Evidence is often taken to be “normative” for doxastic agents. What accounts for the normativity of evidence? According to the view that I’ll call “evidential minimalism”, there is a close connection between strong evidence for the truth of p and a normative reason to believe p: evidence is either itself a normative reason for belief, or evidence gives rise to such a reason when certain other minimal conditions are met. In this paper, I argue against evidential minimalism. I will argue (...) that there are cases where: (i) an individual S possesses strong evidence E for the truth of p at time t, (ii) all other minimal conditions for the normativity of E are met at t, (iii) S doesn’t believe p at t, yet (iv) S isn’t open to any form of criticism on account of (i)-(iii) at t. I will then formulate a plausible linking claim connecting openness to criticism and the existence of normative reasons for belief. The minimalist can either accept or reject this linking claim. Unethical behavior is important to study because it may have an adverse influence on organizational performance. This paper is an attempt to better understand why individuals behave as they do when faced with ethical dilemmas. We first explore the definition, theories and models of ethical behaviors and accountability. This discussion of societal ethics and accountability as forms of social control segues into a discussion of how accountability may influence ethical behaviors. A number of authors have argued that, in order for S to be appropriately held morally responsible for some action or attitude (say, via moral blame), that action or attitude must somehow reflect or express a negative aspect of S’s (“true”, “deep”, or “real”) self. Recently, theorists of “epistemic blame” and “epistemic accountability” have also incorporated certain “self-disclosure” conditions into their accounts of these phenomena. In this paper, I will argue that accounts of epistemic responsibility which require disclosure of an (...) objectionable feature of a person’s self neglect central aspects of our responsibility practices. Specifically, I will argue that we can appropriately hold individuals epistemically responsible for things which do not reflect or express negative aspects of “who they are” in any way. While disclosure of an objectionable feature of (what I will call) a person’s “doxastic self” isn’t altogether irrelevant when it comes to holding that person epistemically responsible, it also isn’t necessary. One lesson I wish to draw is that, insofar as our epistemic responsibility practices are capable of shedding light on the nature of epistemic normativity itself, theorists interested in the latter should be focused on more than just accountability responses which track objectionable features of a person’s self. There exists a family of views concerning the foundations of epistemic normativity that all travel under the heading “epistemic instrumentalism”. These views are unified by their attempt to explain epistemic normativity in terms of instrumental normativity. Very roughly, they all say that we have reason to respond to truth-related considerations when forming and maintaining doxastic attitudes since regulating our doxastic attitudes in this way helps us satisfy our aims, interests, or goals. Thus, according to epistemic instrumentalists, truth-related considerations constitute reasons (...) for belief, but they only do so because regulating our beliefs on their basis is an effective way to satisfy our ends. I will first try to clarify the question that epistemic instrumentalism is supposed to answer. I will then identify a plausible normative commitment and show that the main varieties of epistemic instrumentalism fail to vindicate it. I will conclude by arguing that this provides us with prima facie grounds for rejecting epistemic instrumentalism. (shrink)

In this paper, I respond to Frank Hofmann’s reply to my (2022) argument against “evidential minimalism” (EM). According to defenders of EM, there is a close connection between evidence and normative reasons for belief: evidence is either itself, or (under certain “minimal” conditions) gives rise to, a normative reason for belief. In my (2022), I argued against EM by showing that there are cases where: (i) S possesses strong evidence E for the truth of p at time t, (ii) all (...) minimal conditions for the normativity of E are met at t, (iii) S doesn’t believe p at t, yet (iv) S isn’t criticizable on account of (i)-(iii) at t. I then appealed to a linking claim connecting criticizability with the existence of normative reasons for belief. Hofmann’s reply invokes a distinction between two different kinds of epistemic criticism: a strong and a weak form. I will argue that Hofmann’s distinction fails to save EM from my argument. In light of the myriad accounting and corporate ethics scandals of the early 21st century, many corporate leaders and management scholars believe that ethics education is an essential component in business school education. Despite a voluminous body of ethics education literature, few studies have found support for the effectiveness of changing an individuals ethical standards through programmatic ethics training. To address this gap in the ethics education literature the present study examines the influence of an underlying social cognitive error, called (...) pluralistic ignorance. We believe that if pluralistic ignorance is reduced, the result will be more effective business ethics education programs. Eighty undergraduate management students participated in this longitudinal study, and a mixed-model ANOVA revealed that the reduction of pluralistic ignorance (due to an ethics education program designed to reduce pluralistic ignorance) resulted in higher personal ethical standards over the course of a semester, when compared to a class that did not receive a formal ethics education program as part of their course. We discuss the implications of pluralistic ignorance in training business ethics and ethics education. (shrink)

