The last two volumes of Giorgio Agamben’s Homo Sacer series are concerned with developing a theory of use. This article offers a critical assessment of the two concepts, use and form-of-life, that form the heart of this theory: how do these two notions offer a solution to the problem of bare life that forms the core of the Homo Sacer series? First, the author describes how the original problem of bare life is taken up in The Use of Bodies and (...) how the notion of use offers an important additional characteristic of bare life. Second, inspired by Foucault’s analysis of ancient Cynicism, the author discusses in which sense the type of ‘solution’ Agamben offers to the problem of bare life might be seen as an heir to ancient Cynicism and how this interpretation clarifies his connection of form-of-life and exile. Third, the author critically assesses the different usages of use that we can find in Agamben, by comparing how Franciscan usus, Pauline chrēsis and Platonic chrēsis are taken up in his analysis. Fourth, following Foucault, the author deepens the Platonic sense of use and its relation to taking care of justice. The article concludes with a critical assessment of Agamben’s reading of Plato’s myth of Er, in which the motifs of use, exile, and care are gathered. (shrink)

This article focuses on Foucault’s and Agamben’s readings of Augustine’s account of human nature and original sin. Foucault’s analysis of Augustine’s account of sexual acts in paradise, subordinated to will and devoid of lust, highlights the way it constitutes the model for the married couple, whose sexual acts are only acceptable if diverted by the will away from desire and towards the tasks of procreation. While Agamben rejects Augustine’s doctrine of original sin and reclaims paradise as the original homeland of (...) humanity, his reappropriation of paradise remains conditioned by our turn towards our true nature, from which we have been estranged by sin. Agamben’s politics of reclaiming paradise necessarily involves the demand for obedience to this originary model of human nature. It therefore follows to the letter Augustine’s description of paradisiacal sex, in which the will prevails over desire by applying itself to and curtailing itself. (shrink)

This paper is a contribution to a discussion in philosophy of technology by focusing on the epistemological status of the example. Of the various developments in the emerging, inchoate field of philosophy of technology, the “empirical turn” stands out as having left the most enduring mark on the trajectory contemporary research takes. From a historical point of view, the empirical turn can best be understood as a corrective to the overly “transcendentalizing” tendencies of “classical” philosophers of technology, such as Heidegger. Empirically oriented philosophy of technology emphasizes actual technologies through case-study research into the formation of technical objects and systems and how they, for example, transform our perceptions and conceptions or pass on and propagate relations of power. This paper explores the point of convergence of classical and contemporary approaches by means of the notion of the “example” or “paradigm.” It starts with a discussion of the quintessential modern philosopher of technology, Martin Heidegger, and his thinking about technology in terms of the ontological difference. Heidegger’s framing of technology in terms of this difference places the weight of intelligibility entirely on the side of being, to such an extent that his examples become heuristic rather than constitutive. The second part of the paper discusses the methodological and epistemological import of the “example” and the form of intelligibility it affords. Drawing on the work of Wittgenstein, Foucault, and Agamben, we argue that the example offers an alternative way of understanding the study of technologies from that of empirical case studies. This paper demonstrates how the UK’s Advertising Standards Authority governs advertising ethics with and on behalf of its members and stakeholders. Drawing on an archive of 310 non-commercial adjudication reports, we highlight the substantive norms and procedural mechanisms through which the ASA governs advertising complaints alleging offence and/or harm. Substantively, the ASA precludes potential normative transgressions by publishing, disseminating, consulting upon, and updating detailed codes of advertising conduct. Procedurally, the ASA adjudicates between allegations and justifications of offence and harm on (...) a received complaint-by-complaint basis, often upon consequentialist grounds. Such consequentialism, we claim, has the effect of normalizing power imbalances between the ASA’s members, on the one hand, and wider stakeholders, on the other hand. The paper argues that, in the context of UK advertising, what Michel Foucault called the right ‘to be or not to be governed like that’ is enjoyed by relatively few subjects. Having demonstrated how UK advertising practices are governed, the paper closes with suggestions as to how they might be governed otherwise. (shrink)

The article investigates Giorgio Agamben’s turn to, and radicalization of, Foucault’s concept of governmentality, which Agamben argues constitutes a ’decisive point’ in the Homo sacer-series. The article shows that in the investigation of the Trinitarian oikonomia, Agamben finds the point of intersection between the ‘totalizing procedures’ of the state and ‘individualizing techniques’ of biopolitics thereby disclosing the ‘zone of indistinction’ between sovereignty and government and politics and economy, which constitutes power in the West. Furthermore, the article argues that Agamben shows (...) how the economy is not something distinct from politics, encroaching on its logic, but rather how the governmental paradigm of the West constitutes the continual administration of the given, the continual and perpetual government of the economy and thereby of the existing economic and political power-relations.
