The study investigates the »Four Principles of Biomedical Ethics« published by Tom Beauchamp and James Childress with a particular concern for the principle of respect for autonomy. The leading question is in which philosophical background autonomy is dealt with by Beauchamp/childress and by the enlightenment philosopher Immanuel Kant, while the more emipirical theoretical framework of Beauchamp/childress and the rationalistic framework of Kant are being analyzed. After having considered the foundation of autonomy both in Beauchamp/childress and Kant, the study turns to (...) the relationship of autonomy and human dignity by exploring the implicit extension of autonomy, human dignity and being human, and asks which consequences have to be drawn from a theological point of view. The article traces the origin of Kant's distinction between the right to a good name in the Doctrine of Right and the right to respect for human dignity in the Doctrine of Virtrue. The story begins with Pufendorf's distinction between existimatio simplex and existimatio intensiva. "Existimatio" for Pufendorf means "worth." Accordingly, existimatio simplex is plain human worth, whereas existimatio intensiva is the worth of dignitaries, meaning of persons who are ascribed special worth. For Thomasius and Barbeyrac "existimatio" becomes "respect." Existimatio (...) simplex then becomes, for example for Achenwall, simple respect, which the law requires everyone to give his fellow human beings. Existimatio intensiva becomes recognition, among other things, of another's probity. The latter existimatio intensiva is a part of ethics. Kant then looks for the existimatio simplex that can be contrasted to this existimatio intensiva. He finds it in the respect for the dignity of all of mankind.Der Beitrag sucht den Ursprung von Kants Unterscheidung zwischen dem Recht der Unbescholtenheit, das in die Rechtslehre, und dem Recht auf Achtung vor der Würde des Nebenmenschen, das in die Tugendlehre gehört. Die Geschichte beginnt mit Pufendorfs Unterscheidung von existimatio simplex und existimatio intensiva. "Existimatio" bedeutet bei Pufendorf "Würde". Existimatio simplex ist danach die schlichte Menschenwürde, existimatio intensiva die Würde von Würdenträgern , also von Personen, denen eine besondere Würde zukommt. Die Frage, wie das, was die Vernunft einsieht, dazu motivieren kann, dies auch zu tun, gehört zu den Grundfragen von Kants praktischer Philosophie. Die vorliegende Untersuchung erschließt Kants Antwort auf das Problem der moralischen Motivation innerhalb seiner Handlungstheorie und Moralphilosophie. Neben einer philosophiehistorischen und systematischen Einordnung liefert sie eine umfassende textnahe Analyse der kantischen Argumente, die auch werkgeschichtliche Aspekte berücksichtigt. Auf diese Weise entsteht ein reichhaltiges Bild der kantischen Theorie moralischer Motivation, die in Kants Konzept der Moralbegründung nicht nur verwurzelt (...) ist, sondern dieses auch unterstützt. So ist die Achtung vor dem Gesetz als Modus zu verstehen, in dem sich der Mensch die praktische Norm zu eigen macht. Moralische Gründe erweisen sich nach der hier vorgeschlagenen Interpretation als unbedingte, universal gültige Regeln, deren praktische Bedeutung als subjektive Handlungsgrundsätze und Motive erst durch Kants Theorie der moralisch-rationalen Sensibilität verständlich wird. Kants Ansatz ist damit nicht nur werkintern von Interesse, sondern liefert darüber hinaus einen inspirierenden Beitrag zu einer modernen Theorie praktischer Normativität. (shrink)

Es geht in diesem Aufsatz um die Frage, was es heißt, eine andere Person zu achten. Im Zentrum steht dabei die moralische Achtung, nicht die Achtung im Sinne der Wertschätzung einer anderen Person. Ein wohlfahrts- und ein autonomietheoretisches Verständnis moralischer Achtung werden dargestellt und zurückgewiesen. Es wird für ein Verständnis moralischer Achtung argumentiert, wonach eine Person genau dann geachtet wird, wenn ihr authentischer Wille ernst genommen wird. Die Achtung schulden wir dabei der Würde der Person. (...) Achtung vor der Würde der Person ist Achtung vor dem, was die Selbstachtung von Personen ermöglicht. Die Würde von Personen ist unantastbar sowohl in der anderen wie auch in der eigenen Person. In der Medizin gehören Kinder neben Ausländern, Behinderten und psychiatrisch Erkrankten zu den besonders vulnerablen Patientengruppen. Im Folgenden soll die Frage nach der Würde der Kinder in medizinethischer Hinsicht behandelt werden. Dazu werden drei Thesen erläutert und begründet: (1.) das Prinzip der Menschenwürde kann nicht ganz außer Acht gelassen werden, wenn Kinder als Patienten in medizinethischer Hinsicht thematisiert werden; (2.) das Prinzip der Menschenwürde wird in der Medizinethik nicht schon vollständig durch die medizinethischen Prinzipien der Patientenautonomie und der Fürsorge für (...) die Patienten abgedeckt; (3.) die habituelle und bewusste Achtung der Würde des Menschen bringt immer wieder neue und bisher noch wenig beachtete Aspekte des medizinischen, therapeutischen und pflegerischen Umgangs mit Patienten und Kindern als Patienten ans Licht. Diskussionen über den Gehalt des Prinzips der Menschenwürde gehen nicht nur in der Medizinethik, sondern auch in anderen Bereichen der angewandten Ethik in der Regel von Erwachsenen aus. Erwachsene gelten als die paradigmatischen Subjekte