What are our responsibilities in the face of injustice? How far should we go to fight it? Many would argue that as long as a state is nearly just, citizens have a moral duty to obey the law. Proponents of civil disobedience generally hold that, given this moral duty, a person needs a solid justification to break the law. But activists from Henry David Thoreau and Mohandas Gandhi to the Movement for Black Lives have long recognized that there are times (...) when, rather than having a duty to obey the law, we have a duty to disobey it. -/- Taking seriously the history of this activism, A Duty to Resist wrestles with the problem of political obligation in real world societies that harbor injustice. Candice Delmas argues that the duty of justice, the principle of fairness, the Samaritan duty, and political association impose responsibility to resist under conditions of injustice. We must expand political obligation to include a duty to resist unjust laws and social conditions even in legitimate states. -/- For Delmas, this duty to resist demands principled disobedience, and such disobedience need not always be civil. At times, covert, violent, evasive, or offensive acts of lawbreaking can be justified, even required. Delmas defends the viability and necessity of illegal assistance to undocumented migrants, leaks of classified information, distributed denial-of-service (DDoS) attacks, sabotage, armed self-defense, guerrilla art, and other modes of resistance. There are limits: principle alone does not justify law breaking. But uncivil disobedience can sometimes be not only permissible but required in the effort to resist injustice. (shrink)

ABSTRACTResearch that dissociates different types of processes within a given task using a processing tree approach suggests that attitudes may be acquired through evaluative conditioning in the absence of explicit encoding of CS-US pairings in memory. This research distinguishes explicit memory for the CS-US pairings from CS-liking acquired without encoding of CS-US pairs in explicit memory. It has been suggested that the latter effect may be due to an implicit misattribution process that is assumed to operate when US evocativeness is (...) low. In the present research, the latter assumption was supported neither by two high-powered experiments nor by complementary meta-analytic evidence, whereas evocativeness exerted an influence on explicit memory. This pattern of findings is inconsistent with the view that CS-liking acquired without encoding of CS-US pairs in explicit memory reflects an implicit misattribution process at learning. Hence, the underlying learning process is awaiting further empirical scrutiny. (shrink)

Quelles sont nos responsabilités face à l’injustice ? Les philosophes considèrent généralement que les citoyens d’un État globalement juste doivent obéir à la loi, même lorsqu’elle est injuste, quitte à employer exceptionnellement la désobéissance civile pour protester. Les militants quant à eux, qu’ils luttent pour les droits civiques, contre les violences faites aux femmes ou pour le climat, jugent souvent que l’obligation première est résister à l’injustice.

Deep learning and other black-box models are becoming more and more popular today. Despite their high performance, they may not be accepted ethically or legally because of their lack of explainability. This paper presents the increasing number of legal requirements on machine learning model interpretability and explainability in the context of private and public decision making. It then explains how those legal requirements can be implemented into machine-learning models and concludes with a call for more inter-disciplinary research on explainability.

