Disorders of consciousness continue to profoundly challenge both families and medical professionals. Once a brain-injured patient has been stabilized, questions turn to the prospect of recovery. However, what “recovery” means in the context of patients with prolonged DOC is not always clear. Failure to recognize potential differences of interpretation—and the assumptions about the relationship between health and well-being that underlie these differences—can inhibit communication between surrogate decisionmakers and a patient’s clinical team, and make it difficult to establish the goals of (...) care. The authors examine the relationship between health and well-being as it pertains to patients with prolonged DOC. They argue that changes in awareness or other function should not be equated to changes in well-being, in the absence of a clear understanding of the constituents of well-being for that particular patient. The authors further maintain that a comprehensive conception of recovery for patients with prolonged DOC should incorporate aspects of both experienced well-being and evaluative well-being. (shrink)

Patient outcome after serious brain injury is highly variable. Following a period of coma, some patients recover while others progress into a vegetative state (unresponsive wakefulness syndrome) or minimally conscious state. In both cases, assessment is difficult and misdiagnosis may be as high as 43%. Recent advances in neuroimaging suggest a solution. Both functional magnetic resonance imaging and electroencephalography have been used to detect residual cognitive function in vegetative and minimally conscious patients. Neuroimaging may improve diagnosis and prognostication. These techniques (...) are beginning to be applied to comatose patients soon after injury. Evidence of preserved cognitive function may predict recovery, and this information would help families and health providers. Complex ethical issues arise due to the vulnerability of patients and families, difficulties interpreting negative results, restriction of communication to “yes” or “no” answers, and cost. We seek to investigate ethical issues in the use of neuroimaging in behaviorally nonresponsive patients who have suffered serious brain injury. The objectives of this research are to: (1) create an approach to capacity assessment using neuroimaging; (2) develop an ethics of welfare framework to guide considerations of quality of life; (3) explore the impact of neuroimaging on families; and, (4) analyze the ethics of the use of neuroimaging in comatose patients. The problem of environment is the leading common problem of people living on Earth, the sky and soil of which have been polluted. I believe that pollution in a broad sense is the basis for all other important problems of this world. Man has polluted himself and Earth. In the former, which is called cultural pollution, man becomes alienated from other members of his own species and in the latter, which is called physical pollution, man becomes alienated from nature of (...) which he is a child. Both problems, which are based on alienation, show the deficiency in the implementation of the idea of the unity of man and nature, of the unity of mankind. The unity of humanity presupposes the consciousness of living in a common world and of the fact that man is a child of Earth. The possibility of and the necessity for such a consciousness to come into being in a physical-geographical space, which is metaphorically represented by Istanbul, in which different cultures managed to exist side by side throughout history, shows itself more clearly in the present day. Istanbul might be seen as the city which is probably most suitable for being seen as a metaphor for a world in which the idea of the unity of humanity may be realized in the future, because it is an entrance to Asia with its eastern side and to Europe with its western side and as such the point of intersection of the eastern and western cultures. It was a cosmopolitan city and still is. Having a look at the world from Istanbul as a metaphor is in a sense the same as having a look at Istanbul itself. (shrink)

A belief commonly held in linguistics and philosophy is that semantics is defined by syntax. In this article, I will demonstrate that this does not hold true for Turkish. A fundamental syntactical rule builds around the successive order of words or speech units in a sentence. The order determines the meaning of the sentence, which in turn is rendered meaningless if the rule is not observed. In a given language, if a sentence retains meaning without this rule being applied, then (...) the rule cannot be said to determine meaning. Turkish, with its mathematical structure, is one such language. In effect, the degree to which semantics is determined by syntax varies considerably from one language to the other. If meaning is constructed through dissimilar means in different languages, then it is not possible to talk about a single theory of meaningfulness valid for all languages. Each language is uniquely determined, and is a reflection of its proper cultural background. A theory of language must take into account this cultural framework. In this paper, I shall deal with a different way of constructing meaning whereby syntax does not determine semantics, and present the linguistic possibilities it gives rise to. (shrink)

