Comparing Rancière’s and Crouch’s respective concepts of post-democracy and the way they problematise the state of contemporary (Western) societies, this article opts for a third way to state the problem, associated with the idea of democracy as a form of life. Common to all three approaches is the critique of an ‘engineering attitude’ that conceives problems as disturbances that have merely to be fixed. All three also warn against the dominant influence of economics in politics and the increase of right-wing (...) populism. However, they diverge in their basic understanding of what problems are and how they are constituted. This article will show that the way we conceive the notion of a problem itself has important implications for our understanding of the problems of democracy and our engagement with them. (shrink)

This paper advances a novel take on Chantal Mouffe’s appropriation of the late Wittgenstein, arguing that Wittgenstein’s philosophy, at the same time, gives rise to and offers a solution to the relativism problem as it can be found in Mouffe’s radical political thought. Unlike other vindications of Wittgenstein-inspired political thought, I also show at which point Wittgenstein’s support for such an approach comes to an end. I thus acknowledge that the relativism problem – at least to some extent – stems (...) from the ambiguity of Wittgensteinian thought itself. After having outlined these challenges, I suggest turning to alternative approaches from the field of critical social philosophy. In particular, Rahel Jaeggi’s Frankfurt School account of forms of life highlights what such a non-relativist but still context-sensitive approach may look like. By virtue of this last step, this paper contributes to recent engagements by Critical Theorists with the late Wittgenstein. (shrink)

How does mutual intelligibility impact the political sphere? This paper uses Wittgenstein’s Philosophical Investigations as a means of examining this connection. I argue that Wittgenstein’s paradigm of a dialectical world suggests that his analysis of mutual intelligibility in understanding experiences is necessary in a pluralistic democracy. I conclude that via his theory of social reality politics is a dynamic dialectical process of communicating experiences.

During the last forty years, the Aboriginal peoples of the Americas, of the British Commonwealth, and of other countries colonized by Europeans over the last five hundred years have demanded that their forms of property and government be recognized in international law and in the constitutional law of their countries. This broad movement of 250 million Aboriginal people has involved court cases, parliamentary politics, constitutional amendments, the United Nations, the International Court of Justice, the development of an international law of (...) Aboriginal peoples, and countless nonviolent and violent actions in defense of Aboriginal systems of property and cultures. The Aboriginal peoples of New Zealand, Canada, and the United States have been at the forefront of the movement, and it is in these countries that the greatest legal recognition has been achieved. This article deals critically with the process of coming to terms with ‘genocide’. It starts from the observation that conventional philosophical and legal approaches to capturing the essence of ‘genocide’ through an improved definition necessarily fail to adapt to the ever-changing nature of political violence. Faced with this challenge, the article suggests that the contemporary debate on genocide (and its denial) should be complemented with a focus on transforming the perceptive and interpretive frameworks through which acts of violence are discussed (...) in the public sphere. The main purpose of this article is to contribute, from the vantage point of political theory, to this debate by offering a novel normative perspective on negative reactions to genocide. Hence I argue that it is productive to speak of ‘genocide blindness’ in cases when the members of the public sphere are simply incapable of seeing an instance of violence as genocidal. To establish this claim, the article introduces Ludwig Wittgenstein’s reflections on ‘aspect-seeing’ so as to underline the importance of changing the way that political violence is perceived and interpreted. In a second step, the article turns to María Pía Lara’s theory of storytelling as a concrete mechanism for triggering and instituting this kind of change. (shrink)

Drawing on experience teaching secondary philosophy students, I investigate meaningful engagement with Wittgenstein in a Grade 12 epistemology unit. The premise is that without some introduction to landmark philosophers of the early twentieth century, students are left out of many contemporary philosophical conversations: linguistic idealism or relativism, and nominalism versus realism. Wanting to share with students Foucault, Rorty, and Hacking, I need expedient avenues of approach. Using Wittgenstein's methods I offer practical, ‘shallow grounds’ for an eclectic syllabus conveying post-foundational epistemology, (...) justifying Wittgenstein's inclusion in a textbook written for diverse teenagers. How should sociologists use the word theory? Gabriel Abend’s recent insistence that this question should be tackled politically raises two important issues: Is sociology political? And if so, what normative implications follow for its organization? Drawing on Wittgenstein’s notion of family resemblance and post-Gramscian theories of hegemony, I argue that Abend’s proposal that semantic questions about theory can be addressed separately from ontological, evaluative, and teleological ones is untenable. Disagreements about the latter are constitutive, not merely supplementary to the meaning (...) of theory. Against Abend’s deliberative-democratically oriented vision, I propose an agonistic politics of theory. In doing so, I consider both the internal inconsistencies of deliberativism and the practical advantages and sociological relevance of agonism. (shrink)

