I argue that all rights exist by convention. According to my definition, a right exists by convention just in case its justification appeals to the rules of a socially shared pattern of acting. I show that our usual justifications for rights are circular, that a right fulfills my criterion if all possible justifications for it are circular, and that all existing philosophical justifications for rights are circular or fail. We find three non-circular alternatives in the literature, viz. justifications of rights (...) by consequences, by autonomy or by divine commands. I show that all three alternatives fail, and I conclude that all rights exist by convention. This ontological result has a surprising and beneficial consequence. A common argument against conventionalism is that it implies cultural relativism. I finish by showing that the suggested conventionalism is incompatible with cultural relativism. (shrink)

In the Theaetetus Socrates provides an elaboration and discussion of Protagoras’ measure doctrine, grounding it in a “secret doctrine” of flux. This paper argues that the anthropology of the myth in the Protagoras provides an earlier, very different way to explain the measure doctrine, focusing on its application to civic values, such as “just,” “fine,” and “pious.” The paper shows that Protagoras’ explanation of the dual etiology of virtue – that it is acquired both by nature and by nurture – (...) tracks the two meanings of “anthropos” in his formulation of the measure doctrine, as “humankind” and “individual human.” On Protagoras’ account, humankind’s survival can be explained by the fact that humans share shame and justice, which enables them to live together in cities. According to Democritus' anthropogeny is a microcosmic consequence within the process of cosmogony. However, the case of man is a peculiarity: man, this atom complex, is well aware of himself, yet is not aware of what he must do. Man does not naturally do that which promotes the harmonious ordering of his atoms. We must create a second nature. Now it becomes possible for us to be as we must be according to our first nature. Democritus is the is first (...) thinker who explains to us what our nature is and who, from our being, derives an ought: he who wishes to do the right thing for both himself and others finds himself subject to the ought requirement to do that which brings the most calm to the atoms. This is a direct connection between being and ought, an extravagant mechanical existentialism. (shrink)

This paper seeks to explore the way Giovanni Pico della Mirandola treated the Orphics and the Pythagoreans in his Conclusiones nongentae, his early and most ambitious work, so that he formulates his own philosophy. I do not intend to present and analyze the sum of Pico’s references to Orphics and Pythagoreans, since such an attempt is beyond the scope of this paper. Rather, I aim to highlight certain Pico’s aphorisms that allow readers to understand and evaluate his syncretic method and (...) his goals. In addition, I attempt to trace Pico’s sources and evaluate his proper knowledge, understanding and treatment of the Orphics and the Pythagoreans. Pico resorts to the Orphics and the Pythagoreans because he wants to give a practical and applied dimension to his philosophy. He attempted the revival of the original wisdom that underlies the traditions he combined. He was not a fan of the Aristotelian θεωρίης ἢνεκεν. Philosophy does not aim at proper knowledge, but is the key for the manipulation of the cosmos, physically and metaphysically speaking. Pico probably thinks of himself as the modern Orpheus: he does not intend to reveal the paths which cross the sensible and the intelligible, but he aspires to tread them. (shrink)

I develop a positive interpretation of Democritus' theory of agency and responsibility, building on previous studies that have already gone far in demonstrating his innovativeness and importance to the history and philosophy of these concepts. The interpretation will be defended by a synthesis of several familiar ethical fragments and maxims presented in the framework of an ancient problem that, unlike the problem of free will and determinism, Democritus almost certainly did confront: the problem of the causes of human goodness and (...) success. I will argue that Democritus' account of the virtues and success is naturally interpreted as an intellectualist one. His focus on our intellectual powers as the source of our own agency and cause of our success led him to remarkable breakthroughs in moral psychology, including the development of a kind of cognitive-behavioral therapy for stress and anxiety, and the proposal of an autonomous source of moral sanction.
