Recently the confrontation has grown more intense. The ap pointment of clinical ethicists in hospitals and other health care settings is an accelerating trend in North America. Concomitantly, those institutions involved in training peo ple in clinical ethics have added organized exposure to the world of practice, in the form of placement requirements, to the normal academic course load. Reichenbach held that all scientific inference reduces, via probability calculus, to induction, and he held that induction can be justified. He sees scientific knowledge in a practical context and insists that any rational assessment of actions requires a justification of induction. Gaps remain in his justifying argument; for we can not hope to prove that induction will succeed if success is possible. However, there are good prospects for completing a justification of essentially the kind he sought by showing that while (...) induction may succeed, no alternative is a rational way of trying.Reichenbach's claim that probability calculus, especially via Bayes' Theorem, can help to exhibit the structure of inference to theories is a valuable insight. However, his thesis that the weighting of all hypotheses rests only on frequency data is too restrictive, especially given his scientific realism. Other empirical factors are relevant. Sidgwick's seminal textThe Methods of Ethicsleft off with an unresolved problem that Sidgwick referred to as the dualism of practical reason. The problem is that employing Sidgwick's methodology of rational intuitionism appears to show that there are reasons to favour both egoism and utilitarianism. Katarzyna de Lazari-Radek and Peter Singer offer a solution in the form of an evolutionary debunking argument: the appeal of egoism is explainable in terms of evolutionary theory. I argue that like rational prudence, rational benevolence (...) is subject to debunking arguments and so problematic, but also – and more importantly – that debunking arguments are irrelevant in the debate over the dualism of practical reason on the view of reason and rational intuitionism that Lazari-Radek and Singer embrace. Either both egoism and utilitarianism are debunked, or neither are. If I am right, Sidgwick's dualism is left standing. (shrink)

If animism is regarded as an ontology—a set of beliefs regarding the kinds of entities that exist—it is incompatible with naturalism: the idea that the only causal entities and powers are those identified by our best science. But an enactivist and practice-based theory of knowledge enables us to see that ontologies emerge from practices. An animistic ontology is one way of theorizing ‘animic’ practices, while naturalism is one way of theorizing the practice of science. There exist different (...) ways of theorizing each set of practices, only some of which lead to a verdict of incompatibility. But an enactivist and practice-based theory of knowledge takes us further. The Practical Turn in Political Theory sounds like the monograph political theorists have been waiting for – a monograph that identifies ‘practices’ as a uniting theme that runs through several recently influential debates on non-ideal theory, practice dependence, realism and pragmatist theories of legitimacy and democracy, and then discusses the promise and limits of this uniting theme for the future of political theory. However, The Practical Turn is driven by selective portrayals, omissions and misrepresentation, and hence (...) is not a good source to turn to for understanding the debates it surveys or whether they manifest a ‘practical turn in political theory’ or not; rather, it serves as a warning of how struggles over power can influence and even structure seemingly the most purely intentioned of practices. The question of what role social and political practices should play in the justification of normative principles has received renewed attention in post-millennium political philosophy. Several current debates express dissatisfaction with the methodology adopted in mainstream political theory, taking the form of a criticism of so-called ‘ideal theory’ from ‘non-ideal’ theory, of ‘practice-independent’ theory from ‘practice-dependent’ theory, and of ‘political moralism’ from ‘political realism’. While the problem of action-guidance lies at the heart of (...) these concerns, the critics also share a number of methodological assumptions. Above all, their methodology is practice-dependent in the sense that an existing practice is assumed to put substantial limitations on the appropriate normative principles for regulating it. In other words, we cannot formulate and justify an appropriate principle without first understanding the practice this principle is supposed to govern. The aim of this paper is to map out and analyze the common denominators of these debates with regard to methodological commitments. We will investigate how this practice-dependent method may be understood and motivated. Using the context of controversies surrounding evolutionary developmental biology (EvoDevo) and the possibility of an Extended Evolutionary Synthesis, I provide an account of theory structure as idealized theory presentations that are always incomplete (partial) and shaped by their conceptual content (material rather than formal organization). These two characteristics are salient because the goals that organize and regulate scientific practice, including the activity of using a theory, are heterogeneous. This means that the same theory can be (...) structured differently, in part because theory presentations (as idealizations) intentionally depart from different features known to be present in a theory. Since there are diverse and potentially incompatible theory structures derived from heterogeneous goals found in scientific practices, a question arises about the absence of a unifying theory structure in the background. The notion of a “theory façade” offers a fruitful perspective on this potentially unsettling result. (shrink)

