The Posthuman offers both an introduction and major contribution to contemporary debates on the posthuman. Digital 'second life', genetically modified food, advanced prosthetics, robotics and reproductive technologies are familiar facets of our globally linked and technologically mediated societies. This has blurred the traditional distinction between the human and its others, exposing the non-naturalistic structure of the human. The Posthuman starts by exploring the extent to which a post-humanist move displaces the traditional humanistic unity of the subject. Rather than perceiving this (...) situation as a loss of cognitive and moral self-mastery, Braidotti argues that the posthuman helps us make sense of our flexible and multiple identities. Braidotti then analyzes the escalating effects of post-anthropocentric thought, which encompass not only other species, but also the sustainability of our planet as a whole. Because contemporary market economies profit from the control and commodification of all that lives, they result in hybridization, erasing categorical distinctions between the human and other species, seeds, plants, animals and bacteria. These dislocations induced by globalized cultures and economies enable a critique of anthropocentrism, but how reliable are they as indicators of a sustainable future? The Posthuman concludes by considering the implications of these shifts for the institutional practice of the humanities. Braidotti outlines new forms of cosmopolitan neo-humanism that emerge from the spectrum of post-colonial and race studies, as well as gender analysis and environmentalism. Theories of the liberal tradition have relied on independence as a norm of personhood. Feminist theorists such as Eva Kittay in Love's Labor have been instrumental in critiquing normative independence. I explore the role of corporeal vulnerability in Kittay's account of personhood, developing a comparison to the role it plays in Thomas Hobbes's Leviathan. Kittay's crucial contribution in Love's Labor is that once we acknowledge the facts of corporeal vulnerability, we must not only acknowledge but also affirm dependency in a (...) genuinely inclusive affirmation of personhood. While endorsing Kittay's “dependency critique,” I discover difficulties that beleaguer Kittay's development of new norms of personhood. I trace these to a dependency of Kittay's account on a crucial premise of the liberal model it resists. I argue that in order to affirm dependency in a manner that departs more thoroughly from the criticized aspects of liberal personhood, we must cease to position it in a dichotomy of power and vulnerability. I suggest that attending to the corporeality of vulnerability can aid us in developing the terms of a discourse affirming relational personhood while undermining that dichotomy. (shrink)

This article raises questions about the nature and status of the persona behind which contemporary capital operates. It does so by developing Marx's comments on personification in a very different direction to that intended by him, taking them, via Hobbes, into the deeper recesses of company law. The argument that develops is that modern law has facilitated the mechanism by which capital dominates civil society, an argument illustrated through the veil of the corporate persona worn by capital. The rhetorical trope (...) around which the argument is organized is the stage of power; the barely-mentioned backdrop is the possibility of real resistance to corporate power; the broader intention is to help develop the Marxist theory of law. This Article examines how the legal subjectivity of the migrant subject is intimately connected to the construction of the citizenship subject and how both have been products of the colonial encounter. Deploying the lens of postcolonialism, I argue that the migrant is addressed through a spectrum of legal rules based on normative criteria reminiscent of the colonial encounter. These criteria reinscribe citizenship within dominant racial, sexual, and cultural norms as well as claims of civilizational superiority. That which does not fall (...) within the boundaries of citizenship is regarded as outcast, an "Other," and subject to restraint, persecution, censorship, social stigma, incarceration, and even annihilation. The discussion draws examples from recent judicial decisions in the context of postcolonial India, dealing with migrant bar dancers and migrant Muslims, highlighting the deep and lasting impact of the colonial encounter and the imperial imagination on understandings and constructions of citizenship in the contemporary period. The cases further illustrate how notions of "global" or "world" citizen, unbound by territory or the nation-state, are unable to account for the complex and contradictory understandings of citizenship that have emerged from within a postcolonial context. The arguments force us to inquire into the role of citizenship, its relevance or meaninglessness in the lives of the migrant once its exclusionary potential has been exposed. (shrink)

This paper examines the other side of Enlightenment which privileges the authority and autonomy of reason for human progress and emancipation. It contends that Enlightenment marginalizes and denigrates the categories of (1) body, (2) woman, (3) nature, and (4) non-West which happen to be four central landmarks of postmodern thought.

This article locates a theoretical reflection on the form of legal subjectivity against twenty-first century complexities and pressures, including the structural complexities visible in biotechnological developments, new hybridities and numerous contemporary theoretical and practical manifestations of heterogeneity, multiplicity and complexity emerging in a range of disciplines, including cybernetics, techno-theory, post-humanism and ecology. The author defends the theoretical and critical utility of understanding the legal subject as an explicit (and explicitly limited ) constructus . Criticising the constructed naturalism (and the historical (...) and contemporary exclusions) of the 'human being' of law, the author suggests that the language and concept of the 'legal entity' (rather than that of the 'legal person') draws attention to the patterned 'gap' between law and life (and to related injustices enacted by the form of the materialisation of legal subjectivity) while simultaneously providing the degree of theoretical plasticity now required by the mutable complexities of the twenty-first century and beyond. This essay is about the United States Supreme Court's discursive creation of two kinds of persons, one corporate the other criminal, during its 1886 term. The aim is to contrast the Supreme Court's construction of corporate personhood in County of Santa Clara v. Southern Pacific Railroad with its view of the criminal's body in Ex parte Royall, a habeas corpus case. The Court's purpose in deciding these two cases was to design a way to disperse newly emergent and conflicting interests (...) in particular directions within the judicial apparatus. The result is that both criminal and corporate bodies come to be understood through discourse, not outside of it. Crime, Reason and History provides an alternative approach to the study of the general principles of criminal law. It emphasises, in contrast to orthodox texts, the tensions and contradictions at the law's heart. The author outlines the themes of responsibility, rationality and justice which govern the orthodox criminal law text. He traces these to the early nineteenth century reform of the criminal law and notes conflicts within reform ideologies relating to the idea of the 'responsible individual'.
