L'exemple de Kant" s'emploie à montrer que l'examen de la fonction de l'exemple permet de situer les enjeux essentiels de la philosophie critique de Kant, aussi bien dans le domaine théorique que dans le domaine pratique. Nous examinons les rôles attribués par Kant aux exemples ("Darstellung" d'un objet, preuve de possibilité de la vertu, outil rhétorique ou encore œuvre de jugement politique), pour ensuite analyser les difficultés qu'il y a à justifier la possibilité de ces rôles dans les termes mêmes (...) de sa pensée. Cette étude est aussi un plaidoyer pour l'importance de la troisième "Critique" dans l'économie de l'œuvre kantienne puisqu'il s'agit de montrer d'une part, que c'est là que la méthode transcendantale fait l'épreuve de ses propres limites, et, d'autre part, que Kant y élabore une réponse originale au scepticisme - par le biais d'une théorie originale de l'exemple. Three experiments examined whether the mere priming of potential action effects enhances people’s feeling of causing these effects when they occur. In a computer task, participants and the computer independently moved a rapidly moving square on a display. Participants had to press a key, thereby stopping the movement. However, the participant or the computer could have caused the square to stop on the observed position, and accordingly, the stopped position of the square could be conceived of as the potential effect (...) resulting from participants’ action of pressing the stop key. The location of this position was primed or not just before participants had to stop the movement. Results showed that priming of the position enhanced experienced authorship of stopping the square. Additional experimentation demonstrated that this priming of agency was not mediated by the goal or intention to produce the effect. (shrink)

The conscious awareness of voluntary action is associated with systematic changes in time perception: The interval between actions and outcomes is experienced as compressed in time. Although this temporal binding is thought to result from voluntary movement and provides a window to the sense of agency, recent studies challenge this idea by demonstrating binding in involuntary movement. We offer a potential account for these findings by proposing that binding between involuntary actions and effects can occur when self-causation is implied. Participants (...) made temporal judgements concerning a key press and a tone, while they learned to consider themselves as the cause of the effect or not. Results showed that implied self-causation increased temporal binding. Since intrinsic motor cues of movement were absent, these results suggest that sensory evidence about the key press caused binding in retrospect and in line with the participant’s sense of being an agent. Through the exponential growth in digital devices and computational capabilities, big data technologies are putting pressure upon the boundaries of what can or cannot be considered acceptable from an ethical perspective. Much of the literature on ethical issues related to big data and big data technologies focuses on separate values such as privacy, human dignity, justice or autonomy. More holistic approaches, allowing a more comprehensive view and better balancing of values, usually focus on either a design-based approach, in which it (...) is tried to implement values into the design of new technologies, or an application-based approach, in which it is tried to address the ways in which new technologies are used. Some integrated approaches do exist, but typically are more general in nature. This offers a broad scope of application, but may not always be tailored to the specific nature of big data related ethical issues. In this paper we distil a comprehensive set of ethical values from existing design-based and application-based ethical approaches for new technologies and further focus these values to the context of emerging big data technologies. A total of four value lists were selected for this. The integrated list consists of a total of ten values: human welfare, autonomy, non-maleficence, justice, accountability, trustworthiness, privacy, dignity, solidarity and environmental welfare. Together, this set of values provides a comprehensive and in-depth overview of the values that are to be taken into account for emerging big data technologies. (shrink)

