In this article I consider the uses of the concepts ‘society’ and ‘culture’ in various sociological and anthropological traditions, arguing that sociology needs to learn from the division between social anthropology and cultural anthropology. First I distinguish the social and the cultural sciences: the former use ‘society’ as leading concept and ‘culture’ as a subordinate concept; the latter do the contrary. I discuss the origins of the terms société and Kultur in the classical French and German traditions respectively, and their (...) subsequent uptake in Anglo-American sociology and anthropology, ‘society’ becoming the leading concept for sociology and social anthropology, ‘culture’ the leading concept for cultural anthropology. I contrast the sociology of culture with the cultural anthropological consideration of society. I next examine the terms for ‘society’ in the classical German tradition, especially Weber, pointing to interpretivism as a cultural theory of society. I then consider Weber’s Kultursoziologie, arguing that it is culture (Kultur) not society (Gesellschaft) that is the ultimate object of Weber’s sociology. I conclude that sociology needs to identify classical German sociology and its derivatives as cultural science not social science, and to make comprehensive adjustments to its methodological debates accordingly. The implications of this for the problem of sociology’s encounter with the natural world are noted. (shrink)

This article explores the continuities and discontinuities of pre-Revolutionary intellectual traditions in 1920s Soviet culture and the Stalin-era cultural revolution. Through examination of the pre-revolutionary philosophical legacy underpinning Soviet musicological theory, I demonstrate that there are decisive features, such asSoviet Prometheanism, that characterize the musicology of the 1920s that both underline and differ from the pre-revolutionary philosophy of music and the musicology of the 1930s. I offer the basic outlines of aSoviet cultural theory of musicformulated by Russian music critic, historian, (...) composer and musicologist Boris Asafiev (1884–1949) in the 1920s. Explaining and describing what I mean by a particular cultural theory of music in the Soviet context forms the core issue of my article. (shrink)

This paper argues that, contrary to what many musicologists and classical musicians have maintained, music can, and should, be analysed as discourse. It then surveys a number of approaches to the critical analysis of musical discourse and applies these approaches to a range of examples, including sonatas, advertising jingles and news signature tunes.

Throughout its history the Game was closely allied with music, and usually proceeded according to musical or mathematical rules. One theme, two themes, or three themes were stated, elaborated, varied, and underwent a development quite similar to that of the theme in a Bach fugue or a concerto movement.… Experts and Masters of the Game freely wove the initial theme into unlimited combinations [p. 30].

The most important structural feature of the music of the New World is its often-time polyrhythmic and polymetrical character. This is also a key to unlocking the nature of social form and democratic persona in the diasporic and settler metropolises of the New World. In such settings, composers and musicians working with simultaneous temporalities, lines, groups, textures and characters offer intimations of a just totality for culturally fragmented societies.

In this article, I use Stengers’ (2010) concepts of ‘factish’, ‘requirements’ and ‘obligations’, as well as Latour’s (1993) critique of modernity, to interrogate the rise of Equal Temperament as the dominant system of tuning for western music. I argue that Equal Temperament is founded on an unacknowledged compromise which undermines its claims to rationality and universality. This compromise rests on the standardization which is the hallmark of the tuning system of Equal Temperament, and, in this way, it is emblematic of (...) Latour’s definition of modernity. I further argue that the problem of the tuning of musical instruments is one which epitomizes the modern distinction between the natural and the social. In turn, this bears witness to what Whitehead calls the ‘bifurcation of nature’. Throughout this article, using the work of Stengers and Latour, I seek to use tuning as a case study which allows social research to talk both of the natural and of the social aspects of music and tuning, without recourse to essentialism or simple social construction. This article examines how the twentieth-century composer dealt with the paradox of communicating with the composer's own self and with other musicians, but not with the public at large.

This paper analyses the paradigms of interpretation and the evolution of the creative processes in music and law. Whether it is matter of a score or a law, the text is reborn through the work of the interpreter who, in dealing with the epistemological problem of the understanding, has to harmonize the purity of the philological reconstruction of the object with the need to actualize its sense. Moving from the creative character of every interpretation—neither the musician can be reduced to (...) a mere executor of a concatenation of musical symbols on the staff as Stravinsky wanted nor the judge may be conceived as a bouche de la loi according to Montesquieu’s theory—this work, after having discussed Gadamer and Betti’s hermeneutical approaches to music and law, focuses on the issue of the limits to the interpreters’ freedom. The interpretation here proposed revolves around improvisation, seen as a typical cultural practice of the aesthetic dimension of music. Improvisation, which from baroque to jazz does not correspond to the realm of absolute freedom, is used as a trait d’union in order to make a comparison with legal experience. This is particularly true with the development of case law, which becomes increasingly problematic especially in the light of “liquid modernity”, where the “polytheism of values” has been gaining strength. Seen from this perspective, the comparison between the judge and the musician in their activity as interpreters of a formalized system of signs highlights the controversial relationship between form and creativity, the accuracy of the text and the requisites deriving from the social context, certainty and justice. This article investigates the status assigned to Max Weber’s The Protestant Ethic and the Spirit of Capitalism as a case study on the development of the concept of theory in twentieth century sociology. I trace this development in the interplay between scholars in the United States and Germany and distinguish three waves of meaning given to the text. The transitions between these phases were brought about by an initial process of mystification of the text in the 1930s and a dynamic (...) of de- and re-mystification beginning in the 1980s. Following this process of (re)interpretation over time, I show that at the beginning of the century the work was perceived as an empirical inquiry, while at the end of the century it was treated as pure theory. Based on the example of the peculiarities of the Weberian expert communities in the United States and Germany, I analyze how the invention of a concept of theory as independent from empirical evidence helped to stabilize the value of scholarly expertise on Weber in the face of otherwise declining resonance of the text. The analysis of this paradigmatic case adds to our understanding of the development, uses, and meaning of theory in contemporary sociology. (shrink)

