Consisting of two essays, this work by a Harvard professor offers his thoughts on the idea of a social contract regulating people's behavior toward one another.

At the center of Rawls’s work post-1980 is the question of how legitimate coercive state action is possible in a liberal democracy under conditions of reasonable disagreement. And at the heart of Rawls’s answer to this question is his liberal principle of legitimacy. In this paper I argue that once we attend carefully to the depth and range of reasonable disagreement, Rawls’s liberal principle of legitimacy turns out to be either wildly utopian or simply toothless, depending on how one reads (...) the ideal of reciprocity it is meant to embody. To remedy this defect in Rawls’s theory, I␣undertake to develop the outlines of a democratic conception of legitimacy, drawing first on Rawls’s generic conception of legitimacy in The Law of Peoples and second on a revised understanding of reciprocity between free and equal citizens. On this revised understanding, what free and equal citizens owe one another is not reciprocity in judgment, but reciprocity of interests. (shrink)

Nationalism is often dismissed today as an irrational political creed with disastrous consequences. Yet most people regard their national identity as a significant aspect of themselves, see themselves as having special obligations to their compatriots, and value their nation's political independence. This book defends these beliefs, and shows that nationality, defined in these terms, serves valuable goals, including social justice, democracy, and the protection of culture. National identities need not be illiberal, and they do not exclude other sources of personal (...) identity, such as ethnicity or religion. An ethics that gives weight to special relationships is more effective in motivating people to pursue justice and other values because it connects peoples’ duties to their identity; but this is consistent with recognizing some universal values, such as human rights. There are strong reasons for making the boundaries of states and nations coincide wherever possible, but in other cases, nations can achieve forms of self‐determination that fall short of full sovereignty. Multicultural arguments in favour of identity politics and special rights for minority groups ignore the benefits that such groups derive from participating in a shared national identity and the kind of democratic politics that such an identity makes possible. Although national identities are often said to be in decline in an increasingly globalized world, they serve such important purposes that our aim should be to rebuild them in a form that makes them more accessible to excluded cultural minorities. Can Rawlsian theory provide us with an adequate response to the practical question of how we should proceed in the face of widespread and intractable disagreement over matters of justice? Recent criticism of ideal theorizing might make us wonder whether this question highlights another way in which ideal theory can be too far removed from our non-ideal circumstances to provide any practical guidance. Further reflection on it does not show that ideal theory is redundant, but it does indicate that there (...) is a need for a non-ideal theory that does not consist simply in an account of how to apply the principles which are yielded by ideal theory to non-ideal circumstances in the light of what is feasible and an assessment of the costs of implementation. Indeed any non-ideal theory that can adequately address this question will have to be partially autonomous, drawing on a notion of legitimacy that is rather different to the one which lies at the heart of Rawlsian ideal theory. Contemporary society involves a number of different persons, groups, and ways of life that are deeply divided and very often opposed on fundamental matters of deep concern. Today, many contemporary philosophers regard this 'fact of diversity' as a problem that needs to be addressed when assessing the principles employed to organize society. In this paper, I discuss the fact of diversity, as it is understood by the notion of reasonable pluralism, and explain why it is thought by some to challenge (...) the stability of a society's political morality. I examine the leading attempt to offer an account of the stability of a political morality and I argue that John Rawls's attempt to account for the stability of Justice as Fairness fails for reasons applicable to all political moralities because the very notion of a stable political morality is implausible. Diversity, as reasonable pluralism understands it, is not a problem that can be solved either by identifying a stable political morality or by modifying a political morality in some way that will make it more stable. Instead, the fact of diversity indicates only that disagreements on all aspects of society's organization, including its organizing principles and matters of value, is a permanent feature of social life that cannot be ignored, wished away, or solved.
