In many cases the institutional performance fails and puts into evidence perverse consequences affecting the social tissue. Facing this situation many critics tend to neglect the rationality-criterion to assume alternative and more attractive points of view. In spite of their acceptance and over-popularity those approaches haven't been able to provide a robust-enough set of concepts to successfully replace the rationality-criterion.

Eight years since the Spanish statute on gender violence (Ley 1/2004) has been passed, it is time to assess its implementation. This paper deals with the proof of acts that are typified under that heading. In particular, it focuses on three issues. Firstly, it questions the admissibility of accepting the victim testimony as sufficient evidence to outweigh the presumption of innocence in favour of the accused. Secondly, it analyzes whether the Spanish Supreme Court doctrine on evidence in cases of gender (...) violence allows inferring such admissibility, and whether this is applicable to every case or only to a certain type. Thirdly, it tries to identify the consequences that can be attached to that admission. (shrink)

Despite the strong criticisms to ethical utilitarianism, this theory has not succumbed and remains one of the most notorious. The main criticisms address to the consequentialist conception of right that underlies the theory. However,it has been such a conception of right that, at the same time, saved utilitarianism. The article set out the features and changes that, according to the author, are the causes to explain the subsistence of utilitarianism.

In liberal societies, we generally admit the principle of Procreative Liberty (PL) that, though usually defended with no explicit reference to Mill’s Harm Principle (HP), is perfectly coherent with it. It comprises several liberties, such as the liberty to decide when, how many times, with whom and if to procreate at all. On the other hand, we talk about the principle of Parental Autonomy (PA) or Parental Liberty: the parents have the right to raise their children and to make all (...) decisions concerning them free from governmental intervention. Whatever the scope defended for this right, we usually admit that it has more limits than PL. The reason is clear enough: there is a third party involved, the child, and, according to Mill’s HP, the society can rightfully intervene. Though traditionally procreative and parental rights have been considered as independent rights, and though PL and PA have been defended on different basis, in this paper I want to argue that some proposed extensions of PL are best considered as cases of PA. This paper takes as starting point the relative indeterminateness of current legal systems. This circumstance determines from the point of view of judicial activity a substantial freedom for judges, which translates into the existence of different interpretive possibilities. For this reason the role of argumentationin judicial activity has been reinforced, but at the same time the question arises of how to control the judges and what kind of responsibility they have in exercising their functions.

A journey usually has a starting point and a destination. In this brief essay only a portion of this journey can be discussed: that which begins with Mill’s search for a new conception of liberty which he first developed in Principles of Political Economy (1848) and then considered in another context in On Liberty (1859). Here, we shall confine our attention to the concepts that enabled Mill to make this journey. We shall conclude by considering the question of whether or (...) not Mill should be considered a believer in a socialist ideology. There is no simple answer to this question. It will be argued that part of the problem lies less with the kind of socialism that might appeal to Mill and more with Mill’s conception of his role in public life as a logician and philosopher rather than as a public moralist advancing ideological views. The paper offers an interpretation of the role the concept of nationality plays in John Stuart Mill’s thought. To that purpose, I consider not only his best-known writings, but also those less frequently studied in the academic literature on that issue. The argument benefits from Quentin Skinner’s methodological insights into the study of the history of political thought. In that sense, I focus on Mill’s System of Logic textual revisions. In doing so, I briefly examine Mill’s intellectual and personal relationship (...) with Auguste Comte and hence the influence of positivism on Mill’s social and political thinking. (shrink)

Introductory study to “Utilitarismo y Constitucionalismo: La Ocasión de 1812. (Eds. Manuel Escamilla Castillo y Josefa Dolores Ruiz Resa) Ed. Dykinson, Madrid, 2012.”.

There are good moral reasons to support euthanasia, and these reasons are fundamentally of a utilitarian root. There are few moral reasons to oppose euthanasia in its strict sense, and they are clearly outweighed by the reasons argumented from a utilitarian perspective. Such teleological and consequentialist good reasons were originally advanced by David Hume in his brief and brilliant essay "Of Suicide" (1757), the true source for current Bioethics. Hume's arguments have been expanded in scope by some contemporary utilitarians, especially (...) by Peter Singer. Both the classical arguments of Hume as the most current by Sin­ger (and by some other utilitarian thinkers) are evaluated here, holding, in conclusion, that, regardless of specific criticisms, and of some important discrepancies between the different kinds of utilitarianists, however, the utilitarian ethical position is a strong and solid support for the defense of the "good voluntary death" as an individual right (in fact, a legitimate interest that demands legal protection) with a dominant force over other rights or interests, both individual or collective.