This article suggests that an epistemological and ontological pluralist perspective may enable human beings to cooperate each other and live with less injustice. Intercultural cooperation may help for a reformulation of the Human rights in order to consider aspects of different ways of life like the variations of moral, political and judicial norms. I expound that Liberal pluralism does not respond adequately to present day multiculturalism. Additionally, I explain that Human rights are not inclusive norms for all ways of life. La relevancia de tal capacidad radica en que la estructura y función de los juicios reflexionantes, tal como son leídos por hannah Arendt a partir de la Crítica del Juicio kantiana, nos permiten explicar el difícil equilibrio entre los juicios compartidos en las comunidades y la posibilidad de la crítica.

James Tully's account of a ?post?imperial constitutionalism?, in his book Strange Multiplicity, wrongly rejects the ideal of impartiality in modern political theory. Pace Tully, this paper argues for a conception of impartiality called ?justice as provisionality?. This is demonstrated by explaining the concept of a ?contrastive hard case?. These cases, exemplified both by indigenous peoples? struggles for recognition and ?traditional? justifications for violence against women, centrally involve conflicts over the cultural interpretation of value. The paper argues that the just adjudication (...) of these cases depends on understanding two different senses of the term ?provisionality?. These demonstrate that the post?imperial state can give impartial reasons for the rights of parties to ?contrastive? claims in a way that integrates the concerns of both feminists and cultural pluralists. The two senses of provisionality are: first, that consequent upon historical injustice, the post?imperial state should recognize the legitimacy of citizens? partial reasons for their actions and practices; and hence, should recognise that the domain of public, impartial reason is always provisional and incomplete. Second, our capacities for reason are dependent on public and nonpublic provision, protection and care. This is because diverse inequalities and injustices could prevent vulnerable people, in some cases women, from acting according to reasons at all. (shrink)

This paper examines the properties of the validity and scope of arguments as standards for evaluating the epistemic qualities of particular deliberative exchanges within a context of value pluralism where parties can hold differing views of the common good based on incommensurable basic values. In this context, the task of political decisions is to maximise the interests of all, only judging between internally coherent versions of the common good on the basis of their mutual impact. The paper argues open, democratic, (...) deliberation provides the best chance of discovering such a path, through developing mutual understanding across incommensurable positions. Identifying the validity and scope of a deliberative exchange enhances this potential. Any deliberative exchange may be characterised in terms of its validity – the reasons that support its conclusions – and scope – the unquestioned assumptions that mark the boundaries of that reasoning. The paper explains the epistemic role of these two features in developing understanding across plural positions. Clarity about the validity of an exchange reveals positions that can be shared. Acknowledgement of its scope avoids over-extending its conclusions and reveals how positions differ, providing the starting point for further deliberation about their co-ordination. The paper ends by drawing the conclusion that deliberation characterised in this way should be democratic and open. (shrink)

Recent work in the strategic-relational approach to explaining the relationship between structure and agency emphasises the significance of ideas, discourses, and the semiotic realm of symbols. However, this work does not yet offer an explanation of how discourses relate to symbols – how texts take on meaning. This article shows why this is needed. It then provides such an account of language use and learning in explicitly strategic-relational terms. That account both grounds strategic-relational concepts of discourse, and helps define them (...) more clearly. While complementing and strengthening such notions, it also provides an insight into the way particular discourses interrelate. In particular, the model presented here suggests the importance of the constructive and critical potential of reason, in enlarging the scope for critical syntheses across discourses, and guarding against hegemony. Although the discussion about feasibility in political theory is still in its infancy, some important progress has been made in the last years to advance our understanding. In this paper, we intend to make a contribution to this growing literature by investigating the proper place of feasibility considerations in political theory. A motivating force behind this study is a suspicion that many presumptions made about feasibility in several current debates—such as that between practice-independence and practice-dependence, ideal and non-ideal theory, and (...) political moralism and political realism—are too rigid and underestimate the numerous different ways in which feasibility concerns may enter into our theorizing. To chisel out this feasibility space, our aim is to suggest two metatheoretical constraints on normative political principles as intuitively plausible, the so-called ‘fitness constraint’ and the ‘functional constraint’, through which we elucidate five central aspects for determining proper feasibility constraints of an account in political theory. This paper argues that, because Science and Technology Studies lost contact with political philosophy, its defense of public participation in policy-making involving technical claims is normatively unsatisfactory. Current penchants for political under-laboring and normative individualism are critiqued, and the connections between STS and theorists of deliberative democracy are explored. A conservative normativity is proposed, and STS positions on public participation are discussed in relation to current questions about individual and group rights in a liberal democracy. This article explores parallel tendencies in Ludwig Wittgenstein’s and Ernst Gombrich’s thinking that aimed to dissolve misconceptions about mind, culture, and art that emerged in modernity but that continue to influence current art education. Section one gives an overview of Wittgenstein’s and Gombrich’s therapeutic projects, which drew on perspicuity and genealogy to eliminate confusions in thinking, rather than advance new theories. The second section illustrates Wittgenstein’s and Gombrich’s curative response to modern misconceptions about mind and culture. The analysis is extended (...) in a thematic way to dissolve similar misconceptions that prevail in current art education. One consequence of the later Wittgenstein's influential critique of epistemological foundationalism has been to convince many contemporary philosophers that the ideal of universal and necessary cognitive grounds for moral or political norms is illusory. Recent neo-Wittgensteinian accounts of practical reason attempt to formulate a conception of a post-foundational politics in which a political ethos can be legitimate, rational or just even if its informing practices and cognitive standards lack foundational justification. Against these appropriations of Wittgenstein, I argue that his account (...) challenges foundationalism only by generating epistemological relativism at both the first-order level of belief systems and at the second-order level of the comparative evaluation of first-order belief systems and their non-comparable forms of justification. The result is a polytheism of forms of reason which imperils the methodological ideal of a non-relativistic practice of moral-political criticism. (shrink)

