L’intérêt pour les idées de l’Etat de droit en Lituanie comme dans les autres pays s’est développé de façon marquée dans les périodes où l’appétit de liberté des citoyens était stimulé par le caractère oppressif du pouvoir d’Etat contre lequel ils devaient se défendre. Cette théorie exposait que seul l’Etat de droit pouvait être considéré comme une organisation politique légitime de la société. Les premières théories lituaniennes de l’Etat de droit sont apparues entre le XVIe et le XVIIIe siècles, dans (...) le Grand-Duché de Lituanie lorsque le pouvoir de l’Etat était affaibli et permettait plus aisément de lutter contre ses excès. Nous considérons cette période comme marquant les prémices de l’Etat de droit en Lituanie, comme le début de l’Etat de droit en Lituanie qui survivait les causes et les conséquences de l’évolution de ces idées. In this article the author analyzes the first written constitutions adopted at the end of the eighteenth century (the Constitution of the United States of 1787, the Constitution of Polish – Lithuanian State and the Constitution of France of 1791). These constitutional acts mark the beginning of the era of constitutionalism. These are the constitutions of the first phase (‘wave’) of constitutional development, which laid the foundations for the further establishment of constitutionalism in the world. The history of the first (...) modern constitutions confirms that the nations adopt constitutions in order to protect individuals from possible abuses of state power. The essence of constitutional regulation is the restriction of this power. The three countries differ in many ways, but all had certain tradition of the restriction of powers. The first modern constitutions established the separation of powers and protected classical individual rights. They have become an example for the authors of later constitutions. These constitutions propose legal standards for constitutional development. Each of these constitutions is an original system of principles and norms. (shrink)

The relevance of this topic is determined by the processes of “globalization 4.0”, taking place in a new industrial revolution, which brings about both positive and negative consequences in science, medicine, engineering, financial sphere, geopolitical, and cultural dimensions. Digital technologies based on software and social networks become more effective and integrated, causing transformation in all spheres of the global economy. The purpose of the study is to analyze the development of smart technologies in medicine in conditions of “Globalization 4.0”. The (...) objective of the study is social and philosophical analysis of the “globalization 4.0” phenomenon and the revolutions that preceded itin the context of these revolutions the problems of smart technologies in medicine are developing; the study of the interaction problems of society, man and innovations in the sphere of medicine as mutually determined phenomena of human existence that satisfy, enrich and complement each other. The state of theme study that initiated problem solution: the concept of “globalization 4.0” entered the scientific world due to the works of Klaus Schwab, a German economist, founder and president of the World Economic Forum in Davos, the author of the book “The Fourth Industrial Revolution”. Various aspects of this phenomenon that influenced its formation were reflected in the articles and monographs of Ukrainian scholars - V. Voronkova, V. Lukianets, O. Kravchenko, L. Ozadovska, V. Liakh, V. Pazeniuk, C. Raida, and others, as well as a series of Western scholars such as Ken Robinson, Samuel Greengard, Aarathi Prasad, Martin Ford, Kevin Kelli and others. Study methodology. The study methodology includes analysis of new smart technologies phenomena in medicine in the context of “globalization 4.0” that is developing in front of our eyes and is built on the basis of an integrated approach in the context of interdisciplinary character. The article uses such methods of scientific knowledge as analysis and synthesis, measurement, transition from abstract to concrete, synergistic approach, due to which it was possible to analyze complex problems of smart technologies in medicine. The scientific novelty of the study – is the identification of interaction problems between man, society and medicine in the conditions of “globalization 4.0”, which contribute to the formation of a new technological space. Results of the study: the positive and negative effects of “globalization 4.0” for the development of society, medicine and human beings are analyzed; the future scenarios in overcoming of dangerous diseases for humanity are revealed. Conclusion - the feature and fundamental difference of “globalization 4.0” is the synthesis of these technologies and their interaction in physical, digital and biological domains. (shrink)