Problem setting. Latin America and the Caribbean traditionally referred to as a large and ambiguous region in an out-side territorial scientific environment. A whole stratum of problems of identities, peculiarities of self-awareness, civilization affiliations of messianic ’appointments ’ in the history of the region and the world, the development of ways of cultural and historical development corresponding to them, the affirmation of the tendencies of state formation is in a scientific researcher focus. Among the many aspects that conceptualize the demandfor (...) research in the region and its implementation, we would like to highlight the following: 1) Latin America and the Caribbean are, to some extent, «a territory of historically significant validation of modern trends» in their speculative lengthening, the field ofdeveloping new ones political and economic novations, including regarding various projections of the correlation of socio-political practices, institutional design and legal technologies, derived from the understanding of nature and the purpose of law. 2) The region ’provides ’ a wide range of heterogeneous materials for analytical work, both concatenate-linear in nature, and combining poly-meaningful multidimensionality, multifaceted coexistence of values generated by contemporary media, the glare of meanings, signs, intentions of conscious transformations, random «breakthroughs» of network travel followers. In the discovery literature thatfollows only the analysis of statistical indicators, it is often noted that Latin America and the Caribbean is a region of polarization. 3) Considering the full amount of opportunities and perspectives available, Latin America in general, in some associative formulation, is clearly «boxing at levels below its weight and its impact on international canvases», that is, there are some reasons for internal and external character that significantly reduce the region’s role in the world, affecting accents of processes of political, legal and economic worsen the work «for the common good», underestimate «the bar of tasks and results» do not meet the expectations of the significance of the region. Mahoney and researchers of modifications of the development of neo-patrimonialism in Latin America and Karsten Bachle. Focused on the trends and innovations of the constitutional process in the countries of the region are the scientific orientations of Rogelio Nu'nez and P. I. Kostogryzov. A broad analytical and research base on the transformation of political regimes in Latina America and the Caribbean and the peculiarities ofpolitical processes in individual countries are provided by the works of B. Geddes, G. O’Donnell, L. Diamond, D. Ziblatta, S. Levitsky, Z. V. Ivanovsky, T. A. Vorotnikova, P. P. Yakovlev, D. V. Morozov, and others. Paper objective. The purpose of this work is to find out the broad contexts of the relationship between economic and political and legal processes in Latin America and the Carribien countries with attention to the peculiarities of the rule of law formation. The tasks are to analyze a set of approaches to finding the causes of the difficulties of socio-political and institutional-legal development in the region with the involvement of interdisciplinary scientific experience and to identify some essential features of meaning- forming and socio-constructing phenomena in the contextual contours. Paper main body. One of the options for designating the specificity of the current state of affairs is framed in the concept of the so-called «curse of volatility» - the dependence of local, mainly commodity and export-oriented with low internal economy savings from cycles, fluctuations of the world economy. This dependence is a definite structural factor and has been forming for a long time. Also, macroeconomic indicators within the framework of a certain political economy methodology in the projection for the sum ofpolitical and legal events allow us to see the spread of ideology, whether left or right, the rise of populism, the tendency for further democratization of the way of life or vice versa from democracy, the relative calm of the political process or the turbulence ofpolitical events are, after all, tied to basic economic indicators, and often more or less relevant to us and corresponding to figures about the level of safety of life. The trajectory of development was laid down by some decisions at a time of critical juncture when privatization created the basis of the local economy as a structural part of the world capitalist system with its dynamics of development that facilitated the formatting and reproduction of the reactive sequences caused by different types of liberal reforms. Conclusions of the research. The particular attention in Latin America and the Caribbean countries on the expectations and responsibilities of building the future is focused on the development of Constitutional law as a leading sphere in the system of national law. Hence the numerous constitutional changes in the countries of the region, the constitutional reforms of different grades, which are intensively continued today. The lifestyle liberalization, resolving key property issues, attempts at democratization in Latin America and the Carribien countries took place in different ways, but after the foundations ofpublic law that were borrowed in outline in the USA. Between enshrined key provisions in the Constitutions and the coexistence of essentially diverse mass consciousnesses and aspirations on different ’floors’ of the society, has raised multi-dimensional discord, that is emerging from the institutionalization of the liberal-democratic model of the state, generated in the context of understanding freedom as a key concept. Therefore the aspect ofan all-public agreement on coexistence rules does not appear to be fully realized, which gives rise to a search for a constitutional character. The focus remains on the relationship between multiple interests and ideas about the common good, by means of the formation of the general will in the structure and practice of constitutional-democratic regimes. It is inextricably linked to the transformation of the concepts of representation and citizenship. Democratic legitimation is correlated with ideas about the rule of the masses, the will of the majority in the living creation of the norms of life, and with the accompanying active and continuous participation in the political process of large groups, sectors of the population. The constitutional creativity of the countries of the region shows the element of an assertion of messianism, the designation of the special role of the country, its leader, ideology, the Constitution in the processes of historical implementation at the level of regional or the world. This moment of national pride for the country and its contribution to the cultural and civilizational space of history is realized in experimental projects of various expressions. (shrink)