This article reflects on the received view of the rupture which constitutes the beginning of a critical, ethical, political and legal opening, the understanding of which inhabits the cry of, and response to, injustice. It takes the very critique that feeds into, and is distorted by, practical reasoning, as its point of departure. Grasping this rupture as the complementary relation between deconstruction and radical alterity, would entail unreflectively accepting a certain kind of truthfulness—truthfulness as [in]correctness, manifesting in a relationship that (...) involves rootless and controlling movement of making and unmaking of world. In closely reading Wittgenstein and Heidegger on the level of seeing, showing and saying, truthfulness is shown to contain an essential tension between, on the one hand, the Socratic, metaphysically-bound notion of beingness, correctness and meaning-steering and, on the other hand, the pre-Socratic notion of unconcealment (a-lethia), which, pointing even earlier than pre-Socratics into aboriginality, involves attentive letting of gliding in the inexpressible saying of language. While steering is about generating new possibilities of expressibility, gliding is about poetic dwelling, or enduring inexpressibility as a constitutive part of saying. Although aletheia is taken to be the key influence on rootless post-foundational thinking, it is argued that unconcealment involves letting and enduring the presencing inexpressibility of place and home-coming, that is, worlding-rootedness; thus showing Heidegger’s originary politics as the district of the uncanny to be about worlding that attentively lets the presencing inexpressibility of earth be as place. In reading Heidegger’s views on humanism, beginning and language, the argument links inexpressibility—essentially and historically—to the grasping of the belongingness together of world, earth and place, viewing this belongingness as key to both the saying of art and of mortals dwelling together temporally, spatially, materially in a manner always strange to, and nearer than, the steering/controlling of beingness, time, space and place that the very gesture and emergence of critique is captive of and is not capable of attuning to and capturing. Art always estranges the metaphysical cycle of correctness which preserves pain and suffering—a cycle that inhabits a double bind of responding to violence and injustice generated by the violence of metaphysics with metaphysical violence and justice. In showing essential strife within truthfulness itself, Heidegger points to even greater and earlier problematic than the pre-Socratics—to the painful core of inexpressibility between the ontology of steering time, spaces and material—steering places—and the gliding temporality, spatiality and materiality of ontology of place. This paper argues that the critique of depoliticization in Mouffe’s agonistic political theory needs to be revised. This is because her account of the political does not succeed in filtering out undesirable forms of politicization such as science denialism and other types of post-truth politics. Mouffe's conception of the common symbolic space does not accomplish the task of limiting extreme pluralism in the absence of certain standards about how to correctly apply the fundamental notions of this space. By drawing on (...) a quasi-Wittgensteinian reading of linguistic normativity, I develop principled but non-universalist limits on politicization that are needed for a healthy, well-functioning democracy. Indigenous cultural possessions constitute a diverse global issue. This issue includes some culturally important, intangible tribal objects. This is evident in the Australian copyright cases viewed in this study, which provide examples of disputes over traditional Indigenous visual art. A proposal for the legal recognition of Indigenous cultural possessions in Australia is also reviewed, in terms of a new category of law. When such cultural objects are in an artistic form they constitute the tribe's self-presentation and its mechanism of cultural (...) continuity. Philosophical arguments for the legal recognition of Indigenous intellectual `property' tend to assume that the value of Indigenous intellectual property is determinable on external criteria. (shrink)