A pandemic may cause a sudden imbalance between available medical resources and medical needs where fundamental care to a patient cannot be delivered. Inability to fulfil a professional commitment to deliver care as needed can lead to distress among caregivers and patients. This distress is sometimes alleviated through mechanisms that hide the facts that care is rationed and not all medical needs are met. We have identified three mechanisms that jeopardise accountable and optimal allocation of resources: hidden value judgements that (...) allow rationing under the disguise of triage or prioritisation, disguised conflict of interest between societal and individual patient’s needs and concealed biases in the application of medical tools. Under these three pitfalls decisions of resource allocation and who gets treated are handled as medical decisions: normative decisions are concealed and perceived as falling with the realm of medical judgement. Value judgements and moral agency are hidden to offer a ‘false sense of medical judgement’, while in fact there are several ethical judgements and biases at stake. The three pitfalls entail hidden normative deliberation and are inappropriate for sustainable healthcare delivery and resource allocation. We believe it is necessary to maintain transparency in decision making under conditions of insufficient resources to maintain trust in professional care givers and secure fair treatment allocation. Recognition of the pitfalls, by applying our recommendations, may help to ensure transparent and accountable distribution of care and contribute to public acceptance of the ethics behind rationing. A growing number of studies show that a significant proportion of patients, who meet the clinical criteria for the diagnosis of the vegetative state, demonstrate evidence of covert awareness through successful performance of neuroimaging tasks. Despite these important advances, the day-to-day life experiences of any such patient remain unknown. This presents a major challenge for optimizing the patient’s standard of care and quality of life. We describe a patient who, following emergence from a state of complete behavioral unresponsiveness and a (...) clinical diagnosis of VS, reported rich memories of his experience during this time. This case demonstrates the potential for a sophisticated mental life enabled by preserved memory in a proportion of patients who, similarly, are thought to be unconscious. Therefore, it presents an important opportunity to examine the implications for patient QoL and standard of care, both during the period of presumed unconsciousness and after recovery. (shrink)

:Long-term patient outcomes after severe brain injury are highly variable, and reliable prognostic indicators are urgently needed to guide treatment decisions. Functional neuroimaging is a highly sensitive method of uncovering covert cognition and awareness in patients with prolonged disorders of consciousness, and there has been increased interest in using it as a research tool in acutely brain injured patients. When covert awareness is detected in a research context, this may impact surrogate decisionmaking—including decisions about life-sustaining treatment—even though the prognostic value (...) of covert consciousness is currently unknown. This paper provides guidance to clinicians and families in incorporating individual research results of unknown prognostic value into surrogate decisionmaking, focusing on three potential issues: Surrogate decisionmakers may misinterpret results; Results may create false hope about the prospects of recovery; There may be disagreement about the meaningfulness or relevance of results, and appropriateness of continued care. A general obligation to make aggregate research results available to participants has been widely supported in the bioethics literature. However, dementia research presents several challenges to this perspective, particularly because of the fear associated with developing dementia. The authors argue that considerations of respect for persons, beneficence, and justice fail to justify an obligation to make aggregate research results available to participants in dementia research. Nevertheless, there are positive reasons in favor of making aggregate research results available; when the decision (...) is made to do so, it is critical that a clear strategy for communicating results is developed, including what support will be provided to participants receiving aggregate research results. As of now, requests made by individuals before national courts to assess the compatibility of certain acts with international humanitarian law failed. The present case study and commentaries focus on the decision of a German civil court sitting Bonn to deny the victims of a NATO air raid the right to sue Germany and claim compensation for alleged violations of international humanitarian law.

