This article contributes to the revision of the concept of system in social theory using complexity theory. The old concept of social system is widely discredited; a new concept of social system can more adequately constitute an explanatory framework. Complexity theory offers the toolkit needed for this paradigm shift in social theory. The route taken is not via Luhmann, but rather the insights of complexity theorists in the sciences are applied to the tradition of social theory inspired by Marx, Weber, (...) and Simmel. The article contributes to the theorization of intersectionality in social theory as well as to the philosophy of social science. It addresses the challenge of theorizing the intersection of multiple complex social inequalities, exploring the various alternative approaches, before rethinking the concept of social system. It investigates and applies, for the first time, the implications of complexity theory for the analysis of multiple intersecting social inequalities. Citizenship is both a contentious and contested struggle about the creation of rights, duties, and opportunities. Feminist practices and debates can clarify the meaning of citizenship. This is because the form of feminist practices, characterized by an ongoing struggle, and the content of feminist debates, focusing on gender and other inequalities, recognition of different voices, and critiques of the public and private dichotomy, are particularly suited for dealing with the challenges of contentious and contested processes of citizenship. This article aims to claim ‘body size’ as an increasingly important axis of signification. It draws on research from various disciplines to present an exploratory overview of the different ways in which body size categorizations – being fat or slender – intersect with other axes, such as gender, race, sexuality, social class and age. The article argues that an intersectional perspective on body size adds to our understanding of the layeredness and complexity of power differentials, normativities and identity formations that (...) co-produce inequalities. Furthermore, it attempts to show how processes of exclusion and marginalization based on body size categorizations are similar to racist, ableist and misogynist logics and practices. Hereby the article intends to demonstrate the vast impact of body size categorizations, specifically but not exclusively on the lives of those who occupy the marked position in relation to this axis: the ‘fat’. It argues that an intersectional perspective helps us to see body size discrimination more clearly and can help disrupt dominant discourses about the body in order to create a truly ‘healthy’ environment in which bodies of all sizes, shapes, colours and abilities can be celebrated. Women's equality claims have occupied the forefront of the European debate on face-veil bans; most claims have been denounced as mere manipulation for anti-Islamic and/or anti-immigrant political agendas, and the dilemma between anti-sexist and anti-racist struggles has been argued to be false. This article examines how opportunistic manipulation of gender equality claims and the ‘ethnicisation’ of sexism have been assessed and confronted in the scholarly debate opposing the bans, as well as the impact that this debate has had on women's (...) equality claims and the intersectionality issue. I argue that the women's oppression argument has not been fully considered, because it would have disrupted the anti-racist struggle due to unresolved problems with understanding intersectionality. Much is written about quantitative techniques and feminist and gender studies. Despite convincing arguments in favour of utilizing these methods, they are still largely absent in the heartland of gender studies. In this article, this is related to the observation that methods are tied to epistemological positions and consequently quantitative studies are a priori associated with overgeneralization. A new perspective – the diversity continuum – is presented in order to contextualize research and make it possible to judge it relatively. This (...) shows that quantitative research can increase the understanding of differences and similarities. Subsequently, it is discussed how quantitative research can be utilized to understand differences between people using existing basic techniques. In line with the conceptualization of diversity, this includes techniques to study intersectionality and how developments have different effects on men and women. The potential for biases being built into algorithms has been known for some time, yet literature has only recently demonstrated the ways algorithmic profiling can result in social sorting and harm marginalised groups. We contend that with increased algorithmic complexity, biases will become more sophisticated and difficult to identify, control for, or contest. Our argument has four steps: first, we show how harnessing algorithms means that data gathered at a particular place and time relating to specific persons, can be used (...) to build group models applied in different contexts to different persons. Thus, privacy and data protection rights, with their focus on individuals, do not protect from the discriminatory potential of algorithmic profiling. Second, we explore the idea that anti-discrimination regulation may be more promising, but acknowledge limitations. Third, we argue that in order to harness anti-discrimination regulation, it needs to confront emergent forms of discrimination or risk creating new invisibilities, including invisibility from existing safeguards. Finally, we outline suggestions to address emergent forms of discrimination and exclusionary invisibilities via intersectional and post-colonial analysis. (shrink)

