We introduce the appropriate iterated version of the system of ordinal notations from [G1] whose order type is the familiar Howard ordinal. As in [G1], our ordinal notations are partly inspired by the ideas from [P] where certain crucial properties of the traditional Munich' ordinal notations are isolated and used in the cut-elimination proofs. As compared to the corresponding “impredicative” Munich' ordinal notations (see e.g. [B1, B2, J, Sch1, Sch2, BSch]), our ordinal notations arearbitrary terms in the appropriate simple term (...) algebra based on the notion of collapsing functions (which we would rather identify as projective functions). In Sect. 1 below we define the systems of ordinal notationsPRJ( ), for any primitive recursive limit wellordering . In Sect. 2 we prove the crucial well-foundness property by using the appropriate well-quasi-ordering property of the corresponding binary labeled trees [G3]. In Sect. 3 we interprete inPRJ( ) the familiar Veblen-Bachmann hierarchy of ordinal functions, and in Sect. 4 we show that the corresponding Buchholz's system of ordinal notationsOT( ) is a proper subsystem ofPRJ( ), although it has the same order type according to [G3] together with the interpretation from Sect. 2 in the terms of labeled trees. In Sect. 5 we use Friedman's approach in order to obtain an appropriate purely combinatorial statement which is not provable in the theory of iterated inductive definitions ID< λ, for arbitrarily large limit ordinalλ. We show that it is relatively consistent with ZFC that there is a projective wellfounded relation with rank higher than all projective prewellorderings.

Using the Lascar inequalities, we show that any finite rank δ-closed subset of a quasiprojective variety is definably isomorphic to an affine δ-closed set. Moreover, we show that if X is a finite rank subset of the projective space P n and a is a generic point of P n , then the projection from a is injective on X. Finally we prove that if RM = RC in DCF 0 , then RM = RU.

This report recounts three developments during the last two years of the SIEPM Project to revise and complete the repertory of commentaries on Peter Lombard’s Sentences published by Friedrich Stegmüller in 1947. The chronological sections of the project have been established, and scholars have been assigned to lead them. A centralized administration for the Project is now located in Freiburg im Breisgau, which will co-ordinate the various sections and preserve their findings, as well as facilitate and oversee the various editorial (...) projects on commentaries on the Sentences currently underway. It is argued that the Tractatus Project of Logical Atomism, in which the world is conceived of as the totality of independent atomic facts, can usefully be understood by conceiving of each fact as a bit in logical space. Wittgenstein himself thinks in terms of logical space. His elementary propositions, which express atomic facts, are interpreted as tuples of co-ordinates which specify the location of a bit in logical space. He says that signs for elementary propositions are arrangements of names. (...) Here, the names are understood as numerical symbols specifying coordinates. It is argued that, using this approach, the so-called colour-exclusion problem, which was Wittgensteins reason for abandoning the Tractatus, is in fact soluble. However, if logical space is a continuum then some coordinates will need to be expressed by numerical symbols that are infinite in size. How is this to be understood in Tractatus terms? It is shown that, in the Tractatus, Wittgenstein did recognise the possibility of infinite propositions and sentences expressing them. At first sight his approach to infinite sentences, and the approach of the present paper, seem to differ, but it is argued that the difference is superficial. Finally, we address the question of whether Logical Atomism is viable and this raises issues concerning its relationship to natural science. (shrink)

