Although legal terms are conventionally considered to have self-referential, self-closed meaning independent of context, a legal term only acquires its meaning within a given context. As long as the context varies, the meaning of the same legal term as a signifier may change correspondingly. Based on case studies by applying semiotics, we argue that a legal term is just a sign within its sign system; a legal term as an individual sign does not have any inherent meaning, and its meaning (...) can only exist in the relationship with other signs or sign systems. In other words, a legal term only denotes in a particular temporal and spatial context. Through this study, we conclude four propositions about a legal term as a sign: first, the connection of a legal term with a legal concept is relatively arbitrary; second, the meaning of a legal term exists in a sign system; third, a legal term can be subject to multiple interpretations; fourth, the defining of a legal term may be affected by other sign systems. Les sentiments d'ordre temporel s'étalent dans chaque branche du fait musical et dans chacun de ses moments. Les pratiques musicales se présentent donc comme des actes de temporalisation qui mettent en jeu l'ensemble du monde vital du sujet et activent ses mécanismes fonciers : la foi en l'avenir, la peur de la mort, l'angoisse du futur, le regret du passé, l'ancrage dans le présent, la fuite devant le présent, tout un univers existentiel qui ne touche pas seulement la musique mais (...) la vie humaine dans toute sa magnitude. Qu'il s'agisse des dispositions psychologiques profondes ou de la fuite virtuelle devant des contraintes inévitables, telles que la mort elle-même, l'art musical secoue l'affectivité. Ce serait dans ce type d'émotion, où se réunissent expérience esthétique et vécu existentiel, qu'il faudrait plonger à la recherche d'une spécificité de la musique parmi les faits sociaux. (shrink)

Qu'est-ce que la "non-politique"? Est-elle pensable? Pourquoi l'évidence de la politique est-elle si forte? L'histoire de la philosophie occidentale est une tentation toujours renouvelée de "penser la politique depuis la non-politique". Nous pouvons indiquer qu'au moins, dans la modernité, les théoriciens du contrat social inventent déjà une idée révolutionnaire de "l'état de nature" qui est une notion non politique par excellence. Si nous admettons qu'il y a quelque chose de non politique, il y a au moins trois possibilités de penser (...) la non-politique qui nous conduisent à étudier trois théories radicalement distinctes : la "philosophie de l'avenir" de Nietzsche, la "psychanalyse" de Freud et la "non-philosophie" de François Laruelle. Non seulement ce sont les trois possibles conceptions de la non-politique, mais elles mettent en jeu le devenir historique de la notion non politique chez ces trois penseurs d'immanence. Nietzsche est le représentant du primat de la politique : la non-politique finit toujours par être surmontée et absorbée par le politique. Freud observe une différence irréductible entre politique et non-politique : l'une ne domine pas l'autre et vice versa. Enfin, Laruelle démontre que c'est la non-politique qui détermine en dernière instance la politique ; c'est l'Un qui fait un usage unilatéral du matériau occasionnel qu'est l'Autorité dont le coeur est la Pensée-Monde. No sense of responsibility or respect, blogs are filled with exhibitionists and acts of verbal violence, far exceeding the usual limits of individual rights. Are we the people we were? If we are continuants, then the answer to this question is an affirmative one. But it is a moot point whether anything is a continuant. The debate over this issue—of whether there are such things as continuants—is often conducted in the context of theories concerning the apparent passage of time. Thus it has been argued that the tenseless theory of time, according to which time does not really pass, forces us to tear down part (...) of the basis for the intuitive distinction between ordinary, reidentifiable objects on the one hand, and processes on the other, and to regard such objects as mountains as persisting through time in exactly the way that thunderstorms do: by having distinct temporal parts at different times. I confess that I am a tenseless theorist of time, and take that theory to entail such a conclusion about the persistence of objects. But it is not just a certain stance over time’s passage that motivates sympathy towards temporal parts and suspicion of continuants. Thinking of objects as having temporal parts sits more comfortably than does the rival view with two natural assumptions concerning continuity: that beginning and ceasing to exist, at least for most objects, involves underlying changes which are continuous in nature; and that objects exhibit continuity through time, in the sense of not having gaps in their existence. E. J. Lowe sets out in a recent paper1 to refute McTaggart's proof of the unreality of time, by exposing