The issue at stake in this volume is the role of science as a way to fulfil a quest for knowledge, a tool in the exploration of foreign lands, a central paradigm in the discourse on and representations of Otherness. The interweaving of scientific and ideological discourses is not limited to the geopolitical frame of the British empire in the nineteenth and early twentieth centuries but extends to the rise of the American empire as well. The fields of research tackled (...) are human and social sciences (anthropology, ethnography, cartography, phrenology), which thrived during the period of imperial expansion, racial theories couched in pseudo-scientific discourse, natural sciences, as they are presented in specialised or popularised works, in the press, in travel narratives at the crossroads of science and literature in essays, but also in literary texts. Contributors examine such issues as the plurality of scientific discourses, their historicity, the alienating dangers of reduction, fragmentation and reification of the Other, the interaction between scientific discourse and literary discourse, the way certain texts use scientific discourse to serve their imperialist views or, conversely, deconstruct and question them. Such approaches allow for the analysis of the link between knowledge and power as well as of the paradox of a scientific discourse which claims to seek the truth while at the same time both masking and revealing the political and economic stakes of Anglo-saxon imperialism. The analysis of various types of discourse and/or representation highlights the tension between science and ideology, between scientific "objectivity" and propaganda, and stresses the limits of an imperialist epistemology which has sometimes been questioned in more ambiguous or subversive texts. This paper analyzes how national institutional factors affect the adoption of the international environmental management standard ISO 14001, using a panel of 139 countries from 1996 to 2006. The analysis emphasizes that during the emerging phase of the standard, the potential lack of consensus within the constituents of the national institutional environment concerning the value of a new standard could send mixed signals to firms about the standard. The results show that in the early phase of adoption, regulative and normative (...) forces within the institutional environment can work against each other. Results also showthat regulative or coercive forces play a relatively more important role in the early phase of adoption of the standard than in the subsequent phases of diffusion. In the later phases of diffusion of ISO 14001, normative forces, such as the diffusion of other management standards, as well as factors related to trade, play a more important role. Because of the similarities between environmental management standards and corporate social responsibility standards, this study can help identify some of the challenges for diffusion of ISO management standards in the area of social responsibility. Dans le Traité de la réforme de l’entendement, le jeune Spinoza réconcilie sans les confondre les deux principales composantes de la vera Methodus et, dans une certaine mesure, unifie Méthode réflexive et Philosophie. Or, ces deux démarches apportent un éclairage sur la Méthode d’interprétation de l’Écriture conçue au chapitre VII du Traité théologico-politique. En effet, il existe une cohérence trop négligée dans les études spinozistes entre la vera Methodus et ce qu’est devenue la Philosophie ultérieure de Spinoza lorsqu’il formule les (...) règles de l’interprétation de l’Écriture. Cette cohérence s’exprime sur deux plans. Primo, l’interprétation spinozienne des Lettres sacrées implique dans un autre registre l’histoire de l’entendement fondée par le jeune Spinoza sur la connaissance réflexive de l’idée vraie donnée et l’expérimentation. Secundo, l’impossibilité d’une « science vraie » de l’Écriture et l'emploi d'outils intellectuels innés placent le Traité théologico-politique et le Traité de la réforme de l’entendement dans un horizon commun : celui d’un usage spécifique de l’entendement et d’une alternative à la connaissance causale déployée dans l’Éthique. We propose a model that identifies the configurations of relations between environmental practices and other management practices that can improve employee performance, measured as labor productivity. To test our model, we use the qualitative comparative analysis methodology, which allows us to demonstrate empirically how different configurations of management practices, including environmental practices, quality management systems, teamwork, and interorganizational relations, contribute to work systems in ways that increase labor productivity. Our results, based on data from 4,975 employees from 1,866 firms, show (...) that environmental practices are associated with higher labor productivity only when they are combined with other management practices. This study assesses the impact had by institutional isomorphic pressures in the organisational fields of 185 businesses operating within the United Kingdom. The emphasis throughout is on how external institutions affect the socially and environmentally responsible aspects of an organization’s purchasing practice. Factor analyses and a linear regression model are employed to test the influence of these pressures. Initial findings suggest that what other industry participants are doing in this area is not as important in affecting the procurement practice of (...) the focal organisation as is the managers’ perception of how legitimacy is awarded by stakeholders and, indeed, if competitors with well-developed social and environmental supply chain management programs are perceived favourably in the industry. Leo Strauss (1899-1973) est certainement un penseur majeur du XXe siècle. Lui qui a rouvert des procès jugés depuis longtemps - la querelle des Anciens et des Modernes, ou encore l'opposition entre la raison et la révélation - fait l'objet de commentaires contradictoires, le présentant comme un penseur tantôt fondamentalement apolitique, uniquement soucieux de redonner sens à la vie philosophique, tantôt secrètement politique, servant les forces les plus conservatrices des Etats-Unis. Ce livre entreprend d'abord de retrouver en Strauss un des (...) philosophes politiques les plus stimulants de son siècle, c'est-à-dire un philosophe soucieux de comprendre et d'éclairer les phénomènes politiques. Il faut toutefois convenir qu'abordée sous cet angle, son oeuvre présente un singulier paradoxe. Car si Strauss plaide avec force pour un retour à la compréhension classique des régimes politiques, il se montre en même temps très réticent à analyser les différents régimes et clivages du monde moderne. Plus étonnant encore, alors qu'il en appelle à une science politique qui soit fidèle à l'appréhension citoyenne des phénomènes, il ne cesse de relativiser, à propos de son époque, les différences entre communistes, progressistes et conservateurs. En somme, entre sa conception de la bonne science politique, et sa manière presqu'apolitique de traiter de la modernité, il existe un déroutant hiatus. C'est ce problème plus spécifique que nous explorons ici. (shrink)

The following text seeks to identify the origins of what has come to be called the Sokal hoax. It appears that these origins remain problematic insofar as they cannot be thought without engaging into intrinsically duplicitous thinking. Thus, « originally », the gesture of the hoax is indeed « productive and conflictive, and no self-identity, no unity, and no inherent simplicity can possibly precede it », as « he » said, but « he » was disseminating, as we say. But (...) that is precisely the « strength » of the « form » of the Sokal hoax. With the delicate question of origins as its stumbling block—a stumbling block which may also be the question of irony—, the present text takes its cue from an passage from La Barbarie à visage humain and proposes to reveal the constructive consequences of the affair triggered by the hoax, while constantly paying tribute to its performance. Whether my argument will make it possible to distinguish the consequences from the origins remains moot : post hoc ergo propter hoc. One must remember that this is a sophism. (shrink)

Comprendre la tyrannie, retrouver les critères qui nous permettent de l’apercevoir et d’en juger correctement, telle est la fin que Leo Strauss assigne explicitement à son étude du Hiéron de Xénophon. Pourtant, la lecture du livre peut aisément donner l’impression qu’il y est moins question de la tyrannie proprement dite que du rapport entre le philosophe et le politique, ou entre la sagesse et la loi. La préoccupation pour la tyrannie semble ainsi s’effacer devant une préoccupation plus générale sur la (...) nature de la philosophie politique classique dans son ensemble. Nous voulions toutefois ici prendre plus au sérieux l’intention de Strauss, et nous efforcer de comprendre son argumentation ou « enseignement » sur la tyrannie. (shrink)