The editor's introduction discusses Clarence I. Lewis's conceptual pragmatism when compared with post-empiricist epistemology and argues that several Cartesian assumptions play a major role in the work, not unlike those of Logical Positivism. The suggestion is made that the Cartesian legacy still hidden in Logical Positivism turns out to be a rather heavy ballast for Lewis’s project of restructuring epistemology in a pragmatist key. More in detail, the sore point is the nature of inter-subjectivity. For Lewis, no less than for (...) the Logical Positivists at the time of the Protocols Controversy and Husserl in the Cartesian Meditations, this is a problem without a solution. The reason is that all these philosophers are apparently unable to realize that the existence of a plurality of knowing subjects cannot be treated at once both as a speculative problem and a methodological one. Lewis, thanks to his pragmatist approach both comes closer to the right answer and offers an even more naïve unsatisfactory solution to the pseudo-problem under discussion. The fact that he has clear in mind that inter-subjectivity means not only a plurality of linguistic utterances but also a co-existence of different kinds of practical behaviour. Eventually, the very idea of mind, the key-idea in the book, suffers from the above mentioned tension. In fact, if inter-subjective communication and action is considered at a methodological level, the very idea of mind would not need an analysis, and no kind of ‘reflexive’ analysis. Methodology might be limited to a ‘naïve’ level where the existence of the world and a plurality of subjects be taken as a bedrock of uncritically accepted evidence. Philosophical reflection on ultimate evidence, instead, would take a different approach, maybe the one Wittgenstein was putting into practice in the same years when Mind and the world order was written, namely it would be bound to question the very meaning of the idea of ‘mind’ as an undue fiction – the same carried out by Descartes – when he assumed the Cogito to be at once a body of self-evident truths and a thing or substance, the familiar Platonic idea of psyche or soul. If the bounded proper forcing axiom BPFA holds and ω 1 = ${\mathrm{\omega }}_{1}^{\mathrm{L}}$ , then there is a lightface ${\mathrm{\Sigma }}_{3}^{1}$ well-ordering of the reals. The argument combines a well-ordering due to Caicedo-Veličković with an absoluteness result for models of MA in the spirit of "David's trick." We also present a general coding scheme that allows us to show that BPFA is equiconsistent with R being lightface ${\mathrm{\Sigma }}_{4}^{1}$ , for many "consistently locally certified" relations R on $\mathrm{\mathbb{R}}$ . In this highly original study, Nuccio Ordine uses the figure of the ass as a lens through which to focus on the thought and writings of the great Renaissance humanist philosopher Giordano Bruno.

We identify a particular mouse, [Formula: see text], the minimal ladder mouse, that sits in the mouse order just past [Formula: see text] for all [Formula: see text], and we show that [Formula: see text], the set of reals that are [Formula: see text] in a countable ordinal. Thus [Formula: see text] is a mouse set. This is analogous to the fact that [Formula: see text] where [Formula: see text] is the sharp for the minimal inner model with a Woodin (...) cardinal, and [Formula: see text] is the set of reals that are [Formula: see text] in a countable ordinal. More generally [Formula: see text]. The mouse [Formula: see text] and the set [Formula: see text] compose the next natural pair to consider in this series of results. We formulate and prove a combinatorial property assuming AD + V = L(R). As a consequence, we show that every regular κ which is either a Suslin cardinal or the successor of a Suslin cardinal is δ 2 1 -supercompact. In particular, all the projective ordinals δ 1 n are δ 2 1 -supercompact.

We work under the assumption of the Axiom of Determinacy and associate a measure to each cardinal $\kappa < \aleph_{\varepsilon_0}$ in a recursive definition of a canonical measure assignment. We give algorithmic applications of the existence of such a canonical measure assignment (computation of cofinalities, computation of the Kleinberg sequences associated to the normal ultrafilters on all projective ordinals).

