We implemented a user-centered approach to the design of an artificial intelligence (AI) system that provides users with access to information about the workings of the United States federal court system regardless of their technical background. Presently, most of the records associated with the federal judiciary are provided through a federal system that does not support exploration aimed at discovering systematic patterns about court activities. In addition, many users lack the data analytical skills necessary to conduct their own analyses and (...) convert data into information. We conducted interviews, observations, and surveys to uncover the needs of our users and discuss the development of an intuitive platform informed from these needs that makes it possible for legal scholars, lawyers, and journalists to discover answers to more advanced questions about the federal court system. We report on results from usability testing and discuss design implications for AI and law practitioners and researchers. (shrink)

This chapter argues that the Great Ideas are integral to Mortimer J. Adler’s Great Books Movement in much the same way that the Four Noble Truths and the Noble Eightfold Path are integral to Buddhism. Both use ‘Great’ and ‘Noble’ to point toward human excellence. For Adler, the Great Ideas are the metaphysical and moral concepts out of which Western civilization developed. They are the main topics in an ongoing great conversation that shapes Western culture. Precisely because these (...) Great Ideas are great, insofar as they point toward human excellence (virtue), they ought not be considered the exclusive property of the West. Instead, as Adler recognized, they should be utilized in the analysis of other cultural traditions. This chapter uses two of Adler’s Great Ideas, freedom and religion, to analyze Buddhism as it is encountered in the early Indian Buddhist texts. It asserts all human philosophy and culture, including that of Buddhism, is ultimately based in religion, thereby making religion the greatest of Adler’s and the Buddha’s Great philosophical and cultural ideas. This idea is the scaffolding of the late Lauren Berlant's pivotal work, Cruel Optimism (2011), which explores the idea that attachment to a collectively invested fantasy of "the good life" acts in disservice of personal growth and lasting fulfillment. The (...) Inconvenience of Other People ostensibly repeats this structure while reattributing the role of fantasy. The premise here is that attachments to other people act in disservice to the fantasy of personal sovereignty. Of course, both texts argue for collectivity and for a recasting of the ordinary that structures current fantasies. But while Cruel Optimism builds around the unavoidable condition of fantasy, Inconvenience takes relations within the present as its fundamentally unavoidable condition, specifically the drive to be in relation even though such relations are inconvenient. "People" in the work's title stands for any attachment, any person or thing to which we exist in relation. To be part of the world is to be constantly taking in and living with the objects around us. This constant process of adjustment generates constant friction with our fantasy of sovereignty, or control, over ourselves. In Berlant's words, "inconvenience is another way of pointing to the experience of nonsovereign relationality," making our inconvenience drive the urge to maintain and explore those nonsovereign relations despite the uncomfortable friction they produce (18). Berlant's final monograph investigates the complexities of living with that inconvenience as well the potential for "loosening [those inconvenient objects] and becoming loose with them" in order to make that inconvenience generative of new perspectives and approaches (150).The prospect of overhauling our relationship with inconvenience takes place on multiple registers, both in terms of the affective states that guide the experience of inconvenience and the frameworks that determine its expression in the world. For Emerson, it stands for "the separation within the nonsovereign relation [of the commons] that makes linking possible" (Berlant 94). Spahr takes a more critical approach, continuing Emerson's use of the term while shining light on the glitches that emerge when any analogy is examined too closely. Acknowledging the rhetorical gymnastics required to "figure equally valued social being" within "imperialist capitalist infrastructures" reveals every possible analogy as both grossly oversimplifying and only temporarily comprehensible (105). Considered by many to be one of the major influences on modern Humanistic Judaism, Felix Adler (1851-1933) was a professor of political and social ethics and a social reformer who founded the Ethical Culture movement. First published in 1903 "Life and Destiny" contains quotations from Adler's lectures for the New York Society for Ethical Culture in its early years. It covers such things as the meaning of life, religion, immortality, moral ideas, the ethical outlook, and related topics.