While the presence or absence of consciousness plays the central role in the moral/ethical decisions when dealing with patients with disorders of consciousness (DOC), recently it is criticized as not adequate due to number of reasons, among which are the lack of the uniform definition of consciousness and consequently uncertainty of diagnostic criteria for it, as well as irrelevance of some forms of consciousness for determining a patient’s interests and wishes. In her article, Dr. Specker Sullivan reexamined the meaning of (...) consciousness in the DOC taxonomy and proposed to go away from the routinely used clinical definition of consciousness as “wakeful awareness”, and adopt the meaning that is common in the Eastern tradition which is a form of “pure experience” (Specker Sullivan 2018). She further argued that understanding consciousness as a “pure experience” is ethically relevant for DOC patients. This suggestion is original, novel and important since it preserves the importance of the notion of consciousness for the clinical practice while simultaneously offering an additional ethical tool for the moral decisions in medicine. At the same time, without placing such Eastern notion in the Western tradition it is difficult to see how pure experience could be usefully operationalized to make sense in the clinical practice with DOC patients. It is so because pure experience is a subjective phenomenon which is completely inaccessible in noncommunicative DOC patients and also it does not express behaviorally (Monti et al 2010), therefore some objective-like operationalization is needed. This is why the fusion of Eastern and Western traditions is required to gain the full potential of Dr. Specker Sullivan’s suggestion. We propose that such fusion could be achieved on the basis of the Operational Architectonics (OA) theory of brain-mind functioning (Fingelkurts et al. 2010; 2013a) which suits ideally the purpose due its compatibility with both Western and Eastern traditions of consciousness. Despite the fact that attention is a core property of all perceptual and cognitive operations, our understanding of its neurophysiological mechanisms is far from complete. There are many theoretical models that try to fill this gap in knowledge, though practically all of them concentrate only on either involuntary (bottom-up) or voluntarily (top-down) aspect of attention. At the same time, both aspects of attention are rather integrated in the living brain. In this chapter we attempt to conceptualise both aspects of attentional (...) state within the theory of Operational Architectonics of brain and mind functioning, which provides a plausible theoretical basis for neurophysiological understanding of how attention is brought to existence in the living brain. A hallmark of recent critical social science has been the commitment to methodological and theoretical pluralism. Habermas and others have argued that diverse theoretical and empirical approaches are needed to support informed social criticism. However, an unresolved tension remains in the epistemology of critical social science: the tension between the epistemic advantages of a single comprehensive theoretical framework and those of methodological and theoretical pluralism. By shifting the grounds of the debate in a way suggested by Dewey's pragmatism, the author (...) argues that a thoroughgoing pluralism strengthens, rather than weakens, both the social scientific and political aims of critical social science. Not only does pragmatism offer a plausible interpretation of the epistemic pluralism of the social sciences, but it also provides a way of thinking about their fundamentally practical and political character. With a better normative vocabulary with which to discuss the epistemological issues of such a pluralistic mode of inquiry, the democratic role of critical inquiry and its specifically practical form of verification can be clarified. Comparative political theory is at best an embryonic and marginalized endeavor. As practiced in most Western universities, the study of political theory generally involves a rehearsal of the canon of Western political thought from Plato to Marx. Only rarely are practitioners of political thought willing (and professionally encouraged) to transgress the canon and thereby the cultural boundaries of North America and Europe in the direction of genuine comparative investigation. Border Crossings presents an effort to remedy this situation, fully (...) launching a new era in political theory. Thirteen scholars from around the world examine the various political traditions of West, South, and East Asia and engage in a reflective cross-cultural discussion that belies the assumptions of an Asian "essence" and of an unbridgeable gulf between West and non-West. The denial of essential differences does not, however, amount to an endorsement of essential sameness. As viewed and as practiced by contributors to this ground-breaking volume, comparative political theorizing must steer a course between uniformity and radical separation--this is the path of "border crossings.". In this issue of Hypatia there is a consensus that science is not value-neutral and that cultural/political concerns enter into the epistemology, methodology and conclusions of scientific theory and practice. In future dialogues the question that needs to be further addressed is the precise role political concerns should play in the formulation of a feminist theory and practice of science.