This paper argues that Cantorian transfinite cardinality is not a necessary assumption for the ontological claims in Badiou’s L’Être et l’Événement. The necessary structure for Badiou’s mathematical ontology in this work was only the ordinality of sets. The method for reckoning the sizes of sets was only assumed to follow the standard Cantorian measure. In the face of different and compelling forms of measuring non-finite sets, it is argued that Badiou’s project can indeed accommodate this pluralism of measurement. In turn, (...) this plurality of measurement implies that Badiou’s insistence on the “subtraction of the one”, the move to affirm the unconditioned being of the “inconsistent multiple”, results in the virtuality of the one, a pluralism of counting that further complicates the relationship between the one and the multiple in the post-Cantorian era. The larger project broached here is to look at the generally sentence “if X is well-ordered then f is well-ordered”, where f is a standard proof-theoretic function from ordinals to ordinals. It has turned out that a statement of this form is often equivalent to the existence of countable coded ω-models for a particular theory Tf whose consistency can be proved by means of a cut elimination theorem in infinitary logic which crucially involves the function f. To illustrate (...) this theme, we prove in this paper that the statement “if X is well-ordered then εX is well-ordered” is equivalent to . This was first proved by Marcone and Montalban [Alberto Marcone, Antonio Montalbán, The epsilon function for computability theorists, draft, 2007] using recursion-theoretic and combinatorial methods. The proof given here is principally proof-theoretic, the main techniques being Schütte’s method of proof search [Kurt Schütte, Proof Theory, Springer-Verlag, Berlin, Heidelberg, 1977] and cut elimination for a fragment of. Michael Potter presents a comprehensive new philosophical introduction to set theory. Anyone wishing to work on the logical foundations of mathematics must understand set theory, which lies at its heart. Potter offers a thorough account of cardinal and ordinal arithmetic, and the various axiom candidates. He discusses in detail the project of set-theoretic reduction, which aims to interpret the rest of mathematics in terms of set theory. The key question here is how to deal with the paradoxes that bedevil set (...) theory. Potter offers a strikingly simple version of the most widely accepted response to the paradoxes, which classifies sets by means of a hierarchy of levels. What makes the book unique is that it interweaves a careful presentation of the technical material with a penetrating philosophical critique. A variety of projects in proof theory of relevance to the philosophy of mathematics are surveyed, including Gödel's incompleteness theorems, conservation results, independence results, ordinal analysis, predicativity, reverse mathematics, speed-up results, and provability logics.

Some philosophers have recently argued that decision-makers ought to take normative uncertainty into account in their decisionmaking. These philosophers argue that, just as it is plausible that we should maximize expected value under empirical uncertainty, it is plausible that we should maximize expected choice-worthiness under normative uncertainty. However, such an approach faces two serious problems: how to deal with merely ordinal theories, which do not give sense to the idea of magnitudes of choice-worthiness; and how, even when theories do give (...) sense to magnitudes of choice-worthiness, to compare magnitudes of choice-worthiness across different theories. Some critics have suggested that these problems are fatal to the project of developing a normative account of decision-making under normative uncertainty. The primary purpose of this article is to show that this is not the case. To this end, I develop an analogy between decision-making under normative uncertainty and the problem of social choice, and then argue that the Borda Rule provides the best way of making decisions in the face of merely ordinal theories and intertheoretic incomparability. The forms this graffiti takes, our inscriptions on the landscape, are as numerous as our Nations, abundant as our ancestors who loved, lived, and passed down knowledge of our lands and histories. "You are the result of the love of thousands," writes Linda (...) Hogan, who beseeches us to listen to the environment surrounding us (159). Deborah Miranda (Coastal Esselen and Chumash) reminds us that we are also the result of violent histories, in her tribal memoir Bad Indians, a book that relishes the tales of her ancestors who resist and act out to survive. This harm, genocide, and settler mapping of worlds also must be attuned to in our surroundings and in "our bodies [that are] bridges over which our descendants cross, spanning unimaginable landscapes of loss" (Miranda 74). Visual cartographic mapping has been part and parcel of the erasure of California Indians, relegated to the small, contained, and past temporal space of a romanticized mission.This paper centers on the NDN Collective's work and the photography of Cara Romero's project Tongvaland and the works of Gabrielino Tongva artist