an ‘indexical fallacy’ in his disproof of the existence of tensed (i. e., A-series) facts.2 Lowe then develops an original account of what makes time the dimension of change, based on his own account of tensed facts. But in our opinion he fails on both counts: (1) he fails to refute McTaggart's perfectly sound disproof of tensed facts, which shows that (...) time can be real only if (Lowe and McTaggart not withstanding) it needs no tensed facts, and (2) he fails to explain the temporal character of change, since his account of it has an exact spatial analogue. Forty years after it first appeared, Sidney Shoemaker's much-read article, "Time without Change" , with its striking thought experiment, still dominates discussions of this intriguing topic. And rightly so: it is imaginative, subtle, and controversial. But times have changed, as they do, and in particular, the epistemological context in which Shoemaker was writing, overshadowed as it was by verificationism, no longer constrains our thinking as once it did. Nancy), ont fait évoluer profondément le problème du lien entre "l'âme" et le corps ; et cela au-delà des contours de la problématique marquée par les recherches cognitives du XXe siècle, qui ont pourtant donné une accélération remarquable à l'étude des rapports entre le cerveau et la machine corporelle. Ces perspectives ont introduit dans le (...) cadre de l'ancien débat, d'origine cartésienne, des variantes liées surtout à l'art, l'écriture et la pensée environnementale. L'Orient et l'Occident se retrouvent ainsi confrontés à un corps aux multiples "décors", qui le spécifient, l'entourent, l'enrichissent, etc. Le Mind Body Problem d'ordre simplement épistémologique, suivant la tradition jusqu'à la seconde moitié du siècle dernier, s'est changé en problème culturel, cognitif, écologique qui récupère de façon critique la notion générale de "vie", de "contexte phénoménologique de vie", d'existence également. Space and time are the most fundamental features of our experience of the world, and yet they are also the most perplexing. Does time really flow, or is that simply an illusion? Did time have a beginning? What does it mean to say that time has a direction? Does space have boundaries, or is it infinite? Is change really possible? We present a model of rational behavior by which we characterize business ethical dilemmas as trade-offs between processes and consequences. As an illustration, we formulate the oil industry's business ethical dilemma as a trade-off between a socially detrimental process (emitting greenhouse gases, hence inducing a risk of climate change) and a self-interested consequence (profits). The proposed framework allows us to specify two types of strategies, differing by whether priority is given to the consequences or to the processes. We analyze and (...) illustrate these strategies at both the behavioral and the discursive levels. In particular, communication strategies raise questions about good faith in business argumentation, in the sense that business discourse may or may not be consistent with actual assumptions and/or actual behaviors. Il sistema filosofico cinese, che rappresenta l’unificazione della cosmologia, dell’epistemologia e della metodologia della nazione cinese, è un sistema filosofico completo e maturo che si è formato nella società tardo primitiva molto prima delle Dinastie Xia, Shang e Zhou. La cultura originale cinese, dalla cultura della ceramica dipinta di 7.000 anni fa fino ai giorni nostri, dalla cultura archeologica sotterranea alla cultura di massa terrestre, è un concetto ampio di belle arti, determinato da una visione filosofica dell’arte plastica di osservare gli oggetti e prendere immmagini. Photographs, paintings, rigid sculptures: all these provide examples of static images. It is true that they change—photographs fade, paintings darken and sculptures crumble—but what change they undergo is irrelevant to their representational content. A static image is one that represents by virtue of properties which remain largely unchanged throughout its existence. Because of this defining feature, according to a long tradition in aesthetics, a static image can only represent an instantaneous moment, or to be more exact the state of affairs (...) obtaining at that moment'. It cannot represent movement and the passage of time. This traditional view mirrors a much older one in metaphysics: that change is to be conceived of as a series of instantaneous states and hence that an interval of time is composed of extensionless moments. The metaphysical view has been involved in more controversy than its aesthetic counterpart. Aristotle identified it as one of the premises of Zeno's arrow paradox and Augustine employed it in his proof of the unreality of time. (shrink)

