Abstract

O contratualismo moral procura fundamentar a moralidade a partir do auto-interesse. No entanto, nem as teorias clássicas na tradição do contrato social, nem os representantes do contratualismo moral procuram oferecer uma fundamentação dos direitos humanos. O objetivo deste artigo é justamente apresentar uma tal fundamentação. Direitos humanos – essa é a tese central deste artigo – são tipos específicos de direitos morais de que os indivíduos podem lançar mão em sua relação com o Estado.Moral contractualism aims at a justifi cation of morality through self-interest. Yet, neither classic social contract theories nor moral contractualism seek to provide a systematic account of human rights. The aim of this article is to present such an account. Human rights – this is a main thesis advanced in this article – are special kinds of moral rights to which individuals resort in their relationship to the state