Mercedes Dorame. The setting of these projects is in the sprawling landscape of Los Angeles, or the homelands of the Gabrielino Tongva people, who call it Tovaangar. I will examine the anti-colonial aesthetics and care practices mapped out in the work rather than presenting a "true" Indigenous map or alternative map. Mapping a history of the landscape by creating a "new" narrative or "true" narrative is not enough. As Maori scholar Linda Tuhwi Smith states, "[w]e believe that history is also about justice, that understanding history will enlighten our decisions about the future. Wrong. History is also about power. In fact, history is mostly about power. … [A] thousand accounts of the truth will not alter the fact that indigenous peoples are still marginal [End Page 50] and do not possess the power to transform history into justice" (34). The Gabrielino Tongva, who comprise an estimated 2,300 people, do not possess the population power and cannot access the form of voting or democracy to make the changes needed just by telling their truth. Across California, people know about the raw deal, the embezzlement, the genocide, and the so-called lost treaties. In fact, under Eisenhower, recompense was paid out in small amounts to Tongva families of the dispossessed. Instead, to continue with the words of Smith, "[i]t is also about reconciling and reprioritizing what is really important about the past with what is important about the present" (111). What Romero and the NDN Collective—made up of numerous tribal leaders, scholars, and other artists—did was relay and prioritize how they wanted to be seen in their homelands. These billboards invite us in, in a gift of sharing, or what tribal cultural leader Craig Torres related to me as a spirit of Maxxa, a sharing, gifting, or swapping of knowledge. Dorame's beautiful and critical installations in public art spaces reflect Maxxa—they invite the viewers to think through land from her curious arrangements. As artists, part of their practice is not that of a Western version of a tortured genius but instead is energized by pulling in community and creating a collective practice. They undo settler space together and with us. The cartographic practices of these California Indians' creative arts exemplify communities of care that must be considered when we think through the unmapping of settler terrains. This question requires an approach of radical care. As Hi'ilei Hobart and Tamara Kneese make clear, the notion of care is "inseparable from systemic inequalities and power systems" (Hobart and Kneese 1).The work of the NDN Collective and Dorame counters a settler-based, commercial map of Los Angeles. Indigenous people, relegated by the settler state as expendable and erasable graffiti, confront capitalist and state ordinances at various scales. Rather than understand this as a subjugated positionality, I posit that graffiti is the critique necessary and valuable to understanding interlocking structures of oppression. Propositional attitude verbs, such as think and want, have long held interest for both theoretical linguists and language acquisitionists because their syntactic, semantic, and pragmatic properties display complex interactions that have proven difficult to fully capture from either perspective. This paper explores the granularity with which these verbs’ semantic and pragmatic properties are recoverable from their syntactic distributions, using three behavioral experiments aimed at explicitly quantifying the relationship between these two sets of properties. Experiment 1 gathers a measure of 30 (...) propositional attitude verbs’ syntactic distributions using an acceptability judgment task. Experiments 2a and 2b gather measures of semantic similarity between those same verbs using a generalized semantic discrimination task and an ordinal scale task, respectively. Two kinds of analyses are conducted on the data from these experiments. The first compares both the acceptability judgments and the semantic similarity judgments to previous classifications derived from the syntax and semantics literature. The second kind compares the acceptability judgments to the semantic similarity judgments directly. Through these comparisons, we show that there is quite fine-grained information about propositional attitude verbs’ semantics carried in their syntactic distributions—whether one considers the sorts of discrete qualitative classifications that linguists traditionally work with or the sorts of continuous quantitative classifications that can be derived experimentally. The venerable cities of the past, such as Venice or Amsterdam, convey a feeling of wholeness, an organic unity that surfaces in every detail, large and small, in restaurants, shops, public gardens, even in balconies and ornaments. But this sense of wholeness is lacking in modern urban design, with architects absorbed in problems of individual structures, and city planners preoccupied with local ordinances, it is almost impossible to achieve. In this groundbreaking volume, architect and planner Christopher Alexander presents a new (...) theory of urban design which attempts to recapture the process by which cities develop organically. To discover the kinds of laws needed to create a