Increasing numbers of decisions about everyday life are made using algorithms. By algorithms we mean predictive models captured from historical data using data mining. Such models often decide prices we pay, select ads we see and news we read online, match job descriptions and candidate CVs, decide who gets a loan, who goes through an extra airport security check, or who gets released on parole. Yet growing evidence suggests that decision making by algorithms may discriminate people, even if the computing (...) process is fair and well-intentioned. This happens due to biased or non-representative learning data in combination with inadvertent modeling procedures. From the regulatory perspective there are two tendencies in relation to this issue: to ensure that data-driven decision making is not discriminatory, and to restrict overall collecting and storing of private data to a necessary minimum. This paper shows that from the computing perspective these two goals are contradictory. We demonstrate empirically and theoretically with standard regression models that in order to make sure that decision models are non-discriminatory, for instance, with respect to race, the sensitive racial information needs to be used in the model building process. Of course, after the model is ready, race should not be required as an input variable for decision making. From the regulatory perspective this has an important implication: collecting sensitive personal data is necessary in order to guarantee fairness of algorithms, and law making needs to find sensible ways to allow using such data in the modeling process. The legal basis for processing personal data and some other types of Big Data is often the informed consent of the data subject involved. Many data controllers, such as social network sites, offer terms and conditions, privacy policies or similar documents to which a user can consent when registering as a user. There are many issues with such informed consent: people get too many consent requests to read everything, policy documents are often very long and difficult to understand and users (...) feel they do not have a real choice anyway. Furthermore, in the context of Big Data refusing consent may not prevent predicting missing data. Finally, consent is usually asked for when registering, but rarely is consent renewed. As a result, consenting once often implies consent forever. At the same time, given the rapid changes in Big Data and data analysis, consent may easily get outdated. This paper suggests expiry dates for consent, not to settle questions, but to put them on the table as a start for further discussion on this topic. Although such expiry dates may not solve all the issues of informed consent, they may be a useful tool in some situations. (shrink)

It is generally assumed that storing predictive relations between two events in memory as bi-directional associations does not require conscious awareness of this relation, whereas the formation of unidirectional associations that capture the direction of the relation does. This study reports a set of experiments demonstrating that unidirectional associations can be formed even when awareness of the relation is actively prevented, if attention is “tuned” to process predictive relations. When participants engaged in predicting targets based on cues in an unrelated (...) task before the actual acquisition phase, unidirectional associations were formed during this acquisition phase even though E1 was presented subliminally. This suggests that although processing the relation between events may often be accompanied by awareness of this relation, awareness is not a prerequisite for the formation of unidirectional associations. The two terms he uses to describe the object of affirmation further reinforce the understanding that Derrida is taking on metaphysics both in the sense of adopting it, and in the sense of challenging it. Thus, if doing “without sovereignty” is one of Derrida's imperatives, then that (...) is an imperative to do without the metaphysical fulcrum. The author purposes in what follows will be to articulate in very general terms the manner in which Derrida transformed the Kantian heritage. He will emphasize that the transformation involves both opening a different perspective on some of Kant's key concepts and developing a new relation to the methodology which critical philosophy inaugurated. Responding to Elizabeth Rottenberg's invitation to consider good signs, I first raise a question about “good” and “too good” signs by referring to a letter of Louis Althusser's that describes the risk that “too good” signs will be misread. I then turn to the distinction Rottenberg makes between deconstructive signs and Immanuel Kant's historical signs. Borrowing an image from Jacques Derrida's The Animal That Therefore I Am (2008), I suggest that we think of the task of abolition of the death (...) penalty as requiring a particular kind of strangulation of Kantian discourse, a strangulation that would reach the center of its nervous system and disarm its powers without putting it to death. Finally, I turn to a recent initiative by a Belgian nongovernmental organization (Groupe d'action dans l'interet des animaux or Global Action in the Interest of Animals [GAIA]) in their campaign to abolish the practice of castrating piglets without anesthetic, reading it as an example of a strategy that mobilizes the discourse of rights while at the same time undermining the sovereign power that sustains it. This provides an image of the sort of stranglehold with a certain lightness of touch that, I argue, Derrida's work on the death penalty prescribes as the task for unconditional abolition. (shrink)