Humankind is facing many existential global problems that require international and transgenerational efforts to be solved. Preparing our next generation with sufficient knowledge and skills to deal with such problems is imperative. Fortunately, the digital environment provides foundational conditions for children’s and adolescents’ exploration and self-learning, which might help them cultivate the necessary knowledge and skills for future survival. We conducted the Bayesian Mindsponge Framework (BMF) analytics on a dataset of 2069 students from 54 Vietnamese elementary, secondary, and high schools (...) to test this presumption. The results showed that students with higher digital literacy are more curious and have better knowledge regarding global issues (i.e., climate change, disease, overpopulation, aging, etc.). Students’ curiosity also mediates the relationship between digital literacy and global issues knowledge. Based on these findings, we argue that digital explorative space is essential for digital natives’ education for survival, individually (i.e., for future employment requirements) and socially (i.e., for making informed decisions and creating innovations that can be helpful to society). Children’s and adolescents’ exposure to digital explorative space should be promoted to improve their digital literacy rather than prohibition. During the exploration, emotional intelligence is critical in mitigating existential risks, or threats, to digital natives to navigate and overcome chaotic processes occurring in unchartered waters in the virtual world. Neurophenomenology (Varela 1996) is not only philosophical but also empirical and experimental. Our purpose in this article is to illustrate concretely the efficiency of this approach in the field of neuroscience and, more precisely here, in epileptology. A number of recent observations have indicated that epileptic seizures do not arise suddenly simply as the effect of random fluctuations of brain activity, but require a process of pre-seizure changes that start long before. This has been reported at two different levels of (...) description: on the one hand, the epileptic patient often experiences some warning symptoms that precede seizures from several minutes to hours in the form of very specific lived events. On the other hand, the analyses of brain electrical activities have provided strong evidence that it is possible to detect a pre-seizure state in the neuronal dynamics several minutes before the electro-clinical onset of a seizure. We review here some of the ongoing work of our research group concerning seizure anticipation. In particular, we discuss experimental evidence of upward (local-to-global) formation of conscious experience and its neural substrate, but also of the downward (global-to-local) determination of local neuronal activity by situated conscious activity and its substrate large-scale neural assemblies. This causal role of conscious experience may lead to new kinds of therapy for epileptic patients. (shrink)

Le but de cet article est d'examiner le rôle de l'analogie du calcul dans la philosophie du langage de Wittgenstein pendant les périodes intermédiaires et finales. Ce rôle a changé parce que Wittgenstein est passé d'une interprétation stricte à une interprétation large de cette analogie. L'analogie revêt un sens large dès lors que l'on admet que le langage peut être comparé à un calcul d'une multitude de manières et pour une multitude de raisons différentes. Le trait commun aux deux interprétations (...) consiste en leur ambition d'éradiquer un mentalisme conduisant à prendre la pensée et la compréhension pour des processus et des états se produisant dans l'esprit du locuteur, mais Wittgenstein a progressivement découvert qu'une lecture stricte de l'analogie induisait une représentation fausse du rôle des règles dans le langage. In her recent book _A Duty to Resist_ (2018), Candice Delmas contends that both beneficiaries and victims of injustices have a duty to resist unjust laws and to try to change them, and proposes several ways of grounding this duty. One of these proposed groundings appeals to considerations of fairness. Delmas holds that anyone who refuses to participate in resisting some injustice, including victims of that injustice, can be accused of free-riding and thus of unfair conduct that violates the duty (...) of fair play, which means that they have a fairness-based duty to resist. In this paper, I critique this attempt to ascribe a duty to resist grounded in considerations of fairness specifically to victims of injustice. Against Delmas, I argue that victims of injustice do not have this fairness-based duty to resist because, unlike the beneficiaries of an injustice, they cannot be considered free-riders when they do not participate in resistance to the injustice. I then discuss additional problematic implications of Delmas’s view, focusing on the issue of victim-blaming, and show how these problems can be avoided. In this way, I hope to contribute to the urgent project of determining who has a duty to resist injustice. (shrink)