ABSTRACT “Meister Eckhart’s Mysticism in Comparison with Zen Buddhism” originally appeared as the concluding section of Ueda Shizuteru’s first book, Die Gottesgeburt in der Seele und der Durchbruch zur Gottheit: Die mystische Anthropologie Meister Eckharts und ihre Konfrontation mit der Mystik des Zen-Buddhismus. It was first published in 1965 as an expanded version of Ueda’s doctoral dissertation, which was written under the supervision of Ernst Benz at the University of Marburg. Ueda’s careful analysis not only illuminates important points of affinity (...) between Eckhart and Zen, but also explains why Eckhart’s mysticism cannot be simply interchanged with Zen Buddhism. To allow the reader to read for themselves, I kept all interpretative notes to a minimum. The text is translated from the most recent edition of the German text, published in 2018 by Verlag Karl Alber, and edited by Wolf Burbat. In 1985, Swiss legal philosopher Walter Ott visited Herbert Hart in Oxford and made this record of their meeting, which casts novel light on some of Hart’s ideas. Ott engaged Hart in a fresh encounter with the legal philosophy of Gustav Radbruch, particularly Hart’s and Radbruch’s reasons for a minimum content of justice in law. They also discussed the grudge informer, state responsibility under laws of an earlier régime, and questions of the definition and falsifiability of legal theories. Hart surprisingly (...) reported Hans Kelsen as stating, when they had met at Berkeley in 1961, that Hume (and not Kant, and certainly not Wittgenstein) was the greatest philosopher who had ever lived. In 1813 Isaak von Sinclair published a poem entitled “The New Acquaintance.” It recounts a meeting between himself, his friend Friedrich Hölderlin, and one other unidentified guest whom Sinclair awaited with keen anticipation. Because of Hölderlin’s well established friendship with Hegel it has been assumed in the past that the unknown acquaintance was in fact Hegel. However, at the time to which the poem refers, Hegel was a relatively obscure and unknown figure with no reputation. If we are therefore to (...) accept that the poem does indeed allude to Hegel then we must assume that Sinclair, as early as 1813, had recognized Hegel’s genius and wanted retrospectively to associate his name with the newly rising star of German philosophy. In that case we must ask why he refrained from mentioning Hegel by name or at least making the character of the unknown unambiguously clear? In translating this poem for the first time into English I offer for consideration another candidate as the “acquaintance,” namely, Wilhelm Heinse. (shrink)

This is a translation of "Socialite et argent", a text by Emmanuel Levinas originally published in 1987. Levinas describes the emergence of money out of inter-human relations of exchange and the social relations - sociality - that result. While elsewhere he has presented sociality as "non-indifference to alterity" it appears here as "proximity of the stranger" and points to the tension between an economic system based on money and the basic human disposition to respond to the face of the (...) other person. Money both encodes and effaces sociality, both designates and disguises social relations. It arises from the way that needs and interests are manifested in exchange relations, in what he calls the "interestedness" of economic life. But interests are always already cut through by the fact that being is always "being with others". Being is always "inter-being". Interestedness is always confronted by disinterestedness, that is, by a sociality marked by the "goodness of giving", attachment to and concern for the poverty of the other person. Levinas concludes with a discussion of sociality and justice, posing questions about the tension between the demand to respond to an Other immediately before me and at the same time to respond to the demands of an other Other (the third person) who also invites a response. In European culture the sacred and the secular have existed in a dialectical relationship. Prodi sees the fifteenth-century crisis of Christianity as opening up three paths that eroded this dualism and tended towards modernity: civic-republican religion, sacred monarchy, and the territorial churches. Important counter-forces, which sought to maintain dualism, included the Roman-Tridentine Compromise, and those forms of Radical Christianity which rejected confessionalisation outright. During the Eighteenth Century, all these phenomena tended to contribute to one of two tendencies: towards civic religion, (...) or towards political religion. The former preserved a distinction between conscience and law; the latter comprised a state religion which sought to perfect all of human nature. It was civic religion which become embodied in the early USA, alienating God from worldly power, but leaving him as the guarantor of agreements between humans. Back in Europe, Prodi tracks the relationship between the Catholic Church and the new national states. He then turns to the political religions of the Twentieth Century. Prodi concludes by emphasising that this dualism of sacred and secular power lay at the centre of Western modernity, and expresses his fears about the collapse of civic religion into political religion, especially in the USA. ‘Language and End Time’ is a translation of Sections I, IV and V of ‘Sprache und Endzeit’, a substantial essay by Günther Anders that was published in eight instalments in the Austrian journal FORVM from 1989 to 1991. The original essay was planned for inclusion in the third volume of The Obsolescence of Human Beings. ‘Language and End Time’ builds on the diagnosis of ‘our blindness toward the apocalypse’ that was advanced in the first volume of The Obsolescence in (...) 1956. The essay asks if there is a language that is capable of making us fully comprehend the looming ‘man-made apocalypse’. In response to this, it offers a critique of philosophical jargon and of the putatively ‘objective’ language of science, which are both dismissed as unsuitable. Sections I, IV and V introduce this core problematic. The selection of this text for inclusion in this special journal issue responds to present-day realities that inscribe Anders’s reflections on nuclear science and the nuclear situation into new contexts. The critique that ‘Language and End Time’ advances resonates with the way in which the decisions of a few companies and individuals are shaping the future of life on earth. At the same time, the wider stakes of Anders’s turn against the language employed by scientists are newly laid bare by the realities and politics of climate change and fake news. In this new context, the language of science is all too readily dismissed as if it were a mere idiom that can be ignored without consequence. It is against the backdrop of a future that is, if anything, more uncertain than at the time of Anders’s writing, that the essay’s reflections on popularisation, the limits of language and the nature of truth gain added significance. At this historical moment, few terms are as charged and powerful as the omnipresent term environment. It has become a strategic tool for politics and theories alike, crossed the borders of the disciplines of biology and ecology, and left the manifold field of environmentalism. This article explores the first steps on this path of expansion, in which the term becomes an argumentative resource and achieves a plausibility that transforms it into a universal tool. It is not self-evident to describe ubiquitous (...) media, cinematic spaces, or augmented realities as environments. To understand how the term gained this plausibility, it is necessary to distinguish it from two other terms: the French milieu and the German Umwelt. When these three terms substitute one another and are used as translations, they lose their historical specificity and depth, and three different theoretical and philosophical traditions merge into indifference. Consequently, a conceptual history of the term environment and its relation to milieu and Umwelt—as well as terms such as medium, atmosphere, ambiance, and climate—can help us to understand the potentials and dangers of the term’s plausibility. In this sense, the article argues for a new perspective on epistemologies of surrounding that relate that which surrounds to that which is surrounded. (shrink)

