Abstract

Este artigo pretende, a partir de um diálogo com autores do cenáriocontemporâneo, executar uma análise crítica acerca dos problemas queenvolvem o pensamento ético-político atual em sua intrínseca relação com oDireito, no que concerne a sua ordenação e prática jurídicas. Do mesmomodo, pontua-se o fato de tal relação com o Direito representar um apportpara a minimização da Condição Humana. Pretendo, a partir do diálogocitado, apresentar uma breve leitura crítica das estruturas de biopoder ebiopolítica engendradas a partir e com o evento da Revolução Francesa, eque possuem hoje solidez, apontando para o fato de o Direito exercer papelfundamental na legalização e, mais ainda, na legitimação da minimização daCondição Humana e na redução do homem à sua menor parte enquanto servivente. Para tanto, utilizo-me das leituras dos pensadores Giorgio Agamben,Albert Camus, Hannah Arendt, Jacques Derrida e Carl Schmitt.The aim of this article is to engage in dialogue with authors of thecontemporary scene and perform a critical analysis of the issues involved incurrent ethical and political thought in its intrinsic relationship with the Law,especially regarding legal ordination and practice. Indeed, such a relationshipwith the Law represents an apport to the minimization of the human condition.I intend to present a short critical review of biopower and biopoliticalstructures arising from, and with, the event of the French Revolution. These structures remain pertinent to this day. The Law exerts a fundamental role inthe legalization and the legitimization of the minimization of the humancondition, whereby the human being is reduced to her smallest part in termsof a living being. To this end, I borrow from the readings of Giorgio Agamben,Albert Camus, Hannah Arendt, Jacques Derrida and Carl Schmitt