A recurrent challenge in applied ethics concerns the development of principles that are both suitably general to cover various cases and sufficiently exact to guide behavior in particular instances. In business ethics, two central approaches—stockholder and stakeholder—often fail by one or the other requirement. The author argues that the failure is precipitated by their reliance upon “universal” theory, which views the justification of principles as both independent of their context of application and universally appropriate to all contexts. Do pharmaceutical companies have a moral obligation to expand access to investigational drugs to patients outside the clinical trial? One reason for thinking they do not is that expanded access programs might negatively affect the clinical trial process. This potential impact creates dilemmas for practitioners who nevertheless acknowledge some moral reason for expanding access. Bioethicists have explained these reasons in terms of beneficence, compassion, or a principle of rescue, but their arguments have been limited to questions of moral permissibility, leaving (...) for future research the question of whether expanded access is morally obligatory. We take up this further question and argue that pharmaceutical companies have a moral obligation to expand access. Our defense is not based on beneficence, compassion, or rescue, but instead on a reciprocal moral expectation resulting from existing social commitments that help ensure a robust pharmaceutical practice within the broader healthcare system. Our aim is to give this obligation, along with several others, a coherent and plausible structure within the wider clinical trial process so that one might better explain the sources of the dilemmas and their possible resolutions. Introduction Understanding the views of the public is essential if generally acceptable policies are to be devised that balance research access to general practice patient records with protection of patients' privacy. However, few large studies have been conducted about public attitudes to research access to personal health information. Methods A mixed methods study was performed. Informed by focus groups and literature review, a questionnaire was designed which assessed attitudes to research access to personal health information and factors that influence these. (...) A postal survey was conducted of an electoral roll-based sample of the adult population of Ireland. Results Completed questionnaires were returned by 1575 (40.6%). Among the respondents, 67.5% were unwilling to allow GPs to decide when researchers could access identifiable personal health information. However, 89.5% said they would agree to ongoing consent arrangements, allowing the sharing by GPs of anonymous personal health information with researchers without the need for consent on a study-by-study basis. Increasing age (by each 10-year increment), being retired and primary level education only were significantly associated with an increased likelihood of agreeing that any personal health information could be shared on an ongoing basis: OR 1.39 (95% CI 1.18 to 1.63), 2.00 (95% CI 1.22 to 3.29) and 3.91 (95% CI 1.95 to 7.85), respectively. Conclusions Although survey data can be prone to response biases, this study suggests that prior consent agreements allowing the supply by GPs of anonymous personal health information to researchers may be widely supported, and that populations willing to opt in to such arrangements may be sufficiently representative to facilitate valid and robust consent-dependent observational research. The Bayesian brain hypothesis, predictive processing, and variational free energy minimisation are typically used to describe perceptual processes based on accurate generative models of the world. However, generative models need not be veridical representations of the environment. We suggest that they can be used to describe sensorimotor relationships relevant for behaviour rather than precise accounts of the world.

Is there really an ethical crisis? We propose that the situation is not as bad as many would have us believe. We have attempted to present an alternative explanation for some earlier reports of an ethical crisis. This has resulted in a number of research propositions. We are optimistic that there are, in spite of reports to the contrary, an overwhelming majority of ethical people populating our business community.