Le Supplément au Voyage de Bougainville est le point d’aboutissement d’une critique menée à l’encontre de toute absolutisation de la norme morale, au travers de la confrontation des « codes » civil, religieux et naturel. Les individus, comme les constellations de jugement qu’ils forment, sont passés au crible d’une écriture digressive qui démonte les mécanismes idéologiques de l’agir. Les institutions écclésiales sont mises à mal, cela va de soi, en raison des atteintes qu’elles portent à la liberté individuelle. Pourtant, Diderot (...) dépasse une visée polémique, par trop démonstrative, pour faire de l’écriture dialogique, construite sur deux niveaux, le lieu d’une exploration des conditions d’application de la « loi naturelle » dans le champ de la morale et, partant, du politique. En 2014 et 2015 se sont tenus à Paris une série d’ateliers de recherches « Autour d’Alexandre de Halès », coorganisés par Claire Angotti, Sophie Delmas, et Dominique Poirel 1.Le point de départ de ces ateliers fut le constat d’un paradoxe: en dépit de son action fondatrice dans l’histoire de l’université de Paris comme dans la naissance d’un courant théologique franciscain, Alexandre de Halès n’avait fait l’objet que d’études nombreuses morcelées. Utiles pour circonscrire ses positions propres sur divers points (...) de doctrine, ces études ne permettaient guère de comprendre l’œuvre et la pensée dans ce qui fait leur originale unité. En... The author presents a deduction system for Quantum Logic. This system is a combination of a natural deduction system and rules based on the relation of compatibility. This relation is the logical correspondant of the commutativity of observables in Quantum Mechanics or perpendicularity in Hilbert spaces. Contrary to the system proposed by Gibbins and Cutland, the natural deduction part of the system is pure: no algebraic artefact is added. The rules of the system are the rules of Classical Natural Deduction (...) in which is added a control of contexts using the compatibility relation. The author uses his system to prove the following theorem: if propositions of a quantum logical propositional calculus system are mutually compatible, they form a classical subsystem. (shrink)

What is wrong with government whistleblowing and when can it be justified? In my view, ‘government whistleblowing’, i.e., the unauthorized acquisition and disclosure of classified information about the state or government, is a form of ‘political vigilantism’, which involves transgressing the boundaries around state secrets, for the purpose of challenging the allocation or use of power. It may nonetheless be justified when it is suitably constrained and exposes some information that the public ought to know and deliberate about. Government whistleblowing (...) should then be viewed, along the lines of civil disobedience, as a collective cognition- and legitimacy-enhancing device. (shrink)

Este trabalho apresenta uma pesquisa sobre a religiosidade em Mazagão Velho, expressa por meio das festas devocionais que ali ocorrem, buscando compreendê-las como um elemento histórico de coesão social. Para tanto, parte-se do estudo da mentalidade formada no Brasil colônia com sua ideologia de expansão da fé cristã. É nesse contexto que toma forma o catolicismo popular. A localidade escolhida como base para este estudo apresenta especificidades que a tornam um caso único. Ela traz a memória das antigas lutas entre (...) cristãos e mouros ainda no Marrocos, onde foi primeiramente fundada, sendo posteriormente transferida para o Brasil no século XVIII. Além disso, apresenta um rico processo de interação com os indígenas e africanos, caracterizando-a como uma sociedade multicultural. Essa história ainda é marcada pela degradação social ocorrida no final do século XVIII. Contudo, mesmo passando por diversos reveses, a comunidade subsistiu e mantém-se viva até os dias atuais. Como principal prática social, destacam-se as festas devocionais, que são eventos coletivos que congregam elementos, como as crenças e os rituais que expressam a vida em sociedade. Também fazem parte dessas festas as manifestações culturais surgidas a partir do encontro das culturas ali presentes. Para entender essa longa história, a ideia de coesão social foi essencial. Neste sentido, a pesquisa buscou mostrar que essa comunidade manteve sua existência graças à coesão social ali formada e sustentada pela religiosidade que se manifesta, de maneira mais efetiva, por meio das festas em devoção aos santos católicos em um ciclo que se renova a cada ano. Para tanto, o trabalho foi realizado por meio de uma abordagem interdisciplinar, com uma análise que compreende tanto uma perspectiva histórica quanto uma abordagem sociológica. Para isso, houve a observação de algumas festas in loco, a pesquisa documental e a pesquisa bibliográfica. Conclui-se que as festas devocionais são eventos sociais fortemente marcados pela tradição histórica do local. Ademais, a continuidade histórica dos acontecimentos mostra que, diante dos problemas passados pela localidade, a sociedade encontrou forças na união de seus moradores, nas tradições e na memória de seus antepassados, fortalecendo-se por meio da realização das festas devocionais.