growing whole in a city, Alexander proposes here a preliminary set of seven rules which embody the process at a practical level and which are consistent with the day-to-day demands of urban development. He then puts these rules to the test, setting out with a number of his graduate students to simulate the urban redesign of a high-density part of San Francisco, initiating a project that encompassed some ninety different design problems, including warehouses, hotels, fishing piers, a music hall, and a public square. This extensive experiment is documented project by project, with detailed discussion of how each project satisfied the seven rules, accompanied by floorplans, elevations, street grids, axonometric diagrams and photographs of the scaled-down model which clearly illustrate the discussion. A New Theory of Urban Design provides an entirely new theoretical framework for the discussion of urban problems, one that goes far to remedy the defects which cities have today. (shrink)

Like many of their contemporaries Bernard Nieuwentijt and Pieter van Musschenbroek were baffled by the heterodox conclusions which Baruch Spinoza drew in the Ethics. As the full title of the Ethics—Ethica ordine geometrico demonstrata—indicates, these conclusions were purportedly demonstrated in a geometrical order, i.e. by means of pure mathematics. First, I highlight how Nieuwentijt tried to immunize Spinoza’s worrisome conclusions by insisting on the distinction between pure and mixed mathematics. Next, I argue that the anti-Spinozist underpinnings of Nieuwentijt’s distinction between (...) pure and mixed mathematics resurfaced in the work of van Musschenbroek. By insisting on the distinction between pure and mixed mathematics, Nieuwentijt and van Musschenbroek argued that Spinoza abused mathematics by making claims about things that exist in rerum natura by relying on a pure mathematical approach. In addition, by insisting that mixed mathematics should be painstakingly based on mathematical ideas that correspond to nature, van Musschenbroek argued that René Descartes’ natural-philosophical project abused mathematics by introducing hypotheses, i.e. ideas, that do not correspond to nature. We show that in a simple theory T in which the τf-topologies are closed under projections every type analyzable in a supersimple τf-open set has ordinal SU-rank. In particular, if in addition T is unidimensional, the existence of a supersimple unbounded τf-open set implies T is supersimple. We also introduce the notion of a standard τ-metric and show that for simple theories its completeness is equivalent to the compactness of the τ-topology.

Local food initiatives are steadily becoming a part of contemporary cities around the world and can take on many forms. While some of these initiatives are concerned with providing consumers with farm-fresh produce, a growing portion are concerned with increasing the food sovereignty of marginalized urban communities. This chapter provides an analysis of urban contexts with the aim of identifying conceptual barriers that may act as roadblocks to achieving food sovereignty in cities. Specifically, this paper argues that taken for granted (...) commitments created during the birth of the modern city could act as conceptual barriers for the implementation of food sovereignty programs and that urban food activists and programs that challenge these barriers are helping to achieve the goal of restoring food sovereignty to local communities, no matter their reasons for doing so. At the very least, understanding the complexities of these barriers and how they operate helps to strengthen ties between urban food projects, provides these initiatives with ways to undermine common arguments used to support restrictive ordinances and policies, and illustrates the transformative potential of food sovereignty movements. What are the ethical concerns among the growing populations of business people in Central & Eastern Europe, and how might they be dealt with practically in the course of business life? David Murray has been a management consultant since 1979 working primarily with the Hay Group in the area of strategic organisational change. Since founding Maine Consulting Services in 1991 he spends most of his time in the field of business and professional ethics, also holding a Visiting Fellowship at the (...) University of Central Lancashire. He is chairman of the Professional & Technical Board at the (British) Institute of Quality Assurance and a coordinating editor of the quarterly Organisations & People. Marek Kucia is a social researcher operating his own research agency (which organised the Polish part of this exercise) and an academic teaching sociology, and conducting and co‐ordinating Central European Studies at the Jagiellonian University, Krakow. He studied political science, sociology and philosophy at Krakow and studied for his PhD at Oxford. He has also worked for Gallup, London, in opinion and market research. This survey report is based on presentations made in April 1994 to the EBEN Research Centres Conference in Prague, and in June 1994 to the conference on “Ethics in Transition” organised in Gödöllö, Hungary, by the Democracy after Communism Foundation, Budapest. Mitchell Jürgen