L’examen du « canon des Ecritures », après la consécration de l’expression par Athanase au IVe siècle, révèle d’abord une époque où une certaine fluidité caractérisait la réflexion sur l’extension des Ecritures et sur leurs limites. A partir du IVe siècle, une mutation décisive se produit, à laquelle il faut adjoindre une autre évolution sémantique préparée de longue date à travers l’emploi de diatèkè, traduit en latin par testamentum. Ainsi apparaissent deux temps forts dans l’histoire des Ecritures aux premiers siècles (...) du christianisme. Le premier est celui de l’extension du concept de livre saint à d’autres textes que les écrits hérités du judaïsme ; le second, dans la seconde moitié du IVe siècle, est celui des efforts de délimitation de l’Ancien et du Nouveau Testament, des décisions prises pour trancher les débats, commencés deux siècles plus tôt. L’examen de quelques-uns des problèmes que pose l’extension du canon et qui s’offrent ici à l’historien confirme qu’ils ne sont pas résolus définitivement par les Eglises.An examination of the ³canon of the Scriptures,² after the consecration of Athanasius¹ expression in the 4th century, first of all reveals a period when a certain fluidity characterized reflection on the extension of the Scriptures and their limits. From the 4th century a decisive change came about, to which must be added another semantic evolution, which was prepared for a long time through the use of diatéké, translated in Latin by testamentum. Thus, two important periods in the history of the Scriptures appear in the first centuries of Christianity. In the first there was an extension of the concept of the sacred book to texts other than the inherited writings of Judaism. The second period, in the second half of the 4th century, concerns efforts to demarcate the Old and New Testaments, and decisions taken to settle the debates begun two centuries earlier. The examination of some of these problems about the extension of the canon is offered here to the historian and confirms that they are not definitively resolved by the Churches. (shrink)

The social environment influences what information individuals sample: people are often exposed to alternatives that are popular. This can systematically change an individual's evaluation of an alternative if she had previously been avoiding it due to a negative evaluation. The authors show that social exposure can have positive or negative effects on evaluation, depending on how popularity and prior evaluations interact. This theory was supported by a large‐scale analysis of data from a hotel chain.

Their quality changes while the author moves from the philosophical likelihood to the truth of the Scriptures. He opposes one secular image to a biblical one (...) : at the beginning of the dialogue he refuses the comparison which reduces man to a bubble ; in the last part he chooses the solid composition (pukasmos) of the skènopègia (Ps. 117, 27). Other pictures are partly accepted, specially those which are borrowed from the sphere of tekhnè, whereas Macrina dismisses the Platonic myth of the soul’s chariot. Nevertheless, the end of the dialogue becomes pregnant with images derived from the Bible, when Macrina and his brother are discussing resurrection itself. Then by the means of the comparisons which they select, the biblical revelation and the facts of the phusis finally unite. However, in recent years, with the rapid development of emerging industries and industry changes, the turnover rate of employees in the whole enterprise has been greatly improved. Frequent turnover of personnel will have a great impact on the stability of the company, the competitiveness of the enterprise, and the operating cost. Employee loyalty (...) and corporate culture satisfaction assessment is the core of sustainable corporate development, but most of the traditional analysis studies are based on the performance approach, using employee overtime, employee achievement, and company effectiveness as data sources, the former performance data is only a side view of the company’s situation, the latter as the data source of this study is a one-sided and involute form, and the data is not stable. Therefore, this paper proposes an analysis of employee loyalty and corporate culture satisfaction assessment based on sentiment analysis, using association rules and sentiment lexicons from anonymous employee evaluations to analyze the actual data. In the past decade the central principles of western feminist theory have been dramatically challenged. many feminists have endorsed post-structuralism's rejection of essentialist theoretical categories, and have added a powerful gender dimension to contemporary critiques of modernity. Earlier 'women' have been radically undermined, and newer concerns with 'difference', 'identity', and 'power' have emerged. Destabilizing Theory explores these developments in a set of specially commissioned essays by feminist theorists. Does this change amount to a real shift within feminist theory, or will (...) feminism's links with an emancipatory modernism reinstate an older political agenda? Can we transcend the common counterposition of equality and difference, or is feminism condemned to argue within the terms of this binary opposition? (shrink)