We investigated whether regret predicted the motivation to act heroically. In a series of studies, we examined the relationship between regret, search for meaning in life, and heroism motivation. First, Study 1 (a and b) established the link between regret and search for meaning in life, considering regret as a whole, action regret, and inaction regret. Specifically, regret correlated positively with search for meaning in life. In additional two studies, we examined whether regret predicted the heroism motivation and whether this (...) effect would be mediated through search for meaning in life. Study 2 confirmed this hypothesis for individual differences in regret, using a correlational design. Study 3 confirmed the hypothesis for temporary experiences of regret, using an experimental design. In addition, in Study 3 we found that heroism motivation was more likely for people with high self-enhancement needs than for those with lower self-enhancement needs. We discuss the relationship between regret and heroism in light of these results and explore implications for everyday life. (shrink)

How to embed reflexivity in public participation in techno-science and to open it up to the agency of publics are key concerns in current debates. There is a risk that engagements become limited to “laboratory experiments,” highly controlled and foreclosed by participation experts, particularly in upstream techno-sciences. In this paper, we propose a way to open up the “participation laboratory” by engaging localized, self-assembling publics in ways that respect and mobilize their ecologies of participation. Our innovative reflexive methodology introduced participatory (...) methods to public engagement with upstream techno-science, with the public contributing to both the content and format of the project. Reflecting on the project, we draw attention to the largely overlooked issue of temporalities of participation, and the co-production of futures and publics in participation methodologies. We argue that many public participation methodologies are underpinned by the open futures model, which imagines the future as a space of unrestrained creativity. We contrast that model with the lived futures model typical of localized publics, which respects latency of materials and processes but imposes limits on creativity. We argue that to continue being societally relevant and scientifically important, public participation methods should reconcile the open future of research with the lived futures of localized publics. Abstract: In this article the author develops the view, held by some, that political constructivism is best interpreted as a pragmatic enterprise aiming to solve political problems. He argues that this interpretation's structure of justification is best conceived in terms of two separate investigations—one develops a normative solution to a particular political problem by working up into a coherent whole certain moral conceptions of persons and society; and the other is an empirically based analysis of the political problem. The author (...) argues that the empirically based analysis can generate criteria for assessing whether the normative theory successfully works out a solution, thereby developing a functionalist structure of justification. He further argues that this interpretation overcomes a longstanding criticism of constructivism, namely, that the use of substantive moral concepts in the hypothetical choice procedure biases the defense of principles in a particular direction and therefore begs important philosophical questions. Architectural design is typically limited by the constraints imposed by physical space. If and when opportunities to attenuate or extinguish these limits arise, should they be seized? Fair Governance: The Enforcement of Morals is a study of legal interference with individual preferences and will canvass the interdisciplinary literature in economics, psychology, philosophy, and law. It discusses the particular conditions necessary for the state to legally interfere with our freedom of choice, whether it be to either satisfy our individual pursuit of happiness or to prevent us from making immoral choices. Relatively few philosophers know much of the parallel literature on this central problem of ethics; while many legal (...) scholars are acquainted with the psychological literature on judgment biases, they are frequently unfamiliar with the philosophical literature on perfectionism. Francis H. Buckley carefully links these two notions of state power with recent empirical literature on judgment biases and happiness studies and surveys the literature, arguing for a nuanced form of social perfectionism, one which seeks to promote the kind of liberal nationalism found in the United States. This article proposes an innovative methodology for enhancing the technical validation, legal alignment and interdisciplinarity of attempts to encode legislation. In the context of an experiment that examines how different legally trained participants convert select provisions of the Australian Copyright Act 1968 (Cth) into machine-executable code, we find that a combination of manual and automated methods for coding validation, which focus on formal adherence to programming languages and conventions, can significantly increase the similarity of encoded rules between coders. Participants nonetheless (...) encountered various interpretive difficulties, including syntactic ambiguity, and intra- and intertextuality, which necessitated legal evaluation, as distinct from and in addition to coding validation. Many of these difficulties can be resolved through what we call a process of ‘legal alignment’ that aims to enhance the congruence between encoded provisions and the true meaning of a statute as determined by the courts. However, some difficulties cannot be overcome in advance, such as factual indeterminacy. Given the inherently interdisciplinary nature of encoding legislation, we argue that it is desirable for ‘rules as code’ (‘RaC’) initiatives to have, at a minimum, legal subject matter, statutory interpretation and technical programming expertise. Overall, we contend that technical validation, legal alignment and interdisciplinary teamwork are integral to the success of attempts to encode legislation. While legal alignment processes will vary depending on jurisdictionally-specific principles and practices of statutory interpretation, the technical and interdisciplinary components of our methodology are transferable across regulatory contexts, bodies of law and Commonwealth and other jurisdictions. The purpose of this study was to empirically investigate the role of pluralistic ignorance in perceptions of unethical behavior. Buckley, Harvey, and Beu (2000) suggested that pluralistic ignorance plays a role such that individuals mistakenly believe that others are more unethical than they actually are. In two studies, we confirmed that pluralistic ignorance influences perceptions of ethics in a manner consistent with what Buckley et al. suggested. The implications of pluralistic ignorance in perceptions of ethics are discussed with suggestions for (...) how pluralistic ignorance might be reduced and how research in this area may be extended. Technological advances in media communications have raised questions about the appropriateness of media ownership rules for traditional TV and radio broadcast. This article contributes to this debate by defending a set of principles that ought to govern the distribution of broadcast spectrum. In particular, it defends principles reflecting the ‹public interest’ constraint currently informing broadcast media ownership rules, and argues against a free-market procedure for distributing spectrum use. The argument relies upon the application of a political constructivist approach typical to (...) many political theories. In applying this approach, the author illustrates the strengths and weakness of constructivism and in the process provide an example for how constructivism can be applied to other subjects. As a result, the article has two aims. First, it defends a set of broadcast ownership principles. Second, it provides a model for how philosophers might apply constructivism to other subjects. Because of the transcendent nature of the experience of my own self, responsibility for myself necessarily leads to responsibility for others. The aim of this paper is to approach this experience of the transcendence of the self and to show how it relates to a new sense of responsibility which transcends the self through a number of stages. First, the author outlines what might be called the "standard" view of authenticity in Husserl and how this particular view yields a certain (...) view of responsibility as the ability to answer completely for "who" one is and "what" one does. Second, this standard view is challenged with another reading of the "self" in Husserl - one that emphasizes a necessary and productive division within the self. Thus, the author suggests that it is this second view of the self which is developed by Heidegger. Third, he demonstrates how this different view of the "authentic" self, that is inextricably linked to a "loss" of self, leads to a radically distinct view of responsibility for oneself, and for others. The disclosure of information that identifies deceased organ donors and/or organ transplant recipients by organ donation agencies and transplant centres is regulated in Australia by state and territory legislation, yet a significant number of donor family members and transplant recipients independently establish contact with each other. To describe and synthesize Australian laws and guidelines on the disclosure of identifying information. Legislation and guidelines relevant to organ donation and transplantation were obtained following a search of government and DonateLife network websites. Information (...) about the regulation of identity disclosure was extracted and synthesised using a process guided by Walt and Gilson’s (1994) policy analysis framework. Nineteen documents were examined. Six guidelines refer to and were consistent with current legislation. Four documents did not address identity disclosure. All jurisdictions prohibit healthcare professionals from disclosing identifying information. In three states, the prohibition extends to all members of the public including donor family members and transplant recipients. Restrictions on identity disclosure have implications for public promotion of donation and transplantation where sharing of stories and images of organ donors and transplant recipients is common. Further research is required to understand the perspective of donor family members, transplant recipients, and healthcare professionals impacted by the current laws. (shrink)

