Abstract

Resumo A pesquisa de Giorgio Agamben a propósito do sintagma homo sacer se debruça sobre a difícil relação do direito e a vida humana a partir da arqueologia da sacralidade. No marco desta reflexão, apresentamos a tese de que, entre o direito e sacralidade da vida, há uma relação paradoxal que não se resolve negando um dos aspectos, nem dissolvendo-os. O paradoxo contemporâneo do direito em relação à vida humana é um desdobramento do paradoxo biopolítico da sacralidade nas sociedades antigas. Para melhor entendermos esta tensão, se faz necessário perfazer, minimamente, a arqueologia de conceitos-chave como homo sacer, parricidium e a condição jurídico-política do estrangeiro nas sociedades antigas. In the frame of this reflection, we present the thesis that, between the right and the sacredness of life, there is a paradoxical relationship that can not be solved by denying one aspect, or dissolving them. The contemporary paradox of law in relation to human life is an offshoot of biopolitical paradox of sacredness in ancient societies. To better understand this tension, it is necessary to make up, minimally, the archaeology of key concepts such as homo sacer, parricidium and legal-political condition of the foreigner in ancient societies.
