What is wrong with colonialism? The standard—albeit often implicit—answer to this question has been that colonialism was wrong because it violated the territorial rights of indigenous peoples, where territorial rights were grounded on acquisition theories. Recently, the standard view has come under attack: according to critics, acquisition based accounts do not provide solid theoretical grounds to condemn colonial relations. Indeed, historically they were used to justify colonialism. Various alternative accounts of the wrong of colonialism have been developed. According to some, (...) colonialism involved a violation of territorial rights grounded on legitimate state theory. Others reject all explanations of colonialism's wrongfulness based on territorial rights, and argue that colonial practices were wrong because they departed from ideals of economic, social, and political association. In this article, we articulate and defend the standard view against critics: colonialism involved a procedural wrong; this wrong is not the violation of standards of equality and reciprocity, but the violation of territorial rights; and the best foundation for such territorial rights is acquisition based, not legitimacy based. We argue that this issue is not just of historical interest, it has relevant implications for the normative evaluation of contemporary inequalities. (shrink)

This essay argues that a black radical Kantianism proposes a Kantian theory of justice in the circumstances of injustice. First, I describe BRK’s method of political critique and explain how it builds on Kant’s republicanism. Second, I argue that Kant’s original account of public right is incomplete because it neglects that a situated citizenry’s adoption of an ideal contributes to its refinement. Lastly, with the aid of W.E.B. Du Bois’s analysis of American Reconstruction and his proposal of an “abolition democracy,” (...) I offer my refined universalizable standard for political critique. Du Bois reconceptualizes the requirements of justice to protect the political liberties and productive powers of black freedmen and the working poor. While originating with the political demands of black freedmen during the Reconstruction era, the universal protection of political liberties and productive powers offers a novel public standard for political judgment that should still anchor deliberation today. This article grounds the morality of secession on two forms of collective self-determination: one manifests the communal goods of secessionists and the other the value of shared political institutions. Secession is morally valuable when the two are incompatible such that the claimant confronts persistent alienation. For remedial rights theories, only ‘strict violations’ permit secession. For primary rights theories, ‘broad violations’ grant secession as a last resort, and so this thesis, ‘collective self-determination as nonalienation’, should be accepted regardless. First, as the (...) two collective forms of self-determination develop two forms of territorial rights, it supplements cogent accounts of territorial justification for, and claims to, secession. Second, as persistent alienation can have both strict and broad interpretations, it also provides moral grounds shared by remedial and primary rights theories if they concede the value of collective self-determination. The strict sense refers to persistent coercion that violates personal autonomy and nullifies state legitimacy. The broad interpretation denotes long-term political frustration caused by unreasonable prevention of greater collective autonomy that even legitimate states may achieve. Third, to verify whether this amounts to long-term political frustration and to address persistent alienation, secession should be regarded as a last resort, despite its support from the primary rights account. This article explores the tensions between different conceptions of “citizenship.” On the one hand, we point out the virtues and limitations of cosmopolitan citizenship in the terms in which Seyla Benhabib understands it in The Right of Others…; on the other hand, we delve into another notion of citizenship, namely, the localist, in a version that could be at odds with some cosmopolitan values, that is, localism as understood by some Mexican autonomous communities, particularly the Zapatistas. Although Benhabib’s cosmopolitan federalism (...) is inclusive in spirit, it is conceived within a preponderantly global perspective and ends up being asymmetrical. While her proposal has some positive aspects, it faces some difficulties in the case of Mexican autonomous communities. In this article, we shall introduce the notion of democratic confederalism as a form of sociopolitical organization that seeks to strengthen the self-organization of social actors and to recognize the practice of citizenship in the terms in which autonomous communities exercise it. We propose that democratic confederalism could be an alternative for decreasing tensions between global citizenship and the idea of citizenship within autonomous communities. (shrink)

Zusammenfassung: Dieser Artikel nimmt die im Kontext einer vielfach diagnostizierten Renaissance der Stadt erhobene Forderung nach mehr städtischer Autonomie zum Ausgangspunkt, um aus demokratietheoretischer Perspektive der Frage nachzugehen, welche rechtfertigenden Gründe für eine größere städtische Autonomie angeführt werden können. Zu diesem Zweck rekonstruiert der Beitrag normative Leitbilder der demokratischen Stadt, die zugleich Lücken einer allein staatlich verstandenen Demokratiekonzeption verdeutlichen. Es handelt sich bei diesen Leitbildern um das Bild der Stadt als Schule der Demokratie, als urbane Kosmopolis sowie als urbane Allmende. (...) Die untersuchungsleitende These lautet, dass die Stadt ein eigenständiger politischer Handlungsraum ist, an den spezifische demokratische Versprechen geknüpft sind und der spezifische Potenziale für die Verwirklichung einer demokratischen Praxis bietet. Das Erkenntnisinteresse ist zweigeteilt: Einerseits sollen in begrifflicher Perspektive die Leitbilder auf einen spezifisch urbanen Demokratiebegriff hin befragt werden und andererseits gilt es in systematischer Perspektive die zugrundeliegenden Vorstellungen von Gemeinschaft, Partizipation und Mitgliedschaft zu beleuchten und auf ihre demokratietheoretische Anschlussfähigkeit hin zu prüfen. Zusammenfassung: Das Internet bietet die Möglichkeit, eine beliebig große Anzahl von Personen durch unterschiedliche Formen der Deliberation und Beschlussfassung politisch einzubinden. Insbesondere im kommunalen Kontext wird die Online-Partizipation – etwa im Rahmen städtischer Bürgerhaushalte – bereits vielfach als Mittel erprobt, um die soziale Akzeptanz und Legitimität politischer Entscheidungen zu erhöhen. Die Legitimität demokratischer Verfahren hängt neben anderen Faktoren maßgeblich von der Konstitution des Demos und der damit festgelegten Allokation der Teilnahmerechte ab. In historischer Perspektive hat vor allem die Exklusion bestimmter (...) Gruppen, insbesondere von Frauen, Besitzlosen oder nichtweißen Personen, die Legitimität klassischer Offline-Verfahren, wie z. B. Parlamentswahlen, in Frage gestellt. Die neuen Formen der Online-Partizipation bergen hingegen – so die zentrale These des Aufsatzes – die Gefahr der Über-Inklusivität, weil sie häufig auf jegliche Zugangsbeschränkung verzichten. Selbst wenn die Verfahren, wie in der Praxis üblich, einen konsultativen Charakter haben und die politischen Entscheidungsträger formal nicht binden, führt ihre Offenheit zu Legitimationsproblemen. Daraus entsteht die Notwendigkeit, normative Kriterien für die Vergabe von Partizipationsrechten zu entwickeln, die den Besonderheiten der Online-Deliberation angemessen Rechnung tragen. (shrink)