und Objekte der Wahrnehmung, Zuschreibung und Anerkennung von Würde. Meistens denkt man nur an Erwachsene, wenn man darauf besteht, dass die menschliche Würde (1.) vom moralischen und rechtlichen Standpunkt aus grundsätzlich zu achten ist, (2.) unter bestimmten psychologischen, sozialen und politischen Umständen gefährdet ist und (3.) in bestimmten Handlungssituationen mit anderen ethischen Forderungen in Konflikt geraten kann. Bei Erwachsenen ist es relativ leicht, ethische Intuitionen darüber, ob in bestimmten medizinischen Handlungssituationen die Würde eines Menschen verletzt wird, zu formulieren und zu begründen. Denn bei Erwachsenen steht die Würdeverletzung in einem engen Zusammenhang mit der Berücksichtigung verschiedener ethischer Forderungen: (1.) nach Achtung der willentlichen Selbstbestimmung und der normativen Autonomie, (2.) nach Berücksichtigung von persönlichen Lebenszielen und Wertpräferenzen, (3.) nach Bewahrung von mutmaßlichen Lebenschancen (4.) nach Berücksichtigung personaler Bedürfnisse nach Anerkennung, Gegenseitigkeit, Intimität, Integrität, etc. sowie (5.) nach Wahrnehmung und Anerkennung der unverwechselbaren Individualität des Anderen. Die Angemessenheit und Erfüllbarkeit dieser ethischen Forderungen hängt nun aber von soziologischen und psychologischen Gegebenheiten ab, die bei Kindern je nach Altersgruppe und individueller Ausprägung nicht in gleicher Weise gegeben sind. Deswegen soll hier gezeigt werden, welche besondere und zusätzliche Rolle eine medizinethische Erinnerung an die Würde der Kinder im Spannungsfeld zwischen Autonomie und Fürsorge spielen kann. Dabei zeigt sich, dass es gerade die Achtung vor der Würde des Kindes ist, die uns überhaupt erst ermöglicht, das Kind als Kind und damit als ein eigenständiges Subjekt und als ein besonderes menschliches Wesen zu entdecken. Es wird ein Begriff von Würde vorgestellt, der sich nicht auf den Begriff des Respekts vor der Autonomie von Personen reduzieren lässt. Dealing with the reform of the Transplantation Law, the first issue of the new rubric “Philosophie aktuell” met with strong and lively interest from our readers. Subsequent to this discussion a growing number of reports were published dealing with violations of mandatory rules of conduct in transplantation medicine. Therefore the topic is revisited here from the slightly different vantage point “organ transplantation II: elucidation and confidence”.

Wie kommt es, dass die Freiheit im Selbstverständnis der meisten europäischen Nationen eine so große Rolle spielt? Welche Traditionen haben das unterstützt, welche behindert? Dieses Problemfeld, das von großer Aktualität ist, wird hier von renommierten Theologen und Philosophen dargestellt. Die Freiheit des Einzelnen und das liberale, tolerante Zusammenleben im Respekt vor der Freiheit anderer musste erst philosophisch begründet werden, bevor es politische Realität werden konnte. Die Grundlagen dieses Prozesses und der damit verbundenen Probleme zu verstehen, ist zentral für jeden zeitgeschichtlich (...) interessierten Menschen. Für die Argumentation von Moralphilosophen, die die Legalisierung der aktiven Sterbehilfe befürworten, spielt das Autonomieprinzip eine wichtige Rolle. Ihrer Auffassung nach verlangt der Respekt vor der Autonomie, die Entscheidung eines schwer kranken Menschen gegen die Fortsetzung des Lebens vorbehaltlos anzuerkennen. Dagegen haben verschiedene Theoretiker auf Gefahren hingewiesen, die die rechtliche Zulassung der Tötung auf Verlangen für die individuelle Autonomie mit sich bringt. Sobald der Kranke über die Möglichkeit der aktiven Sterbehilfe verfüge, falle ihm die Verantwortung für die Inanspruchnahme (...) von Pflegeleistungen zu. In der Folge könne u. a. von Seiten der Familie die Forderung an ihn gestellt werden, den vom Gesetzgeber eröffneten Ausweg zu nutzen und sie von der Last seiner Pflege zu befreien. Die Bedenken erscheinen insofern berechtigt, als Formen sozialen Zwangs vorstellbar sind, die eine freie Entscheidung des Patienten verhindern. Allerdings vermag weder das Verbot noch die Zulassung der aktiven Sterbehilfe eine autonome Entscheidung aller Individuen zu gewährleisten. Die Abwägung der Risiken, mit denen beide Optionen behaftet sind, spricht im Ergebnis für die Legalisierung der Tötung auf Verlangen. (shrink)

Die Krisenhaftigkeit der jüngeren und jüngsten Zeit ist unübersehbar. Von daher ist auch das verstärkte Bemühen um Verantwortung in Politik und Gesellschaft zu verstehen. Verantwortliches Handeln ist dabei keineswegs unpopulär. Aber es zeigt sich auch, dass es sich in alltagsmoralischen Überzeugungen nicht von alleine durchsetzt, oder in sein Gegenteil verkehrt wird, wenn es bspw. Von Marketingstrategien des 'green-washing' vereinnahmt wird. Die mit einem Geleitwort von Frau Rita Süssmuth versehenen fünf Vorlesungen der Studium Universale-Ringvorlesung 'Kultur der Verantwortung - Verantwortung der Kultur' (...) der Heinrich-Heine-Universität dis-kutieren deshalb auf 120 Seiten einmal die Herkunft und die Widersprüchlickkeit des Verantwortungsprinzips, aber auch die Chancen einer 'neuen Ära der Verantwor-tung' (Ludger Heidbrink). In einer zweiten Vorlesung werden Gründe dafür genannt, warum es auch ethisch vertretbar sein kann, Wirtschaftsunternehmen in Teilen von einer generellen Verpflichtung zur globalen Verantwortung zu entbinden (Michael Baurmann). Dem Zusammenhang von