Abstract

NOS nossos dias, as vítimas estão no centro, elas constituem tema de preocupação para a opinião pública. Mas esta visibilidade das vítimas vê-se sobretudo ao nível do direito, ou seja, ela tem a ver com uma afirmação crescente do direito das vítimas à indemnização, sobretudo económica. O tema do presente artigo, no entanto, é a justiça das vítimas. É que desde o momento em que Adorno enunciou o novo imperativo categórico nos termos de "recordar Auschwitz para que não se repita", as vítimas correm o risco de se converterem em tema da coarctada moral das gerações futuras. Está bem recordar o passado para que não se repita, mas bastará isso para fazer justiça às vítimas? Que proveito, se podemos usar esta linguagem, tiram as vítimas impedindo que a barbárie se repita? Com efeito, não basta a reflexão moral implicada nesse novo imperativo categórico. Pelo contrário, segundo o autor do artigo, impõe-se uma reflexão política que não perca de vista a actualidade dos direitos das vítimas à felicidade e que disso saiba tirar as devidas consequências. /// The victims are now an issue and constitute a theme of preoccupation in the realm of public opinion. The present visibility of the victims reaches mainly the sphere of law; we speak about the right of the victims in order to affirm the right to compensation, above all, in the economic sense. The author intends to offer a reflection on the justice of the victims. Since Adorno enunciated the new categorical imperative in the terms of "remember Auschwitz that it may never repeat itself again", the victims are under the danger of being caught up in the morals of future generations. It is good to remember the past so that it may not repeat itself, but is that enough in order to do justice to the victims? What are the advantages? Should this language be allowed? Will the victims have any advantage by avoiding that the barbarity repeats itself? The article claims that the moral reflection implied in that new categorical imperative is not enough. According to the author, a political reflection is necessary in order to keep in sight the actuality of the rights of the victims to happiness and to derive the corresponding consequences.
