Fred Miller offers a controversial reappraisal of the Politics, suggesting that nature, justice, and rights are central to Aristotle's political thought. He sheds new light on Aristotle's relation to modern natural rights theorists, and to the current liberalism-communitarianism debate.

The problem of being is central to Western metaphysics. Etched sharply in the verses of Parmenides, it took on distinctive colouring in Aristotle as the subject matter of a science expressly labelled 'theological.' For Aristotle, being could not be shared in generic fashion by other natures. As a nature it had to be found not in various species but in a primary instance only. The science specified by the primary nature was accordingly the one science that under the aspect of (...) being treated universally of whatever is: it dealt with being qua being. (shrink)

There are various features of the language and exposition of the Eudemian Ethics that allow us to impute what might be called an ‘egalitarian’ outlook to its author. Each of these features, on its own, might be dismissed as of little significance, or as significant yet anomalous; but taken together, they constitute a body of evidence that cannot easily be put aside. The term ‘egalitarianism’ is of course imprecise, yet it serves its function well enough. I shall take it to (...) signify a certain cast of mind which consists of at least the following cluster of dispositions: being unwilling to view society as divided into ranks or classes or even to use language suggestive of such a division; but rather having a tendency to see the similarity of everyone with everyone else, by finding some good even among those reputed to be bad, and some bad among those reputed good; furthermore wishing to identify with the general run of humanity, or at least not being averse to doing so; and insisting on the fundamental equality and likeness of human beings, so that their inequalities and differences are regarded as secondary. This comprehensive study of Aristotle's Politics argues that nature, justice, and rights are central to Aristotle's political thought. Miller challenges the widely held view that the concept of rights is alien to Aristotle's thought, and presents evidence for talk of rights in Aristotle's writings. He argues further that Aristotle's theory of justice supports claims of individual rights that are political and based in nature.

The purpose of Aristotle's discussion of political justice (τό πολιὸν[unrepresentable symbol]δν δί[unrepresentable symbol]αιον) in "EN" V.6-7 has been a matter of dispute. Although the notion of political justice which Aristotle seeks to elucidate is relatively clear, namely the notion of justice which obtains between free and equal citizens living within a community aiming at self-sufficiency under the rule of law, confusion arises when one asks how political justice relates to the other kinds of justice examined in "EN" V. Is political (...) justice a highly determinate subdivision of justice which Aristotle examines alongside the other varieties of particular justice analyzed in "EN" V.2-5? Or is political justice related to the analysis of ethical agency which follows in "EN" V.8-11? The question is complicated by the fact that the passage in question -- "EN" V 1134a17-1135a15 -- has occasioned much speculation about textual dislocations and has been incorporated into chapter divisions differently according to the two prevalent modern editorial divisions of the Ethics. To resolve these problems, I argue that Aristotle's account of political justice is situated within an extended aporetic analysis which begins in "EN" V.6 and extends through "EN" V.8. Aristotle introduces the notion of political justice within the extended analysis concerning the ascription of character states because calling someone just or unjust presupposes that the person is a fully mature ethical agent, but anyone capable of political justice possesses such agency. Once the extended argument in the second half of "EN" V is properly understood, it appears that the received text is not in need of emendation. To further support my claim that Aristotle's account of political justice introduces a new inquiry which is not analogous to the analyses of particular justice in the first half of "EN" V, I compare political justice to the other species of justice. Ingram Bywater first published his edition of Aristotle's Nicomachean Ethics in 1890. His reconstruction of the Greek text is based on a careful weighing of the Greek manuscript evidence, Latin translations, the witness of early commentators and his own thorough knowledge of Aristotle's language and style. Bywater's choice of readings introduced many important alterations to the text given in previous editions; his preference for manuscripts Kb and Lb and for the commentary of Aspasius, represented by Heylbut's edition, explains many of (...) these changes. Select readings of the most important witnesses are given in a critical apparatus. Bywater's edition has been widely used by scholars and students of the Greek text of Nicomachean Ethics and a number of important translations have been based on it.
