In _Necropolitics_ Achille Mbembe—a leader in the new wave of Francophone critical theory—theorizes the genealogy of the contemporary world—a world plagued by ever-increasing inequality, militarization, enmity, and terror, as well as by a resurgence of racist, fascist, and nationalist forces determined to exclude and kill. He outlines how democracy has begun to embrace its dark side, or what he calls its “nocturnal body,” which is based on the desires, fears, affects, relations, and violence that drove colonialism. This shift has (...) hollowed out democracy, thereby eroding the very values, rights, and freedoms liberal democracy routinely celebrates. As a result, war has become the sacrament of our times, in a conception of sovereignty that operates by annihilating all those considered to be enemies of the state. Despite his dire diagnosis, Mbembe draws on post-Foucault debates on biopolitics, war, and race, as well as Fanon's notion of care as a shared vulnerability, to explore how new conceptions of the human that transcend humanism might come to pass. These new conceptions would allow us to encounter the Other not as a thing to exclude, but as a person with whom to build a more just world. (shrink)

Euclid’s definition of a point as “that which has no part” has been a major source of controversy in relation to the epistemological and ontological presuppositions of classical geometry, from the medieval and modern disputes on indivisibilism to the full development of point-free geometries in the 20th century. Such theories stem from the general idea that all talk of points as putative lower-dimensional entities must and can be recovered in terms of suitable higher-order constructs involving only extended regions (or bodies). In _Critique of Black Reason_ eminent critic Achille Mbembe offers a capacious genealogy of the category of Blackness—from the Atlantic slave trade to the present—to critically reevaluate history, racism, and the future of humanity. Mbembe teases out the intellectual consequences of the reality that Europe is no longer the world's center of gravity while mapping the relations among colonialism, slavery, and contemporary financial and extractive capital. Tracing the conjunction of Blackness with the biological fiction of race, he theorizes Black (...) reason as the collection of discourses and practices that equated Blackness with the nonhuman in order to uphold forms of oppression. Mbembe powerfully argues that this equation of Blackness with the nonhuman will serve as the template for all new forms of exclusion. With _Critique of Black Reason_, Mbembe offers nothing less than a map of the world as it has been constituted through colonialism and racial thinking while providing the first glimpses of a more just future. Holeless doughnuts are like extensionless color, or durationless sound—nonsense. Does it follow, then, that when we buy a doughnut we really purchase two sorts of thing—the edible stuff plus the little chunk of void in the middle? Surely we cannot just take the doughnut and leave the hole at the grocery store, (...) as we cannot just eat the doughnut and save the hole for later. Universalist and nihilist answers to philosophical questions may be extreme, but they are clear enough. Aliquidist answers, by contrast, are typically caught between the Scylla of vagueness and indeterminacy and the Charybdis of ungroundedness and arbitrariness, and steering a proper middle course—saying exactly where in the middle one is going to settle—demands exceptional navigating powers. I myself tend to favor extreme answers precisely for this reason. Here, however, I consider one sense in which Something may claim superiority over its polar (...) competitors, Everything and Nothing, when it comes to answerting the ontological question, “What is there?”. In _Brutalism_, eminent social and critical theorist Achille Mbembe invokes the architectural aesthetic of brutalism to describe our moment, caught up in the pathos of demolition and production on a planetary scale. Just as brutalist architecture creates an affect of overwhelming weight and destruction, Mbembe contends that contemporary capitalism crushes and dominates all spheres of existence. In our digital, technologically focused era, capitalism has produced a becoming-artificial of humanity and the becoming-human of machines. This blurring of the natural and (...) artificial presents a planetary existential threat in which contemporary society’s goal is to precipitate the mutation of the human species into a condition that is at once plastic and synthetic. Mbembe argues that Afro-diasporic thought presents the only solution for breaking the totalizing logic of contemporary capitalism: repairing that which is broken, developing a new planetary consciousness, and reforming a community of humans in solidarity with all living things. This volume sheds new light on modern theories of natural law through the lens of the fragmented political contexts of Italy in the eighteenth and nineteenth centuries, and the dramatic changes of the times. From the age of reforms, through revolution and the 'Risorgimento', the unification movement which ended with the creation of the unified Kingdom of Italy in 1861, we see a move from natural law and the law of nations to international law, whose teaching was introduced in Italian (...) universities of the newly created Kingdom. The essays collected here show that natural law was not only the subject of a highly codified academic teaching, but also provided a broader conceptual and philosophical framework for the 'science of man'. In his main work, The Science of Legislation , the Neapolitan Gaetano Filangieri proposed a set of extensive political and cultural reforms. These reforms were necessary to free eighteenth-century societies from the remnants of feudal institutions that obstructed international peace and economic growth. Filangieri's ideas were shaped by the international political climate between the seven Years’ War and the eve of the French Revolution. Reinterpreting Montesquieu and Genovesi through the influences of French radical and Enlightenment thought , as well as (...) the economics of Hume, Verri and the Physiocrats, he concluded that European modernity was inherently contradictory.From this perspective Filangieri set out to force a clean break between the technical horizons of mercantilism and enlightened absolutism and a society based on civil rights, a fair distribution of wealth and resources, and free trade. Proper ‘scientific’ knowledge of the rules and principles of legislation would allow governments to balance out the natural and cultural factors that characterise individual states, and to identify the appropriate model for social and economic development. If all states acted on their proper interest, international free trade and peaceful competition between states would emerge and the potential for general economic growth be materialised. Thus, the natural equilibrium and ‘universal consensus’ among nations could be restored. (shrink)

