In this article I discuss David Shoemaker’s recently published piece “Responsibility: The State of the Question. Fault Lines in the Foundations.” While agreeing with Shoemaker on many points, I argue for a more unified diagnosis of the seemingly intractable debates that plague (what I call) “responsibility studies.” I claim that, of the five fault lines Shoemaker identifies, the most basic one is about the role that the notion of deserved harm should play in the theory of moral responsibility. I argue (...) that the deep divide between those theorists who affirm and those who deny that moral responsibility is essentially about the justification of desert thus understood can be traced to the disagreement about whether the focus on the reactive attitudes by itself entails that moral responsibility has nothing to do with traditional questions about desert and free will. I then show that the seeming intractableness of the other four fault lines Shoemaker identifies is expectable and explicable in light of this more basic disagreement. After this diagnostic work, I conclude by suggesting a solution to the “morass” that has taken over responsibility studies: theorists working in the field should acknowledge that it has effectively bifurcated into two discrete subareas, which I suggest calling “retribution studies” and “interpersonal studies.” -/- . Once relegated to the margins of the responsibility debate, moral influence theories have recently been rehabilitated. This paper offers a moral influence theory with two parts: a theory of responsibility as influenceability and an act-consequentialist justification of blame. I defend this account against six concerns commonly raised both by opponents and by advocates of similar views. Some concerns target act consequentialism, claiming that it 1) permits blaming innocents; 2) permits coercion, manipulation, and other objectionable forms of influence; and 3) fails (...) to capture intuitions about desert. Other concerns target responsibility as influenceability, claiming that influenceability accounts are 4) unsophisticated, 5) make ascriptions of responsibility dependent on assessments of permissible blame, and 6) have various counterintuitive implications. I highlight three features of P.F. Strawson’s later, neglected work on freedom and responsibility. First, in response to a criticism by Rajendra Prasad, Strawson explicitly rejects an argument put forward in ‘Freedom and Resentment’ against the relevance of determinism to moral responsibility. Second, his remarkable acceptance of Prasad’s criticism motivates him to take the ‘straight path’, that is, to be straightforward about the relation between determinism, freedom, the ability to do otherwise and the conditions of responsibility. He claims that the (...) ability to do otherwise is a necessary condition of responsibility and provides a list of additional conditions, including a knowledge condition. Third, he clarifies the relation between responsibility, quality of will and the reactive attitudes. The latter do not figure essentially in his answer to the question, ‘What are the conditions of responsibility?’, but they do play an essential role in his answer to the question, ‘Why do we have the concept of responsibility?’ We have it, Strawson suggests, because of our natural concern about the quality of will with which people act, a concern expressed in our reactive attitudes. I argue that, although Strawson’s later work definitely involves a shift of emphasis when compared to ‘Freedom and Resentment’, his overall account of freedom and responsibility is coherent. The later work helps to better understand the nature and significance of Strawson’s contribution, and to identify problems with common interpretations of and objections to ‘Freedom and Resentment’. It seems intuitive to think that if you contribute more to an outcome, you should be more morally responsible for it. Some philosophers think this is correct. They accept the thesis that ceteris paribus one's degree of moral responsibility for an outcome is proportionate to one's degree of causal contribution to that outcome. Yet, what the degree of causal contribution amounts to remains unclear in the literature. Hence, the underlying idea in this thesis remains equally unclear. In this article, I (...) will consider various plausible criteria for measuring degrees of causal contribution. After each of these criteria, I will show that this thesis entails implausible results. I will also show that there are other plausible theoretical options that can account for the kind of cases that motivate this thesis. I will conclude that we should reject this thesis. (shrink)

A fundamental question in responsibility theory concerns the relation between being responsible and our practices of holding responsible. ‘Strawsonians’ often claim that being responsible is somehow a function of our practices of holding responsible, while others think that holding responsible depends on being responsible, and still others think of being and holding responsible as interdependent. Based on a Wittgensteinian reading of Strawson, I develop an account of the relation between being and holding responsible which respects major concerns of all parties (...) in this debate. I characterize the way in which being responsible depends on holding responsible as genealogical, and the way in which holding responsible depends on being responsible as justificatory. I show how my account cuts across received ways of carving up the debate, and how it allows for all the kinds of fallibility about moral responsibility that are worth wanting. (shrink)

Does one’s causal responsibility increase the degree of one’s moral responsibility? The proponents of resultant moral luck hold that it does. Until quite recently, the causation literature has almost exclusively been interested in the binary question of whether one factor is a cause of an outcome. Naturally, the debate over resultant moral luck also revolved around this binary question. However, we have seen an increased interest in the question of degrees of causation in recent years. And some philosophers have already (...) explored various implications of a graded notion of causation on resultant moral luck. In this paper, I will do the same. But the implications that I will draw attention to are bad news for resultant moral luck. I will show that resultant moral luck entails some implausible results that leave resultant moral luck more indefensible than it was previously thought be. I will also show that what is typically taken to be the positive argument in favor of resultant moral luck fails. I will conclude that we should reject resultant moral luck. Nesta monografia, discutirei o Argumento Direto pelo incompatibilismo. Incompatibilismo ´e a tese de que responsabilidade moral ´e incompat´ıvel com o determinismo nomol´ogico. De ma- neira simplificada, o argumento ´e o seguinte: N´os n˜ao somos respons´aveis pelo passado e pelas leis da natureza. Se o determinismo for verdadeiro, nossas ac¸ ˜oes s˜ao consequˆencia do passado e das leis da natureza. Portanto, se o determinismo for verdadeiro, n˜ao somos respons´aveis por nossas ac¸ ˜oes. Defendo ao longo da monografia que o Argumento Direto (...) ´e nem prima facie uma ameac¸a ao compatibilismo – a posic¸ ˜ao oposta ao incompatibilismo –, j´a que os proponen- tes do argumento falham em motivar com sucesso o argumento. A monografia se divide em trˆes cap´ıtulos. No primeiro, apresento a formulac¸ ˜ao do Argumento Direto proposta por Peter van Inwagen (1983). Sua formulac¸ ˜ao se vale de um operador modal de n˜ao-responsabilidade, para o qual van Inwagen define duas regras dedutivas. Nos dois cap´ıtulos subsequentes, discuto algumas das cr´ıticas encontradas na literatura contra essas regras e apresento minhas pr´oprias cr´ıticas.