According to an oft-repeated narrative, while Kant maintained racist views through the 1780s, he changed his mind in the 1790s. Pauline Kleingeld introduced this narrative based on passages from Kant’s Metaphysics of Morals and “Toward Perpetual Peace”. On her reading, Kant categorically condemned chattel slavery in those texts, which meant that he became more racially egalitarian. But the passages involving slavery, once contextualized, either do not concern modern, race-based chattel slavery or at best suggest that Kant mentioned it as a (...) cautionary tale for labor practices in Europe. Overall, Kant never explicitly considered chattel slavery as a moral problem to be addressed on its own. Rather, he treated it primarily in terms of its function in human history. If he ended up expressing some qualms about its practices, it was likely because they threatened to deepen intra-European conflicts and undermine the prospect of perpetual peace. The humanity of the enslaved “Negroes” was never part of the reasoning. This was not a casual oversight on Kant’s part. It reflects the complexity of his philosophical system: everything he did or did not say about chattel slavery begins to make sense once we connect his philosophy of history and his depiction of “Negroes” as natural slaves. The claim of this paper is that the everyday functions of knowledge make most sense if we see knowledge as contrastive. That is, we can best understand how the concept does what it does by thinking in terms of a relation “a knows that p rather than q.” There is always a contrast with an alternative. Contrastive interpretations of knowledge, and objections to them, have become fairly common in recent philosophy. The version defended here is fairly mild in that there (...) is no suggestion that we cannot think in terms of a simpler not explicitly contrastive relation “a knows that p.” Some, for instance Schaffer (2005) and Karjalainen and Morton (2003), have hinted that this stronger possibility may be right. But all that I am arguing now is that facts that are easily expressed in contrastive terms are vital to understanding why we need the concept of knowledge. In a piece that is in some ways a companion to this one ("Contrastivism" in Duncan Pritchard and Sven Bernecker, eds. The Routledge Companion to Epistemology. Kant scholars have paid relatively little attention to his raciology. They assume that his racism, as personal prejudice, can be disentangled from his core philosophy. They also assume that racism contradicts his moral theory. In this book, philosopher Huaping Lu-Adler challenges both assumptions. She shows how Kant's raciology--divided into racialism and racism--is integral to his philosophical system. She also rejects the individualistic approach to Kant and racism. Instead, she uses the notion of racism as ideological formation to demonstrate how (...) Kant, from his social location both as a prominent scholar and as a lifelong educator, participated in the formation of modern racist ideology. As a scholar, Kant developed a ground-breaking scientific theory of race from the standpoint of a philosophical investigator of nature or Naturforscher. As an educator, he transmitted denigrating depictions of the racialized others and imbued those descriptions with normative relevance. In both roles, he left behind, as one of his legacies, a worldview that excluded non-whites from such goods as recognitional respect and candidacy for cultural and moral achievements. Scholars who research and teach Kant's philosophy therefore have an unshakable burden to take part in the ongoing antiracist struggles, through their teaching practices as well as their scholarship. And they must do so with a pragmatic attention to nonideal social realities and a deliberate orientation toward substantial racial justice, equality, and inclusion. Lu-Adler pushes the discourse about Kant and racism well beyond the old debates about whether he was racist or whether his racism contaminates his philosophy. By foregrounding the lasting legacies of Kant's raciology, her work calls for a profound reorientation of Kant scholarship. (shrink)