This article discusses the well-known verdict of Vattel's legal positivism in relation to concepts of modernity and the European State System and aims at a re-interpretation of Vattel's understanding of the modern state, just war and the international order. It wants to show that even though States and individuals do not obey the same logic and reason, Vattel was neiter a Hobbesian thinker nor, as Kant claimed, a 'sorry comforter'. The main reason for this is that Vattel's doctrine of the (...) war en forme does not imply a break with the tradition of just war. Instead, it should be read as a reformulation of the inegalitarian notion of the enemy as proposed by just war doctrines. Pointing out to the persistance of a jusnaturalistic framework, the article shows that Vattel's concept of justus hostis is built on the same conceptual framework as the concept of the enemy of the human race. Cette articulation permet également de montrer que cette doctrine de la tolérance ne lie pas la tolérance théologique universelle à l’égard des croyances individuelles à l’idée d’un culte national uniforme au niveau politique, à savoir un seul modèle de religion civile . (...) Au contraire, les circonstances historiques imposent une pluralité de solutions au niveau politique. Cette vision universelle de la tolérance procède du refus de tout universalisme dogmatique.The author discusses the meaning of the Savoyard vicar’s profession of faith in order to explain the peculiar relationship between natural religion, natural law and political right which lays at the basis of Rousseau’s system. Beginning from this relationship, it is possible to show that Rousseau’s theory of toleration is not characterized by the problematic alliance between a private liberty of conscience and a public national religion in the political realm. On the contrary, in order to solve the problem of political toleration Rousseau envisages a plurality of solutions to suit different historical circumstances. He thus endorses a universal doctrine of toleration that is built on the refusal to universalise any single model of toleration. (shrink)

The relationship between the political theory of Rousseau and modern natural law continues to be the subject of debate, both with regard to Rousseau's faithfulness to the idea of natural law itself and regarding the precise extent of the debt he owed to his predecessors. In this article the author re-examines this relationship by focusing attention on what has been defined as the protestant tradition of natural law. In particular she concentrates on the political and theoretical exercise that Jean Barbeyrac (...) had sought to perform by constructing a particular version of this tradition, namely that of using the science of natural law to promote a policy of tolerance between protestants and to justify the right of citizens to resist catholic sovereigns who denied them religious freedom, as well as the right of protestant countries to come to the aid of persecuted fellow believers. The thesis asserts that Rousseau was fully aware of this exercise, just as he was aware that some of Barbeyrac's ideas had been adopted and reworked by another illustrious Genevan, Jean-Jacques Burlamaqui, a member of the Small Council, to support anti-populist and antidemocratic politics in Geneva. Viewed in this way it is possible to perceive in Rousseau's political thought not so much a “first crisis” of natural law as an intention to reformulate this science from a republican perspective in order to derive rigorous principles of political law from it. And in developing his republican political theory Rousseau took up and overturned the analysis of democratic sovereignty carried out by Pufendorf, who in opposing the “pro-monarchist” excesses of authors such as Hobbes and Horn had unhesitatingly demonstrated the complete validity of democratic sovereignty. ☆ I would like to thank Matthew Armistead for his excellent English translation. The paper proposes a notion of fairness which overcomes the conflict arising between efficiency and the absence of envy in economies with uncertainty and asymmetrically informed agents. We do it in general economies which include, as particular cases, the main models of differential information economies, providing in this framework a natural competitive equilibrium notion which satisfies the fair criterion. The analysis is conducted allowing the presence of large traders, which may cause the lack of perfect competition.

We provide results allowing to state, by the simple inspection of suitable classes of posets , that the corresponding intermediate propositional logics are maximal among the ones which satisfy the disjunction property. Starting from these results, we directly exhibit, without using the axiom of choice, the Kripke frames semantics of 2No maximal intermediate propositional logics with the disjunction property. This improves previous evaluations, giving rise to the same conclusion but made with an essential use of the axiom of choice, of (...) the cardinality of the set of the maximal intermediate propositional logics with the disjunction property. We exhibit a family of computably enumerable sets which can be learned within polynomial resource bounds given access only to a teacher but which requires exponential resources to be learned given access only to a membership oracle. In general, we compare the families that can be learned with and without teachers and oracles for four measures of efficient learning.