How can one bring about virtuous behaviour? This question is all the more pressing for Kant as his definition of the virtuous act in terms of autonomy sets up a particularproblem. Indeed, it seems that any effort to provoke an act of autonomy is doomed: should it „succeed”, the act it provoked would no longer be autonomous but rather determined by something external. A possible solution to this logical conundrum is fleetingly adumbrated by Kant in §48 of the Metaphysics of (...) Morals. In this section, the parerga of virtue are credited with both leading to, and belonging to, virtue. Taken in conjunctionwith what the Critique of Judgement teaches us concerning the role of parerga, this suggests an indirect efficacy which is perhaps precisely that which is needed to provoke virtuous behaviour. The Byzantine rite of ordination to the presbyterate culminates in the conferral of a portion of the Eucharist upon the newly-ordained by the bishop. After reviewing the historical roots of this rite, this article examines the philological and biblical background of the term. Parakatathêkê coincides with the notion of paradosis but goes beyond it in personal and eschatological senses. Three simultaneous but distinct acts of personal transmission are highlighted: the personal participation of the newly-ordained in the apostolic ministry of the (...) bishop; the handing over of Christ personally present in the Eucharist to the newly-ordained; and the corresponding personal surrender of the new priest to Christ, to whom he will render an account of his own realization of Christ's priesthood in the service of His Mystical Body, the Church. In this essay I take up and try to follow a tantalizing phrase, "ontological vehemence," that is strewn about Ricoeur's later hermeneutic phenomenology—especially The Rule of Metaphor, Oneself as Another, and Memory, History, Forgetting —and which is often accompanied, often silently, by various forms of "nonphilosophy." I find it telling because it appears to serve as Ricoeur's passage between thinking and acting, and also to allow his unabashed vitalism to dwell with and alongside frank encounters with darkness and brokenness. Personal data use is increasingly permeating our everyday life. Informed consent for personal data use is a central instrument for ensuring the protection of personal data. However, current informed consent practices often fail to actually inform data subjects about the use of personal data. This article presents the results of a requirements analysis for informed consent from both a legal and usability perspective, considering the application context of educational assessment. The requirements analysis is based on European Union law and a (...) review of current practices. As the main outcome, the article presents a blueprint which will be the basis for the development of an informed consent template that supports data controllers in establishing an effective and efficient informed consent form. Because the blueprint, and subsequently, the template, distinguishes between legal and usability requirements, it also provides the basis for the mapping of legal requirements in other contexts. While “inclusion” has been seen as a central mode of redressing ongoing injustices against communities of color in the US, Indigenous political experiences feature more complex legacies of contesting US citizenship. Turning to an important episode of contestation, this essay examines the relation between inclusion and the politics of eliminating Indigenous nations that was part of a shared policy shift toward “Termination” in the Anglo-settler world of the 1950s and 1960s. Through a reading of Indigenous activist-intellectual Vine Deloria Jr.’s Custer (...) Died for Your Sins: An Indian Manifesto, it demonstrates how the construction of what I call the “civic inclusion narrative” in post–World War II American political discourse disavowed practices of empire-formation. Widely considered a foundational text of the Indigenous Sovereignty Movement, the work repositioned Indigenous peoples not as passive recipients of civil rights and incorporation into the nation-state but as colonized peoples actively demanding decolonization. Deloria’s work provides an exemplary counterpoint to the enduring thread of civic inclusion in American political thought and an alternative tradition of decolonization—an imperative that continues to resonate in today’s North American and global Indigenous struggles over land, jurisdiction, and sovereignty. In their paper: “Learning of Predictive Relations Between Events Depends on Attention, Not on Awareness” Custers & Aarts demonstrate that when one is first exposed to a clear predictive relationship – a consequent predictive relationship will be represented as a unidirectional association in the percievers’ minds regardless of their awareness of that relationship. Furthermore, a conscious intention to learn the relationship leads to the formation of a bidirectional association. While these findings may prove to be a significant step in (...) understanding other forms of implicit learning such as implicit artificial grammar learning and implicit sequence learning and why they are affected by intentional learning; Custers & Aarts’ postulation that “top-down” regulation is at work here is debatable as their experimental manipulation can be understood as “bottom-up” activation of implicit learning processes. The first part of this book (“Social Waste and Non-Commodity Waste, and the Individual Circuit of Capital”) will probably be of most interest to readers of this journal. The author argues that Marx’s formula for individual circuits of capital does not allow a fully adequate comprehension of capitalism. Marx discusses the initial money capital invested (M), the commodity inputs purchased with investment capital (C), the production process (P), the new commodities produced (C’), and the money appropriated from sales of those (...) commodities (M’). Custers insists that two other elements must be included: the non-commodity waste produced in the course of commodity production, and the social waste that results when commodities have “negative use-values” (this occurs when their use inflicts net harm on society). He takes the pollution generated in the course of producing nuclear energy as the main example of non-commodity waste, while nuclear weapons provide the paradigmatic illustration of social waste. Custers adds symbols for these two phenomena (-W and =W, respectively) to Marx’s M-C-P-C’-M formula. The discussion of the profound environmental costs of each and every stage in the production of nuclear energy warrants special mention due to its clarity and comprehensiveness. Representatives of the nuclear industry and their allies are becoming increasingly emboldened to propose nuclear energy as the solution to global warming. Many of us suspect this is an insane idea. But it is important to know precisely why this.. (shrink)

