Nicolai Hartmann hat philosophische Studien zur Erkenntnistheorie, Ontologie, Ethik, Philosophie des Geistes und Naturphilosophie geschrieben. Die Beiträge des Bandes gehen davon aus, dass seine Arbeit auf all diesen Feldern im Zeichen der Verabschiedung der Systemphilosophie sowie der Begründung einer Konzeption systematischen Philosophierens steht. Im Zentrum von Hartmanns Denken steht das "Kategorienproblem", d. i. die Frage nach den elementaren Strukturen der Wirklichkeit und der menschlichen Erkenntnis. English summary: Grappling with the tension between our religious orientations and modernity's drive to lend authority to things based on arguments against the backdrop of scientific and historial knowledge has made intellectual honesty a guiding principle in the modern era. The ascent of the concept of religiousness in the 19th and 20th centuries was a reflection of this state of mind. Thus the intellectual climate in the modern era was defined less by religious tone-deafness as it was by an awareness (...) of the crisis caused by scientism and historicism. However, modernity has always seen this crisis as a chance for the religious to make itself more concise. This volume seeks to shed light on the contribution that the quest for intellectual honesty has made to the creation of religious identity in the modern era, a contribution which has by no means been exhausted. German description: Im Bewusstsein der Spannung zwischen religiosen Lebensorientierungen und der Notigung des Gewissens, ihnen durch das Geben und Nehmen von Grunden im Horizont des modernen Wissens Verbindlichkeit zu verleihen, ist die intellektuelle Redlichkeit ein Leitideal der Moderne geworden. While much current research on political Islam revolves around militant Islamism, the genesis of this ideology remains little understood. A System of Life is a pioneering examination of the earliest attempt at a systematic outline of Islamist ideology, namely that proposed in the 1930s and early 1940s by the renowned Indo-Muslim intellectual Sayyid Abu'l-A'la Mawdudi. Hartung reconstructs his thought in the light of the competing ideologies at play at the time, especially his claim to recast Islam as an all-comprehensive, (...) self-contained and inner-worldly system of life. His analysis is embedded in an understanding of the history of ideas that assumed increasingly global dimensions through colonial encounters. By showing how Mawdudi -- depicted as a major protagonist of this development - attempted to align elements of Western philosophical thought with selected traditional Islamic ideas and concepts, 'Islamism' is established as an Islamic contribution to a universalistic notion of modernity. Along with offering a detailed portrayal of Mawdudi's system of thought, Hartung also discusses the reception and modification of his ideas in the Middle East, predominantly among intellectuals of the Egyptian Muslim Brotherhood, and among their imitators in postcolonial South Asia. Albert Lautman (1908-1944) was a French philosopher of mathematics whose work played a crucial role in the history of contemporary French philosophy. His ideas have had an enormous influence on key contemporary thinkers including Gilles Deleuze and Alain Badiou, for whom he is a major touchstone in the development of their own engagements with mathematics. Mathematics, Ideas and the Physical Real presents the first English translation of Lautman's published works between 1933 and his death in 1944. Rather than being (...) preoccupied with the relation of mathematics to logic or with the problems of foundation, which have dominated philosophical reflection on mathematics, Lautman undertakes to develop an understanding of the broader structure of mathematics and its evolution. In medical ethics, business ethics, and some branches of political philosophy (multi-culturalism, issues of just allocation, and equitable distribution) the literature increasingly combines insights from ethics and the social sciences. Some authors in medical ethics even speak of a new phase in the history of ethics, hailing "empirical ethics" as a logical next step in the development of practical ethics after the turn to "applied ethics." The name empirical ethics is ill-chosen because of its associations with "descriptive ethics." Unlike descriptive (...) ethics, however, empirical ethics aims to be both descriptive and normative. The first question on which I focus is what kind of empirical research is used by empirical ethics and for which purposes. I argue that the ultimate aim of all empirical ethics is to improve the context-sensitivity of ethics. The second question is whether empirical ethics is essentially connected with specific positions in meta-ethics. I show that in some kinds of meta-ethical theories, which I categorize as broad contextualist theories, there is an intrinsic need for connecting normative ethics with empirical social research. But context-sensitivity is a goal that can be aimed for from any meta-ethical position. (shrink)

Building on the computer science concept of _code smells_, we initiate the study of _law smells_, i.e., patterns in legal texts that pose threats to the comprehensibility and maintainability of the law. With five intuitive law smells as running examples—namely, duplicated phrase, long element, large reference tree, ambiguous syntax, and natural language obsession—, we develop a comprehensive law smell taxonomy. This taxonomy classifies law smells by when they can be detected, which aspects of law they relate to, and how they (...) can be discovered. We introduce text-based and graph-based methods to identify instances of law smells, confirming their utility in practice using the United States Code as a test case. Our work demonstrates how ideas from software engineering can be leveraged to assess and improve the quality of _legal_ code, thus drawing attention to an understudied area in the intersection of law and computer science and highlighting the potential of computational legal drafting. By turns historical, sociological and autobiographical, this book investigates racism as social pathology - a cultural disease that prevails because it allows one segment of society to empower itself at the expense of another.