Habermas's "colonization of the lifeworld" thesis (1987, 332-73) posits that many of society's pathologies are due to the tendency of institutions to convert social issues that ought to be sorted out by a debating citizenry into technical problems ripe for resolution by expert bureaucracies, thus pre-empting important public (...) discussion. Habermas has attempted to lay bare the pernicious effects of this colonization process in his analysis of public opinion polling, welfare policy, education, German reunification, immigration, and other social issues (see Habermas 1997, 1994, and 1970; Holub 1992). In each of these contexts, Habermas has publicly challenged the encroachment of scientistic modes of decision-making into spheres where joint communicative action by deliberating citizens would yield more appropriate and legitimate judgments. This critical impulse is also evident in Habermas's methodological reflections on the proper role of academic scholarship, where he has argued vigorously against attempts to graft "objectivating" methods of natural scientific inquiry onto research projects in the social sciences (1971, 304-17).From all of this, one might gather that Habermas's commitment to rolling back the influence of technical forms of reasoning is connected to some intrinsic quarrel he has with the natural sciences. Yet such a sweeping generalization is hard to sustain in light of the fact that Habermas does not oppose technical reasoning per se; he recognizes that the daunting complexity of social life in late capitalism requiresthat certain "steering" tasks be delegated to systems that utilize largely instrumental logics to co-ordinate action. Likewise, he acknowledges that the disciplines of the natural sciences necessarily play important supporting roles in such steering projects.One normative presupposition of Habermas's colonization thesis is that there exists some proper boundary demarcating where the sphere of technical reasoning ends and the realm of communicative rationality begins. [End Page 1] On one side of this boundary, Habermas has provided many details on what he sees as the essential qualities of a properly functioning "public sphere," where "new social movements" continuously reweave the threads of communicative fabric holding society together (1996, 359-87), and where "historico-hermeneutic" academic study reflects on public life, sluicing insight back into the capillaries of democratic deliberations (1987, 374-403).What lies on the other side of the boundary is murkier. The proper role of natural scientific investigation has received relatively scant attention in Habermas's critical theory of society, and this has led to some confusion regarding his account of the natural sciences, as well as debate over whether this account has political purchase. One would think that sympathetic commentators, such as Helen Longino (who bases much of her own coherence theory of scientific truth on Habermas), would have reassuring things to say on this point. Yet her lukewarm assessment that, "in trying to clear a space for an autonomous social and critical theory, [Habermas] has ceded nature to the positivists" (1990, 202), raises questions about the flexibility and scope of Habermas's theory of communicative action as a basis for critique of scientific practice.One way to test Habermas's account of the natural sciences on this count is to put his views in conversation with science studies commentators who share a similar commitment to the idea that dialogue and argumentation are constitutive elements of scientific practice. Such an approach recasts the "ceding to positivism" question into a moment of controversy over the role of dialogue, not only as an essential motor driving the scientific enterprise, but also as a vehicle for democratic decision-making on issues related to the purpose and direction of scientific inquiry in society.Part one of this essay locates discursive norms embedded pragmatically in the notion of scientific objectivity. By bringing a modified version of Habermas's theory of communicative action into conversation with other approaches to science studies that foreground intersubjective dialogue as the key motor driving the scientific enterprise, I develop a foundation for robust criticism of systematically distorted scientific communication. Responsible Research and Innovation (‘RRI’) is a cross-cutting priority for scientific research in the European Union and beyond. This paper considers whether the way such research is organised and delivered lends itself to the aims of RRI. We focus particularly on international consortia, which have emerged as a common model to organise large-scale, multi-disciplinary research in contemporary biomedical science. Typically, these consortia operate through fixed-term contracts, and employ governance frameworks consisting of reasonably standard, modular components such as management committees, advisory (...) boards, and data access committees, to co-ordinate the activities of partner institutions and align them with funding agency priorities. These have advantages for organisation and management of the research, but can actively inhibit researchers seeking to implement RRI activities. Conventional consortia governance