In this article we examine the effectiveness of consent in data protection legislation. We argue that the current legal framework for consent, which has its basis in the idea of autonomous authorisation, does not work in practice. In practice the legal requirements for consent lead to ‘consent desensitisation’, undermining privacy protection and trust in data processing. In particular we argue that stricter legal requirements for giving and obtaining consent as proposed in the European Data protection regulation will further weaken the (...) effectiveness of the consent mechanism. Building on Miller and Wertheimer’s ‘Fair Transaction’ model of consent we will examine alternatives to explicit consent. (shrink)

Technological developments increasingly enable monitoring and steering the behavior of individuals. Enforcement of the law by means of technology can be much more effective and pervasive than enforcement by humans, such as law enforcement officers. However, it can also bypass legislators and courts and minimize any room for civil disobedience. This significantly reduces the options to challenge legal rules. This, in turn, can impede the development of legal systems. In this paper, an analogy is made with evolutionary biology to illustrate (...) that the possibility to deviate from legal rules and existing norms is sometimes necessary for the further development of legal systems. Some room to break the law, for instance, through civil disobedience or imperfect enforcement of the law, will ensure sufficient variation. This allows for properly evolving legal systems that can continue to provide fair solutions, even when society and concepts of fairness further develop. (shrink)

Custers and Aarts demonstrated that whether predictive relations between two events are stored in memory as unidirectional or bi-directional structures does not depend on awareness, but on attention. Here, the role of attention and top-down processes in producing these effects are investigated more closely.

The proposal that there is an illusion of conscious will has been supported by findings that priming of stimulus location in a task requiring judgements of action-authorship can enhance participants’ experience of agency. We attempted to replicate findings from the ‘Wheel of Fortune’ task [Aarts, H., Custers, R., & Wegner, D. M. . On the inference of personal authorship: enhancing experienced agency by priming effect information. Consciousness and Cognition, 14, 439–458]. We also examined participants’ performance on this task in (...) relation to self-reported passivity experiences and hallucination-proneness. We found a significant effect of priming, with primes being found to increase the experience of agency. An interaction between gender and priming was also found, with priming enhancing feelings of agency in women but not in men. There were no significant correlations between levels of self-reported passivity experiences or hallucination-proneness and participants’ susceptibility to the priming effect on ratings of agency. Implications of these findings are discussed with regard to a prominent model of passivity experiences. (shrink)

This book argues for the use of nonideal theory in social ontology. The central claim is that a paradigm shift is underway in contemporary social ontology, from ideal to nonideal, and that this shift should be fully followed through. To develop and defend this central claim, the first step is to show that the key questions and central dividing lines within contemporary social ontology can be fruitfully reconstructed as a clash between two worlds, referred to as ideal and nonideal social (...) ontology. Ideal social ontology is characterized by consensus and cooperation, while nonideal social ontology is characterized by conflict and contestation. The second step is to show that, when taken together, objections to the standard model of ideal social ontology (the dominant version of ideal social ontology) imply that this model needs to be given up in favor of nonideal social ontology. In other words, we should look to nonideal rather than ideal social ontology for core concepts. The third step is to offer a positive account, called the power view, of nonideal social ontology. This account places the concept of social power at the core of a general theory of the social world and replaces the flat and narrow conception of power in ideal social ontology with a richer and more extensive conception. In addition, it rectifies a shortcoming in nonideal social ontology by attending to class, which has been notably and oddly overlooked in the literature. (shrink)

Trope theory is a leading metaphysical theory in analytic ontology. One of its classic statements is found in the work of Donald C. Williams who argued that tropes qua abstract particulars are the very alphabet of being. The concept of an abstract particular has been repeatedly attacked in the literature. Opponents and proponents of trope theory alike have levelled their criticisms at the abstractness of tropes and the associated act of abstraction. In this paper I defend the concept of a (...) trope qua abstract particular by rejecting arguments that purport to show that tropes should not be understood as abstract and by arguing that the abstractness of tropes plays an indispensable role in one of our more promising trope-theoretic analyses of universals and of concrete objects.