The political theory of the property-owning democracy can be seen as a way of overcoming the ideological conflict between individualism and collectivism. Rawls offers the contemporary reference-point for this theory. Rawls contrasted the ideal-type of the property-owning democracy with the ideal-type of a capitalist welfare state. However, the terms of that contrast are not well drawn and raise a number of questions, in particular regarding Rawls’s a priori specification of the welfare state. An inductively derived specification of ideal-typical welfare states (...) suggests that horizontal redistribution, in line with the principle of social savings, is more important than vertical redistribution. Rawls’s preference for a social dividend or negative income tax scheme can be contrasted with the use of social insurance, but the latter has a claim to instantiate Rawlsian ideals better than a social dividend. There is a potential problem with the pre-emption of private savings in the welfare state, but this turns out not to be troublesome empirically or conceptually. The irony of the discussion is that those who have interpreted Rawlsian theory as justifying the welfare state have the better of the argument, despite Rawls’s own views. (shrink)

Throughout his writings, Hume extols the benefits of an attribute he calls “Strength of Mind,” which he defines as the “prevalence of the calm passions over the violent” (T 2.3.3.10). But there is some question as to how he thought a person could attain this important trait. Contemporary scholars have committed Hume to the view that only indirect and social methods, such as state punishment or sympathetic pressure, could effectively cultivate it. Yet a closer examination of Hume’s corpus reveals a (...) more direct approach applicable at the individual level. Though rarely achieved and difficult to execute, self-government of the passions is possible according to Hume. The key to success lies in harnessing the power of habit. In its most sophisticated form, the process centrally involves cultivating a certain transformative connoisseurship, the ability to appreciate regularities in one’s own mental activity and thereby alter it. Fortunately, there have been several notable attempts. Throughout his works, Richard Shusterman frequently incorporates the perspectives of various East Asian philosophies into his articulation of somaesthetics. Multiple scholars have explored John Dewey’s lectures in China and their political and educational impact, such as Jessica Ching-Sze Wang’s John Dewey in China or The Democracy of the Dead by Roger T. Ames and David L. Hall. Still others have highlighted the influence of Indian thought on pragmatism’s forerunners, such as American Philosophy Before Pragmatism (Goodman 2015), American Pragmatism: An Introduction (Spencer 2020), and The Ethics of Oneness (Engles 2021). Perhaps the most interesting inquiries into this influence can be found in a special volume of The Journal of Aesthetic Education (Vol. 43, No. 1) where multiple scholars discuss pragmatism’s connections and comparisons to The Bhagavad Gita, Confucianism, and Taoism. Among these scholars is Scott Stroud whose most recent publication The Evolution of Pragmatism in India (2023) represents the culmination of nearly two decades of research on the subject with special attention to the continuities between pragmatism and Indian thought. In it, he meticulously explores the influence of John Dewey on one of his students, Bhimrao Ambedkar (1891–1956), who was a transformative figure in the founding of the nascent Republic of India. This article examines the (bio) ethical and professionalism issues that may arise in the context of medical practice in low and middle income countries (LAMIC), and the challenges this poses for medical regulatory bodies in the regions, in upholding ethics in professional practice. A quadrangle of source of the problems given rise to the breach of ethics in medical practice is identified, and suggested steps, based on ethical principles and concept, is proposed towards the resolution of the problems presented. LAMIC progress to improve the health of its population, this endeavour should occur hand in hand with contemporary medical ethics theories, taking in context the region’s ethnographic and cultural beliefs and practices. Are people with flawed faces regarded as having flawed moral characters? An “anomalous-is-bad” stereotype is hypothesized to facilitate negative biases against people with facial anomalies (e.g., scars), but whether and how these biases affect behavior and brain functioning remain open questions. We examined responses to anomalous faces in the brain (using a visual oddball paradigm), behavior (in economic games), and attitudes. At the level of the brain, the amygdala demonstrated a specific neural response to anomalous faces—sensitive to disgust and a (...) lack of beauty but independent of responses to salience or arousal. At the level of behavior, people with anomalous faces were subjected to less prosociality from participants highest in socioeconomic status. At the level of attitudes, we replicated previously reported negative character evaluations made about individuals with facial anomalies, and further identified explicit biases directed against them as a group. Across these levels of organization, the specific amygdala response to facial anomalies correlated with stronger just-world beliefs (i.e., people get what they deserve), less dispositional empathic concern, and less prosociality toward people with facial anomalies. Characterizing the “anomalous-is-bad” stereotype at multiple levels of organization can reveal underappreciated psychological burdens shouldered by people who look different. (shrink)

The subject of this paper is a characterization of the $\Sigma_1$ -definable set functions of Kripke-Platek set theory with infinity and a uniform version of axiom of choice: $KP\omega+(uniform\;AC)$ . This class of functions is shown to coincide with the collection of set functionals of type 1 primitive recursive in a given choice functional and $x\mapsto\omega$ . This goal is achieved by a Gödel Dialectica-style functional interpretation of $KP\omega+(uniform\;AC)$ and a computability proof for the involved functionals.
