Aporias of the theories of punishment in philosophy: Thoughts on Immanuel Kant

Abstract

Retribution and the prevention are the two foundations of state punishment that clash with each other. Even though a debate between both perspectives would be essential for the criminal law, this debate has not yet taken place as it should. Bearing in mind the current crisis of the theory of positive general prevention, it is once more necessary to carry out a critical analysis of the retributive theory of punishment, considering its most important critical points and thus resuming the dialog between both.