Verantwortung und Kultur gehen an den Beispielen des Intellektuellen und der Avantgardekunst zwei weitere Vorlesungen nach. Während der Intellektuelle in der heute stark medialisierten Öffentlichkeit seine traditionelle Funktion als Kritiker staatlicher und ökonomischer Machtverhältnisse zuneh-mend verliert (Bernd Witte), scheint diese Rolle von den aktivistischen Kunstpraktiken der Avantgarde und der ihr entsprechenden Museumskultur aufgegriffen worden zu sein (Lutz Hieber). Mit der abschließenden Vorlesung wird der Blick auf eine außereuropäische Gesellschaft und Kultur geworfen und gezeigt, wie die offizielle Innen- und Außen-Politik Chinas einer 'harmonischen Gesellschaft und einer harmonischen Welt' sich zwar auf eine konfuzianische Tradition beruft, in der Alltagswirklichkeit diese aber immer wieder wegen tief sitzender Ängste vor einem Zerfall des Riesenreichs unterläuft (Carmen Meinert). Aktuelle bioethische Debatten werden vor allem von zwei Schwierigkeiten überschattet: zum einen von der Unklarheit des Begriffes menschlicher Autonomie. Hier geht es um individualethische Fragen, vor allem um Beginn und Ende menschlichen Lebens. Zum anderen bedroht die Verschiebung individueller Wissensträgerschaft zum anonymen Kollektivsubjekt angesichts einer zunehmenden Ökonomisierung des Gesundheitswesens das ärztliche Ethos des Helfens und Heilens. Diese und weitere konfliktgeladene Problemstellungen diskutiert Jan P. Beckmann in seinem neuen Buch.

In Philosophy, there are two central questions concerning the phenomenon of lying: First, what is lying? And, secondly, what is morally wrong with lying? Those who deal with the second question usually ask if, when, and why lying can be morally justified. Hence, the liar and his reasons stand in the limelight. But what does actually happen when someone is lying, particularly to the addressee of the lie? What is harmed by lying? This paper goes the other way around and (...) focuses on the addressee. It defends the thesis that two principles are concerned: the respect of the person and his/her autonomy on the one hand. And trust on the other hand. Furthermore, the paper is an attempt to answer the question why we consider some lies worse than other lies: Namely, if something essential for our self-conception is involved. Jahrhundert galt es sowohl im Marxismus als auch unter seinen Gegnern als ausgemachte Sache, dass das Werk von Karl Marx eine anspruchsvolle Theorie der Geschichte enthält, die von einer starken optimistischen Grundstimmung getragen wird. Oft hielt man sie für einen als Wissenschaft verkleideten Entwurf einer idealen Zukunftsgesellschaft, für eine Heilslehre. Umso erstaunlicher ist es daher, dass eine gründliche Erforschung des Marxschen Fortschrittsdenkens bislang noch aussteht. Denis Mäders Studie analysiert das moderne Fortschrittsdenken und die zeitgenössische Diskussion desselben. Vor diesem (...) Hintergrund rekonstruiert sie die Entstehung eines originären Fortschrittsbegriffs, den Marx in kritischer Auseinandersetzung mit seinem philosophischen Milieu (vor allem mit Hegel, den Hegelianern und Proudhon) gewinnt. Fortschritt ist die historische Bewegung des Guten. Zugleich aber gibt es für den Dialektiker Marx ohne Gegensatz keinen historischen Fortschritt. Fortschritt bildet für ihn die Möglichkeit positiver Entwicklung, ohne andersartige oder gegenläufige Entwicklungsformen darin aufzuheben. (shrink)

Der Begriff der Person wird häufig im Bereich der biomedizinischen Ethik angewandt, wie vor allem in der Abtreibungsdebatte. Es wird immer noch kontrovers darüber diskutiert, ob ein Embryo als Person anzusehen ist.Dieses Buch zeigt einerseits auf, dass der Begriff der Person keinen Beitrag zur Antwort nach dem moralischen Status eines menschlichen Wesens am Lebensbeginn leisten kann. Andererseits wird jedoch deutlich, dass dieser Begriff für den Respekt gegenüber menschlichen Wesen am Lebensende hilfreich ist. Was bedeutet Respekt vor der Autonomie von (...) Personen bei der Sterbehilfe und was bedeutet Respekt gegenüber dementen Personen, die nicht mehr autonom sind? Bei der Beantwortung dieser Fragen spielt der Begriff der Person eine entscheidende Rolle. Dieses Buch soll einen Beitrag zur Verdeutlichung der Grenzen und Gültigkeit des Begriffs der Person in der biomedizinischen Ethik leisten. (shrink)

Expanded universal carrier screening (EUCS) entails a population‐wide screening offer for multiple disease‐causing mutations simultaneously. Although there is much debate about the conditions under which EUCS can responsibly be introduced, there seems to be little discussion about its aim: providing carrier couples with options for autonomous reproductive choice. While this links in with current accounts of the aim of foetal anomaly screening, it is different from how the aim of ancestry‐based carrier screening has traditionally been understood: reducing the disease burden (...) in the population. The reasons why the aim of EUCS is presented in terms of ‘autonomy’ rather than ‘prevention’ have not been spelled out in the literature. This paper seeks to fill this gap by considering the morally relevant similarities and dissimilarities between foetal anomaly screening, ancestry‐based carrier screening and EUCS. When carrier screening is performed in the prenatal period, enhancing autonomy appears the most appropriate aim of EUCS, as the alternative of ‘prevention