structures pose specific problems for meaningful public and participant involvement, data sharing, transparency, and ‘legacy’ planning to deal with societal commitments that persist beyond the duration of the original project. In particular, the ‘upstream’ negotiation of contractual terms between funders and the institutions employing researchers can undermine the ability for those researchers to subsequently make decisions about data, or participant remuneration, or indeed what happens to consortia outputs after the project is finished, and can inhibit attempts to make project activities and goals responsive to input from ongoing dialogue with various stakeholders. Having explored these challenges, we make some recommendations for alternative consortia governance structures to better support RRI in future. (shrink)

To fight climate change, firms must adopt effective and feasible carbon management practices that promote collaboration within supply chains. Engaging suppliers and customers on carbon management reduces vulnerability to climate-related risks and increases resilience and adaptability in supply chains. Therefore, it is important to understand the motives and preconditions for pursuing supply chain engagement from companies that actively engage with supply chain members in carbon management. In this study, a relational view is applied to operationalize the supply chain engagement concept (...) to reflect the different levels of supplier and customer engagement. Based on a sample of 345 companies from the Carbon Disclosure Project’s supply chain program, the determinants of engagement were hypothesized and tested using multinomial and ordinal logistic estimation methods. The results indicate that companies that integrate climate change into their strategies and are involved in developing environmental public policy are driven by moral motives to engage their suppliers and customers in carbon management. All these factors make a stronger impact on supplier engagement than on customer engagement. Moreover, companies operating in greenhouse gas-intensive industries are driven by instrumental motives to engage their suppliers and customers because increasing greenhouse gas intensity positively influences engagement level. Company profitability appears to increase supplier engagement, but not customer engagement. Interestingly, operating in a country with stringent environmental regulations does not appear to influence supply chain engagement. By utilizing relational capabilities and collaboration, buyers can increase their suppliers’ engagement to disclose emissions, which ultimately will lead to better results in carbon management. This paper proposes a retributive argument against punishment, where punishment is understood as going beyond condemnation or censure, and requiring hard treatment. The argument sets out to show that punishment cannot be justified. The argument does not target any particular attempts to justify punishment, retributive or otherwise. Clearly, however, if it succeeds, all such attempts fail. No argument for punishment is immune from the argument against punishment proposed here. The argument does not purport to be an argument only against retributive (...) justifications of punishment, and so leave open the possibility of a sound non-retributive justification of punishment. Punishment cannot be justified, the paper argues, because it cannot be demonstrated that any punishment, no matter how minimal, is not a disproportionate retributive response to criminal wrongdoing. If we are to hold onto proportionality—that is, proportionality as setting a limit to morally permissible punishment—then punishment is morally impermissible. The argument is a retributive argument against punishment insofar as a just retributive response to wrongdoing must be proportionate to the wrongdoing. The argument, that is, is concerned with proportionality as a retributive requirement. The argument against punishment is set out on the basis of a familiar version of the ‘anchoring problem’, according to which it is the problem of determining the most severe punishment to anchor or ground the punishment scale. To meet the possible criticism that we have chosen a version of the anchoring problem particularly favourable to our argument, various alternative statements of the anchoring problem are considered. Considering such statements also provides a more rounded view of the anchoring problem. One such alternative holds that the punishment scale must be anchored not just in the most severe punishment, but in the least severe punishment as well. Other alternatives hold that it is necessary and sufficient to anchor the punishment scale in any two punishments, neither of which needs to be the most or least severe punishment. A further suggestion is that one anchoring point anywhere along the punishment scale is sufficient, because it is possible to ‘project’ from such a point, so as to determine the correlative punishments for all other crimes, and so derive a complete punishment scale. Finally, the suggestion is considered that one can approach the issue of a punishment scale ‘holistically’, denying any distinction between anchoring and derived (or ‘projected’) punishments. (shrink)