Straipsnyje nagrinėjama analitinės kalbos ir mokslo filosofijos raida Lietuvoje. Konstatuojama, kad analitinė filosofija Lietuvoje pradėta plėtoti XX amžiaus aštuntajame dešimtmetyje, kai Evaldas Nekrašas ir Rolandas Pavilionis paskelbė savo pirmųjų mokslo filosofijos ir kalbos filosofijos tyrinėjimų, kuriuose remiamasi analitine tradicija, rezultatus. Straipsnyje analizuojami jų ir kitų tyrėjų, kurie rėmėsi ta pačia tradicija, pirmiausia Algirdo Degučio ir Albino Plėšnio darbai. Analitinė filosofija buvo pirmoji nemarksistinės filosofijos kryptis, pradėta plėtoti pokarinėje Lietuvoje, todėl aštuntajame ir devintajame dešimtmečiuose ji atliko svarbų vaidmenį plečiant šalyje filosofinių (...) tyrinėjimų tematiką ir keičiant jų metodologinius pagrindus. Nors pastaruoju metu jos įtaka Lietuvos filosofijoje kiek sumažėjo, ji aiškiai juntama kai kuriuose pastarojo meto darbuose, kuriuose nagrinėjamos sąmonės filosofijos, priežastingumo, humanitarinių ir socialinių mokslų metodologijos problemos. Ji padarė nemažą poveikį ir pozityvizmo raidos bei politinės filosofijos problemų tyrimui. Pasibaigus Šaltajam karui smarkiai išaugęs tarptautinių konfliktų skaičius bei identifikuotos naujos grėsmės paskatino tarptautines organizacijas, tokias kaip Jungtinių Tautų organizacija (toliau – JTO) ir Šiaurės Atlanto sutarties organizacija (toliau – NATO) peržiūrėti Šaltojo karo metu taikytą jėgos panaudojimo praktiką, poreikį ir priemones reaguoti į konfliktus. Tokiomis priemonėmis kaip tik ir tapo vadinamieji „mėlynieji šalmai“, kurie Jungtinių Tautų valstybių narių yra priskiriami Jungtinių Tautų Saugumo Tarybos sankcionuotoms operacijoms vykdyti. Nors priskirtos pajėgos vykdydamos tarptautines operacijas dėvi Jungtinių Tautų simboliką, tačiau jų pavaldumas (...) savo valstybei išlieka visą laiką. Analizuodami valstybių dalyvavimo tarptautinių organizacijų sankcionuotose tarptautinėse operacijose teisinius pagrindus, straipsnio autoriai per jėgos panaudojimo prizmę analizuoja Jungtinių Tautų Saugumo Tarybos ir apskritai tarptautinių organizacijų vaidmenį sankcionuojant jėgos panaudojimą pagal Jungtinių Tautų Chartijos nuostatas bei tarptautinių operacijų vykdymo raidą. Straipsnyje taip pat detaliai apžvelgiami siuntimo į tarptautines operacijas nacionaliniai teisiniai pagrindai ir procedūros bei Lietuvos Respublikos praktika. Šis straipsnis yra skirtas visiems besidominties tarptautinėmis operacijomis ir jų sankcionavimo nacionaliniais ir teisiniais pagrindais. Straipsnio struktūra susideda iš trijų dalių. Pirmojoje šio straipsnio dalyje yra nagrinėjamas jėgos panaudojimas pagal Jungtinių Tautų Chartijos nuostatas, antroje ‒ aptariami dalyvavimo Jungtinių Tautų Organizacijos ir Šiaurės Atlanto Sutarties Organizacijos vadovaujamose tarptautinėse operacijose raida ir teisiniai pagrindai, o paskutinėje dalyje yra nagrinėjamas nacionalinis siuntimo į tarptautines operacijas reglamentavimas. T. G. Masaryk and M. Romeris are certainly prominent personalities and great names in history. It would be hard to understand the Czech nation and the development of the state of Czechoslovakia without T. G. Masaryk’s philosophical views on person, nation, state, and his political activity; and it would be hard to understand certain aspects of the interwar Lithuania’s legal and political development without M. Romeris’ scientific heritage. These are the personalities, who have left a significant inheritance due to their (...) scientific, political and social activities. (shrink)

Modern democracy is impossible without political parties. They are necessary in the process of the construction of the political class and building of relations between politicians and ‘ordinary people’. So, in Poland in the twentieth and the twenty-first centuries the significance of parties is also very important. Their history is older than the history of the reborn Poland. Especially in Galicia, an autonomous province of the Hapsburg empire, we can see the activities of many politicians. A part of them in (...) 1895 declared the birth of the Popular Party which is a constant element of the Polish political scene. The second traditional current is the socialistic movement, which is also always legally active in Poland. These two camps represent, in simplification, the ‘two Polands’—the first more traditional, conservative and provincial, and the second more progressive, ‘European’ and urban. Actually, in the typical consciousness of a Polish citizen, the political representation of the ‘black’ country is the party Law and Justice of Jarosław Kaczyński, and the ‘red’ country admires the Citizen Platform with Donald Tusk as a leader. But probably the idea of a twoparty system, like in the Anglo-Saxon world, is still very distant to reality, because in the European continent, the tradition of pluralism in a policentric version is still very significant. In Poland, even in the period of the ‘real socialism’ this conception of the organization of political life was realized, though naturally in the specific version. There were three legal parties and the Polish United Workers’ Party (the PUWP) was the most important. From 1976, the PUWP in the light of the Constitution had the official hegemony in the Republic. It is possible to compare this situation with the period 1926–39, when, after the coup d’état by Marshal Piłsudski, the Government still won in the election and the official elite wanted to create a stable political force with a perspective of permanent rule. But we must remember that between the wars opposition always was legal. In our times of demoliberalism, this is quite normal (though under the Constitution, unconstitutional parties, for example, communist or fascist, are unacceptable); however, interesting is the fact that when you observe sine ira et studio the evolutional trend of the Polish political system, you easily find the tendency of the ‘stabilization’ of the party system in the way of legal operations. From 1997, the laws concerning political parties have changed the possibilities of the conquest of seats in the Seym. Actually, only the parties having 5 per cent (or 8 per cent in coalition) of votes can gain the representation in the Diet. So it is possible to claim that the little parties today are in a more complicated situation than in the first years after the ‘operation of Round Table’ in 1989. The contemporary system is maybe more stable, but less liberal. There are theoreticians who note the danger of the alienation of the political class in the situation of the renewal of the alienation of the political elite, which de facto is more connected with the state than with the society. Many theoreticians emphasize that in the future the role and the character of political structures will be profoundly different from today. Maybe they are prophets, but we can expect that the Polish political parties or ‘post-parties’ and also political structure as a whole will have many similarities with their actual equivalents, because the mentality of the Polish nation, including the politicians, is more or less enduring. In the twenty-first century, human rights play a very important role in modern society. The Universal Declaration of Human Rights, released on 10 December 1948th was thought to become an everlasting source of fundamental human rights and freedoms. The Declaration corresponds to the situation that global community was facing 60 years ago. Today it is a collection of articles that is the cornerstone of the whole system of human rights protection. However, gross human rights atrocities, the dynamic process of legislation, (...) technological progress and changing social values have prompted many to revise the concept of human rights. Today many areas of life have changed: we have untraditional marriages and families, the individual enjoys a completely different social status than 60 years ago. These factors have prompted the creation of an entirely new dimension to human rights and freedoms based on personal autonomy, dynamics and self-regulation. Nowadays, the realization of rights and the aspiration to personal happiness are closely connected with personal autonomy. Autos and nomos—these two terms describe the ability of an individual to initiate one’s actions, to realize them by making independent decisions. This article analyzes whether this ability is a natural right or a privilege, what factors determine the exercise of this right, and what is the role of the state in this process. (shrink)

