Abstract

›Was ist Recht?‹, ›Wie ist das Verhältnis von Recht und Moral?‹, ›Wie funktioniert das Recht?‹ – diese klassischen Fragen der Rechtsphilosophie bzw. -theorie werden von neueren Strömungen, darunter die Critical Legal Studies, als zu eng und überholt angesehen. Sie suchen nicht nur nach neuen Antworten, sondern auch nach neuen Fragen – und nehmen dabei in Kauf, nicht auf alle Fragen eine Antwort zu finden.