When one encounters disagreement about the truth of a factual claim from a trusted advisor who has access to all of one's evidence, should that move one in the direction of the advisor's view? Conciliatory views on disagreement say "yes, at least a little." Such views are extremely natural, but they can give incoherent advice when the issue under dispute is disagreement itself. So conciliatory views stand refuted. But despite first appearances, this makes no trouble for *partly* conciliatory views: views (...) that recommend giving ground in the face of disagreement about many matters, but not about disagreement itself. Many favor representationalism about color experience. To a first approximation, this view holds that experiencing is like believing. In particular, like believing, experiencing is a matter of representing the world to be a certain way. Once you view color experience along these lines, you face a big question: do our color experiences represent the world as it really is? For instance, suppose you see a tomato. Representationalists claim that having an experience with this sensory character is necessarily connected with representing (...) a distinctive quality as pervading a round area out there in external space. Let us call it “sensible redness” to highlight the fact that the representation of this property is necessarily connected with the sensory character of the experience. Kant develops a concept of savagery, partly characterized by laziness, to envision a program for human progress. He also racializes savagery, treating native Americans, in particular, as literal savages. He ascribes to this “race” a peculiar physiological laziness, a supposedly hereditary trait of blunted life power. Accordingly, while he grants them the same “germs” for perfections as he does the civilized Europeans, he allows them no prospect of actually fulfilling any such perfection. For the road to perfection must be paved (...) through industry, a condition that Kant denies to the “savages” by racializing their alleged laziness. A testimony is somebody else’s reported experience of what has happened. It is an indispensable source of knowledge. It only gives us historical cognition, however, which stands in a complex relation to rational or philosophical cognition: while the latter presupposes historical cognition as its matter, one needs the architectonic “eye of a philosopher” to select, interpret, and organize historical cognition. Kant develops this rationalist theory of testimony. He also practices it in his own work, especially while theorizing about race as (...) a subject of natural philosophy. In three dedicated essays on this subject, he treats race from the standpoint of a philosophical investigator of nature (Naturforscher), who (as Kant puts it in the first Critique) learns from nature “like an appointed judge who compels witnesses to answer the questions he puts to them.” This view underwrites Kant’s use of travel reports (a type of testimony) in developing and defending his theory of race. Control measures, such as “lockdowns”, have been widely used to suppress the COVID-19 pandemic. Under some conditions, they prevent illness and save lives. But they also exact an economic toll. How should we balance the impact of such policies on individual lives and livelihoods (and other dimensions of concern) to determine which is best? A widely used method of policy evaluation, benefit–cost analysis (BCA), answers these questions by converting all the effects of a policy into monetary equivalents and then summing (...) them up. A different method, social welfare analysis, proceeds by determining the effects of a policy on individual wellbeing and then applying an aggregation formula to them to evaluate the overall effects of a policy. In this chapter, we survey these methods and argue that social welfare analysis has important advantages. One crucial advantage is that it enables ethical considerations relating to the impact of policies on individual wellbeing and its distribution to be incorporated into policy assessments in a transparent way. We illustrate this with a simple numerical model for evaluating pandemic policies that vary in terms of the stringency of the controls that they impose on individual behaviour, showing how the evaluation depends on the ethical significance accorded to their impact on the wellbeing of different age and income groups. In order to predict and explain behavior, one cannot specify the mental state of an agent merely by saying what information she possesses. Instead one must specify what information is available to an agent relative to various purposes. Specifying mental states in this way allows us to accommodate cases of imperfect recall, cognitive accomplishments involved in logical deduction, the mental states of confused or fragmented subjects, and the difference between propositional knowledge and know-how .

Some philosophical theories of the nature of color aim to respect a "common sense" conception of color: aligning with the common sense conception is supposed to speak in favor of a theory and conflicting with it is supposed to speak against a theory. In this paper, we argue that the idea of a "common sense" conception of color that philosophers of color have relied upon is overly simplistic. By drawing on experimental and historical evidence, we show how conceptions of color (...) vary along several dimensions and how even supposedly "core" components of the contemporary "common sense" conception of color are less stable than they have been thought to be. In this paper, I do a few things. I develop a (largely) empirical argument against naïve realism (Campbell, Martin, others) and for representationalism. I answer Papineau’s recent paper “Against Representationalism (about Experience)”. And I develop a new puzzle for representationalists.

This book is both a history of philosophy of logic told from the Kantian viewpoint and a reconstruction of Kant’s theory of logic from a historical perspective. Kant’s theory represents a turning point in a history of philosophical debates over the following questions. (1) Is logic a science, instrument, standard of assessment, or mixture of these? (2) If logic is a science, what is the subject matter that differentiates it from other sciences, particularly metaphysics? (3) If logic is a necessary (...) instrument to all philosophical inquiries, how is it so entitled? (4) If logic is both a science and an instrument, how are these two roles related? Kant’s official answer to these questions centers on three distinctions: general versus particular logic; pure versus applied logic; pure general logic versus transcendental logic. The true meaning and significance of each distinction becomes clear, I argue, only if we consider two factors. First, Kant was mindful of various historical views on how logic relates to other branches of philosophy (viz. metaphysics and physics) and to the workings of common human understanding. Second, he first coined ‘transcendental logic’ while struggling to secure metaphysics as a proper “science,” and this conceptual innovation would in turn have profound implications for his mature theory of logic. Against this backdrop, I reassess the place of Kant’s theory in the history of philosophy of logic and highlight certain issues that are still debated today, such as normativity of logic and the challenges posed by logical pluralism. In Chapter 1, “Kant and a Philosophical History of Logic – Methodological Reflections,” I discuss certain exegetical challenges posed by Kant’s logic corpus and argue for a “history of philosophical problems” method by which to reconstruct a Kantian theory of logic. In Chapter 2, “The Nature and Place of Logic – A History of Controversies,” I construct a partial history of philosophy of logic that revolves around the (supposedly) scientific status of logic on the one hand and its value or utility on the other. In Chapter 3, “The Making of a Scientific Logic from Bacon to Wolff,” I examine how four representative early modern philosophers – Francis Bacon, John Locke, G.W. Leibniz, and Christian Wolff – approached the four questions mentioned above. In Chapter 4, “Kant on the Way to His Own Philosophy of Logic,” I consider how Kant, in the decade between around mid-1760s and mid-1770s, navigated between existing accounts of logic until he finally found his own voice. I highlight the breakthroughs that would mark his critical departures from previous views and pave the way for the final articulation of his own view. In Chapter 5, “Logic and the Demands of Kantian ‘Science’,” I zero in on Kant’s official theory of logic in his monumental publication, Critique of Pure Reason. How best to think about quantum systems under permutation invariance is a question that has received a great deal of attention in the literature. But very little attention has been paid to taking seriously the proposal that permutation invariance reflects a representational redundancy in the formalism. Under such a proposal, it is far from obvious how a constituent quantum system is represented. Consequently, it is also far from obvious how quantum systems compose to form assemblies, i.e. what is the formal (...) structure of their relations of parthood, overlap and fusion. In this paper, I explore one proposal for the case of fermions and their assemblies. According to this proposal, fermionic assemblies which are not entangled—in some heterodox, but natural sense of ‘entangled’—provide a prima facie counterexample to classical mereology. This result is puzzling; but, I argue, no more intolerable than any other available interpretative option. (shrink)

