: what is the structure of the body as an appearance? This chapter considers how some of the main figures in phenomenology have tried to answer this question. The body is not explicitly discussed in what might be thought of as the two foundational works of phenomenology: Husserl’s Logical Investigations and Heidegger’s Being and Time. Nevertheless, these works set the stage for the subsequent phenomenology of the body by describing the phenomena of multidimensionality and horizontality. Our first task will be to sketch out how these phenomena were described in the foundational works. This sets up our exposition of the body as a multidimensional phenomenon. We consider Husserl’s treatment of the body in Ideas II. We also examine how the Husserlian insights were taken up and developed by Jean-Paul Sartre and Maurice Merleau-Ponty. In conclusion we raise some critical questions regarding a phenomenological focus on the body and its multidimensionality. (shrink)

This work develops a phenomenological account of mindfulness, and related phenomena. It is divided into two main parts. The aim of part one is to articulate a pre-phenomenological sketch of mindfulness by drawing on passages from some of the classic works of Western literature and everyday life, through an interpretation of the Satipaṭṭhāna Sutta and by the means of a critical analysis of the contemporary attempts to account for these phenomena. Part two adds further detail to the sketch by entering (...) a dialogue with the phenomenology of Edmund Husserl. A key distinctions made here is between the transcendental horizon and the open horizon. This difference allows cultivating mindfulness to be defined as the practice of tuning-out of the transcendental horizon and tuning-in to the open horizon. Mindfulness—the potential fruit of tuning-in-tuning-out—is defined as the feeling of being tuned-in to the open horizon.A key findings of this research is that tuning-in-tuning-out is a difference practice than the phenomenological epoché; whereas the latter discloses the transcendental horizon, the former discloses the open horizon—on which the transcendental horizon is dependent. These findings open up the possibility of a phenomenological description of certain phenomena that are closely related to mindfulness. Some of these phenomena are: Mindful attention, which is defined as the function of foregrounding a sub-horizon within the open horizon and the pushing of the other sub-horizons into the background. Concentration : the narrowing down of the open horizon to one of its sub-horizons. Insight : the activity of isolating a sub-horizon, discerning its thingly possibilities, zooming out, isolating a second sub-horizon and discerning its thingly possibilities, and then contrasting the two in such a way that their difference becomes vividly present. Albert Lautman (1908-1944) was a French philosopher of mathematics whose work played a crucial role in the history of contemporary French philosophy. His ideas have had an enormous influence on key contemporary thinkers including Gilles Deleuze and Alain Badiou, for whom he is a major touchstone in the development of their own engagements with mathematics. Mathematics, Ideas and the Physical Real presents the first English translation of Lautman's published works between 1933 and his death in 1944. Rather than being (...) preoccupied with the relation of mathematics to logic or with the problems of foundation, which have dominated philosophical reflection on mathematics, Lautman undertakes to develop an understanding of the broader structure of mathematics and its evolution. The two powerful ideas that are constants throughout his work, and which have dominated subsequent developments in mathematics, are the concept of mathematical structure and the idea of the essential unity underlying the apparent multiplicity of mathematical disciplines. In medical ethics, business ethics, and some branches of political philosophy (multi-culturalism, issues of just allocation, and equitable distribution) the literature increasingly combines insights from ethics and the social sciences. Some authors in medical ethics even speak of a new phase in the history of ethics, hailing "empirical ethics" as a logical next step in the development of practical ethics after the turn to "applied ethics." The name empirical ethics is ill-chosen because of its associations with "descriptive ethics." Unlike descriptive (...) ethics, however, empirical ethics aims to be both descriptive and normative. The first question on which I focus is what kind of empirical research is used by empirical ethics and for which purposes. I argue that the ultimate aim of all empirical ethics is to improve the context-sensitivity of ethics. The second question is whether empirical ethics is essentially connected with specific positions in meta-ethics. I show that in some kinds of meta-ethical theories, which I categorize as broad contextualist theories, there is an intrinsic need for connecting normative ethics with empirical social research. But context-sensitivity is a goal that can be aimed for from any meta-ethical position. (shrink)

The notion of “responsibility gap” with artificial intelligence (AI) was originally introduced in the philosophical debate to indicate the concern that “learning automata” may make more difficult or impossible to attribute moral culpability to persons for untoward events. Building on literature in moral and legal philosophy, and ethics of technology, the paper proposes a broader and more comprehensive analysis of the responsibility gap. The responsibility gap, it is argued, is not one problem but a set of at least four interconnected (...) problems – gaps in culpability, moral and public accountability, active responsibility—caused by different sources, some technical, other organisational, legal, ethical, and societal. Responsibility gaps may also happen with non-learning systems. The paper clarifies which aspect of AI may cause which gap in which form of responsibility, and why each of these gaps matter. It proposes a critical review of partial and non-satisfactory attempts to address the responsibility gap: those which present it as a new and intractable problem (“fatalism”), those which dismiss it as a false problem (“deflationism”), and those which reduce it to only one of its dimensions or sources and/or present it as a problem that can be solved by simply introducing new technical and/or legal tools (“solutionism”). The paper also outlines a more comprehensive approach to address the responsibility gaps with AI in their entirety, based on the idea of designing socio-technical systems for “meaningful human control", that is systems aligned with the relevant human reasons and capacities.