through selective abortion’ would urge women to terminate wanted pregnancies. However, when screening is conducted in the preconception period, carrier couples can avoid the birth of affected children by other means than selective abortion, for instance preimplantation genetic diagnosis. To the extent that this increased control over passing on a genetic disorder raises questions of parental responsibility, it seems necessary that the account of the aims of EUCS is wider than only in terms of enhancing reproductive autonomy. Het denken van de Nederlandse filosoof Leo Polak (1880-1941) heeft nog altijd niet aan actualiteit ingeboet. Hij bepleitte hartstochtelijk de autonomie van de menselijke rede, worstelde met de grondslag van onze ethiek en wierp zich in een tijd van politieke massabewegingen en toenemende verzuiling op als kampioen van het vrije denken. Zelfs tijdens de Duitse bezetting hield hij vast aan zijn zelfstandig oordeel – een houding die hij eind 1941 met de dood in een concentratiekamp moest bekopen. Al die (...) jaren hield hij een dagboek bij, voor hem een essentieel middel om greep te krijgen op zijn leven. Op basis hiervan worden in deze bundel nieuwe aspecten van Polaks leven en werk belicht: zijn denken over schuld en vergelding, zijn verhouding tot grote filosofen als Spinoza en Heymans en zijn houding tegenover het nationaalsocialisme, maar ook zijn familieleven, zijn boekenverzameling en zijn geestelijke nalatenschap. Theoretical models for physician-patient communication in clinical practice are described in literature, but none of them seems adequate for solving the communication problem in clinical practice that emerges in case of factitious disorder. Theoretical models generally imply open communication and respect for the autonomy of the patient. In factitious disorder, the physician is confronted by lies and (self)destructive behaviour of the patient, who in one way or another tries to involve the physician in this behaviour. It is no longer controversial (...) that the physician should communicate his consideration of a factitious disorder without insistence that the patient accepts this diagnosis. However, the balance between patient autonomy and open communication on the one hand, and the preservation of the patient's health, physician integrity and of a constructive physician-patient relationship on the other is easily disrupted. In this article, an epistemological model is described to facilitate a positive outcome of confrontation in treatment of factitious disorder. Analysing the problem in terms of systems theory will help the physician to assess what information is appropriate to use in which phase of the patient's treatment, while preserving the physician-patient relationship. Unconsented episiotomies and other procedures during labour are commonly reported by women in several countries, and often highlighted in birth activism. Yet, forced caesarean sections aside, the ethics of consent during labour has received little attention. Focusing on episiotomies, this paper addresses whether and how consent in labour should be obtained. We briefly review the rationale for informed consent, distinguishing its intrinsic and instrumental relevance for respecting autonomy. We also emphasise two non-explicit ways of giving consent: implied and opt-out consent. (...) We then discuss challenges and opportunities for obtaining consent in labour and birth, given its unique position in medicine.We argue that consent for procedures in labour is always necessary, but this consent does not always have to be fully informed or explicit. We recommend an individualised approach where the antenatal period is used to exchange information and explore values and preferences with respect to the relevant procedures. Explicit consent should always be sought at the point of intervening, unless women antenatally insist otherwise. We caution against implied consent. However, if a woman does not give a conclusive response during labour and the stakes are high, care providers can move to clearly communicated opt-out consent. Our discussion is focused on episiotomies, but also provides a useful starting point for addressing the ethics of consent for other procedures during labour, as well as general time-critical medical procedures. This article asks whether states have a right to close their borders because of their right to self-determination, as proposed recently by Christopher Wellman, Michael Walzer, and others. It asks the fundamental question whether self-determination can, in even its most unrestricted form, support the exclusion of immigrants. I argue that the answer is no. To show this, I construct three different ways in which one might use the idea of self-determination to justify immigration restrictions and show that each of these (...) arguments fails. My conclusion is that the nature and value of self-determination have to do with the conditions of genuine self-government, not membership of political society. Consequently, the demand for open borders is fully consistent with respect to self-determination. (shrink)

