Within article 82 E.c. The court of justice has given a wide interpretation to the concept of 'barriers to entry': Is this wide interpretation conducive to the community competition Telos?

Abstract

Within European Competition Policy Article 82 EC Treaty remains a formidable tool to safeguard against abuse of dominant undertakings. It is clearly applicable, in its own right, and does not necessitate adding of excessively applied and interpreted notions such as barriers to entry. The Commission in formulating and integrating the concept of barriers to entry as a safeguarding tool against abuse of dominant commercial undertakings in the way it has, has added more fire-power to an already potent weapon - the necessity of which remains dubitable.