One of the most fundamental premises of feminist philosophy is the assumption of an invidious asymmetry between the genders that has to be overcome. Parallel to this negative account of asymmetry we also find a positive account, developed in particular within the context of so-called feminist philosophies of difference. I explore both notions of gender asymmetry. The goal is a clarification of the notion of asymmetry as it can presently be found in feminist philosophy. Drawing upon phenomenology as well as (...) feminist difference theory , I argue that a gender asymmetry does exist that cannot-as in the first assumption-be transformed into symmetry. (shrink)

This text reconstructs the Kohlberg/Gilligan controversy between a male ethics of justice and a female ethics of care. Using Karl-Otto Apel's transcendental pragmatics, the author argues for a mediation between both models in terms of a reciprocal co-responsibility. Against this backdrop, she defends the circular procedure of an exclusively argumentative-reflexive justification of a normative ethics. From this it follows for feminist ethics that it cannot do without either of the two types of ethics. Using the notion of a transfiguration of sexed bodies, this text deals with the stratifications of the gender-specific imaginary. Starting from the figurative-thus creative-force of the psyche-soma, its interaction with the configurations of a collective body will be developed from the perspectives of social philosophy and philosophy of history. At the center of my discussion is the interdependence between the individual psyche-soma, the socialized individual, and a collective bodily imaginary, on the one hand, and the strata of a gender imaginary (...) on the other. Despite the overuse of the word in movies, political speeches, and news reports, "evil" is generally seen as either flagrant rhetoric or else an outdated concept: a medieval holdover with no bearing on our complex everyday reality. In _A Philosophy of Evil_, however, acclaimed philosopher Lars Svendsen argues that evil remains a concrete moral problem: that we're all its victims, and all guilty of committing evil acts. "It's normal to be evil," he writes -- the problem is, we have lost (...) the vocabulary to talk about it. Taking up this problem -- how do we speak about evil? -- _A Philosophy of Evil_ treats evil as an ordinary aspect of contemporary life, with implications that are moral, practical, and above all, political. This work argues from a social-theoretical perspective for the view that every concept of 'gender' remains bound to reproduction. As every culture is interested in its continuity, it distinguishes individuals according to their assumed possible contribution to reproduction and so develops a fundamental dual classification. Subsequent gender categories are necessarily derived from this one. The conceptual and empirical arguments for this thesis are illustrated through an imagined dystopia. There I envision under what conditions a complete dissociation of the concepts 'sex' (...) and 'gender' from the old dual distinction would be possible and in what way a multiplicity of genders would be accomplished.