This paper examines the prevalence of the ideal of “independence” in intellectual disability care in the Netherlands. It responds to a number of scholars who have interrogated this ideal through the lens of Michel Foucault’s vocabulary of governmentality. Such analyses hold that the goal of “becoming independent” subjects people with intellectual disabilities to various constraints and limitations that ensure their continued oppression. As a result, these authors contend, the commitment to the ideal of “independence” – the “ethic of autonomy” – (...) actually threatens to become an obstacle to flourishing in the group home. This paper offers an alternative analysis. It does so by drawing on a case study taken from an ethnographic study on group home life in the Netherlands. Briefly put, the disagreement stems from differing conceptualizations of moral life. Put in the vocabulary of moral anthropologist Cheryl Mattingly, the authors propose to approach the group home more from a “first-person” perspective rather than chiefly from a “third-person” perspective. They then draw on Mattingly to cast the group home as a “moral laboratory” in which the ethic of autonomy is not just reproduced but also enacted, and in which the terms of (in)dependence constantly get renegotiated in practice. What emerges is not only a new perspective on the workings of the “ethic of autonomy” in the group home, but also an argument about the possible limitations of the vocabulary of governmentality for analysing care practices. BackgroundRelatives have no formal position in the practice of euthanasia and physician-assisted suicide (EAS) according to Dutch legislation. However, research shows that physicians often involve relatives in EAS decision-making. It remains unclear why physicians do (not) want to involve relatives. Therefore, we examined how many physicians in the Netherlands involve relatives in EAS decision-making and explored reasons for (not) involving relatives and what involvement entails.MethodsIn a mixed-methods study, 746 physicians (33% response rate) completed a questionnaire, and 20 were interviewed. The (...) questionnaire included two statements on relatives’ involvement in EAS decision-making. Descriptive statistics were used, and multivariable logistic regression analyses to explore characteristics associated with involving relatives. In subsequent interviews, we explored physicians’ views on involving relatives in EAS decision-making. Interviews were thematically analysed.ResultsThe majority of physicians want to know relatives’ opinions about an EAS request (80%); a smaller group also takes these opinions into account in EAS decision-making (35%). Physicians who had ever received an explicit EAS request were more likely to want to know opinions and clinical specialists and elderly care physicians were more likely to take these opinions into account. In interviews, physicians mentioned several reasons for involving relatives: e.g. to give relatives space and help them in their acceptance, to tailor support, to be able to perform EAS in harmony, and to mediate in case of conflicting views. Furthermore, physicians explained that relatives’ opinions can influence the decision-making process but cannot be a decisive factor. If relatives oppose the EAS request, physicians find the process more difficult and try to mediate between patients and relatives by investigating relatives’ objections and providing appropriate information. Reasons for not taking relatives’ opinions into account include not wanting to undermine patient autonomy and protecting relatives from a potential burdensome decision.ConclusionsAlthough physicians know that relatives have no formal role, involving relatives in EAS decision-making is common practice in the Netherlands. Physicians consider this important as relatives need to continue with their lives and may need bereavement support. Additionally, physicians want to perform EAS in harmony with everyone involved. Die Betonung der Autonomie des Patienten und Probanden in allen in der letzten Zeit verabschiedeten internationalen Deklarationen gibt dieser Tendenz unmissverständlich Ausdruck. Doch wenngleich diese Entwicklung unstrittig positiv ist, wirft sie dennoch eine Reihe von Fragen auf, die mit der Kodifizierung, Interpretation, Reichweite und Anwendung dieses universalen Prinzips verbunden sind. Die Antworten auf diese Fragen entscheiden darüber, ob Autonomie (...) als hilfreiches, emanzipatorisches oder als überforderndes, gar hegemoniales Prinzip begriffen wird. Diese normativen Probleme werden anhand von Beispielen aus der globalen Medizinethik verdeutlicht. Was in modernen Gesellschaften als Autonomie bezeichnet und für die Praxis fruchtbar gemacht wird, ist als ein soziales Konstrukt zu verstehen, nicht im Sinne einer Schimäre, sondern im Sinne einer soziokulturellen Leistung, die auf komplexen, historisch gewachsenen und kulturell geprägten Interaktionen von Gesellschaften, Institutionen und Individuen beruht. In recent times, Kant’s theory of the moral feeling of respect has increasingly come to the centre of Kant research. His diverse and seemingly contradictory characterisations of this feeling in particular have led to continued controversial discussion. While a number of scholars try to understand the special role of respect in Kant by isolating this feeling from its conceptual context or solely referring to its role as moral motivation, I will concentrate on the systemic position of respect within the framework (...) of Kant’s theory of the autonomy of reason. Furthermore, I will try to elucidate the different characterisations of respect given by Kant, referring not only to his ethics, but also to his general theory of transcendental idealism. Examining the special place of respect within Kant’s transcendental idealism, I will plead for a compatibilist reading of respect, according to which the “intellectualist” as well as the “affectivist” view both hold true. This is motivated by interpreting respect as a volitional structure featuring rational as well as emotional dimensions. (shrink)