In order to clarify the objectives of bankruptcy, to reveal the true essence of bankruptcy procedure and the origin of legal terms, it is necessary to ascertain the nature of this institute of law, as well as the reasons for its creation and development. This article provides historic analysis of the development of the institute of bankruptcy procedure. For this purpose, a historic comparative research is undertaken in the article, in order to find certain parallels of bankruptcy procedure under Roman (...) law and the modern bankruptcy procedure. Roman law has been chosen as the most phenomenal ancient law for the purposes of undertaking a historic analysis of the development of bankruptcy procedure. In the authors’ opinion, it it the best example that reveals the origin of bankruptcy procedure, and the reasons for its formation. Analysis of certain private law institutes of Roman law enables the authors to conclude that the main features (principles) of the bankruptcy procedure formed precisely under Roman law: replacement of personal liability by pecuniary; public auction as a form of realization of debtor’s property; transition from selling of debtor’s property as a whole to disposal of property in divided property units; creation of subject, who administers auctions of debtor’s property under oath not to act in selfish purposes; setting of a term of 30 days, during which a debtor has to cover the debts (claims’ dispute resolution); establishment of the institute of informing creditors about initiated procedures of debt retrieval and encouragement to join these procedures; establishment of the ban to recover debts from household items; laying of the foundations of the institute of peace agreement between the debtor and his creditors; establishment of actio Pauliana - a remedy for the protection of creditors rights. The mentioned rules in one way or another eventually have been transferred to legal acts on legal relations in case of bankruptcy of many foreign countries. (shrink)

This article reveals the implications that made the Lithuanian Council to step aside allowing the Temporary Government to continue the further process of restitution of Lithuania, immediately after becoming the central constitutional state institution. Prior to that, Lithuanian (State) Council had managed to declare the independence of Lithuania on the 16th of February 1918 under extremely difficult political circumstances and established the statehood on the 2nd of November of the same year. Under the will of the Vilnius conference of Lithuania (...) that took place in autumn of 1917, all Lithuanian political streams of these days have been represented in the Lithuanian Council. However, the Council itself has not managed to save the representative ability by agreeing with the resignation of its left element and by continuing the expansion and distance from the community of Lithuania. The Council has become an institution representing the right wing of the Lithuanian community which could not ensure any greater support. (shrink)

In Latin America there are two models of constitutions - the liberal and the most stable Constitution of the Argentine Nation, drafted in 1853, (which was discussed in our previous article) and one of the most radical, comprehensive and unstable – the Constitution of the United Mexican States of 1917. Although both of them were constructed under the model of the US constitution with the influence of Spanish and French constitutionalism and local national traditions, the Argentine constitutionalism has developed on (...) the grounds of the American legal system, as the Mexican one still could not break with the civil law tradition. The article describes the main publications of emigrant press during the period of 1945-1990. These publications reflect a significant contribution to the academic research of the constitutional development problematics of an independent Republic of Lithuania in 1918-1940, made by the emigrants who escaped Soviet aggression by going to the West. Among emigrants these topics were mostly analysed and described at the time when any possibilities of objective academic research in Lithuania were widely limited by Soviet ideology and politics. Exceptional attention (...) of emigrant authors was attracted by the democratic constitutional structure of Lithuania, established by the Constituent Assembly. The article describes the academic research made by emigrants on the main constitutional acts established by the Constituent Assembly, such as the resolution of the 15th of May, 1920, ascertaining the fact of reconstructing the independence of the state of Lithuania, as well as the Constitution of Lithuania of August the 1st, 1922.