In 1998, the Labour government introduced legislation broadening British sentencing powers in relation to crimes aggravated by the offender's hostility towards the victim's actual or perceived race, religion, sexual orientation or disability. Gender is a notable omission from this list. Through a survey of eighty-eight stakeholders working in the violence against women (VAW) sector, this paper explores both the potential benefits and possible disadvantages of adding a gender-based category concerned with VAW to British hate crime legislation. The majority of participants (...) believed that a hate crime approach would offer significant benefits, especially in terms of the symbolic power of the law to send a message to society that VAW is unacceptable. However, most also recognised that the addition of a VAW category to current legislation would involve major practical and conceptual difficulties, not least those resulting from problematic assumptions about the nature of hate crimes versus VAW, and a general unwillingness on the part of policy-makers to address the socio-cultural inequalities that underpin VAW. Overall, the fact that the majority of participants favoured inclusion, on the basis that the possible symbolic benefits were likely to outweigh the potential practical disadvantages, is significant: it speaks to the power of hate crime legislation to challenge many forms of inequality and discrimination still endemic in British society. This article aims to outline some of the ways in which issues of migration and employment relations have been studied in the European context, cross referencing recent interventions in the USA. The argument is a discussion of some of the different dimensions of migration and the way debates within Industrial Relations have been shaped. More specifically, the article will look at the way trade unions have made the ethical turn towards questions of migration and equality. The article will observe the (...) way these issues have been academically framed and the manner in which the ‘problem’ of migration is conceptualized. It will attempt to provide a framework for discussing the way we have been analysing these issues and the ethical dimensions of these discussions. The relevance of the article is that institutionally responding to migration is not solely a question of adjusting employment relations or Industrial Relations institutions to various ‘new’ constituencies. The article will show that the topic raises issues as to how we actually understand what the study of employment and especially Industrial Relations are. The article also argues that there is a growing need for researchers to be aware of ethical issues when studying in the area of migration, and to be sensitive to competing voices and methodologies in this area. In particular we need approaches that are multidimensional and that emphasize the history and context of change in social constituencies, the new mechanisms of representation within communities, the role of the political in terms of discourses and resources, and the broad play and spaces of regulation and social policy. Can the quality of gender+ equality policies be defined in ways that apply across different policy contexts and different policy moments? In light of different scholarly debates and empirical material from gender violence policy debates especially in Southern and Central Eastern Europe, this article discusses dilemmas around defining the quality of gender+ equality policies. It proposes a two-dimensional model. The first dimension links quality to procedural aspects: empowerment of women’s rights advocates at different stages of the policy process, and transformation (...) with reference to prevailing contextual legacies. The second dimension is more substantive, and includes genderedness, intersectionality and the structurally transformative focus of policies. The article illustrates how within the framework set by these criteria, the quality of gender equality policies is constructed through policy debates in ways that are dependent on the different discursive, institutional and structural factors specific to various policy contexts. Austerity politics, war in the Middle East and at other borders of the European Union, the rise of nationalisms, the emergence of populist parties and politicians, Islamophobia and the refugee crisis are amongst the recent developments suggesting the need for discussions about the theories and concepts that academic disciplines provide for making sense of societal, cultural and political transformations. In this article, we focus on the capacities of feminist political theories to undertake this task. By assessing different feminist approaches to (...) political analysis that range from focusing on women and men, to analysing gender, to doing intersectionality and to adopting post-structural and new materialist approaches, we explore the contributions and the limitations of each framework. This allows us to consider where feminist theoretical debates on gender and politics currently are, to assess old and new developments and to address lacunae in the debate. Our argument is that dominant approaches in political science influence the emergence and marginalisation of particular feminist frameworks for political analysis, but also that feminist theorising of gender and politics, in striving for recognition within mainstream political science, reproduces its own hegemonies and marginalisations. Over the last few years, intersectionality has become not only one of the most prominent topics of feminist theory in Europe, but also one of its most serious challenges, pressing us to acknowledge that European nations are not homogeneous entities and calling for more complex accounts of gender relations and forms of gender injustice. Currently, many scholars embrace intersectionality as a concept, but there is no consensus about what adequate theoretical accounts of intersectionality with regard to European contexts should look (...) like. Drawing on theoretical positions that have been put forward within the current intersectionality debate in German-speaking countries, this article addresses two questions that are currently at stake: the what-question of intersectionality, asking what it is, which forms of inequality we focus on as intersecting; and the how-question of intersectionality, focusing on how we should conceptualize what is happening when forms of inequality intersect. The Court of Justice of the European Union (CJEU) has had the opportunity to address the sensitive matter of the wearing of the Islamic headscarf in the workplace in two preliminary rulings. The result of these decisions implies that the wearing of this veil at work is, in general, neither proscribed nor always justified as a legitimate expression of religious beliefs. However, the law studied and applied deals exclusively with discrimination in the workplace on religious grounds. Nonetheless, the Islamic headscarf (...) is only worn by (some) Muslim women (never by men). This article reviews the EU legislation and policy on equality, intersectionality and multiple discrimination to verify that gender mainstreaming does not reach the work of the Court. Only the inclusion of a feminist perspective to the application of justice, with a clear methodology, can guarantee that gender does not disappear in cases of complex discrimination. (shrink)

Much has been achieved in terms of human rights for women and people of the lesbian, gay, bisexual, transsexual, and queer (LGBTQ) community. However, human resources management (HRM) initiatives for gender equality in the workplace focus almost exclusively on white, heterosexual, cisgender women, leaving the problems of other gender and social minorities out of the analysis. This article develops an integrative model of gender equality in the workplace for HRM academics and practitioners. First, it analyzes relevant antecedents and consequences of (...) gender-based discrimination and harassment (GBDH) in the workplace. Second, it incorporates the feminist, queer, and intersectional perspectives in the analysis. Third, it integrates literature findings about women and the LGBTQ at work, making the case for an inclusive HRM. The authors underscore the importance of industry-university collaboration and offer a starters’ toolkit that includes suggestions for diagnosis, intervention, and applied research on GBDH. Finally, avenues for future research are identified to explore gendered practices that hinder the career development of women and the LGBTQ in the workplace. (shrink)