The contributors present the principal viewpoints regarding Gramsci’s theoretical contribution to Marxism, focussing in particular on his advances in the study of the superstructures, and discussing his relation to Marx and Lenin and his influence in Eurocommunism. Leibniz, and many following him, saw the Principle of Sufficient Reason (PSR) as pivotal to a scientific (demonstrated) metaphysics. Against this backdrop, Kant is expected to pay close attention to PSR in his reflections on the possibility of metaphysics, which is his chief concern in the Critique of Pure Reason. It is far from clear, however, what has become of PSR in the Critique. On one reading, Kant has simply turned it into the causal principle of the Second Analogy. On (...) a different reading, PSR is but the supreme principle of reason, which roughly states that, if the conditioned is given, so is the unconditioned. On my reading, PSR appears in the guises of both the causal principle and the supreme principle. This twofold specification, I argue, is key to understanding (i) Kant’s allegations that past metaphysicians failed to prove PSR, (ii) his own Critical account of the possibility of metaphysics in both of its parts (ontology and metaphysics proper), and (iii) his nuanced answer to the contentious question about the relation between physical inquiry and metaphysical reasoning about nature (both being quests for reasons). The problem of trust in social relationships was central to the emergence of the modern form of civil society and much discussed by social and political philosophers of the early modern period. Over the past few years, in response to the profound changes associated with postmodernity, trust has returned to the attention of political scientists, sociologists, economists, and public policy analysts. In this sequel to his widely admired book, The Idea of Civil Society, Adam Seligman analyzes trust as a (...) fundamental issue of our present social relationships. Setting his discussion in historical and intellectual context, Seligman asks whether trust--which many contemporary critics, from Robert Putnam through Francis Fukuyama, identify as essential in creating a cohesive society--can continue to serve this vital role. Seligman traverses a wide range of examples, from the minutiae of everyday manners to central problems of political and economic life, showing throughout how civility and trust are being displaced in contemporary life by new "external' system constraints inimical to the development of trust. Disturbingly, Seligman shows that trust is losing its unifying power precisely because the individual, long assumed to be the ultimate repository of rights and values, is being reduced to a sum of group identities and an abstract matrix of rules. The irony for Seligman is that, in becoming postmodern, we seem to be moving backward to a premodern condition in which group sanctions rather than trust are the basis of group life. (shrink)

In the 1780s through the end of 1790s, Kant made various references to slavery (in its different forms) and the transatlantic slave trade in the context of his political philosophy or philosophy of right; he thereby had opportunities to speak in favor of abolitionism, which was gaining momentum in parts of Europe, or at least to articulate a normative critique of the race-based chattel slavery or Atlantic slavery and the associated slave trade qua (legalized) INSTITUTIONS; but he did neither. Why? (...) In raising and seeking an answer to this question, I am not interested in what Kant’s normative silence about the institutions of Atlantic slavery and slave trade may tell us about him as a person (for example, whether he was blinded by his own racist prejudices or whether he was affected by some kind of cognitive dissonance). Rather, I will focus on what it may tell us about certain limitations of his political philosophy, limitations that might have made it THEORETICALLY DIFFICULT for him to figure out exactly what to DO about those institutions as entrenched political realities.