From the beginning of the COVID-19 global pandemic, it became clear that the practices of naming the disease, its nature and its handling by the health authorities, the news media and the politicians had social and ideological implications. This article presents a sociosemiotic study of such practices as reflected in a corpus of headlines of eight newspapers of four countries in the early stages of the COVID-19 crisis. After an analysis of the institutional naming choices of the World Health Organization (...) and the International Committee on Taxonomy of Viruses, the study focuses on the changes in newspapers’ naming patterns following the WHO’s announcement of the disease name on 11 February 2020. A subsequent political controversy related to naming in the United States is then examined in reports of The New York Times and The Washington Post as a further illustration of how public discourses and perceptions can rapidly evolve in the context of health crises. We present a model of rational behavior by which we characterize business ethical dilemmas as trade-offs between processes and consequences. As an illustration, we formulate the oil industry's business ethical dilemma as a trade-off between a socially detrimental process (emitting greenhouse gases, hence inducing a risk of climate change) and a self-interested consequence (profits). The proposed framework allows us to specify two types of strategies, differing by whether priority is given to the consequences or to the processes. We analyze and (...) illustrate these strategies at both the behavioral and the discursive levels. In particular, communication strategies raise questions about good faith in business argumentation, in the sense that business discourse may or may not be consistent with actual assumptions and/or actual behaviors. Whereas in 1980, the manual had been thought of in a rigorously categorical way, on the basis of (...) distinct and closed syndromic entities, this new version advocated the development of a radically dimensionalist approach, with the diagnosis aiming this time to restore the whole symptomatological picture of the patient on a spectrum of ratings are supposed to cover the entirety of psychiatric semiology (American Psychiatric Association, 2013).For its part, my article aimed to show how standardized assessment, guided by the return of psychiatry’s authority and the assertion of its legitimacy in the diagnostic field, gave the ascendancy in the 1980s to the classificatory tradition and thus to the categorical model, to the detriment of personality approach and test psychology which offered a competing solution here. This perspective, historically dated, may have led the reader to think that there is an antagonism that cannot be overcome here. Rather, it should be seen as a form of structuring opposition, or even a “complementarity inscribed in rivalry,” between psychiatry and psychology, which is naturally susceptible to change over time.Indeed, the reversal operated by the Diagnostic and Statistical Manual of Mental Disorders-V is not total because it cannot be total. The defense of the dimensionalist approach, dear to the psychological testing tradition, was intended here to allow the identification of co-morbidities, present in most patients but poorly apprehended by the categorical approach, and to open up diagnosis to prevention by screening for minor manifestations of psychopathology when they suggest the [End Page 259] development of a manifest episode of the disease in the more or less long term. The risk here is that we end up with overdiagnosis and thus an over-representation of false positives (Wakefield, 2015). In other words, this type of approach does not escape the obligation to determine threshold scores, likely to indicate the lower limit of the disorder, and thus to resort to a categorical approach. There is a first affinity between the two perspectives which obeys, beyond the divergences in principle, a technical requirement.But the two approaches have even more in common when we look at their epistemological background: they share the idea that the representation and the intervention on mental disorder, to use Ian Hacking’s expression (1983), must be based on the model proposed by the physical and natural sciences. And as Greta Kaluzeviciute aptly points out in her comment, this orientation leads to the idea of measuring mental disorder in particular to conduct elaborate quantification operations to determine, for example, whether two entities are statistically distinct or whether a drug has a significant effect on the evolution of a pathology.This is in fact an old question that can be formulated as follows, to use the expression of the psychometrician Joel Michell (1999): are psychological