Purpose This paper aims to critically assess approaches to sex and gender in the Human Brain Project as a large information and communication technology project case study using intersectionality. Design/methodology/approach The strategy of the HBP is contextualised within the wider context of the representation of women in ICT, and critically reflected upon from an intersectional standpoint. Findings The policy underpinning the approach deployed by the HBP in response to these issues parallels Horizon 2020 wording and emphasises economic outcomes, productivity and (...) value, which aligns with other “equality” initiatives influenced by neoliberalised versions of feminism. Research limitations/implications Limitations include focussing on a single case study, the authors being funded as part of the Ethics and Society Subproject of the HBP, and the limited temporal period under consideration. Social implications The frameworks underpinning the HBP approach to sex and gender issues present risks with regard to the further entrenchment of present disparities in the ICT sector, may fail to acknowledge systemic inequalities and biases and ignore the importance of intersectionality. Shortcomings of the approach employed by the HBP up to March, 2018 included aspects of each of these risks, and replicated problematic understandings of sex, gender and diversity. Originality/value This paper is the first to use an intersectional approach to issues of sex and gender in the context of large-scale ICT research. Its value lies in raising awareness, opening a discursive space and presenting opportunities to consider and reflect upon potential, contextualised intersectional solutions to such issues. (shrink)

Today intersectionality has expanded from being primarily a metaphor within structuralist feminist research to an all-encompassing theory. This article discusses this increasing dedication to intersectionality in European feminist research. How come intersectionality has developed into a signifier for ‘good feminist research’ at this particular point in time? Drawing on poststructuralist and postcolonial theory the authors examine key articles on intersectionality as well as special issues devoted to the concept. They interrogate the conflicts and meaning making processes as well as the (...) genealogies of the concept. Thus, the epistemology and ontology behind the ‘intersectional turn’ in feminist theory is the main concern here. The authors argue that the lack of ontological discussions has lead to its very popularity. Intersectionality promises almost everything: to provide complexity, overcome divisions and to serve as a critical tool. However, the expansion of the scope of intersectionality has created a consensus that conceals fruitful and necessary conflicts within feminism. (shrink)

The objective of the work is to analyze the intersectional discriminations that operate in the multiple identities of regional migrant women in the field of health in Argentina during the present pandemic. We will begin with the critical study of key categories and the origin of the inequalities of law of the aforementioned discrimination in migration policies. Second, we will address de facto inequalities, particularly examining the socio-economic inequalities suffered by migrants during the pandemic. Thirdly, in order to enable alternative (...) forms of care and self-care from the recognition of their ethnicity and the inseparable care of the earth, we propose the application of the concept of territorial participatory justice as a condition of intercultural dialogue in health. As a proposal, it seeks to promote dialogues of knowledge located outside the bureaucratic councils and expanding the social base of health rights from the pluriculturality exercised in care networks of migrant women in the territory and not from their domesticated participation. Este artículo propone una revisión crítica del concepto de desigualdad tomando como base de análisis la política europea de lucha contra la pobreza y la exclusión y se pregunta sobre las formas en las que se construye y tiene en cuenta el concepto de interseccionalidad en las narrativas sobre las que se ha ido desarrollando durante los últimos 20 años. La hipótesis de la que se parte es que estas políticas se han dirigido tradicionalmente a grupos específicos desde un enfoque (...) unitario; es decir, a partir de una categoría única, considerada la más relevante o explicativa políticamente en situaciones particulares de desventaja social. De esta manera, la política europea de lucha contra la pobreza y la exclusión se ha institucionalizado sin tener en cuenta el carácter complejo de las desigualdades. (shrink)

El artículo examina algunos de los límites del derecho antidiscriminatorio en su actual configuración, a partir de las grandes tendencias que le dan soporte desde el punto de vista legislativo y jurisprudencial. El texto plantea una reflexión sobre los principios interpretativos tradicionales y los problemas de incorporación en el juicio de igualdad de estándares de orden explicativo y justificatorio que permitan captar los patrones o estructuras sociales de discriminación e identificar de forma más precisa a los sujetos. A tal efecto (...) propone la ampliación del espectro argumental de la discriminación indirecta y la igualdad material, a través de criterios interpretativos adicionales derivados de categorías como la discriminación estructural y la interseccionalidad de las discriminaciones. This article reviews the debate on ‘intersectionality’ as the dominant approach in gender studies, with an emphasis on the politics of representation. The debate on intersectionality officially began in the late 1980s, though the approach can be traced back to the institutionalization of women's studies in the 1970s and the feminist movement of the 1960s. Black and lesbian feminists have long advocated hyphenated identities to be the backbone of feminist thought. But in recent years, intersectionality has sustained criticism from numerous (...) angles within gender studies, ranging from feminist philosophy to applied political research. This article will use the theorization of ‘interference’ as a searchlight to produce an overview of this interdisciplinary debate, culminating in our affirmative answer to the question: should we move from intersectionality to interference?