Centuries before being included in Hugo Grotius’s De iure belli ac pacis and De iure praedae, the subject of reprisal was already being discussed in medieval literature. The aim of this paper is to examine the medieval and early modern practice and theory of reprisal as it developed before and during Grotius’s lifetime. Its first part investigates a number of important foundational elements, such as the issues of definition and terminology, and the common characteristics of a reprisal case. (...) In the second half, the author explores why reprisals were deemed to be a ‘perversus mos’ or ‘bad custom’ and how continued reliance on this practice was nonetheless justified by inserting it into the medieval just war doctrine. The paper does not provide a systematic study of Grotius’s own engagement with medieval reprisal sources. Rather, it should be read in conjunction with another publication in this same volume, ‘Grotius on Reprisal’ by Randall Lesaffer. (shrink)

In this paper, the notion of pearl diving as a metaphor for historical methodology is explored as a possible conceptual contribution to pedagogical thinking and practice. Pearl diving in the thinking of Hannah Arendt and Walter Benjamin refers to a process of bringing to life and coming to terms with a fragmented past, and requires of the thinker a form of Homeric impartiality. This they contrast with the processual and functional modern understanding of historiography, where events and things are (...) subsumed by a causal linearity. According to Arendt and Benjamin, our past cannot be understood as though in one piece, but should rather be engaged as fragmented and crystallised into events—or pearls—which can be retrieved and can help us to illuminate our past and to understand our present. This paper considers what such an approach would entail for pedagogical theory and practice, as well as for the work of the pedagogical thinker and the teacher. (shrink)

The chapter discusses the various ways in which ethical theory and moral practice relate to one another. Various proposals are discussed and evaluated, such as that the relation is a deductive one, that the relation is one of norm-specification, or that the theory provides multiple moral principles that must be balanced against one another. The author makes some suggestions on how the relation between theory and practice should be understood.

Many normative political theorists have engaged in the systematic collection and/or analysis of empirical data to inform the development of their arguments over the past several decades. Yet, the approach they employ has typically not been treated as a distinctive mode of theorizing. It has been mostly overlooked in surveys of normative political theory methods and methodologies, as well as by those critics who assert that political theory is too abstracted from actual political contestation. Our aim is to (...) unearth this grounded normative theory (GNT) approach – to identify its definitive practices and highlight its potential significance. We detail four overlapping commitments characteristic of GNT. These include commitments to expanding the comprehensiveness of input for normative arguments through original empirical research and/or analysis, recursivity in the development of normative claims, attentiveness to the systematic inclusion of a range of voices and ways of knowing, and accountability to those engaged by the theorist in empirical contexts. We discuss methodological distinctions within GNT, including between more- and less-solidaristic approaches. We discuss how GNT answers calls for theorists to engage more closely with empirical political dynamics and we consider responses to possible critiques. (shrink)

In philosophy, the last thirty years or so has seen a split between 'simulation theorists' and 'theory-theorists', with a number of variations on each side. In general, simulation theorists favour the idea that our knowledge of others is based on using ourselves as a working model of what complex psychological creatures are like. Theory-theorists claim that our knowledge of complex psychological creatures, including ourselves, is theoretical in character and so more like our knowledge of the world in general. (...) The body of this paper is divided into three parts. In Part I, I introduce the 'contrastive case' of autism. Autism is a developmental disorder that has recently become the focus of sustained philosophical and psychological attention because of the selective way in which it affects individuals' social capacities. Theory-theorists argue that autistic children's unique profile of assets and deficits is most fruitfully explained by their inability to develop and deploy a theory of mind. After considering the strengths of this hypothesis, I claim theory-theorists face two unresolved difficulties: explaining why high-functioning autistics who develop some theory of mind capacities still fail to engage in normal psychological knowing; and explaining why autistics are generally as unknowable to us in the privileged sense of normal psychological knowing as we are to them. In Part II, I provide the theoretical framework for addressing these challenges by developing an account of normal psychological knowing as psycho-practical expertise. In Part III, I return to the problem of autism, showing how this psycho-practical approach to normal psychological knowing may further suggest how to encompass various aspects of the disorder that tend to be ignored under the prevailing theory-theory approach. The practical nature of all human understanding lies at the heart of Gadamer's philosophical hermeneutics, yet the stress he places on practicality and his appeal to Aristotle remain relatively neglected by the secondary literature. This neglect is due in part to a failure to see the great extent to which Gadamer relies on the Aristotelian concept of phronēsis (practical wisdom) and, to a lesser extent, on the Hegelian concept of the concrete universal. The purpose of this paper is to show (...) how the proper understanding of Aristotle's notions of practical wisdom and theoretical knowing, both of which are crucial to an appreciation of Gadamer's description of human understanding as Spiel (“game” or “play”), will help to reverse two of the recurring mischaracterizations of philosophical hermeneutics: first, that it is ultimately anti-science (against method and theory) and second, that critical reason or rationality plays only a minor role within it. This paper is a report from the international MacIntyre conference 'Theory, Practice, and Tradition'.

