The first modern edition of the Instituzione d’ogni stato lodevole delle donne cristiane (1575), and the Ricordi di Monsignor Agostino Valier Vescovo di Verona lasciati alle monache nella sua visitazione fatta l’anno del santissimo Giubileo 1575 (1575) by Cardinal Agostino Valier (Venice, 7 April 1531 – Rome, 23 May 1606). The Instituzione includes three texts meant respectively for unmarried women, widows, and married women (Del modo di vivere delle vergini che si chiamano demesse; Della vera e (...) perfetta viduità; Instruzione delle donne maritate), while the Ricordi is a book for nuns on monastic life. The texts by Agostino Valier are an important example of conduct literature for and about women in Counter-Reformation Italy. In identifying that the 'essential tension' is the balance between conservative and innovative approaches in the development of knowledge - tried-and tested or new directions - Kuhn pointed out that these two attitudes are both appropriate. This study adds to this picture the social and psychological dynamics that underpin any such balancing.

A penal ethics for today examines the connections between affect and morality. It scrutinises closely the felt moralities within the apprehension of crime. These felt moralities underpin interventions that are seemingly mobilised by a passion for justice. A penal ethics questions whether these sensibilities really do move moral actors as just feelings. This proposition is readily defended by reference to the emotive moralism in some notable areas. These include legitimation of the death penalty as ‘closure’ for victims, and the emergent (...) imperative to wage ‘virtuous’ wars. Developing an ethics that challenges the contemporary penal field requires a sophisticated theoretical elaboration. An approach of this kind entails the conceptual determination and phenomenological analysis of moral sensibilities. This essay accordingly explores the feeling of being moved by a sense of atrocity. It considers the feeling of being moved to respond justly to one globally noted death from crime. This was a death thought to have reinforced the West’s sense of moral purpose in the movement toward ‘virtuous war’ upon an Iraqi regime framed as ‘brutal’. (shrink)

In his renowned collection Philosophy as a Way of Life, Pierre Hadot suggests that the original trait of philosophy as a method by which one exercises themselves to achieve a new way of living and seeing the world fails with the rise of modernity. In that time, philosophy increasingly takes on a merely theoretical aspect, tending toward a system. However, Hadot himself glimpses at the dawn of modernity some instances of the original trait of philosophy still very much present, and (...) in his wake, Michel Foucault warns that between the late 16th and early 17th centuries the philosophical question of the reform of the mind attests to a still very close link between asceticism and truth. This book aims to develop just such an idea by thoroughly analyzing the most representative works of the reform of the mind in the early modern period: Francis Bacon's New Organon (1620), René Descartes' Discourse on the Method (1637), and Baruch Spinoza's Treatise on the Emendation of the Intellect (1677). From this analysis it will emerge that these modern works fully deserve to be counted among the tradition of philosophy as way of life. On closer inspection, the inquiries about method elaborated in these works are fully understandable only when read in the light of a broader and more complex philosophical need: to establish the spiritual conditions for accessing truth and aspiring to full self-realization. In the context of the launch of a new theater company whose mission is to bring entertaining theological content to audiences in and around Jerusalem, Roy Doliner’s Divine Right was chosen as the company’s first production. This play about the Disputation of Barcelona balances historical accuracy and creative dramatic content in a satisfying and intellectually honest portrayal of the events of the Disputation for educated lay audiences. Many theological and dramaturgical issues arise, especially in producing a play with a high (...) level of Christian content and theology for mainly Orthodox or at least traditionally educated Jewish audiences. English speaking audience members in Jerusalem tend to be well-informed, both on the historical level and on the level of Jewish law and mores. This makes them exacting viewers, critical of inaccuracies of history or interpretation, wary of challenging positions but mostly willing to learn, and delighted by thorough research and characterization. This paper examines the technical, dramaturgical, and theological issues that arose during this production for the playwright, director, actors, and audiences. (shrink)

Decision-making assisted by algorithms developed by machine learning is increasingly determining our lives. Unfortunately, full opacity about the process is the norm. Would transparency contribute to restoring accountability for such systems as is often maintained? Several objections to full transparency are examined: the loss of privacy when datasets become public, the perverse effects of disclosure of the very algorithms themselves, the potential loss of companies’ competitive edge, and the limited gains in answerability to be expected since sophisticated algorithms usually are (...) inherently opaque. It is concluded that, at least presently, full transparency for oversight bodies alone is the only feasible option; extending it to the public at large is normally not advisable. Moreover, it is argued that algorithmic decisions preferably should become more understandable; to that effect, the models of machine learning to be employed should either be interpreted ex post or be interpretable by design ex ante. This book examines the most controversial issues concerning the use of pre-drafted clauses in fine print, which are usually included in consumer contracts and presented to consumers on a take-it-or-leave-it basis. By applying a multi-disciplinary approach that combines consumer's psychology and seller's drafting power in the logic of efficiency and good faith, the book provides a fresh and unconventional analysis of the existing literature, both theoretical and empirical. Moving from the unconscionability doctrine, it criticizes (and in some cases refutes) its (...) main conclusions based on criteria which are usually invoked to sustain the need for public intervention to protect consumers, and specifically related to Law (contract complexity), Psychology (consumer lack of sophistication criterion) and Economics (market structure criterion). It also analyzes the effects of different regulations, such as banning vexatious clauses or mandating disclosure clauses, showing that none of them protect consumers, but in fact prove to be harmful when consumers are more vulnerable, that is whenever sellers can exploit some degree of market power. In closing, the book combines these disparate aspects, arguing that the solution (if any) to the problem of consumer exploitation and market inefficiency associated with the use of contracts of adhesion in these contexts cannot be found in removing or prohibiting hidden clauses, but instead has to take into account the effects of these clauses on the contract as a whole.