dimensions metric? In other words, if we want to apply the language of numbers to mental disorders, they must share its properties, two of which seem essential: it must be possible to establish that each mental disorder, in the same way as qualities attributable to length for example, has a zero and can be divided by means of gradients (or degrees of intensity) whose interval is constant (Le Moigne, 2018; Michell, 1999). This article discusses the way how change in depressed patients included in clinical trials was both conceptualized and measured in the 1970s to decide on the efficacy of the first candidate drugs for the treatment of depression. Understanding how this issue was resolved is of major interest as the protocol designed to distinguish the diagnosis of the depressive syndrome from the measurement of its evolution over time built the contours of the methodological device to which the whole of standardized evaluation (...) in psychiatry has since referred. This paper draws on the debates in nascent psychopharmacology in both the United States and Europe and examines the protocols and findings of the research programs on depression the National Institute of Mental Health (NIMH) has developed in the United States at the same time, as well as on the writings of the main authors of the standardized evaluation. This investigation suggests that measurement of patients’ improvement could not be characterized on the basis of psychiatric inventories that were not well-suited to quantification, nor on the basis of psychometric tests which were intended for the evaluation of psychological invariants. This is why the answer given to the characterization of change in depression under therapy rather reveals a syncretism both conceptual and technical, mixing classificatory and psychometric traditions, a syncretism that the distinction endorsed by the Diagnostic and Statistical Manual of Mental Disorders, 3rd edition,between syndromes and personality disorders no longer allows us to perceive. Distant brand extension as an essential strategy of obtaining benefits was highly focused on the normal marketing practice and academic research. In the current study, we aim to recognize that how individuals with different levels of empathy respond to distant extensions under corporate social responsibility and corporate competence associations to explore the corresponding neural mechanisms using event-related potentials. We divided subjects into two groups involving a high empathy group and a low empathy group according to an empathy measure questionnaire. The (...) subjects first faced a brand name following the CSR or CC association descriptions, and then, they were asked to evaluate the new product of brand by a five-point scale. Current results revealed that the participants of the HE group were more apt to accept the distant extension products than those of the LE group. Additionally, in the HE group, products from a brand with CSR associations were more acceptable than CC associations. Moreover, a larger N2 amplitude was elicited in the LE group than in the HE group. For the LE group, an augment N2 was found under CSR than CC associations, reflecting that LE consumers might perceive conflict when evaluating distant extensions and allocate more cognitive resources to deal with CSR information. At the later stage, the HE group showed a greater P3 than the LE group. For the HE group, an increased P3 was elicited under CSR than CC associations, suggesting that empathic individuals might show motivational salience and helping willingness toward distant extension products, especially under the CSR scenario. These results provide potential electrophysiological evidence for the positive impact of brand associations on the evaluation of distant brand extension in the case of subdividing different empathic individuals. Seriously engaging with the needs, hardships, and aspirations of future generations is an emotional experience as much as an intellectual endeavor. In this essay we describe a guided visualization exercise used to overcome the emotional barriers that often prevent us from dealing effectively with intergenerational decisions. The meditation and dreaming technique was applied to a diverse group of researchers who engaged in a visualized encounter with future generations. Following the exercise, we concluded that a serious analysis of intergenerational conflict requires (...) us to confront our own mortality. Also, somewhat surprisingly to workshop participants, our desire to become stewards of the planet was driven by our fear of death as well as our egoist yearning for immortality. We posit that imagining the unknown with visioning practices might increase our emotional resilience, and hence improve our ability to confront the burdens of intergenerational responsibility. Because our actions change, our responsibility is modified; because our responsibility is modified, we need to question the ethics of the action. Our