Human research involving the use social media raises many of the same issues as medical research. The publication of a paper in June 2014 investigating “emotional contagion” received extensive publicity recently because of the methods used. The approach involved manipulating the “News Feeds” of Facebook users, but the participants were not informed of their involvement in the research and had no opportunity to consent or opt out. Some commentators have argued that although it would have been preferable to obtain informed (...) consent, it was not strictly required because the research was unlikely to cause significant harm and was important. This paper argues that the research was unethical because it should have been overseen by an independent ethics committee or review board and informed consent could and should have been obtained. Regardless of the importance of any research and irrespective of its likelihood to cause harm, the ethical principles that have evolved since the 1940s should be followed in all instances when experimental research is being carried out on human participants. The review considers the common and distinctive elements of social capital, developed by the founding fathers-Putnam, Bourdieu and Coleman-and explores how these might help to understand the changing contexts and pursue opportunities for growth.

A fully annotated translation of a manual written in the 12th century AD for the practical use of the Islamic inspector of markets. The manual deals with confectioners, perfumers, money-changers, slave traders, physicians, and veterinarians, outling their professions, ruses and tricks of the trade. The liveliness of description and anecdote, the concern with ordinary people aside from the sultans, wazirs and other government officials who are usually the focus of earlier Islamic writing, makes for fascinating reading.