ZusammenfassungIst Achtung der Autonomie in der Medizin gleichbedeutend mit der Achtung autonomer Entscheidungen? Ist sie nur gegenüber entscheidungsfähigen Patienten möglich? Der Artikel kritisiert diese in der Medizinethik verbreitete Meinung. Sie wird der Problematik des Paternalismus in der modernen Medizin nicht voll gerecht und verkennt den Primat der moralischen gegenüber der psychologischen Bedeutung des Autonomiebegriffs sowie den engen Zusammenhang zwischen Autonomie und Fürsorge. Durch eine Reflexion anthropologischer Grundbedingungen der Moral zeige ich diesen Zusammenhang auf und skizziere Konsequenzen (...) für die Praxis nicht-paternalistischer Fürsorge, die den Willen auch nicht-kompetenter Patienten achtet. ABSTRACT Over the past few decades the concept of (human) dignity has deeply pervaded medical ethics. Appeals to dignity, however, are often unclear. As a result some prefer to eliminate the concept from medical ethics, whereas others try to render it useful in this context. We think that appeals to dignity in medical ethics can be clarified by considering the concept from an historical perspective. Firstly, on the basis of historical texts we propose a framework for defining the concept in (...) medical debates. The framework shows that dignity can occur in a relational, an unconditional, a subjective and a Kantian form. Interestingly, all forms relate to one concept since they have four features in common: dignity refers, in a restricted sense, to the ‘special status of human beings’; it is based on essential human characteristics; the subject of dignity should live up to it; and it is a vulnerable concept, it can be lost or violated. We argue that being explicit about the meaning of dignity will prevent dignity from becoming a conversation‐stopper in moral debate. Secondly, an historical perspective on dignity shows that it is not yet time to dispose of dignity in medical ethics. At least Kantian and relational dignity can be made useful in medical ethics. Truog hat eine brillante Zuspitzung der US-amerikanischen Kritik am „Hirntod”-Kriterium vorgelegt; sein kaum begründeter Vorschlag, Organtransplantationen durch (stellvertretende) Zustimmung bei Menschen mit „irreversibler Bewusstlosigkeit” und „unmittelbar bevorstehendem Tod” zu legitimieren, hält einer kritischen Überprüfung jedoch nicht stand und scheint denen in Deutschland recht zu geben, die im Rahmen der Transplantationsgesetzgebung (1996) mit Blick auf den (gescheiterten) alternativen Gesetzentwurf vor einem Dammbruch zur aktiven Euthanasie warnten. Dieser Aufsatz kritisiert Truogs Vorschlag und zeigt, warum Organentnahmen bei Menschen mit irreversiblem totalen Hirnversagen (...) gerechtfertigt werden können, wenn zum tragfähigen Todeskriterium des irreversiblen Herz-Kreislauf-Stillstands zurückgekehrt wird, ohne dass ein Präzedenzfall für die aktive Euthanasie entsteht. The participation of vulnerable patients in clinical research poses apparent ethical dilemmas. Depending on the nature of the vulnerability, their participation may challenge the ethical principles of autonomy, non-maleficence, or justice. On the other hand, non-participation may preclude the building of a knowledge base that is a prerequisite for defining the optimal clinical management of vulnerable patients. Such clinical uncertainty may also incur substantial economic costs. We present the participation of pre-menopausal women with atrial fibrillation in trials of novel oral (...) anticoagulant drugs as a case study. Due to their non-participation in pivotal trials, it is uncertain whether for them, the risks that are associated with these drugs are outweighed by the advantages compared with conventional treatment. We addressed the question whether research of this new class of drugs in this subgroup would be appropriate from both, an ethical as well an economic perspective. We used the method of specifying norms as a wider framework to resolve the apparent ethical dilemma, while incorporating the question whether research of oral anticoagulants in premenopausal women with atrial fibrillation can be justified on economic grounds. For the latter, the results of a value-of-information analysis were used. Further clinical research on NOACs in premenopausal women with atrial fibrillation can be justified on both, ethical and economic grounds. Addressing apparent ethical dilemmas by invoking a method such as specifying norms can improve the quality of public practical reasoning. As such, the method should also prove valuable to committees that have formally been granted the authority to review trial protocols and proposals for scientific research. (shrink)

