The disconnection between the idea of nation-based citizenship and the current practices of migrants presents the opportunity to reconceptualize and redefine the idea of citizenship and thereby grasp the realities of movement. I employ Giambattista Vico's theories of universal rights and his history of civilizations to interrogate rhetorically national origins and expand on what I call a renovation of citizenship. This is a process that embraces daily practices of nation-based citizenship and encourages us to imagine new ways to express citizenship, (...) ways that comport with the realities of a mobile world, specifically the human right of freedom of movement. In formulating this renovation of citizenship based on mobility, I introduce the metaphor of stochastic citizenship to resolve the tension between the legal structures governing citizenship and the promotion of mobility as a human right. Plato's dialogues are filled with metaphors and likely stories from the Ring of Gyges to the metaphor of the Sun to the tale of Atlantis, as are Hegel's works, from the "night in which all cows are black" to the phrenological skull to the owl of Minerva that flies only at the falling of dusk.How are we to comprehend the extremes of philosophical doctrine on the one hand and the discourse that expresses it on the other? Is the discourse simply the outer shell of the doctrine, inessential to its truth, or does the doctrine itself require for its truth all that is needed for its proper statement?I wish to seek the answer to this by connecting Plato to Hegel, using Vico as an intermediary, in particular Vico's conception of la sapienza poetica (poetic wisdom) and his conception of the universale fantastico (imaginative universal). Cognitive scientists typically wish the abstractions in their theories to be universals, but seldom attend to the ontology of universals. Two sorts of universal, resulting from Galilean abstraction and materialist abstraction respectively, are available in the philosophical literature: the abstract universal—the one-over-many universal—is the universal conventionally employed by cognitive scientists; in contrast, a concrete universal is a material entity that can appear within the set of entities it (...) describes, of which it represents the essential, paradigmatic case. RESUMO Este artigo pretende mostrar o fundamento geométrico-matemático que permitiu a Giambattista Vico estabelecer um vínculo entre a criação humana e a criação divina. A pesquisa centrou-se no uso formal que o autor fez das ciências matemáticas para compreender o mundo. Considerando o pitagorismo presente na filosofía viquiana até 1710, o esforço busca mostrar a sobrevivência deste nos trabalhos posteriores do autor. Para isso, destacamos o novo papel que a geometria cumpriu inteligentemente na storia ideale eterna da Providência na "Scienza (...) Nuova". ABSTRACT The aim of this article is to show the geometric-mathematical basis that allowed Giambattista Vico to establish a bond between human and divine creation, focusing on the formal use of mathematical sciences in his comprehension of the world. Considering the Pythagorean character of his philosophy, up to year 1710, this study reveals its survival in Vico's later works by stressing the role of geometry in the witty understanding of Providence's storia ideale eterna in the "Scienza Nuova". This contribution investigates the idea that an act of signification can be understood in terms of the self-referentiality that is typical of the biological organization. The capacity of a living being to interpret and appreciate its own environment can be understood as being grounded in its ability to perform self-referential experiences. We may call this the living being’s capacity of sense. In any act that generates sense, it is possible to distinguish a process of signification from its outcome, but such (...) a distinction between logical levels inevitably demands an external observer’s point of view. Hence, the concept of ‘subjectivity’ can be defined in terms of an absence of such distinction between logical levels. This absence is considered pivotal both for the self-referential organization of the living and for the generation of sense. A case example from the field of psychotherapy is added to illustrate the distinction as well as the non-distinction between logical levels of description. (shrink)

Work on the relation between figurative language and the law is a fairly recent trend, within legal discourse studies, linguistics, and semiotics. The work in conceptual metaphor theory, for example, is starting to unpack the underlying metaphorical and metonymic structure of legal language, producing some new and important insights into the nature of this language. Missing from this emerging line of inquiry are the views of the Neapolitan philosopher Giambattista Vico, who was the first to understand the power of figurative (...) language in the creation of symbolic systems, like language and the law. His tripartite evolutionary model of language shows that there is not one language of the law, but three “languages.” By integrating Vico’s model with the work in conceptual metaphor theory it will be possible to penetrate the underlying conceptual structure of legal discourse and thus lead to a more insightful science of this discourse. El paradigma del Juicio constituye un modelo de racionalidad que pretende elevarse como alternativa positiva ante los retos coyunturales introducidos por el giro lingüístico de la filosofía en el pensamiento contemporáneo. Frente a la difícil tarea de defender principios universalistas en la cultura actual, este modelo aspira a pronunciarse positivamente sobre cuestiones tales como la de la validez normativa que pueda afectar las relaciones entre acción humana y deliberación. Para alcanzar su objetivo, el paradigma del Juicio patrocina una forma de (...) la normatividad sin principios (validez ejemplar), enraizada en el juicio reflexionante kantiano y en el sensus communis (sentido común) de la tradición retórico-humanista. El objetivo de este artículo es la presentación de dicho modelo de racionalidad dentro de la filosofía kantiana y, por medio de la exploración de sus antecedentes histórico-filosóficos (Gadamer), y gracias a un rodeo por la tradición retórico-humanista (Aristóteles y Vico), se busca soslayar el énfasis estético que la fundamentación de Kant acentuó. On 18 October 1708, Giambattista Vico (1668–1744) gave his seventh inaugural oration, De nostri temporis studiorum ratione (De ratione) at the University of Naples. There, he used the term conspirare to propose collaboration among the sciences. An initial study of the historical context, specifically the scholar’s involvement with the Conspiracy of the Prince of Macchia (1701) and the debates on university reform, makes it possible to formulate a hypothesis regarding Vico’s intent and word choice that enriches our understanding of the (...) preserved text. On a personal level, the Neapolitan professor was looking for a modicum of protection from the new authorities, especially the recently named viceroy in audience that day, Cardinal Vicenzo Grimani. On the political plane, along with a surreptitious argument against tyranny, Vico sought to dissuade the new governors from subscribing to the divisive approach embodied in the university policy of the Cartesian and Bourbonic reformers. Direct analysis of the text of De ratione enabled theoretical scrutiny of the frame from which Vico called for more than mere encyclopaedic knowledge. He was setting forth a vision for a conspiratorial project among the sciences based on a broad understanding of rhetoric.