action is situated right there between announcing a diagnosis, the theoretical and practical result of identification, the determining and naming of a fact and voicing the disease which is a human action where medical and technical expertise comes up against a life and its story. Amyotrophic Lateral Sclerosis (ALS), or Lou Gehrig’s disease, is a degenerative disease of (...) the motor neurons leading to paralysis. In the absence of any curative treatment, the natural course always results in death. Since 1989, progress in the management of this disease in France has been exponential, resulting in the creation of 17 expert centres throughout the country in 2003. Guidelines have been drawn up through consensus conferences and coordination meetings. For the delicate stage of the announcement, three requirements have been adopted: the quality of receptiveness of the medical practitioner and his team, their ability to listen and to adapt to the particularities of the patient in their care; their commitment with regard to legal obligations as to how and to whom to transmit information; and the need for a multidisciplined approach to be able to rapidly support the patient and his family. Questioning in the field of applied ethics has led us to examine whether having a benevolent and non-harmful attitude towards these patients, respecting their autonomy and legal rights are parameters required in this specialized practice. Through a transversal thematic analysis of the experiences of the medical practitioners at the Centres, we would like to explore a hypothesis of the remarkable epistemological progression of the neurologist in this form of care in the pure Hippocratic tradition. Through the compassionate experience of the other by these committed doctors and their teams, we will try to outline the view of anthropological phenomenology with regard to the ALS patient, their awareness of the future paralysis of the body that is being announced, their awareness of the temporality and will characteristic of the ALS patient and of his finality that they will be accompanying. Sustained peripheral somatosensory stimulations, such as high-frequency repetitive somatosensory stimulation (HF-RSS) and vibrated stimulation, are effective in altering the balance between excitation and inhibition in the somatosensory cortex (S1) and motor cortex (M1). A recent study reported that whole-hand water flow (WF) stimulation induced neural disinhibition in the M1. Based on previous results, we hypothesized that whole-hand WF stimulation would lead to neural disinhibition in the S1 because there is a strong neural connection between M1 and S1 and aimed to (...) examine whether whole-hand WF stimulation would change the neural balance between excitation and inhibition in the S1. Nineteen healthy volunteers were studied by measuring excitation and inhibition in the S1 before and after each of the four 15-min interventions. The excitation and inhibition in the S1 were assessed using somatosensory evoked potentials (SEPs) and paired-pulse inhibition (PPI) induced by single- and paired-pulse stimulations, respectively. The four interventions were as follows: control, whole-hand water immersion, whole-hand WF, and HF-RSS. The results showed no significant changes in SEPs and PPI following any intervention. However, changes in PPI with an interstimulus interval (ISI) of 30 ms were significantly correlated with the baseline value before whole-hand WF. Thus, the present findings indicated that the whole-hand WF stimulation had a greater decreased neural inhibition in participants with higher neural inhibition in the S1 at baseline. Considering previous results on M1, the present results possibly show that S1 has lower plasticity than M1 and that the duration (15 min) of each intervention may not have been enough to alter the balance of excitation and inhibition in the S1. Public health policies typically assume that there are characteristics and constraints over health that an individual cannot control and that there are choices that an individual could change if he is nudged or provided with incentives. We consider that health is determined by a range of personal, social, economic and environmental factors and we discuss to what extent an individual can control these factors. In particular, we assume that the observed health status of an individual is a result of factors (...) within the individual’s control and constraints the individual faces. We suggest three different constraints: budget, time and psychological constraints and position various determinants of health according to increasing levels of constraint and increasing degrees of individual control. We finally discuss public health policies such as nudging, intervening and rewarding within this new framework and show that the level of constraints and the degree of individual control on health status are essential dimensions to consider when designing and implementing public health policies.