Non-treatment decisions concerning demented patients are complex: in addition to issues concerning the health of patients, ethical and legal issues are involved. This paper describes a method for the development of a guideline that clarifies the steps to be taken in the decision making process whether to forgo curative treatment of pneumonia in psychogeriatric nursing home patients.The method of development consisted of seven steps. Step 1 was a literature study from which ethical, juridical and medical factors concerning the patient's health (...) and prognosis were identified. In step 2, a questionnaire was sent to 26 nursing home physicians to determine the relative importance of these factors in clinical practice. In a meeting of nine experienced physicians , the factors identified in step 2 were confirmed by most of these professionals. To prevent the final guideline being too directive, a concept guideline that included ethical and legal aspects was designed in the form of a “checklist of considerations” . Experts in the fields of nursing home medicine, ethics and law reviewed and commented on the concept guideline . The accordingly adapted “checklist of considerations” was tested in a pilot study , after which all experts endorsed the checklist .The resulting “checklist of considerations” structures the decision making process according to three primary domains: medical aspects, patient's autonomy, and patient's best interest. In the moralistic‐paternalistic model, there is almost no health law of explicit medical ethics and the little law there is is usually based on traditional morality, combined with (...) paternalist motives, the objections to this modal are that its paternalism and moralism are unacceptable, that it is too static and knows no external control mechanisms. In the liberal model, which is now dominant on most Western countries, law and ethics closely cooperate and converge, both disciplines use the same framework for analysis: they are product‐oriented rather than practice‐oriented; they use the same conceptual categories, they focus on the minimally decent rather than the ideal, and they are committed to the same substantive normative theory in which patient autonomy and patient rights are central. However, each of these four characteristics also result in a certain one‐sidedness. In some countries, a third model is emerging. In this postliberal model, health law is more modest and acknowledges its inherent and normative limits, whereas ethics takes a richer and most ambitious self image. Die Frage nach der Gerechtigkeit wurde in der Antike vor allem als Frage nach dem tugendhaften Leben und Handeln verstanden. In der Gegenwart wird dagegen stärker die politische und soziale Gerechtigkeit thematisiert. Diese einzelnen historischen Akzentuierungen dürfen jedoch nicht über den grundsätzlichen Charakter der Gerechtigkeit als Teil der allgemeinen Ethik hinwegtäuschen.

Zum Verständnis des Kantschen Rechtsbegriffs ist es notwendig, sich die Diskussionslage seiner intellektuellen Umgebung vor Augen zu führen, auf die nach längerer Ausarbeitung 1797 sein rechtsphilosophisches Hauptwerk Die Metaphysik der Sitten. Metaphysische Anfangsgründe der Rechtslehre traf. Die Naturrechtsentwicklung des 18. Jahrhunderts hatte – zumindest in Deutschland – zur Herausbildung eines engeren, äußeren und auf äußeres Verhalten gerichteten sowie mit Zwang verbundenen, „strikten“ Naturrecht geführt, das besonders für das positive Recht bestimmend war. Diese Verengung auf ein striktes, äußeres, mit Zwang verbundenes (...) Naturrecht war allgemein anerkannt und wurde als Fortschritt begrüßt. Man muß annehmen, daß sie Kant wohlvertraut war. Sie wird etwa in Baumgartens Initia Philosophiae Practicae und auch in Achenwalls Jus Naturae erläutert, zwei Schriften, nach denen Kant Vorlesungen gehalten hat. Theoretical models for physician-patient communication in clinical practice are described in literature, but none of them seems adequate for solving the communication problem in clinical practice that emerges in case of factitious disorder. Theoretical models generally imply open communication and respect for the autonomy of the patient. In factitious disorder, the physician is confronted by lies and (self)destructive behaviour of the patient, who in one way or another tries to involve the physician in this behaviour. It is no longer controversial (...) that the physician should communicate his consideration of a factitious disorder without insistence that the patient accepts this diagnosis. However, the balance between patient autonomy and open communication on the one hand, and the preservation of the patient's health, physician integrity and of a constructive physician-patient relationship on the other is easily disrupted. In this article, an epistemological model is described to facilitate a positive outcome of confrontation in treatment of factitious disorder. Analysing the problem in terms of systems theory will help the physician to assess what information is appropriate to use in which phase of the patient's treatment, while preserving the physician-patient relationship. In this article the authors seek to conceptualize a dynamic and inclusive understanding of personal identity within multicultural democracies such as South Africa, which will draw on both the liberal and communitarian traditions' respect for the project of self. A preliminary lay out for such a project emerges from a literature survey of recent, primarily South African publications on identity and culture, and it suggests that selfhood depends on: a) virtues, cultivated within cooperative communities which allow for effective freedom; b) (...) a