Introduction. The article is focused on analyzing the aesthetic aspect of A. Kojève’s philosophy, the ability of his philosophy, from an aesthetic point of view, to clarify a number of key problems of the modern political and cultural environment. The purpose of the study is to determine the epistemological attitude of A. Kojève’s philosophy able to clarify the way in which his philosophy problematizes the current cultural and political reality. Methods. Hermeneutics, comparative analysis and deconstruction are used as research methods. (...) Comparative analysis allows us to demarcate A. Kojève’s own line of reasoning, in the context of aesthetic and epistemological theories, as well as Hegelian themes themselves. Hermeneutics is the central method in the work, since the philosophy of A. Kojeve requires interpretation as an aesthetic theory. Deconstruction, formalized to the status of a method according to P. de Man, allows us to detect inconsistencies, the principle of mutual problematization of Kojeve’s philosophy and the current political and epistemological agenda. Scientific novelty of the research. The standard way of interpreting the work of A. Kojève is to evaluate him as an interpreter of G. Hegel. The author analyzes some meaning of A. Kojève’s philosophy, separate from G. Hegel’s explanation of the text. The novelty lies not only in the fact that A. Kojève’s philosophy is defined as theorizing that goes beyond technical hermeneutics (clear presentation), but also as a specific representation of such theorizing as epistemological aesthetic theory. The latter is a rather rare interpretation of the philosophy of A. Kojeve. This allows us to expand the traditional assumption that post-Hegelian epistemesthetics is the property of an extremely limited number of authors (for example, B. Croce). Moreover, such an interpretation of A. Kojève’s theories is a new element in the emerging trend of considering political issues within the framework of epistemological aesthetics. Results. The specific mode of interpreting G. Hegel, which is carried out by A. Kojève, turns the philosophy of the former into a unique aesthetic project. In this project, the category of aesthetic experience comes to the foreground, indicating the empty, formal nature of any discourse. In this regard, any claim to knowledge of reality, to a correct idea of the subject is replaced by the idea of creating the subject of discourse. Consistent treatment of this idea is symptomatic of the philosophy of A. Kojève. This philosophy is a reflection of those historical changes that gave rise to the culture of “aesthetic rationality”: empty and formal. In A. Kojève’s philosophy, one can see how such a culture of the End of History is, contrary to Hegelian ideas, not the era of the struggle decline, but the era of its strange transformation, a symptom of increasing political violence. Conclusions. A. Kojève’s philosophy is considered not as a utopian political project, but as a problematization of the modern cultural and political sphere. The latter is understood as an indication of the inconsistency of ontological discourses of Truth, the discovery in the very essence of discursive practices of an empty, formal principle, and therefore primarily of interest to aesthetics. The modern era of the End of History and the end of the era of persuasive speech gives an idea of the main political paradox (at least for the philosophy of A. Kojève, and at most for the modern political environment). The era of disappointment in discourse should become an era of refusal to fight for discourses, but it becomes an era of maximizing violence, since it is in a situation of disappointment that discourses can only be supported by force. We move from unconvincing speech to convincing violence, but it is possible to understand the origins and specifics of this transition only by considering A. Kojève’s philosophy in the light of such a discipline as aesthetics. (shrink)

Deanna Kuhn's theory of informal argumentation (1991) evaluates arguments according to a theory/evidence model where subjects first articulate a theory and then must provide critical testing of alternatives on the basis of evidence. Using this model, Kuhn reports that many subjects fail to supply adequate evidence for their 'theories' and are often unable or unwilling to generate alternatives. In this paper an account of practical reasoning is provided that suggests an alternate interpretation for Kuhn's subjects' poor perfonnance. (...) It is argued that treating practical arguments as failed theoretical justifications causes Kuhn to misrepresent the contribution of many of her subjects' arguments. (shrink)

Are the theoretical frameworks of phenomenology and of science compatible? And, if so, what would a reconciliation entail for science as it is practiced? Gallagher [2019] poses these two questions, answering the first in the affirmative and leaving the second unaddressed. I argue that treating the two as separate questions presupposes an inadequate distinction between theory and practice that Gallagher’s non-reductive framework motivates rejecting. Recognizing the intertwining of theory and practice allows us to answer Gallagher’s two (...) questions about phenomenology and science all at once, but it also motivates a less conciliatory conclusion than the one he offers.