venture into existential uncertainty, which alleviates that fear of loss of identity that is supposedly central to many multicultural conflicts; c) the hermeneutic construction of identity through narratives that allow for a plurality of voices; and d) the creative transcending and re- interpretation of values and traditions. The authors contend that such an under standing of identity goes some way towards addressing the question of the way that diverse personal and group identities are to be accommodated in South Africa's multicultural democracy, and to re thinking the unity which underlies diversity without resorting to liberalism's reduction of personal identity to rational autonomy. This (by no means exhaustive) survey of Postman’s work reflects on his penetrating analyses of contemporary technology. He focused attention on the ways technology today, especially the television and the computer, inevitably change us. The essential questions he asks us to ask (and answer) are, How does technology affect us? Is it for good or ill? and Must we accept all technological advances? Postman recognized the current dominance and autonomy of technology as well as the concomitant dangers and consequently made (...) the case and the plea for the reassertion of human over technological values. ABSTRACTAccording to many governments and educationalists, education should aim to develop dispositions conducive to political participation and solidarity, because democratic citizenship presupposes participation and solidarity. But there are radically different views on the nature of good citizenship. We examine the implications of this dissensus for citizenship education. Education, we contend, should involve and develop autonomy and open-mindedness. We argue that this requires a more critical approach than is possible when political participation and solidarity are conceived of as goals of education.

This article looks at how and why addiction should be understood as a ‘sociorelational’ disorder, and what this implies on a policy level in terms of the treatment and prevention of addiction. In light of scientific research, we argue that the neurobiological changes that underlie addiction are heavily influenced by sociorelational processes. We thereby advocate for a conceptual approach in which autonomy in addiction is a sociorelational concept, and social environments are considered autonomy undermining or autonomy promoting. Health authorities increasingly request that general practitioners use information and communication technologies such as electronic patient records for accountability purposes. This article deals with the use of EPRs among general practitioners in Britain. It examines two ways in which GPs use the EPR for accountability purposes. One way is to generate audit reports on the basis of the information that has been entered into the record. The other is to let the computer intervene in the clinical process through prompts. The (...) article argues that GPs' ambivalence toward using the EPR makes them active in finding ways that turn the EPR into a meaningful tool for them, that is, a tool that helps them provide what they see as good care. The article's main contribution is to show how accountability and autonomy are coproduced; less professional autonomy does not follow from more requests to document one's work. Instead, new forms of autonomy are produced in the sociotechnical network that is made up by health policy and local engagements with patients and technology. (shrink)

Hoewel in de laatste jaren sterk de nadruk is gelegd op de “autonomie” van het geschrevene ten opzichte van de schrijver en diens belevingswereld, wil deze auteur graag beginnen met een persoonlijke betuiging van erkentelijkheid. Een mens is toch wel zodanig verbonden met een geesteskind dat hij lang bij zich gedragen heeft, dat hij de aandacht en de grondigheid die uit de hiervoor geplaatste reacties spreekt, alleen maar in hoge mate kan waarderen. Hij heeft ze ervaren als toonbeelden van (...) “ontmoeting”. De verschillen tussen de drie reacties laten nog eens zien dat ontmoeting verre van monotoon is. Juist ook die verschillen vond ik leerzaam. Bij de opzet van mijn repliek wil ik aan de diversiteit zo goed mogelijk recht doen door de reacties stuk voor stuk te bespreken. Af en toe zal een “intertekstuele” opmerking wenselijk of onvermijdelijk zijn. Overigens vrees ik dat binnen het bestek van deze repliek niet voldoende ingegaan kan worden op alle vragen en tegenwerpingen. (shrink)

Der Beitrag stellt die Frage nach den Bedingungen eines im moralischen Sinne angemessenen Umgangs mit dem toten menschlichen Körper. In unserem gegenwärtig geltenden Recht sind bereits entsprechende Normierungen etabliert, die aber, bedingt durch die gesellschaftliche Entwicklung und den wissenschaftlichen Fortschritt, einer erneuten Grundlagenreflexion ausgesetzt werden müssen. Aus philosophischer Perspektive stellt sich die Frage, ob wir den toten menschlichen Körper unter einen besonderen Schutz stellen sollen, um ihm Respekt und Achtung zu sichern und ob sich überhaupt moralische Pflichten gegen den (...) Leichnam begründen lassen. Diese Fragen lassen sich allerdings weder unabhängig von der begrifflichen Bestimmung des Todes noch ohne Klärung des anthropologischen Verhältnisses, in dem Person und Leib bzw. Leib und Leichnam stehen, entwickeln. (shrink)
